Jawapan Parlimen: Pengharaman Hindraf kerana Pengerusi Keluar Negara

Tuan Manikavasagam a/l Sundaram [Kapar] minta Menteri Dalam Negeri menyatakan sebab-sebab Kerajaan mengharamkan pergerakan Hindraf. Apakah kewujudan bukti-bukti yang mengaitkan pergerakan tersebut dengan kumpulan penganas luar Negara.

Untuk makluman Yang Berhormat, Hindraf adalah sebuah pertubuhan haram yang tidak berdaftar. Kumpulan ini telah diisytiharkan sebagai sebuah kumpulan haram pada 14 Oktober 2008 mengikut peruntukan Seksten 8(1) Akta Pendaftaran Pertubuhan 1966 (Akta 335). Tindakan penahanan lima (5) orang pemimpin Kumpulan Haram Hindraf (KHH) di bawah seksyen 8(1) AKDN 1960 adalah kerana tindak tanduk mereka menganjurkan aktiviti-aktiviti yang jelas mebangkitkan sentiment perkauman dan agama yang serius yang boleh mencetuskan konflik antara kaum dan seterusnya memudaratkan kententeraman awam dan keselamatan Negara. Mereka juga telah menganjurkan perhimpunan-perhimpunan yang membangkitan sentiment sehingga mencetuskan tindakan-tindakan yang berunsur keagamaan.

Maklumat perisikan telah mendedahkan terdapat usaha-usaha oleh Kumpulan Haram Hindraf (KHH) untuk mendapatkan bantuan dan sokongan dari Negara luar. Maklumat perisikan juga melaporakan bahawa lawatan Waytha Moorthy a/l Ponnusamy , Pengerusi kumpulan ini ke luar Negara pada 28 November 2007 adalah diantara lainnya, untuk mendapatkan sokongan antarabangsa termasuk usaha mengadakan perjumpaan dengan pemimpin LTTE.

Penang Kampung Buah Pala controversy – Koh Tsu Koon should speak up as to whether he would make amends for his decisions as Penang Chief Minister

The former Penang Chief Minister and now Minister in the Prime Minister’s Department, Tan Sri Dr. Koh Tsu Koon should speak up as to whether he would make amends for his decisions as Penang Chief Minister in the Kampung Buah Pala, Penang controversy by securing a Federal Government grant to Penang State Government to resolve the issue with “a stroke of the pen”?

The Penang Pakatan Rakyat government is now caught in a vice created by Koh’s administration although it had prevented the eviction of the residents in the area since the middle of last year.

Firstly, Koh must explain why as Chief Minister, his Executive Council had approved the state government land of Kampung Buah Pala to Koperasi Pegawai Kerajaan Pulau Pinang, first time on 18th August 2004 and second time on 8th June 2005 at a very low premium of RM6.42 million or RM20 per square feet.

Secondly, why Koh and his Exco subsequently halved the premium to RM3.21 million or only RM10 psf on the recommendation of the Umno Deputy Chief Minister – far below the market price of the prime land.

Thirdly, why Koh and the Penang State Government had not consulted the residents concerned before alienating the land which is now to be developed into the 14-storey luxury-living Oasis project with a Gross Development Value of RM150 million, comprising 490 condominium units (priced from RM240,000 to RM290,000) on the 2.6 hectare site.

It has been said that the Penang Chief Minister, Lim Guan Eng can resolve the Kampung Buah Pala issue with “a stroke of the pen”. Yes, it can be resolved with “a stroke of the pen” but involving compensation for the RM150 million Oasis project.

Can the Penang State Government afford such a compensation?

Is Koh prepared to raise in Friday’s Cabinet meeting that the Federal Government make a grant to the Penang State Government for the amount needed to resolve Kampung Buah Pala issue with “a stroke of the pen” by the Penang Chief Minister?

Time has come for Koh to speak up or he will be failing his own KPI although he is the Cabinet monitor to oversee the KPIs of all Ministers.

The Penang chief minister was wrong to claim that Kampung Buah Pala residents were offered RM200,000 per family by the developer, according to spokesperson for the villagers.

Kampung Buah Pala Residents Association secretary J Steven Draviam said the developer, Nusmetro Venture (P) Sdn Bhd, had originally offered only a RM90,000 cash payment or a low-medium cost corner unit measuring 850 sq ft in the upcoming project, the Oasis.

“The developer has never offered RM200,000 per family... never. The chief minister got it all wrong. Perhaps he is getting wrong (information) from the wrong people,” he said, calling on Lim Guan Eng to visit the village to get first-hand information.

lim guan engLim had said yesterday that the village residents were offered up to RM200,000 per family by the developer, and that the sum had been accepted by some, while many others have chosen to stay put at the site.

He also said the developer would have evicted the residents in the middle of last year if not for the state government's timely intervention, which Steven duly acknowledged.

Nusmetro, meanwhile, has agreed to give a month's grace as of yesterday, to allow the state government to explore ways to resolve the predicament amicably.

Deputy Chief Minister 2 P Ramasamy announced this when he met the residents at the village yesterday afternoon. He also said the state government is working overtime on the matter.

The villages had filed an application yesterday morning to set aside an ex-parte order dated June 16 obtained by the land office, landowner Koperasi Pegawai-Pegawai Kanan Kerajaan Pulau Pinang and Nusmetro to issue a writ of possession effective tomorrow.

The application was filed on the behalf of the residents by lawyer Darshan Singh Khaira.

Three demands submitted


Yesterday evening, some 150 Hindu Rights Action Force activists and villagers held a rally outside Komtar to protest against what they called the “incompetence and ineptness” of the state government in resolving the problem.

They passed three resolutions and submitted these to Mansor at a dialogue session in Komtar after the rally. They want the state government to:

  • stop the developer from demolishing the village;

  • provide an alternative site for the Oasis project; and

  • include three representatives, comprising the village association chairperson M Sugumaran and assistant secretary C Tharmaraj, and Hindraf activist N Ganesan in the state investigation team probing the alleged land scam in this matter.

In Petaling Jaya, there were more police personnel than the Hindraf protesters.

Some protesters carried banners lashing out at DAP for not helping the villagers in Kampung Buah Pala in DAP-led Penang.

The protest was part of a nationwide demonstration in front of DAP offices organised today by Hindraf.

There was a bigger crowd in Penang where some 150 Hindraf supporters gathered at the state administration centre in Komtar.

And in Ipoh about 10 Hindraf supporters turned up at the DAP office to protest.

DAP ready to talk

Hindraf's point of contention is that the land is the last remaining Indian traditional urban village on the island.

“We consider it (Kampung Buah Pala) to be a heritage land,” Selvam told reporters after police had dispersed the gathering in Petaling Jaya.

Although there were no untoward incidents, there was momentary tension when the police ordered the protesters three times to diperse. This led to the deployment of a light strike unit.

Petaling Jaya police divison chief Arjunaidi Mohamed later confirmed that 50 police personnel had been deployed.

Ipoh Timor MP Lim Kit Siang, who arrived later, said DAP MPs do not run away from problems and were willing to talk to Hindraf on the matter.

The matter is of great concern, he said, but the hands of the Penang government were tied because of decisions made by the previous Gerakan-led state government.

Other DAP leaders present were Ipoh Barat MP, M Kulasegaran and Perak exco member A Sivanesan.

'Not unduly worried'

Earlier today, staff at the DAP headquarters in Petaling Jaya said they were not unduly worried about the protest.

Head of staff Foo Yueh Chuan said when contacted that Hindraf had not provided direct information about the protest.

She said the party only found out about this through media reports and text-messages that were circulated.

The party headquarters, with a staff-force about 15, is located in a housing area in Paramont Garden, Petaling Jaya.

The organisers had planned to mobilise some 10,000 activists to demonstrate outside Komtar - which houses the Penang government office - and DAP offices in Petaling Jaya, Ipoh, Damansara, Seremban, Johor Bahru and Malacca.

These rallies, the first by Hindraf against a Pakatan Rakyat ally, are a blow to Penang Chief Minister Lim Guan Eng, who has positioned his government as one based on competency, accountability and transparency.

Is there a foul play in A. Gnanapragasam’s death or for the matter the post mortem?- R.Shan (Human Being)

Sure we all know there is and will believe this as another cover up but what is more intriguing and interesting is how the police decided to use Dr Prashant S. Ambekar to conduct the post mortem.

Now that is a food for thought, you may actually believe everything is true in the post mortem report as it done by Dr Ambekar. That is one tough question, don't you think so?

The wife saw the husband on Friday, June 12, 2009 with bruised eyes. The deceased complained to the magistrate on the beating and torture by the police, yet the magistrate never summoned the police to conduct a medical test on him.

Then, on June 15, 2009 he is found dead in the toilet in the police station. When the wife and sympathizers visited his body at the mortuary, no cell phone and cameras were allowed.

On June 16, 2009, Bernama reports that Selangor police chief Khalid Abu Bakar said Monday night the cause of Gnanapragasam’s death was "toxaemia secondary to spontaneous peritonitis" or blood poisoning due to a bacteria infection in the intestines. He said the autopsy at Universiti Malaya Medical Centre (UMCC) at noon yesterday was done by pathologist Dr Prashant Ambekar. Meanwhile, Petaling Jaya police chief ACP Arjunaidi Mohammed said the autopsy did not trace any bruises or injuries on the body.

Relating back to Kugan’s case the same Dr Ambekar had disputed the finding of the Selayang fellow and Health Ministry Director-General Dr Mohd Ismail Merican implied that Dr Prashant S Ambekar relatively lack of experience had contributed to mistakes in his postmortem findings.

Doesn’t this sound all too fishy that the same doctor is now on top of the chart for the police to conduct the post mortem for a murder of a Malaysian Indian in custody. After all Dr Ambekar became infamous for his finding in Kugan’s murder, can anyone question him here on the finding of A. Gnanapragasam? Are we witnessing another conspiracy theory or is it my figmentation of imagination?

My figmentation of imagination is the police using the very same doctor who had captured the confidence of the people in Kugan’s case is now being coerced by the might of the government to state otherwise? Your guess is as good as my guess.

I don’t mean to insinuate anything here but I think you get my jive that the government tacked along with the mighty police force is actually getting smarter in their attempt to hoodwink the public in their so called governance without any impartiality.

For you and me, another episode in Bolehland Malaysia, but for humanity more so for a Malaysian Indian family just another sad tragedy that never will see the light of justice in the pretext of all is fair and equal in a pseudo Malaysia.

HINDRAF - UTHAYAKUMAR CONTINUES TO BE HARASSED BY THE POLICE

Police continues to harass Uthayakumar at his residence on June 13 & June 14, 2009. On June 13, 2009 at around 11.00pm, five (5) policemen for apparently no reason visited his present residence in his fiancées flat and started harassing her old and sickly parents.

They were questioned about his whereabouts in threatening and intimidating manners that shocked these elderly couple. Further they proceeded to take pictures of the flat both inside and outside of it.

Are we leaving in a police state? What right do the police have to enter into premises to question and take pictures. Is this a raid? Even so, is it not correct that a warrant should be produced for such unlawful invasion and trespass of private property?

The police has to get their act right that the public cannot be subjected to such arbitrary act for their whims and fancies without the due process of the law.

Uthaya Kumar was a prisoner of conscience and now a free man, not some thief in charade to hoodwink the police force. Is he hiding from you? Why does the police resort to tactics to intimidate and harass some old folks using the power that is granted to them by the public ie the voters and the tax payers unless the police force feels that it is above the law and it could do anything it wants, when it chooses, and their victims are their choice at the expense of the peace loving public.

HINDRAF condemns the act of the police on the intimidation acts that are carried out on Uthaya Kumar, nor condones to such behavior in a so called democracy state.

What is even more baffling is, there is a permanently parked van outside the flat that obviously watches his movement, please see attached photo, so HINDRAF fails to comprehend why then 5 policemen needs to enter his fiancées flat at 10.00pm and intimidate some old folks.

HINDRAF questions’ such actions and motives by the police force nor will it stand quietly to address such issues as at large, it is not about HINDRAF, or Uthaya Kumar but the erosion of human liberty in Malaysia to live peacefully without a misguided mechanism through government tools ie the police, judiciary, executive powers to trample over basic life, liberty and pursuit of happiness in a multicultural society to flourish in Malaysia.

HINDRAF does not want a police state in Malaysia, nor does the public desires for one, so an overtly act by the police force disregarding the process of law needs to be questioned before Malaysia actually becomes a police state.

HINDRAF - KAMUNTING RESIDENTS FACING THREAT OF RACIAL VIOLENCE

HINDRAF have obtained reliable information from members of the public including sympathisers from the Malay Community that the underworld “3 Line and Mat Rempit gang are mobilising a large number of superbikers into Kamunting on Saturday, June 13, 2009 to “teach” the Indians a lesson as a result of the racial clash that sparked on June 8, 2009.

HINDRAF wishes to stress that we do not condone to any form of violence let it be from the Indians, Malays or any race for the matter.

The racial attacks in Kamunting on June 8, 2009 and the ongoing unrelated, unprovoked attacks on innocent Malaysian Indians in Kamunting are being perpetrated by outsiders in gangs of superbikes believed to be members of the underworld Malay “3 Line and Mat Rempit” gangs.

Over the last 2 days Indians in groups (in Kamunting) of more than 3 are told to disperse by the police or face arrest but they seem to deliberately ignore the large groups of the underworld superbikers who are patrolling and intimidating the Malaysian Indian folks in Kamunting.

A Hindu Temple namely the Madurai Veeran Temple in Batu 4, Kamunting was also torched by members of these underworld and Police is yet to investigate the report lodged by members of the said Temple .

The impartiality of the Royal Malaysian Police Force is questionable as they are fully aware of these gangs’ activities in arousing racial clashes in Kamunting and it appears that they are colluding with these gangsters in continuing their activities for motives only known to them.

HINDRAF calls upon the IGP to act in accordance to the oath he had taken in providing protection to all citizens of the country and prevent Kamunting from turning into another Kg. Medan massacre that took place from 8/3/2001 to 23/3/2001 (15 days in a row without any interference from the Police Force to restore law and order) where hundreds were seriously injured and 6 lives were lost.

We call upon the IGP to take a pragmatic and realistic approach particularly in mobilizing his men on 13th June 2009 to prevent any untoward incident planned by the underworld gangs which could lead to unnecessary cost to innocent lives.

There has to be more patrols and protection to the people of Kamunting and those culprits who have been attacking innocent people over the last four days must be arrested immediately and charged in Court, failing which the confidence of the people in the Royal Malaysian Police Force would be eroded further.

Friends of Tamils Resolution Dated 31 May 2009

At a meeting held at the Highgate Murugan Temple in Archway Road, North London, On Sunday 31st May 2009, for all those considering themselves to be ‘Friends of the Tamils,’ agreed a resolution calling upon the Sri Lankan Government to take immediate measures to preserve life in the region.

All present agreed that in order to prevent a deepening humanitarian crisis in the North of the country, the government of Sri Lanka must without delay: -

1. Provide adequate shelters, food, medicine, clean drinking water and sanitation, with private bathing facilities for women. These essentials should be maintained in all camps until every Internally Displaced Person (IDP) is settled into their own homes.

2. Allow unhindered and unconditional access for UN Monitors and media personnel to all areas in the North East of the island.

3. Uphold human values for any prisoners of war in accordance with the Geneva Convention.

4. Allow all IDP camps to be managed by local NGO’S and INGO’S, supervised if necessary by UN Independent Monitors.

5. Fast track care for all particularly vulnerable IDPs - mainly the elderly, women and children - within the next 30 to 60 days.

HINDRAF – Can You Lead Us, Are You the Third Force?

The first thing that comes to mind is that it is a racist movement only to enhance the Malaysian Indians, right? Right!!!!

Well, the well-oiled mechanism of manipulation, propaganda, imagery and public relations wizardry to frighten and silent the public has obviously put them in such a light.
Frankly, don’t you agree that Malaysian Indians are responsible for the largest problems (ie, theft, robbery, suicide, stateless people etc) statistically in proportion to their populace as a minority in Malaysia?
Yes, you may argue that the Malays, the Chinese, and all those lain-lain face the same faith and predicament in this society. But again, why have those who care so much for them not waged a war against the government to safeguard their interests? Is it because these so-called leaders have their own individual needs or the needs that serve society or they fear the almighty government?
The biggest distortion of the truth comes from us. It is us as one Malaysians with our lying in silence that causes all the mayhem.
HINDRAF may have by default triggered the tsunami of March 8, 2008 but the message has always been the truth to its cause no matter how narrowly you see it. Whether they are racists or not can only be answered by you - if you can see the bigger picture.
Today, we have two factions in the Malaysian political scene; one UMNO-led BN and PKR-led Pakatan. Both gloat on their objectives and their track records yet they can’t even see beyond themselves without stepping onto each other’s shoes. It is always a tit for tat contest and the public suffer.
Now, why don’t we create a third force, a force that is independent? Here again, when I mean independent, I mean totally independent without any selfish needs. Solitude in its objective for doing what is the truth and right without any compromise.
HINDRAF, I believe, can be a serious contender for a third force only if all Malaysians embrace and expand their pursuit for the truth and moral obligation of a people-elected government without the usual shenanigans that we are all accustomed to based on race, religion, following or creed.
There are many active and some lip service NGOs in Malaysia. What is the purpose of these NGOs? The phrase non-governmental organization came into use with the establishment of the United Nations in 1945 with provisions in Article 71 of Chapter 10 of the United Nations Charter [1] for a consultative role for organizations that neither are governments nor member states.
HINDRAF, similar to other NGOs, was developed to emphasize humanitarian issues, developmental aid and sustainable development.
Now the golden question is, how can it enhance the society? Can HINDRAF in affiliation with other NGOs in Malaysia cut across the racial barriers and create the third force to dictate the path of Malaysia? In my opinion, yes it can; only if all the NGOs can forgo their own alter egos and understand that HINDRAF was waged for the truth and reality that faced the obedient and peaceful Malaysian Indians as opposed to the racial stand that most of us believe.
HINDRAF should be ready to move ahead and carve out the direction with the other NGOs to expand the horizon for humanity and we the people should heed this call to show that a third independent force can dictate the course of our nation to create the necessary check and balance.
My people, it is you and only you who can make the change without the bigotry that we have in us individually for a truly Malaysian nation.

HINDRAF condemns the threat by the Prime Minister.
In what way was, the statements made by HINDRAF leaders are extreme in nature?

How can the call by the HINDRAF leaders against the review on the release of the HINDRAF detainees and accordingly equal & fairer treatment towards all Malaysian born are construed as an extreme in nature when the Prime Minister shouts out for One Malaysia.

Instead of looking into the genuine grievances raised by HINDRAF and addressing them objectively, the government plays to the tune and sentiment of racialism as capitalized by certain elements and warns that something that is pursuit in the sense of fairness and justice as extreme statement.

To date, HINDRAF has been demonized by the government with all kinds of allegation and accusation, yet the government fails to see that HINDRAF has created an awareness within the public with its sole objective is to ensure an equal and fair treatment in a nation that we call Malaysia.

If the Prime Minister and his government is really working towards promoting unity, then it should take the trouble to engage all parties and voices genuinely and deepen the solidarity between their people, while respecting their history, culture and their traditions, rather than abusing its power by threatening and intimidating through its machinery which is in line with authoritarianism, intolerance, and a police state.

The warning issued by the Prime Minister is one callous in nature without regard for the suffering of the minorities, in particular the poor and neglected ones across the board and their sentiments to create a better Malaysia for all.

GOVERNMENT SHOULD DROP CHARGES AGAINST HINDRAF SUPPORTERS

HINDRAF calls upon the government to drop all charges against the HINDRAF supporters who were involved in the peaceful rally that took place before the British High Commission and those arrested in Batu Caves .

HINDRAF rally was one of peaceful nature and those HINDRAF supporters were made as pawns for the government’s selective prosecution. Those HINDRAF supporters and their family had suffered enough for showing their support in addressing the grievance of the Malaysian Indians.

The HINDRAF rally of November 25, 2007 was one for just and fair cause and within the sphere of the federal constitution that is embedded in Article 10 (1) that guarantees the freedom of speech, the right to assemble peacefully and the right to form associations to every Malaysian citizen.

The government must recognize and acknowledge that in using fear and intimidation against genuine struggles that are peaceful in nature will only further alienate the people from the government. The HINDRAF supporters who were charged were law abiding citizens exercising their birth right for a genuine cause.

HINDRAF’s paramount importance is to its people and their grievances and subjecting these HINDRAF supporters for the selective prosecution will only further agitate the public.

As such, the government should heed the call of HINDRAF and drop all those pending charges against them as soon as possible.

PKR man: Pakatan not doing enough for Indians

A grassroots PKR leader today lashed out at Pakatan Rakyat and its administration in Selangor for continuing to marginalise the Indian community in the state."The sidelining of the Indian community by the Pakatan in Selangor is not much different from what Barisan Nasional has done," said Petaling Jaya Selatan division's deputy chief A Thiruvenggadam today.He alleged that all promises made by Pakatan leaders, including PKR president Anwar Ibrahim and Selangor Menteri Besar Khalid Ibrahim, before the general election in March 2008 to uplift the Indian community remained unfulfilled."In Selangor, the PKR-led state government has so far failed to keep up with its promise to do something for the community."No job offers have given to the Indian community. No contracts have also been allocated for the Indian businessmen in the state," said Thiruvenggadam, who is a PKR-appointee as a councillor to the PJ city council."I have been asking for the past one year or so for the state government under Khalid to make it a state policy to provide jobs and business opportunities for the Indian community but to date nothing has moved," he said in a statement.He claimed that all Pakatan leaders were repeatedly lying to the Indian community by promising them better things as compared to the neglect committed by Barisan Nasional."They are only cheating the community to garner support.

Otherwise, it will just remain neglected," he said.He added that it was ironic that many Pakatan leaders in power today were human rights defenders before this and now they were not seeing the sorry plight suffered by the Indian community in the state.He also challenged the state government to come up with statistics on what it has done to uplift the Indian community in the state.Thiruvenggadam said he would be revealing more on the state government's failure in helping the Indian community at a press conference next Monday.Nalla: I am not surprised by this The Indian community, for long BN voters, shifted sides to Pakatan in the last general election after complaining that they have been neglected for years.Pakatan leaders had said that they would be different from BN and would help the community gain an economic status.However many observers, including insiders like Thiruvenggadam, have complained that the plight of the community remained the same.Commenting on this, BN-allied Malaysian Indian United Party (MIUP) leader KS Nallakaruppan said he agreed with the contention that the Pakatan state governments have done nothing for the community. Pakatan won control of five states in the general election."The complaints are valid. I have travelled throughout the country, including to the five states under Pakatan control and the feedback I get is that they are still in the same poor, neglected state."Apart from appointing some Indians to some high-profile posts and local councils, Pakatan had failed to deliver its promise for the Indian community," he told Malaysiakini.He was referring to the appointment of DAP's P Ramasamy as the deputy chief minister 2 in Penang and V Sivakumar as the Perak assembly speaker."Temples are still being demolished in the Pakatan states. Tamils schools are still in the same condition. Have they reduced poverty?" he asked."I know full well about Anwar and other PKR leaders. They have never cared about the Indian community," he added.He said that while BN could have been slow in reacting to the needs of the Indian community in the past, it has now learnt its lessons with the federal government implementing some policies to overturn the situation.Nallakaruppan left PKR in 2007 after a fallout with Anwar and formed his party.
