IPOH: Kindergarten teacher M. Indira Gandhi, who is seeking to quash her three children’s conversion to Islam, has applied for the case to be moved to the Federal Court or heard in full by the High Court.

Her lawyer M. Kulasegaran made the application before High Court assistant registrar Helmi Ghani in his chambers yesterday.

Kulasegaran told reporters that Justice Zainal Adzam Abdul Ghani would decide on May 6 if he would order a full hearing into the case or refer it to the apex court.

Indira Gandhi is seeking to nullify her children’s conversion to Islam by their father without her consent on April 3, 2009.

Despite an order made by a separate High Court here last May for her estranged husband Mohd Ridzuan Abdullah to return their youngest child, Prasana Diksa, mother and child have yet to be reunited.

The case, in which Indira Gandhi has been also granted custody of her two elder children – Tevi Darsiny, 13, and Karan Dinish, 12 – is pending appeal by Mohd Ridzuan, who has obtained interim custody of the children from the Syariah High Court here.

Met at the High Court, Indira Gandhi, 36, said she continued to live with the pain of not being able to see and hold Prasana.

The child turns three on April 8 and the last time the mother saw her daughter was just before the little girl’s second birthday.

“It’s a reminder of how much I have missed out on my baby’s life,” she said.

Hindraf the Hindu Human Rights activist movement made headlines when their gathering in Kula Lumpur was dispersed with police brutality years ago.

With the ongoing Civil Unrest all over Middle East and North Africa in Islamic countries, Malaysia might turn out to be the next stage setting for the serial drama of suppression of human rights.

Hindu ethnic minorities have been long denied educational and employment opportunities and the Islamization under Mahathir reached sinister proportions when thousands of Hindu temples were razed down by the regime.

That was a turning point in Malaysian politics when Indians irrespective of even religious differences, with even Christians joining under the umbrella of HINDRAF- the Malaysian Hindu Rights action forum.

The disenchantment with Malaysia’s Islamistaion and discrimination was so wide spread among Indian origin Malaysians that the Hindraf even upset the last election results unseating long entrenched Community leaders who were branded as traitors to their cause and interests.

Now then came the news of refusal of permission for a protest meeting at a time when regimes are convulsing with popular unrest in all the Muslim nations.
 
None of the regimes have been able to suppress without losing credibility and even losing hold of control, the latest being Libya and Bahrain.

Unlike the Arab street protesters who have no dearth for torch bearers and cheer leaders among the media and opinion makers, the plight and news of Hindu minorities reeling under the oppression of Islamisation in Bangladesh, Pakistan and Malaysia are selectively blacked out and under reported, if not distorted as communalists.

The anti-Hinduism has thus assumed the same connotation as anti Semitism.

CRACK DOWN ON HINDU PROTESTERS AT PETRONAS

The protest is about introduction of a novel that spits out venomous racial slurs with terms such as ‘pariah’ meaning an ‘Outcaste’ referring the Tamil Hindus which the Hindu community seriously feels offensive.

The Malaysian Indian Congress too had seriously objected to the Curriculum including a blatantly offensive racist novel as literature for students.

The Hindraf web site had published pictures of the crackdown while demonstrators attempted to proceed toward Twin towers of PETRONAS buildings, to hold a Protest meet against the ongoing discrimination and suppression of Islamist Malaysia.

Around 50 demonstrators broke through the barricade and gathered at a temple at Kula Lampur and demonstrated holding placards and shouted-
“Ban interlock”
“Don’t insult the Indian community”
Their leader jayathas had stated to AP-

“We want a stop to racism against minority citizens, especially the Indian poor, and a ban on Interlok, which is sowing the seeds of racism in schoolchildren. We are not asking for special rights but equal opportunity,”

This towkay DAP does not need 50 years to rule Penang or to get to Putrajaya first to do this. All he needs is just 5 seconds to sign a policy paper as the Penang Chief Minister has 100% powers on all land issues by virtue of Section 76 of the National Land Code.

If he is unsure he should ask MB Khalid Ibrahim of Selangor who granted land to 40 Malay settlers within 3 months of promising during the Hulu Selangor by-election.

DAP and PKR in Selangor and also PAS in Kedah are all playing the very same a la MIC & UMNO politics by using their Indian mandores in hatching and rehatching the very same point. If at all the nutty Professor must know that a good point does not become better when he keeps repeating it.

Like UMNO, PKR, DAP & PAS keep the Indian poor minds busy by making especially by Tamil media statements of land here and land for Hindu temples, cemeteries and Tamil schools there but refuse to make public the tittles there to.

PKR, DAP & PAS don’t like the Indian to move on beyond this Tamil school, Hindu temple and Hindu cemetery problem, to thereafter start demanding equalness to the Malay muslims local and overseas Yayasan scholarships state tenders and projects, top jobs in these P.R. state governments, Municipal Council Presidents, Directors and top state civil service jobs, top state, GLC jobs etc.

At least undo the injustices meted out by the UMNO government to the Indians in these 3 states in over the last 50 years. So where is the change?

PKR, DAP and PAS are no different from the racist UMNO regime.

All what they want is the Indian votes. And Not and Never their problems however serious or critical it may HRP’s Project 15/38 is the only way forward.
There is no other way.

Chinese groups weigh in on Interlok

(Malaysiakini) A number of prominent Chinese groups are among 45 organisations which inked a joint statement criticising the government's decision to retain the controversial novel 'Interlok' as a compulsory textbook for secondary schools.

In a strongly-worded statement, the civil society groups ticked off the novel for attempting to indoctrinate Form Five students with the 'Malay supremacy' ideology.

Describing 'Interlok' as an “insidious poison”, the civil society groups accused the novel of propagating the ideology of “Ketuanan Melayu”.

“In fact, Interlok is barely a step away from the Biro Tatanegara brainwashing that promotes racism and disunity. 'Interlok' conveys the central message that Chinese, Indian and other minorities are second-class citizens in addition to perpetuating the divisive notion of a host community (the Malays) versus foreigners ('bangsa asing' Cina dan India).

“Not so subtly, 'Interlok' intends to put the Chinese and Indians in their place as 'pendatang', and validating a social hierarchy according to ethnic origin.”

Organisations which signed the statement included KL and Selangor Chinese Assembly Hall, Negeri Sembilan Chinese Assembly Hall, Johor Federation of Chinese Associations and Penang Chinese Town Hall.

It is however not the first time that Chinese groups have issued statements on the matter.

“Not only offensive to Indians, Interlok portrays the Chinese in the most derogatory manner too,” said the hard-hitting statement.

“Kim Lock (in 'Interlok') is depicted as a miserly opium addict and callous adulterer while his son Cing Huat is painted as cunning, greedy, unscrupulous and someone who would happily sell his daughters.

“A major thread of the plot has the Chinese character cheating and oppressing the Malay character. Other Chinese characters such as the communist guerrillas are nasty and immoral, and the Malayan People's Anti-Japanese Army comprising Chinese recruits is demonised by the author.”

The civil society groups said that 'Interlok' has failed to comply with the guidelines set by the Education Ministry.

“The National Interlok Action Team (Niat) has pointed out that its contents violate five out of six criteria outlined by the KBSM (Malaysian National Syllabus for Secondary Schools) textbook guidelines.

“Education Minister Muhyiddin Yassin recently announced that the government has agreed to amend 19 words/passages found to be sensitive. Nonetheless, the fact that the 'Interlok' review panel has had to suggest a total of 106 changes only goes to show how problematic the novel is.

“Furthermore, the withdrawal in protest of the three Indian panelists serves to discredit the ministry's proposed resolution to the issue.”

Solution is to replace 'Interlok'

The groups said that the way out of the impasse is to replace 'Interlok' with other text more suitable for use in the classroom.

“Some defenders of 'Interlok' have claimed that the main characters in the book are mere individuals who cannot be extrapolated as representatives of their race.

“This is a mistaken line of argument as the Interlok lesson guide produced by the Education Ministry's curriculum development department has clearly stated: 'The theme of Interlok is the integration of three main races – Malay, Chinese and Indian – in Malaysia and the challenges they face in order to live together in an independent and sovereign country'.

“Because it is the ministry itself which has dictated that the characters in the novel are allegorical, therefore it will be wrong for us to now view them as atypical. Rather the Pak Musa, Cing Huat and Maniam personas (in 'Interlok') are indeed symbolic of their races.”

The joint statement stressed that the protest against 'Interlok' was in no way a disrespect to author Abdullah Hussain's freedom of expression.

“We do not object to his novel being sold in the bookshops. We do not ask either for the unabridged original version to be edited or censored although we welcome its critical appraisal by discerning adults. But the upshot is Interlok should not be a textbook in schools.”

Sentimen masyarakat India terhadap buku tersebut juga begitu.

Sentimen kemarahan yang ditunjukkan badan bukan kerajaan masyarakat India terhadap Interlok edisi murid sebenarnya tidak banyak berbeza dengan masyarakat Melayu dan Umno dalam tahun 1950an.

Pada tahun 1952, Setiausaha Agung Umno Zulkifli Hashim telah menyeru masyarakat Melayu agar membakar buku ensiklopedia bertajuk ‘Oxford Junior Encyclopaedia’ dalam satu majlis minum petang anjuran bersama Umno dan MCA.

Ucapan beliau ini dilaporkan oleh akhbar The Straits Times bertarikh 16 Disember 1952.

Alasannya, ensiklopedia 12 jilid tersebut menggambarkan Melayu sebagai masyarakat yang ketinggalan, biasa dengan pemerintahan autokratik kesultanan Melayu dan bangsa pemalas.

Jika Umno sendiri mahu membakar ensiklopedia tersebut, seruan kumpulan pendesak seperti Badan Bertindak Interlok Kebangsaan (Niat) agar Interlok edisi murid oleh Abdullah Hussain tidak digunakan wajar dipertimbangkan.

Mereka sama sekali tidak membakar Interlok, malah pindaan hanya akan mencacatkan kelangsungan cerita Interlok.

Setelah 106 pindaan dikemukakan, Niat masih belum berpuas hati. Hujah mereka, perkataan boleh bersilih ganti namun pengertian masih sama. Tambahan pula keretakan hubungan kaum jelas kelihatan ekoran kontroversi ini.

Perspektif politik

Kepimpinan negara juga perlu melihat isu ini dari perspektif politik. Apakah kerajaan Barisan Nasional mampu bertahan sekiranya tsunami politik kedua melanda.

Pilihanraya umum 2008 memperlihatkan 90% undi masyarakat India jatuh ke tangan Pakatan Rakyat.

Sekarang adakah BN di bawah pimpinan Perdana Menteri Datuk Seri Najib Tun Razak boleh bertahan dengan kombinasi kontroversi Al- Kitab dan Interlok?

Perlu diingat di sini bahawa meskipun masyarakat India hanya mempunyai majoriti pengundi di Dewan Undangan Negeri Buntong, tetapi terdapat lebih 80 kerusi parlimen dan negeri di mana mereka menjadi faktor penentu kejayaan calon.

Di dalam BN sendiri, satu-satunya faktor yang menyebabkan masyarakat India mengembalikan sokongan adalah kerana faktor ‘Najib’.

Penulis sendiri pernah menghadiri satu majlis di mana Najib mengalu-alukan sumbangan masyarakat Malayalam. Pemimpin MIC sendiri tidak menerima sambutan mesra seperti yang diterima Najib.

Takkan kerana mempertahankan sebuah karya, BN sanggup kehilangan kuasa. Bak kata pepatah, menang sorak kampung tergadai.

I recently stumbled upon the fact that there is in the possession of the Sultan of Perak and the Perak Royal Family some astounding relics of antiquity that in all probability have an extremely significant bearing on the question of Malaysian identity and history.

One such astonishing artifact is the sword Cura Si Manja Kini or Chora Samanda Kian mentioned in John Leyden's 1810 Malay Annals or Sejarah Melayu (published in 1821 by Sir Stamford Raffles). The same sword is said to have been used during the installation of Parmeswara as ruler of Melaka in 1400. 

But in fact, its origins go further back, possibly 200-400 years earlier than 1400. 

The sword was part of the regalia of a Indian/Hindu prince linked to the Chola Kings (Raja Cholan) from South India, i.e. Nila Utthaman/Sri Tri Buana/Sang Nila Utama (founder of Singapore) narrated in the Sejarah as having landed on Mt. Segantang Maha Meru in Palembang, Sumatra together with two other princes, Vichitram and Karna Pandita, and a probable Brahmin Priest, Bat'h, exact date unknown!

Now, Bat'h is a pretty unusual name for an Indian and perhaps it's a truncated form of Vadhyar (Tamil for priest), Vadh, which became Bat'h, in the same way Vichitram is spelt in the Sejarah as Bichitram. This is consistent with the fact that the Malay language generally does not have old words that commence with the letter 'V' and 'B' was substituted.

The Sejarah relates that it is this self-same sword that was used by the borrower (from Nila Utthaman/Sri Tri Buana/Sang Nila Utama) and champion warrior Peramas Cumambang to slay the serpent monster Saktimuna (Sakatimuna/Ichktimani) into 3 parts in Minangkabau, Sumatra. In the process the sword became etched with 190 notches which strange "clue" of Dan Brown and da Vinci Code proportions, no Indonesia or Malaysian historian or anyone else has ever deciphered!

The list of relics, other than Cura Si Manja Kini, dating anywhere from 600-1,000 years includes:
  1. Royal Collar (15th century) said to have been presented by the Emperor of China
  2. Dokong or Kerongsang Besar (Neck Pendent)
  3. Cap Lalulintar (Royal Silver Seal) of Sultan Muhammad Shah (Melaka) and Kayu Gampit mentioned in Sejarah Melayu. (The Royal Lance, Limbuar appears to be missing)
  4. Betel Boxes
  5. Mestika Embun (Bezoar of Dew)
  6. Kancing Halkah (Royal Collar Ornament)
  7. Kris Taming Sari (originally said to belong to Hang Tuah).

So, how did all these relics from Palembang and Melaka end up in the custody of the Perak Royalty?

After the fall of Melaka on 24th April 1511 to Portugal  led by Alphonso de Alburquerque, Melaka's last ruler, Sultan Mahmud Shah eventually made his way to Kampar in Sumatra where he died in 1528. One of the sultan's two sons, Muzzafar Shah journeyed to Perak where he was installed the first Sultan  in 1528. It was Sultan Muzzafar Shah who brought with him the artifacts which had been handed down to his father, Sultan Mahmud.

The inscriptions on Cura Sa Manjani Kini in Sanskrit are said to come from the the words "Churiga Si Mandakini" which means "the blade from Lake Mandakini of the Ganges (River) in India!! Refer to Sembangkuala's blog for more details.

And what is the link between the Chiri of Perak, nobat players and Bat'h the Brahmin Priest cum charitra or cheritra teller in the Sejarah (pg. c4/23 - 25 John Leyden's Sejarah Melayu)? Click here and refer to the document below extracted from the Sejarah and a translation of it from page 175 of 'A History of Perak' by R.O.Winstedt and R.J.Wilkinson published by The Malaysian Branch of the Royal Asiatic Society (MBRAS): :




 
In short, Bat'h had recited the lineage of the 3 Indian/Hindu princes who landed in the mountains of Palembang to Demang Lebar Daun, the aboriginal chief and his people in Sanskrit !! Astonishing, is it not? 

The Sejarah clearly states Parameswara was buried in Tanjung Tuan (Cape Rachado) near Port Dickson, Negeri Sembilan (in Malaysia). It is Demang Lebar Daun and Nila Utthaman/Sri Tri Buana/Sang Nila Utama who are reputed to have actually been buried in Fort Canning, Singapore!!

There is therefore some serious error with the claim that Parameswara was buried in Fort Canning (Bukit Larangan) in Singapore. Click here for Keramat Iskandar, Singapore details. It absolutely makes no sense that Parameswara would be buried in Singapore when he originally fled from there in fear of his life, before founding Melaka!!). 

The time has come for the Singapore Government to initiate investigations to identify through modern scientific procedures such as carbon dating, DNA testing etc., exactly who is buried in Keramat Iskandar and Fort Canning.

Some of these artifacts and regalia must be at least a thousand years old and there is not a shadow of a doubt about their links to Parameswara and the Melaka Sultanate of the 15th and early 16th century, Indonesia and INDIA!

So, why haven't our Government and Department of Antiquities engaged an archaeologist and expert in Sanskrit and Indian languages/dialects and South East Asian history (and there must literally be hundred of them in India) as well as China counterparts to piece together what must surely be THE story of the century?

In particular, the Sanskrit inscriptions on Parameswara's sword need to be investigated in depth!

So, why the leaden footedness? Too busy "interloked" in controversies?

Building a UNIFIED INDIAN COMMUNITY UNDER HINDRAF

We read a lot nowadays in Hindraf blogs and the website about many issues involves our Indian suffering and persecutions. It's a sad scenario, many innocent people are ignored by basic rights of Human living and the rights to live and survive. This is nowadays are frequent reading materials that we see in the website and the support groups writings.

Our Hindraf Leaders have voice out what need to be said and to be done, as slowly Indian supports are gaining strength for our community. Many that i see are young vibrant people in their middle age are our main supporters. They are professionals, students, businessman and other layman whom support HINDRAF, coming down strong in their comments and their writings.

The actual facts is , we have strong people whom voice out the grievances and their problems they faced in their daily life in work, community and also in society.
What a group we are going to be IF only we could cage our parents, brothers , sisters, in laws, friends and relatives to be with us in this struggles.

My suggestion is as you all who have followed my writings ... FREINDS get FRIENDS scheme ... its a simple thing actually ... we just have to get our own friends and family to get involve and support.

I would suggest the followings :-

1) Let Hindraf leaders to carry on the UMNO bashing and plan for political moves.

2) We on the other hand ... could create groups such as HINDRAF Single Mum's,
Hindraf Students groups, Hindraf Senior Citizen groups, hindraf Professional
groups and much more for us to help and assist our community to grow as
one unit under HINDRAF flagship.

We will able to help and assist all this people and we could gather strength to builds a united INDIAN community .... we won't waste time as we could create and move together with the leaders of hindraf .

It won't just be a saying " HINDRAF is just fighting the Government BUT not doing anything for the INDIAN community. So, we as the support group, we could start the ball rolling by building these groups and futher leaders in HINDRAF.

My dear brothers and sisters, LETS not only make comments here in this website, lets start building groups as we all know it well .... nothing going to change by writing here only ... the only thing is we need to talk about our fights, our new groupings and be UNITED. lets spread this articles around for INDIANS to understand our genuine intention to build a strong INDIAN community for the sake of all INDIAN children future and generations to come ....

MY wish is to build this kinda of groupings and i ask all interested please write and comment and get your friends too to join us ... Dismissed 10 years ago from their estate jobs, 42 people are still waiting for news of better compensation as they worry about sudden eviction.

LABU: Forty-two former workers at Kirby Estate here have been living in suspense for the past 10 years, not knowing when they will be chased out of the houses they have been living in since colonial times.

They were among 180 workers dismissed in May 2001 and told to leave the land within four months. The others obeyed the order, but these 42, disappointed with the compensation offered, ignored the notice.

The offer was RM220 for each year of service. They asked for more, but the estate management never gave its response.

“We couldn’t and we won’t leave,” said P Shanmugam, chairman of a committee representing the 42. “We have nowhere else to go. We have lived here since the time of our great grandfathers.

However, as Shanmugam said, no one likes to live forever in limbo. They constantly worry about being forcibly evicted.

In 2007, the committee wrote to the estate management, asking it to raise the compensation to RM1,000 per year of service or a piece of land on which they could build new homes.

There has been no reply. So the anxiety remains, although the Negri Sembilan government has given its assurance that there are no plans to develop the land.

This is according to Party Socialis Malaysia secretary-general S Arutchelvan, who said he had been following the issue since the beginning.

“But I am not impressed by the assurance,” Arutchelvan added. “The real decision-maker is Sime Darby, which owns the land.”

Negri Sembilan MIC chief T Rajagopalu said he would raise the issue with the Plantation Industries and Commodities Ministry as well as MIC president G Palanivel, a deputy minister at the ministry.

“I have discussed this issue before with the state government, but we ended in a deadlock,” he said.
“But this time I’ll make sure it is resolved.”

Parent wants state to resolve ‘land grab’ row

The parent claims that MPSJ has taken land belonging to the school to build a bus station. But the local PKR leader denies this.

PUCHONG: An angry parent has asked the Selangor government to help settle the row between the Subang Jaya Municipal Council (MPSJ) and a Tamil school in Puchong.

According to a Tamil daily report today, MPSJ had taken half acre of land that was previously allocated to the school.

Speaking to FMT, the parent, who wished to be known only as Maniam, said that there is an allegation that MPSJ wanted to construct a bus station on the plot.

Maniam said that in 2005, the previous state government rejected MPSJ’s bid to build a bus station there.

“The land was given to the Tamil school to build a canteen,” he added.

He said that originally the school owned six acres, but later the Education Ministry carved this up and gave four acres to a national school.

“Why is the local council eyeing the school’s land where there is private land nearby? We hope that the state government will clarify the situation as soon as possible,” he said.

Contacted later, Puchong PKR division chief S Murali rubbished the allegation.

“MPSJ has no right to take away land belonging to schools, and the council is not dumb to do such a thing,” he said, adding that as far as he knew, there were no plans to build a bus station there.

“So, the parents should show where exactly is the land that belongs to the school. And if it is true that the half acre was given to the school, then PKR will urge the Education Ministry to build the canteen,” he said.

Raja Dr. Nazrin Shah: "lawyers must never mock the courts.” HRP – provided courts dispense justice as in western civil societies and not act like another UMNO govt dept.

We mean no disrespect to DYMM the Raja Muda of Perak but we truly believe in Justice (see NST 29/3/11 at page 4). As a first year law student in England in the 1980’s one of the most celebrated legal principles we first studied in Constitutional law is that Justice must not only be done but must manifestly and undoubtedly be seen to be done.

In Malaysia the UMNO run courts beginning from the Magistrates Courts to even the Federal Court are nowhere to be seen to be dispensing Justice as in the Western civil societies at least in so far as the Malay-sian Indian poor vis a vis Hindraf Makkal Sakthi and HRP are concerned .

As late as this month from the 1st to the 4th of March 2011 as the tip of the iceberg case some 53 Hindraf Makkal Sakthi activists including Secretary Ramesh Periasamy was maliciously prosecuted at the K.L., Selayang, Ipoh and Seremban Magistrates Court for merely being a member of Hindraf Makkal Sakthi, a minority and human rights NGO.

No where else in any world democracy except in absolute monarchy Saudi Arabia has anyone ever been prosecuted for merely having been a member of a Minority and Human Rights NGO.

This is only possible in the racist and religious supremacist UMNO One Malay-sian Courts.

Ramesh was slapped with an RM 8,000 bail by the Malay-sian K.L. Court when the maximum fine is only mere RM 5,000. What level of Justice can we expect from this UMNO Court?

To us even the chance of Justice is not even a starter .

For all the 53 Hindraf Makkal Sakthi activists an excessive RM 111,000. Bail was imposed when they are no criminal intent but merely championing the Malaysian Indian poor public interest.

P. Uthayakumar (a lawyer of 20 years standing) for alleging “ethnic cleansing” (the Kg. Medan state sponsored murders and 100 over caused grievous bodily harm) in his letter of complaint to the British Prime Minister Gorden Brown was prosecuted for Sedition and a bail of RM 50,000 was imposed by the K.L Sessions Court Judge Sabaraiah binti Othman when the maximum fine is only RM 5,000.

We dread thinking of the full trial to us Justice is a non starter. Injustices will be the order of the day in the Malay-sian Courts. And a conviction is a foregone conclusion which would be determined by the racist UMNO Executive.

Also this month (March 2011) the K.L. High Court dismissed the ISA Civil Suit of lawyers P. Uthayakumar and M. Manoharan without even the UMNO government of Malay-sia having to file their Statement of Defence. If this can happen to even lawyers of 20 years standing seeking Justice, what can the common Indian man on the streets of Brickfields expect?

Last month the Court of Appeal at Putrajaya dismissed Uthayakumar’s civil suit appeal again without even the UMNO government having to even open their mouth on the very serious LTTE terrorist allegation made against Uthayakumar which was the basis of his ISA detention for 514 days.

If the Malay-sian Courts does not dispense, where else do you go to clear your name that one is not a terrorist?

Malaysia’s apex Court, the Federal Court even dismissed the forced to convert to Islam cases of Shamala, Corporal Moorthy and Subashini. All when even Islam forbids forced conversion to Islam and when Article 11 of the Federal Constitution guarantees Freedom of Religion .

This is just the tip of the iceberg of the injustices meted out to especially the Indian poor. We have a whole list which we would be making public soon.

Be that as it may we have never been deterred and neither has it stopped us; we knew what we were getting into right from the very beginning.

Our Hindraf Makkal Sakthi struggle will continue irrespective until all the even up to the sixth generation Malaysian born Indian poor is treated as equal citizens like any other Malaysian citizens as is enshrined in Article 8 of the Federal Constitution.

We too are the sons of this soil. The Indian poor are also the bumiputeras of Malaysia why then should they in particular be targeted under UMNO’s acts of gross racism and religious extremism. We are born in Malaysia, raised in Malaysia and will die in Malaysia.

The Malay-sian courts literally let UMNO get away with even murder.

How then not to mock the Malay-sian Courts.

A Human Rights organisation in Malaysia – HINDRAF has particularly been targeted by the Malaysian Government on a clampdown and mass arrests of its leaders and members who organised the first ever seen Anti Racism March in Malaysia on the 27th February 2011.

Hindraf-Makkal Shakti in alliance with Human Rights Party, Malaysia (HRP) organised Solidarity March Against Racism (UMNO racism) on Sunday 27th February at KLCC. More than 1 million fliers were distributed in this campaign to eliminate and dismantle UMNO’s 54 years of Institutionalised racism. Various road shows were held nationwide to explain to the people the elusive manner in which the UMNO government manipulates, plants and entrenches racism in Malaysia but almost all of these events were disrupted by the Malaysian Royal Police Force by bearing upon the events with sheer number of officers who resorted to threats, intimidation and physical force upon the activists.

The March on 27th February was subject to a massive crackdown by the Police who had sought to detain all key Hindraf/HRP leaders and their volunteers nationwide. All 15 key Hindraf Makkal Sakthi /HRP leaders were arrested 2 hours before the march. At least 30 coaches ferrying campaigners from across the country were stopped from entering Kuala Lumpur city at various points. The coach drivers were threatened with revocation of their bus permits if they were to disregard their orders.

In the Kuala Lumpur city, Indians were subject to racial profiling and were arrested within 3 KM radius of the city as early as 5a.m., (4 hours before the march). A group of wheelchair bound well-wishers were also arrested and prevented from joining the March. On the whole, there were at least 3000 people throughout KL city and anyone intending to lend support to the March were prevented from reaching the designated KLCC as Police either intimidated them from proceeding further or threatening them with arrest on site.
Almost 280 people were arrested but out of this the Police processed only 109 and the rest were released without recording their details.

Since the 27th Feb, the police have been engaged in systematic elimination of Hindraf Makkal Sakthi, which is a Human Rights Advocacy movement for the protection of marginalised minority rights. On the 1st March, 5 leaders in Kuala Lumpur were arrested and charged for being members of an illegal society.
On 2nd March a further 6 leaders and well-wishers from Ipoh were arrested and charged.

On 3rd March 22 key leaders and well-wishers in the Negeri Sembilan State were arrested and charged. On the 4th March 2011, a further 21 leaders and well-wishers from the State of Selangor were also charged. The Police have also attended the work places of the movement’s well-wishers to harass them and also forced their respective employers to terminate the employment contracts of those arrested. The Police have similarly targeted the well-wishers home and intimidated their family members.

I believe this is a repeat of the 2007 crack down on Hindraf members and we deplore the employment of such methods to place terror or fear into our members by the police.

All of those recently arrested have been charged for being a member of an unlawful organisation; that is Hindraf (a previous name for the current Hindraf-Makkal Shakti). Hindraf was declared a banned organisation on media in a ministerial statement in 2008, but no evidential justification was given for the decision. We have yet to be served with any court order to that effect. In 2009 we re-branded our organisation and renamed it Hindraf Makkal Shakti. On 2nd October 2009, our solicitors Messrs Kumar Hashimah & Co applied to register our rebranded organisation- Hindraf Makkal Shakti but to date the Government has not taken a decision on our application. Interlok: ‘Govt chose wrong novel’

A PAS leader questions the government's choice of the novel when there are hundreds of other books available better suited to promote national unity.

KUALA LUMPUR: Kubang Kerian MP Salahuddin Ayub took the Education Ministry to task over the Interlok controversy, claiming that the government has failed to introduce an acceptable literary novel in schools.

Salahuddin also criticised the rationale of setting up an independent panel to amend the novel and getting its author to retract certain words from the book.

“No author will ever agree to amend words in his literary piece,” Salahuddin said.

He questioned the government’s decision to choose Interlok, saying that the selection process started on a wrong footing.

He added that there were hundreds of other novels available which were better suited to promote national unity.

“If national unity was the idea, why was Dewan Bahasa dan Pustaka and language experts not consulted before selecting the book (Interlok)?” he asked.

Last week, Deputy Prime Minister Muhyiddin Yassin told Parliament that Interlok would be retained in schools but 19 parts considered offensive by the Indian community were either dropped, changed or substituted.

The changes were made following the recommendations by the independent panel set up in January to review the controversial novel.

Among the words substituted were “tuhan” with “dewa” and also the removal of the phrase “orang berkulit hitam” (dark-skinned people).

The remaining 87 parts recommended were not considered offensive by the government.

Unhappy with the statement, DAP’s Ipoh Barat MP M Kulasegaran traded verbal blows with Muhyiddin in Parliament, but the minister defended his decision by saying that even MIC had agreed to the amendments.

A Memorandum on the Fate of Sabah in the Malaysian Federation

Presented by DANIEL JOHN JAMBUN, Esq. At the House of Commons, London, the United Kingdom, March 9, 2010

Good afternoon all Honourable Members of the House, ladies and gentlemen.

First of all, I would like to record our most sincere gratitude having been given this honour of presenting this memorandum before this esteemed House. Today, marks a moment of honour for the people of Sabah, the former North Borneo, for having been accorded this rare opportunity to present a Memorandum a matter of grave significance, a matter which affect our fate as the people of the Federation of Malaysia. We see this as a historical event, a moment granted by God’s grace, in which we can communicate under this honourable roof, to reminisce a milestone of history half a century ago which was followed by sad events that in too many instances happened with numerous misgivings.

For decades now, we the people of Sabah, have been haunted by ghosts of history dating back to August 31, 1963, the day we gained independence from Great Britain. Malaysia was conceptualised and constituted with the best of promises, endearing in us hopes and dreams for a greater future. It is with sadness that I stand here to witness that what had transpired since September 16, 1963 had been a series of events that had led us to the present situation in which we can justly proclaim to be a situation of shattered hopes and broken dreams!

We therefore stand before this House, in good faith, to seek redress and to appeal for an inclusive dialogue, which we hope will lead to a clearer and brighter tomorrow to all parties concerned. I seek the indulgence of this House to hear our side of the story and adjudge the events of the past with a clear conscience and a sympathetic eye, and to lend us a hand in seeking a just and righteous solution to our problem.

I would like to present three pertinent issues, which may or may not have direct concern of the present British government. Firstly, we need to take a critical review of the rationales and instruments for the formation of Malaysia. There is the nagging question of justice in the drafting of the critical Malaysia Agreement, the efficiency and integrity off the Cobbold Commission, the reliability of the promises of the Twenty Points, the Inter governmental Committee Report and the Malaysian Act, historical documents which must be familiar to the knowledge of the Honourable Lawmakers in this House. Secondly, is the perennial issue of security which now affect the sovereignty of Sabah within Malaysia. And thirdly is the case of the spiraling deterioration in the economic wellbeing of the people of Sabah.

Sabah’s Expectations of Malaysia vs Reality and the Malaysian Agreement

The facts of history is that Sabah, a former British colony, achieved its independence on August 31st, 1963. On September 16, 1963, it merged with Malaya, Singapore and Sarawak to form the Federation of Malaysia on terms agreed by all parties. The concept of merger and equal partnership was introduced by Tunku Abdul Rahman to allay fears in Sabah and Sarawak of the possibility of Malaya recolonizing them upon the departure of the British masters.

The terms of this Federation are contained in various documents such as the Twenty Points, the IGC report and of course the Malaysia Agreement, which on paper protected the interests of Sabah and Sarawak within this new Federation so that they do not lose their autonomy in certain areas of governance which gave meanings and substances to their independence.

Without doubt, this was the expressed hope of the founding fathers, principally Tunku Abdul Rahman, the first Prime Minister of Malaysia; Lee Kuan Yew, the former Prime Minister of Singapore, Donald Stephens and Mustapha Harun of Sabah, Stephen Kalong Ningkan of Sarawak, etc. Independent speeches were delivered by various leaders including Razak, Tun Mustapha, Donald Stephens and Sir William Goode to during the historic celebration of Sabah’s nationhood. I present several quotes from them below:

Today, is a historic day for Sabah. It marks the beginning of self-government and independence and the end of colonialism.

– Sir William Goode, outgoing Governor of North Borneo
(Sabah Times, Jesselton, August 1, 1963)

The Tunku naturally uttered several historic statements on the matter:

“The granting of self-government too would enable Sabah to stand on its own feet as equal with Malaya, Sarawak and Singapore.”

(Sabah Times, Jesselton, August 30th, 1963)

“The important aspects of the Malaysia Ideal, as I see it, is that it will enable the Borneo territories to transform their present colonial status to ‘self government’ for themselves and absolute independence in Malaysia simultaneously...”

“The days of imperialism are gone and it is not the intention of Malaya to perpetuate or revive them. When the Borneo territories become part of Malaysia, they will cease to be a colony of Malaya, they will be partners of equal status, no more or less than the other States.”

(Strait Times, October 2nd 1962) The “other States” refer to the other States entities of Malaya, Singapore and Sarawak.”

Today, more than forty six years after independence, the people of Sabah are asking what happened to these rosy pronouncements and assurances. In fact the Sabahans have always been seriously clarification as to why Sabah is now functioning as if it is only a colony of Kuala Lumpur. Many still remember the warnings given by former Indonesian president Sukarno, who said that Malaysia will not change colonialism but will only shift its headquarters from London to Kuala lumpur. Has Sukarno’s prophecy come true today?

Tunku Abdul Rahman kept assuring us that Sabah was now independent; that it was no longer a colony and that Sabah will have its” absolute independence” in Malaysia. What Tunku Abdul Rahman said was exactly what we expected Sabah to gain and benefit from being part of the Federation, i.e. being a fully autonomous state within the Federation. But contrary to that promise, the reality today is that Sabah has become the 12th state of Malaya. Federal government leaders, dominated by Malayans, today can arbitrarily change, at their whims and fancies, whatever they wish to suit their needs and convenience. They even ignored the Twenty Points and the Malaysia Agreement and made it sensitive to even talk about them.

The Problem of the Illegal and Legalised Immigrants in Sabah

About half of Sabah’s population of 3.25 million today are foreigners. Out of this number, 750,000 are undocumented or without travel documents or work passes. Dr Chong Eng Leong paper, “Human Rights and Citizenship: Its impact on Economics, Social and Cultural Rights,” presented at the SUHAKAM Roundtable Discussion on July 31, 2006 refers.

Of these, 60,000 are categorized as refugees and about 153,000 to 418,000 are those supposedly given work passes. In addition there are those with false documents but over and above these numbers are the 600,000 who have been given genuine Malaysian identity cards or MyKads by higher authority under “Projek IC Mahathir” (Dr. Chong Eng Leong, Ibid.)

The most serious and obvious injustices inflicted upon Sabah is the deployment of non-citizen to become voters, thereby depriving citizens of the right to democracy and self-determination. The main category of foreign voters comprise the 600,000 who have been given Mykads, under “Projek IC Mahathir.” This project was widely debated in the local papers in 2006. A witness to a trial on an election dispute confessed in court to possessing a dubious identity card, telling the magistrate that he obtained his IC through “Projek President Mahathir.” This evidence was never contested, and nor has there been any denial form the former Prime Minister.

Security and Sovereignty

Most of these foreigners come from a neighbouring country (the Philippines) which, incidently, has yet to drop its territorial claim over Sabah. By the sheer number of the illegals from the Philippines alone, with their settlements surrounding all the major cities and towns, this claim could be easily legitimized. Sabah is now a haven for escaping terrorists, rebels and kidnappers. JI or Jemaah islamiyah, a terror network, has been identified as having its presence in Sabah. So is Darul Islam Sabah. Hence, with the presence of armed foreigners on our soil, Sabah is no longer a secure state.

This begs the question: Where is the security that the founding fathers of Malaysia had promised us? With the explicit support of Great Britain, we had been hard-pressed to join in the formation of Malaysia, in the name of security from Indonesia’s Confrontation and Phillippines’ claim. But as it turned out, today Brunei, which opted out following a rebellion, and Singapore which was later expelled, are doing so much better. There is therefore no denying that Brunei had been far-sighted, and Singapore had been ironically blessed by its expulsion.

Reverse Take Over

As the number of non-citizens are now rapidly outnumbering the local population in some areas (Dr Jeffery Kitingan, Justice for Sabah, Table 4.1), it is merely a matter of time for this foreign population to spread and overwhelm the whole of Sabah. SUHAKAM’s former Commissioner, Prof. Hamdan Adnan, once said that a foreigner reverse takeover is imminent if the trend continues unabated.

Poverty

Sabah is a rich state endowed with much natural resources such as oil and gas, timber, fertile agricultural land and tourism potentials. With a population of just about three million, Sabah offers abundant promises for vibrant economic development and enviable prosperity. Unfortunately, Sabah today is the poorest state in Malaysia (according to the government’s Malaysia Plan Report). Most of Sabah’s timber has already been harvested without any heed to sustainable supply management, and over eighty percent of the agricultural land develop for oil palm belong to corporate giants owned by west Malaysian companies. Ironically, Sabah is Malaysia’s largest oil palm producer with 60% of the nation’s palm oil being produced in Sabah. Sabah is also one of three Malaysia’s oil producing states, producing more than 73,000 barrels of crude petroleum per day. Why then is Sabah poor and financially dependent on the federal government? The answer is simple: It is either that Sabah is not getting its fair share of its own wealth or is the victim of mismanagement, or both. UNDP (United Nation Development Program) put the State poverty rate at 24.3% of the population.

Poorest State

Sabah, once the richest state in Malaysia, is now the poorest. Most of the poor are Natives in the rural areas, including paddy farmers, fishermen and smallholders. The state government of Sabah has one of the highest budget deficit in the country amounting RM252.89 million (2006). With a population of 3.25 million, its per capita income currently stands at RM9,536 compared to RM18,040 for Malaysia. This show a huge disparity with Sabah’s per capita income way, way below the national standard. Where do our riches go to? To be exact: to the Federal Government. Sabah can never be rich as long as our State cake” is continuously divided into thirteen.

Oil Revenue

Oil and gas belong to the state but in 1976 the federal government made the state surrender this state resource to a central government agency, PETRONAS. It is said that that the “Double Six” Tragedy (airplane crash at Sembulan which killed senior Sabah cabinet members, including the then Chief Minister Tun Fuad Stephens, the former Donald Stephens) was the result of the refusal by Stephens to sign away Sabah’s oil right in Labuan then. Soon after Tun Fuad’s funeral, Harris Salleh signed the agreement. In return the state gets only 5% of the oil revenue. Why? Why do we get only 5% of the revenue from oil, when in the first place, it is a state resource? Who gets the other 95%? How much revenue earnings have been generated from Sabah’s oil and gas, including their by-products?

Felda and Felcra

Land given out to Felda and Felcra by the State Government for the purpose of development assistance to the landless local was never implemented. According to the former Chief Minister, Harris Salleh, 300,000 hectares have been given to Felda/Felcra for this purpose. We know of no one Sabahan having benefited, although perhaps there may be a few. So who are the rest of the beneficiaries? Who is reaping the oil palm harvest from our land? Obviously, justice must be served. And these lands must revert back to the State Government and their utilisation reviewed as part of our economic revival and poverty eradication programmes.

Political

The enormous political implications of the non-citizens currently holding citizens’ identity cards are mind boggling. It is frightening to contemplate the ramifications of the fact that they can vote, as they have been recruited and mobilised by certain political leaders in the BN (the Barisan Nasional or National Front) ruling coalition. In fact most of these “voters for hire” have been recruited as members of UMNO (the United Malay National Organisation), the backbone of the BN.

Even a fellow BN member had openly admitted that illegals could be in BN parties. Chin Su Ling, Youth Chief of the Liberal Democratic Party, a component of the BN said there is a possibility that many illegal immigrants have become members of various BN component Sabah. (Borneo Post, Tuesday, September 19th, 2006). These foreigners may just be “voters for hire” at present but once they can organize themselves, they could be in a position to control Sabah UMNO and elect their own representatives into the State Assembly and Parliament. Once this is achieved they could take over the government and change the rules of the game in their favour. This is not impossible.

How did Sabah’s population grow so fast? Are we more fertile than Sarawak or the peninsular? NO! The high growth in Sabah’s population is explained by the high arrivals of foreigners, many of whom were later exploited to become voters through the “Project IC.” Worse, these foreigners who obtained MyKads through the backdoor also claim to be Bumiputeras (sons of the soil). They are in fact The New Bumiputeras! These new “natives” are now the same number as the natives!

Source of Socio-economic Problems

This large foreign population in Sabah also presents a heavy drain on the economy and social services fund. One estimate puts this cost to the State between RM271 million to RM811 million a year. They also take away from the local quota for education in schools and institutions of higher learning. They use a lot of medical facilities and health care services and encroach onto natives lands, producing squatter colonies. They also rely on low cost housing schemes provided by the government. They are also involved in drugs. According to the police, 90% of drugs are from the Philippines. They steal water and electricity through illegal connections and pollute the environment. Employment wise, many illegals are now running taxis, mini buses as drivers.

Conclusion

The root cause of Sabah's dilemma is the fact that the Inter-Governmental Committee Report had failed to ensure Malaysian Government compliance with the Malaysia Agreement on a continuous basis. Various ‘modification’ and ‘adjustments’ had been surreptitiously inserted into the national governance mechanism which had trapped us into subservience and compliance and in the process eroding much of our rights and privileges.

The IGC must be revived and the United Kingdom, along with Singapore, Sarawak, Sabah and Malaya (the Federal Government), must play an active role as sympathetic and just former master to institute effective and enduring rectifications. This is the least that we can ask for. This is also the way forward. The United Kingdom is the first stop in our mission to revive the IGC. Efforts are also being made at this material time in Kuala Lumpur by Dr Jeffrey Gapari Kitingan, the chairman of the Common Interest Group Malaysia (Cigma) to seek the same redress and review of the terms of independence And formation of the Federation of Malaysia. Likewise we are mobilising a similar mission to Singapore prior to seeking a dialogue with the Sabah and Sarawak State Governments on the same issue.

With respect and reverence we lay our hopes and desires before this honourable House for a redirection of the negative trends that beset us in Borneo, in the full confidence that a vehicle to the future can be chartered for justice and truth, to pick up the pieces of the shattered hopes and broken dreams.

On March 19, Uthayakumar, the Advisor to the Human Rights Party, criticized me, Arutchelvan and the Parti Sosialis Malaysia for taking a “soft line” on “UMNO Racism” and thus serving to cover the oppression of Indians by UMNO. We, in the PSM, think that it is Uthayakumar who doesn’t understand the root causes of oppression of the Indian Poor in Malaysia, and that his ill-advised statements and actions actually make the situation worse for the Indian Poor.
However, before going into the issue of root causes of Indian poverty, I would like to place on record that though I think his analysis is wrong, I recognize Uthayakumar’s courage to stand up and speak up for what he believes is true. He has not been silenced by ISA detention and has remained consistent in the past 12 years that I have known him. Quite clearly he is impervious to attempts by the BN to buy him over. Society needs men and women who are prepared to stand by their beliefs – but these beliefs must be based on a correct analysis, otherwise such individuals might actually do more harm!.

UK:Thank you for the compliments and and we too have never doubted Dr Jayakumar’s struggle as being a lot more sincere than that of PKR,DAP or PAS’.


I also wish to place on record that the Hindraf led uprising of November 2007 was a major factor leading to the March 8th Tsunami in the 2008 General Elections, and I too was a beneficiary of that wave of discontent against the BN. But that doesn’t mean that I will go along with Hindraf’s analysis if that is off the mark.

UK: No wonder there was a tsunami if not an avalanche of reciprocating Parliamentary Emergency Motions, RM1.00 Minister’s pay cut motions,walking out of Parliament, strenuous Parliamentary questions, Public forums, public protests etc for the real and critical Indian problems by PKR,DAP,PAS and PSM MPs’. Also pin drop silence when 53 Hindraf activists were prosecuted early March 2011 for being members of Hindraf, a minority and human rights NGO and the 300 over Hindraf activists who were arrested on the 27th Febuary 2011 Hindraf Rally. Let alone for the Hindraf lawyers who were immediately thereafter detained under ISA for 25th November 2007  Hindraf Rally.Thank god in particular the Indian poor masses stood by us until the very end the very day of our release lest we would still be languishing in Kamunting Prison.(We will welcome the long list of the aforesaid PKR,DAP,PAS and PSM ‘deeds’ for our publication in full in this our website!Believe us, we have the space!)We also have not forgotten PSMs’ official written stand that the Hindraf rally was racist and telling the people not to attend.But they did not mind the fruits of the Hindraf rally though! 


The main differences between the PSM and the Hindraf analyses are
1.  Hindraf/HRP believes that the main cause of the marginalization of poor Indians in Malaysia is the racial policies of the UMNO led government.
The PSM agrees that there is racial discrimination against the non-Malays, and that this has to be changed. But in our assessment, racial discrimination contributes only about 30% to the socio-economic problems of the Indian Poor. About 70% is due to the Capitalist system that oppresses the poor of all races through low wages, inadequate housing, eviction of communities to make way for development, privatization of basic amenities, etc.

UK: The broad based phrase non-malays has long been conveniently ‘used” by PKR,DAP, PAS, PSM,NGOs’ and the Indian elite to dilute and divert away from the far far more real and critical Indian poor problems socially engineered by UMNO racism as is reported on a day to day basis in our website www.humanrightspartymalaysia.com But which the aforesaid parties pretend does not exist.One cannot equate the Indian poor with the (non malay) especially Chinese poor which community are the economic giant that controls some 60% or so of the Malaysian economy and which in any event has 507 Chinese New Villages as their social safety net for the Chinese poor as opposed to the almost zero Indian villages for the Indian poor.There may be some temporary Indian Village names but which the racist UMNO has classified as ‘squatters” and is awaiting systematic eviction if not systematic “ethnic cleansing”.The poor Malay,Orang Asli,Iban,Kadazan etc all have thousands of their permanent ancestral villages and land as their social safety net which 99% of the Indian poor don’t have.So let us not pretend that the Indian poor equals a malay or non malay poor.
We beg to differ.Capitalism is a convenient excuse not to fight UMNO racism that has socially engineered to preserve the 70% Indian poor and to create the future Indian poor.Socialism certainly includes championing the cause of the Indian poor and against UMNO racism.


2. Hindraf/HRP believes that the best way to help the poor Indians is to mobilize all Indians to oppose UMNO. So Hindraf seizes on any issue it can that has the potential to make Indians angry with UMNO.

UK:No,Hindraf rose to fill the almost full vaccum left vacant by the almost zero takers for the non “politically rewarding” Indian problems vis a vis to fight UMNO racism.Hindraf fought without fear or favour while PKR,DAP,PAS,PSM,NGOs’ and the Indian elite pretended that it did not exist and choose to play to the aforesaid majoritarian especially the Malay muslim political gallery.On the other hand MIC and almost all the other Indian NGOs’ merely played the UMNOs’ Indian mandore role via their scores of wayang kulit propaganda on a day to day basis which is reported on a day to day basis especially in the three Tamil dailies etc.


The PSM believes that the way to help any poor community is to get down to the ground and mobilize them to fight for their rights. PSM also believes that in the longer rum, the only way to solve the problem of the Indian poor is by forming a multi-racial coalition of the poor from all ethnic groups to come together to demand a fairer share of the economic cake for all the rakyat. So the PSM tries to build solidarity among the poor of all races.

UK:Yes we agree and are still waiting for the day it really happens.


3.  Hindraf/HRP wants larger quotas for Indians – for scholarships, for university seats, for shares, contracts, for positions in local councils, etc.
The PSM says that defining quotas by ethnicity will lead to a much larger share of the quotas going to middle class Indians and the rich Indians and very little to the poor Indians. Quotas must be defined strictly by socio-economic criteria and not by ethnicity.

UK:No,Hindraf has never asked for higher quotas.We have always demanded for equal rights which is our constitutional right as is enshrined in Article 8 of the Federal Constitution.In fact our motto is “Rights not Mercy” and being up to the the sixth generation Malaysian born Indians we too are equally the sons of this soil as much as any other Malaysian.


4. Uthayakumar seems to argue that fighting for the rights of the poor in other races is a betrayal of the Indian poor as it takes our time and energy away from the Indian issues.

UK:No.One betrays the cause of the Indian poor when one pretends that for every Indian poor there is a Chinese poor.And the Indian poor is equals the Malay muslim poor for which poor when it comes to higher education,business opportunities and government jobs in particular,the sky is the limit.This is definitely not the case for the Indian poor.Why/Why not?And why does one sidestep the gravity and seriousness of the Indian poor problems as equals to every other Malaysian poor problems.Why are we in a state of denial?In short intellectual dishonesty by diluting and diverting away from the real pressing and critical Indian poor problems created by especially UMNO racism is the betrayal of the true cause of the Indian poor.



The PSM believes that our involvement in the just struggle of the non-Indian poor actually strengthens our capacity to fight for the rights of the Indian poor. In many of our pickets to prevent eviction, we draw multi-racial participation. If there are arrests of Indian settlers, within hours we can assemble a multiracial crowd in front of the Balai. Multi-racial solidarity of all the poor is the best tool to fight both class oppression and  UMNO racism.

UK:Yes.We are also still waiting for the day for this to happen.


You can’t fight Malay racism with Indian racism! For this is exactly what UMNO wants – for it helps them consolidate their support among the Malay population.

UK:Accusing one of fighting Malay racism with Indian racism is about the most convenient excuse used by especially the many liking to sound magnanimous “multi racial” Indian elite to sidestep the real and critical Indian problems which was first told to me some 20 years ago by the “multi racial” Indian elite.Thank god even as a young lawyer I did not fall into this “multi racial”Indian mindset trap.Today I analyze this to be arising out of Minority complex and Inferiority complex.For championing this cause of the Indian poor I was detained for 514 days under the ISA and on 11 other occasions and a charge of Sedition for alleging UMNOs’ “ethnic cleansing”especially with regards to the Kg Medan racial attacks targeting the Indian poor where 5 Indian poor were murdered and 100 over inflicted with grievous bodily injuries and carrying a three years jail sentence are still hanging over my head in the UMNO Courts.I have no regrets.(We have not forgotten that in this Kg Medan atrocities, the worst case of human rights violations in the history of Malaysia saw almost pin drop silence from the supposedly “multi racial” PKR,DAP,PAS,PSM,NGOs’ and the so called “multi racial “ Indian elite.


5.   Uthayakumar believes that his strong criticism of UMNO and its racism is weakening it.
The PSM believes that though Uthayakumar is sincere in opposing UMNO, his action and pronouncements which can be easily portrayed by UMNO as attacks against the Malay community, actually helps UMNO politically. Hindraf/HRP provides the perfect counter-foil to Perkasa!

UK:Unlike PKR,DAP,PAS,NGOs’ and the ‘multi racial”Indian elite, Hindraf and HRP refuse to play to the majoritarian racist political gallery nor are we prepared to become their Indian mandores.The Perkasa allegation is yet another “multi racial” Indian excuse to play to the 60% malay muslim majoritarian voter gallery and but never mind the Indian poor kena nyaya on a day to day basis.Our paramount public interest is to go by Justice,equality,equity and Human rights and not whether UMNO gets the votes or not.We leave that to the good doctor Dr.Jayakumar,PSM and his ‘multi racial’ Indian elite friends, PKR,DAP,PAS etc


These then are the main points of difference between the PSM position and the Hindraf/HRP position on the causes of the “Indian Problem” and the way to overcome it. I think it will be good to continue the debate on this, but may I suggest, lets not descend to name calling and attributing bad intentions to the other side, so that we can focus on the key issues and get these clarified.

We do not have the luxury to debate on this issue. One must be able to feel the Indian poor cause to know what the true Hindraf and HRP struggle is all about. Either you feel it or you don’t. To quote a Tamil proverb “If one cannot help one should not come in the way of Hindraf and HRP”. “Rights not Mercy”

We now treat this matter as closed as our real enemy is the racist and religious supremacist UMNO.

Siapa pendatang?

Penulis mengajak pembaca menilai suatu isu besar yang berada di depan mata tetapi sering tidak dibincangkan secara terbuka.

Saya amat menyampah apabila sesiapa sahaja merujuk warganegara Malaysia daripada kalangan kaum Cina, kaum India dan “lain-lain” sebagai “pendatang” dan “bangsa asing”.

Ternyata kelompok yang menggunakan istilah berbentuk penghinaan itu tidak tahu membezakan antara “keturunan”, “kaum” dan “bangsa” serta tidak tahu sejarah dan asal-usul masyarakat pelbagai kaum di negara ini.

Sepatutnya kelompok seperti itu ditahan mengikut Akta Keselamatan Dalam Negeri (ISA) kerana mampu menggugat keamanan dan keselamatan negara dengan membawa unsur-unsur ekstremis dan perkauman melampau.

Saya biasa mendengar penggunaan istilah “bangsa asing” dan “pendatang”; misalnya apabila kelompok tertentu (termasuk Badut Paul Lathic, tentunya) berkata, “Bangsa asing dan pendatang perlu menghormati bla bla bla …” di mana istilah itu digunakan untuk merujuk kepada mana-mana warganegara Malaysia yang bukan “kaum Melayu”.

Saya juga amat menyampah apabila kelompok tertentu bercakap mengenai penduduk di Sabah dan Sarawak bagaikan kedua-dua negeri itu bukan sebahagian daripada Malaysia!

Sering juga saya mendengar orang berkata, “Bangsa asing dan pendatang pun sudah pandai bercakap Bahasa Malaysia” di mana “bangsa asing” dan “pendatang” bukan merujuk kepada bangsa asing (bukan warganegara Malaysia) dan pendatang asing tetapi merujuk kepada sesiapa sahaja yang bukan “kaum Melayu” walaupun mereka adalah warganegara Malaysia yang berjiwa Bangsa Malaysia.

Saya berani mengatakan bahawa istilah “pendatang” dan “bangsa asing” digunakan ke atas warganegara Malaysia yang bukan “kaum Melayu” hanya oleh kelompok yang fanatik, penuh dengan kebencian, bersikap perkauman secara ekstrem serta menganggap dirinya sendiri adalah “pendatang” yang sedikit pun tidak berjiwa atau bersemangat Bangsa Malaysia.

Maka, untuk menutup hakikat kelemahan dirinya itu, mulalah individu berkenaan melabel orang lain sebagai “pendatang” dan “bangsa asing”; tidak ubah seperti kelompok tertentu yang takut bayang-bayang sendiri dalam soal penggunaan istilah “Bahasa Malaysia” apabila merujuk kepada bahasa kebangsaan dan bahasa rasmi negara ini.

Pada 26 Julai 2010, saya ada menyatakan begini pada ruangan status di laman rangkaian sosial Facebook:

“Terkejut kerana masih ada kelompok tertentu yang merujuk pada warganegara Malaysia kaum India dan kaum Cina sebagai ‘bangsa asing’ dan ‘pendatang’.”

Pelbagai reaksi dan protes peribadi

Status itu mendapat beberapa reaksi daripada rakan-rakan. Masing-masing memberikan pandangan, komen dan kritikan untuk manfaat bersama. Sekurang-kurangnya, ada ruang dan peluang untuk mereka bersuara dan menyatakan pendirian berhubung topik yang sengaja dilabel pihak tertentu sebagai “sensitif” dan “menggugat keselamatan negara”.

Pada tarikh yang sama juga, saya memutuskan untuk mengambil langkah wajar sebagai protes peribadi terhadap penghinaan yang dilakukan mana-mana pihak melalui penggunaan istilah “bangsa asing” dan “pendatang”.

Keputusan saya adalah seperti berikut; sebagaimana saya paparkan pada ruangan status di Facebook pada 26 Julai 2010:

“Sesiapa yang berpendirian bahawa warganegara Malaysia daripada kalangan kaum Cina, kaum India dan ‘lain-lain’ sebagai ‘pendatang’ dan ‘bangsa asing’ tolong segera klik Remove From Friends kerana saya tidak layak menjadi sahabat anda. Teruskanlah hidup anda yang penuh kepura-puraan.”

Dalam masa tidak sampai 24 jam, dua individu berbuat demikian. Terima kasih, Tuhan, kerana menyelamatkan saya daripada terus berkawan dengan puak ekstremis yang menggugat keamanan negara!

Bayangkan! Walaupun negara merdeka pada 1957 dan Malaysia terbentuk pada 1963, desas-desus melibatkan “pendatang” terus kedengaran pada 1960-an, 1970-an, 1980-an dan 1990-an.

Sejak kecil, saya juga sering mendengar kanak-kanak, remaja, orang dewasa dan warga emas mengatakan bahawa kaum Cina dan kaum India di negara ini tetap dilihat sebagai pendatang dan boleh “dihalau keluar pada bila-bila masa”.

Tentu sahaja sebagai seorang kanak-kanak – dan kemudian remaja – perasaan saya terguris mendengar kata-kata yang menafikan hak dan kedudukan mana-mana warga Malaysia.

Saya juga sedikit marah terhadap generasi terdahulu kaum Cina dan kaum India yang masih risau memikirkan kemungkinan mereka “dihalau keluar pada bila-bila masa” kerana kononnya mereka tetap dianggap “pendatang” walaupun mereka lahir, tinggal dan bakal meninggal dunia di sini.

Bagi saya, citra kaum India di Malaysia adalah seperti watak Madhavi dan Vijay Kumar serta datuk mereka (Kumara Kurunadhar) yang saya paparkan dalam cerpen “Nayagi” (Menara 5, 1993).

Keakraban generasi muda pelbagai kaum di Malaysia adalah seperti yang diwakili dua watak kanak-kanak dalam cerpen “Orang Pulau” (Siru Kambam, 1996).

Peristiwa 13 Mei 1969 sepatutnya sudah menjadi satu pengajaran besar. Tentu sahaja tidak mungkin berlaku bencana seperti saya gambarkan dalam sebuah faksyen berjudul “Pulau Pendatang” yang sebelum ini disiarkan secara bersiri dan eksklusif menerusi blog saya mulai Ogos 2010.

Dahulu, saya tidak faham mengapa ada kaum Cina dan kaum India yang masih “takut” sedangkan segala hak dan kedudukan mereka terjamin di bawah Perlembagaan Persekutuan, iaitu undang-undang tertinggi negara.

Namun, nampaknya isu “pendatang” masih berlarutan pada Alaf Baru. Pelbagai cara licik dan tidak bermaruah digunakan pihak tertentu untuk terus mempersoalkan kesetiaan rakyat negara ini.

Kreativiti dan inovasi ternyata dimanipulasi sepenuhnya dalam hal ini. Sekadar contoh, apabila kaum Cina dan kaum India kurang berminat menyertai angkatan tentera, dikatakan mereka tidak patriotik!

Mujurlah majoriti Bumiputera Sabah dan Sarawak masih kekal di negeri masing-masing. Jika tidak, mereka juga berhadapan risiko dianggap “pendatang” berdasarkan acuan yang dijadikan ukuran untuk membezakan antara “rakyat” dan “pendatang”.

Realiti yang menyedihkan di negara ini adalah bahawa sesiapa yang tidak termasuk dalam acuan budaya kaum tertentu dan/atau acuan agama tertentu secara automatik masih boleh dipertikaikan semangat patriotik mereka dan masih boleh dipanggil “pendatang”.

Dan tindakan tidak bermaruah seperti itu dianggap tidak bertentangan Perlembagaan Persekutuan. Malah, jangan lupa bahawa sehingga 24 Mac 2011, kaum India yang dilabel menggunakan gelaran tertentu dalam novel Interlok edisi murid (DBP: 2010) dianggap tidak menjadi masalah.

Di sisi lain, polemik mengenai konsep, makna dan agenda sebenar “Ketuanan Melayu” (sila bezakan dengan “Kedaulatan Melayu”) masih berlarutan dalam kalangan kaum Melayu di negara bertuah ini.

Sesiapa sahaja tentu berhak mempertikaikan hasil penelitian rambang yang saya paparkan di sini bahawa kaum Cina dan kaum India di Malaysia masih dilabel sebagai “pendatang” dan ‘bangsa asing”.

Pada masa sama, tentu sahaja mana-mana pihak yang mengakui kewujudan Tuhan tidak boleh menafikan realiti yang benar-benar wujud di depan mata berhubung perkara yang saya perkatakan.

Kita tidak memerlukan WikiLeaks untuk membantu membuka mata kita untuk melihat gajah di depan mata!
