Hindu Activist/Lawyer Detained in Malaysia

KUALA LUMPUR, Malaysia – International media watchdog, ,Reporters without Borders (RSF) and the Hindu community asks for the release of P. Uthayakumar, who has been detained without trial since last December. Malaysian authorities arrested Uthayakumar, a human rights lawyer for a non-profit Hindu rights organization, Hindu Rights Action Force (Hindraf), under Malaysia’s Internal Security Act (ISA).

Hindraf works to publicize the plight of ethnic Indian minorities who have been consistently marginalized in Malaysia. Uthayakumar pointed out that every year 1 Hindu is killed under police custody and called upon the international community to put pressure on the Malaysian government to try perpetrators in International Criminal Court. Last November, Uthayakumar posted on his website a letter he wrote to British Prime Minister Gordon Brown asking the Prime Minister to support a UN Security Council resolution that condemned the “persecution” of Hindu minorities in Malaysia.
After Hindraf organized a massive rally last year, where nearly 30,000 Indians marched the streets, the Internal Minister of Malaysia declared Hindraf an unlawful organization.

The Internal Minister accused Hindraf of exploiting racial issues which disrupted peace and public order and since last December five Hindraf leaders have been arrested under the ISA.
Under article 8 of the ISA, a person can be detained up to two years if he is “acting in any manner prejudicial to the security of Malaysia” and the detention can be extended indefinitely.

RSF said, “Uthayakumar’s detention yet again shows to what degree the ISA is used to violate the principle of free expression … by allowing someone to be arrested without charge, this law enables the government to silence its opponents. We urge the authorities to release Uthayakumar, who just used his right to free speech.”

Not Tamil and Chinese Schools but Institutional race, religious and supremacist plans, policies and programmes that is causing racial and religious polarization, disharmony and disunity.


We refer to the above matter and to Datuk Mukhriz’s statement (NST 2/12/08 at page 8) that vernacular schools are causing racial and religious polarization in Malaysia. It is the UMNO controlled Malaysian Government’s institutional race, religion and supremacist based national development plans, policies and programmes that is the root cause and the present day major cause of polarization, disharmony and disunity in Malaysia despite 51 years of independence.

May we draw your kind attention that this current UMNO’s policies using race religion and Malay Supremacy as the basis is not only unfair and unjust but is also obsolete especially when the world and the people of the most powerful country in the world has actually elected the son of an immigrant slave ancestry black and “muslim” as the President of the United States of America.

In Malaysia the non malay muslims are not even allowed to become a District Officers. The Indians in particular are excluded and segregated from almost every aspect of the country’s national development plans, policies and programmes beginning from the Permata, kemas and other kindergardens to fully residential Mara and elite schools to University and UITM intake to government contracts, heavy lorry and bus permits, to Felda, Felcra Risda Agropolitan land schemes for the landless, to licences, permits, business opportunities to civil service GLC corporations corporate and business employment and top jobs etc. and almost every aspect of day to day life has been made into institutional race, religious and further expanding day by day.

When this segregation and exclusion stops, Tamil and Chinese schools will die a natural death. In the 1950’s and 1960’s most of the Indians and Chinese and even the Malays preferred the then English schools any way. Because then there was equality and equal opportunities.

Kindly reevaluate your race religious and Malay Supremacist based policies which is taking up so much of the nation’s energy - focus should be used to progress.

MAKKAL SAKTHI SUBMITS PEOPLE'S PETITION TO DYMM YDP NG SEMBILAN






On 20th Dec 2008, Makkal Sakthi representing majority Malaysian Indian submitted a petition to the Highness YDP Negeri Sembilan at his palace, Istana Hinggap at about 3pm. More than 200 people gathered to show their loyality and seek the Highness to look into Malaysian Indian problems. It was a peaceful gathering.

3.15pm at Istana Hinggap Seremban, Malaysian Indians sent the petition to swear allegience to the Rulers and hope the Rulers can address issues of marginalization & discrimination of UMNO goverment against Malaysian Indians.
We were disappointed the Istana official was not there to received our petition. The official Datuk Abdullah who was not there, have instructed Lans Corperal Zurish (Police ID.No 146288) to received on behalf of Istana.
We were surprise the heavy present of Police and FRU. The way they look as thou we are not welcome there. The police were very rude, they give us 5 minute to disperse or they will arrest us. We left peacefully.

Day 4 - Letter from P.Waythamoorthy, UK that appealled to call off the hunger strike.

HINDRAF APPEALS UPON HUNGER STRIKERS TO CALL OFF STRIKE.OPPRESSIVE UMNO REGIME WOULD PAY FOR THEIR SINS.

HINDRAF appreciates the effort of S.Jayathas and 14 others who began a hunger strike to protest the ISA arrests and had vowed to go on hunger strike until the Government abolishes the ISA. Last few days have been tough and testing moments for those participating.
They are now weak and Mr jayathas had to be rushed to hospital today after he collapsed during the Maha yaagam (Fire ritual).
Jayathas is a kidney patient and last had his dialysis done a week ago. I now appeal to all those participating in the strike to call off their hunger strike as the UMNO regime is a ruthless and oppressive regime which does not care about its citizens. It is not worth scarifying lives for UMNO for they are a bunch of cruel and inhumane lot who cares a damn about humanity, democracy and rights.

To the 15 hunger strikers I bow before all of you and appeal you would heed my humble request and call of the strike.

The whole democracy loving Malaysians are behind you. Your sacrifices and spirit have encouraged many others. Well done and keep up the spirits.

Day 4 - Hunger Strike Update -Jayathas taken to hospital on 4th day!!

Hindraf coordinator S Jayathas who has been on a hunger strike with 14 others to protest the draconian Internal Security Act (ISA) was admitted to hospital today, organisers said.

P Waytha Nayagi, another participant in the hunger strike which began on Sunday, said Jayathas was taken by ambulance to hospital.
She said that Jayathas, 41, collapsed while performing a special 24-hours prayer or yagam which started at 8.30am today.
The hunger strike is being staged at a small Hindu temple in Seri Gombak. Participants are consuming only water.



"Jayathas became weak after four days. He also missed two rounds of dialysis treatment. He is a kidney patient," Waytha Nayagi said.
"He missed his treatment on Monday and today... his last dialysis was on Friday and he was very weak," she added.She said that Jayathas avoided his dialysis treatment as he would have to consume food after undergoing the treatment.She also told Malaysiakini that Jayathas had initially refused medical care because he wanted to continue with the strike but the others had convinced him to change his mind. Undergoing dialysisWhen contacted at about 4pm, Jayathas told malaysiakini that he was being treated at the emergency ward in Selayang Hospital."I'm feeling much better now and I will be undergoing dialysis in a while," he said.Explaining his earlier condition, Jayathas said that he first felt giddy while performing the prayers and that his legs began to cramp.

"My blood had become toxic because I had avoided the (dialysis) treatment," he said.Nevertheless, he is determined to continue the strike once he is well enough to return to the temple.The strike began on Sunday at the Sri Maha Kaliamman Temple in Seri Gombak to commemorate the first anniversary of the detention of five Hindu Rights Action Force (Hindraf) leaders under the ISA.
Waytha Nayagi is the sister of P Uthayakumar, one of Hindraf 5, who are being detained without trial.
The five, one of whom is a state lawmaker, were arrested last December after enraging the government by mounting a mass rally alleging discrimination against Indian Malaysians.
Ending the fast tomorrow
Waytha Nayagi said the group would end their hunger strike tomorrow.
"But we will continue our struggle in other forms until the ISA is abolished and all detainees are freed," she said.





The strike was initially planned to take place in Shah Alam but the organisers failed to secure the location.Waytha Nayagi explained that they had also approached over 30 temples in the vicinity of Kuala Lumpur and Selangor but were denied permission."They were afraid and some of them were threatened by the police...when they (temples) face demolition, makkal sakthi (people power) is always there... that's the irony of this, you see," she added.


The yagam is being held for "divine intervention in securing our goals", said Waytha Nayagi.
Indians make up less than eight percent of the population of 27 million.
The ISA, a relic of the British colonial era when it was used to fight a communist insurgency, allows for renewable two-year periods of detention without trial.
The government says it is a vital tool to fight terrorism, but rights groups say the law has been improperly used to silence government critics, and that detainees are mentally and physically tortured.

Home Minister Syed Hamid Albar said last week that since he took over the portfolio in March, the number of ISA detainees - most of them alleged Islamic militants - had been reduced from 70 to 46.

Waytha Nayagi Ponnusamy, another of the participants in the hunger strike which began on Sunday, said that Mr S. Jayathas, coordinator of rights group Hindraf which organised the protest, was taken by ambulance to a nearby hospital.
'Mr Jayathas became weak after four days of hunger strike. He also missed two rounds of dialysis treatment. He is a kidney patient,' she said.
Ms Waytha is the sister of P. Uthayakumar, one of five ethnic Indian leaders of Hindraf who are being held under the controversial Internal Security Act (ISA) which allows for indefinite detention without trial.

The following are message from Mr.P.Uthayakumar Dear HINDRAF Supporters
Though HINDRAF has been banned by this Government I urge all of you to continue the true spirit of HINDRAF that has been to pressure the government to address all issues affecting the Malaysian Indian Community. The most crucial demands of the Malaysian community are contained in the 18 demands we had submitted in August 2007 and I stand by those demands and am willing to be in prison for as long as it takes for the Government to fulfil those urgent needs of the community.
I take full responsibility for those demands made and urge the Government to release my fellow Lawyer brothers who merely acted in helping me and my brother Waytha Moorthy in various matters in court.
The 3 Lawyers have suffered in prison for a year and there are no valid reasons for the Government to hold them and they should be immediately released. This one year of prison life has taught me to be strong and I am resolved to struggle for the rights of Malaysian Indians. UMNO Government has cheated the Malaysian Indians for more than 51 years and this has to come to an end.
Let us all unite as one voice to speak for our rights. Keep our differences at bay. No two man can think alike and have the same opinions.
But basic rights are something that we should all demand equally and to do so we have to have a single voice. With this single voice we should continue to push forward and I urge all of you to be prepared for a higher task of not only demanding our rights from this government but to also make yourselves available to serve the community in a positive way.
Year 2009 should be dedicated to serve the community and I urge all of you to come forward to join us in our next agenda to serve the public.

Fifteen Hindraf supporters launched a hunger strike on Sunday to demand the abolition of a tough security law which the government says is needed to combat terrorism, organisers said.

"The five-day hunger strike is to protest against the draconian Internal Security Act (ISA) and to demand all detainees are freed," S. Jayathas, coordinator of the rights group Hindraf which organised the strike, told AFP.

"The hunger strike is also to demand the government end all injustices in Malaysia and stop discriminating against minority Indians."

The ISA, a relic of the British colonial era when it was used to fight a communist insurgency, allows for renewable two-year periods of detention without trial.
The government says it is a vital tool to fight terrorism, but rights groups say the law has been improperly used to silence government critics, and that detainees are mentally and physically tortured.

Rights groups say 70 people, mainly alleged Islamic militants, are being held under the ISA.
Hunger strikers to only take water
The protesters are staging their hunger strike at a small temple north of Kuala Lumpur.
Some of those taking part are relatives of five Hindu Rights Action Front (Hindraf) leaders, who are being held under the ISA.
The five, one of whom is a state lawmaker, were arrested after enraging the government last November by mounting a mass rally alleging discrimination against Malaysia's minority ethnic Indians.
Ethnic Indians make up less than eight percent of the 27-million-strong population of the mainly Muslim Malay country.
Jayathas said the protesters would only consume water during the strike.

Today (14th Dec 2008 ) Makkal Sakthi supporters launched a hunger strike until the UMNO regime acts on the plight of all Malaysians to Abolish the draconian ISA law, release all ISA detainees and allow their chairman Mr. P. Waythamoorthy for a save return to his beloved homeland.
Almost 50 Makkal Sakthi supporters gathered at the

today and commenced the hunger strike after paying homage to the Almighty Goddess Mother Sri Maha Kaliaman.
P.Uthayakumar's sister P.Waythanayagi also join in the hunger strike to Abolish the draconian law ISA. National Coordinator, S.Jayathas said that a copy of the "Makkal Sakthi 18 Points Demand" was surrendered at the feet of Goddess Maha Kaali , seeking Her blessings to make the UMNO led BN government to repeal the ISA and address the 51 yrs of colonialization, discrimination and suppression against the minority Malaysians Indians.
The supporters demanded immediate and unconditional release of the HINDRAF leaders together with the others detained under the ISA.
They urged that KEMTA be shut down and questioned that "When America's president elect Barrack Obama can shut down Guatanamo Bay Centre, why can't the same done to KEMTA by the Malaysian Government.
S. Jayathas further stated that the selective prosecution and double standards in recognizing the right to freedom of assembly, with those opposing government policies targeted for arrest and harsh crackdowns. Recently we celebrated World Human Rights Day and the Universal Declaration of Human Rights article 1 says That all human being are born FREE and EQUAL in dignity and rights, but today in Malaysia this dosent take place instead racial discrimination continues. ISA detainee and banned movement Hindraf leader P Uthayakumar made a startling revelation last night when he vowed to take full responsibility for the fevents which led to the detention of his ‘fellow lawyer brothers’.

Delivering the message through his 14-year-old nephew V Prasad (right) at the anti-ISA forum in Klang, he said that he would take complete responsibility for the 18-point demands the group had submitted to Prime Minister Abdullah Ahmad Badawi in the administration capital Putrajaya in August last year.
"I stand by those demands made and urge the government to release my fellow lawyer brothers who merely acted in helping me and my brother (Hindu Rights Action Force chairperson) P Waythamoorthy in various matters in court.
"The three lawyers have suffered in prison for a year and there are no valid reasons for the government to hold them and they should be immediately released," said lawyer and Hindraf’s legal adviser Uthayakumar in his brief statement to the 250-strong crowd who had gathered at the PAS hall.

Uthayakumar was referring to lawyers M Manoharan, R Kenghadharan and V Ganabatirau who were detained together with him on Dec 13 last year under the tough security law for allegedly carrying out activities which threatened national security.
The other Hindraf leader who has been detained is the movement’s organising secretary, T Vasanthakumar.

Forty-seven-year-old Uthayakumar is elder brother of self-exiled Hindraf chairperson Waythamoorthy, who is currently in London and is likely to face arrest under ISA should he return home.

‘One year in prison taught me to be strong’

As Prasad delivered his uncle’s message to the somber but high-spirited crowd, Uthayakumar also said that one year in prison has taught him to be strong.

"I’ve resolved to struggle for the rights of Malaysian Indians. The Umno government has cheated Malaysian Indians for more than 51 years and this has to come to an end," he said.

Uthayakumar also pointed out that it was crucial for the minority Indians to be united and speak in a single voice.
"With this single voice we should continue to push forward and I urge all of you to be prepared for a higher task of not only demanding our rights from this government but to also make yourselves available to serve the community in a positive way," Uthayakumar added.

As 2008 comes to a close, Uthayakumar urged Malaysians to dedicated themselves to serving the community in the new year.
"I urge all of you to come forward to join us in our next agenda to serve the public," he said.

Despite being declared a banned movement, Hindraf’s spirit among its supporters still lived on, and this was proven at their anti-ISA forum at PAS’ hall in Klang last night.

The Hindu Rights Action Force’s forum, attended by about 250 people, was held in conjunction with the first anniversary of the Internal Security Act (ISA) detention of five Hindraf leaders, which many of the supporters have described as their ‘blackest day’.

According to national coordinator S Jayathas, who was the first speaker at the forum, the event was organised to launch a hunger strike, which is to kick off today at a Hindu temple in Shah Alam.

According to Jayathas (left), the hunger strike of a dozen of supporters will continue "until the government releases their leaders and abolish the ISA".

The three-hour forum saw some prominent Pakatan politicians including PAS Kota Raja MP Dr Siti Mariah Mahmud, DAP Puchong MP Gobind Singh Deo, PKR Kapar MP S Manikavasagam and Selangor exco member Dr Xavier Jayakumar.


RPK did not show up

Much to the supporters’ disappointment however, controversial Malaysia Today editor and former ISA detainee Raja Petra Kamarudin, who was expected to address the crowd last night, could not make it as "he was warned three times by the police not to attend" the forum.

This was claimed by Hindraf coordinator W Sambulingam in his speech, saying that "if he (Raja Petra) chooses to come here tonight, he would face another arrest, so he decided not to come".

Sambulingam also lamented that there were six police roadblocks leading to the PAS hall, and this could have affected the turnout of yesterday’s crowd.

The five Hindraf leaders have been held under the tough security law on Dec 13 last year for "carrying out activities that threatened national security" and allegedly having links with Sri Lanka separatist group Liberation Tigers of Tamil Eelam.

Those detained are P Uthayakumar M Manoharan, R Kenghadharan and V Ganabatirau and T Vasanthakumar.

Prior to their arrest, Hindraf had organised a massive protest which saw some 30,000 people taking to the streets in Kuala Lumpur.

The movement was made illegal on Oct 15 two weeks after some 200 Hindraf supporters visited the prime minister's 'open house' during the Hari Raya celebration at the Putra World Trade Centre, where they had pressed for the repeal of the ISA.

‘Arrest me, I am not scared’

The anti-ISA forum began with a high-spirited speech from Manikavasagam.

He challenged the Special Branch police officers, whom he claimed were present at the forum, to arrest him for supporting Hindraf.

"Hindraf is still alive! I’m not scared because I have been working with (detained Hindraf leader) Uthayakumar for seven years. Arrest me anytime you want, I am not scared," thundered the Kapar MP, drawing cheers from the crowd.

Meanwhile, Siti Mariah (right) said "every cloud has a silver lining" as many Malaysian Indians have come to realise that Islamic opposition party PAS had been continuously fighting to abolish ISA.

"If Hindraf leaders were not arrested under the ISA, many Indians would not know what ISA is. Now they know that it’s a draconian law that we should all fight against it.

"However, it’s a shame that most of Malays who are more highly-educated still think we need the ISA to protect the security," said the PAS leader.

The focus then turned to outspoken Puchong MP Gobind, who said there were still ‘ghosts’ in the ruling Barisan Nasional who wanted ISA amended, but were still unwilling to do the necessary to achieve that.

He was referring to PPP’s recent threat to leave the BN coalition if ISA is not amended although Prime Minister Abdullah Ahmad Badawi said there were no plans to do so.

"PM has already told them ISA is not going to be amended, then leave now. Why bother? And where is the leader? He’s not even here, is he scared to make a decision?" said Gobind of M Kayveas, who is currently overseas.

Small commotion erupted during speech

While Gobind was delivering his speech to the crowd, a small commotion erupted at the sideline of the forum where three people who claimed to be Hindraf supporters protested over a banner depicting the movement’s leaders.

It was learnt that the supporters were not satisfied with the organisers as the banner showed only four detained Hindraf leaders together with a photo of the outlawed organisation’s self-exile chairperson P Waythamoorthy.

"Where’s the other photo of the Hindraf 5? It should be five rather than four," they said furiously, referring to the group’s organising secretary and ISA detainee, Vasanthakumar, whose photo was not on the banner.

The argument with the organisers lasted for about five minutes, which some claimed the three outraged supporters "were planted to sabotage the event".

It was later revealed to Malaysiakini by one of the organisers that Vasanthakumar’s wife has requested not to have her husband’s photo on the banner or "she would sue us".

Over the past four months, there has been a fallout between Waythamoorthy - who is currently in London - and Vasanthakumar’s family.

It is believed that, among others, Vasanthakumar prefers a less in-your-face campaign for the release of the Hindraf 5.

The forum ended with a one-minute silence to commemorate the first anniversary of the arrest with lit candles and the released of five pigeons - each representing the five detainees.

Briefing in UK House of Lords on M'sian Indians Plight

HOUSE OF LORDS BRIEFING ON THE PLIGHT OF MALAYSIAN ETHNIC INDIAN COMMUNITY - 8TH DECEMBER 2008 A NEW BEGINNING ON THE CAMPAIGN TO HIGHLIGHT THE ATROCITIES OF UMNO GOVERNMENT AT INTERNATIONAL LEVEL.

British Conservative party's Shadow Minister for Education and a member of the House of Lords Baroness Verma of Leicester today (Dec 8, 2008) hosted a briefing on the plight of minority Indian rights of Malaysia.

The briefing was held at the House of Lords on behalf of the Friends of Minority Communities in Malaysia.
The purpose of the briefing was for members of the House of Lords and House of Commons to obtain a true picture on the plights of the ethnic minority Indian community in Malaysia.

Baroness Verma had extended invitation to key personalities from Malaysian as well as from the USA.

The speakers were the Director of Public Policy of the Hindu American Foundation Ishani Chowdhury, the Director of Centre for Public Policy Studies (Malaysia) Tricia Yeoh, Human Rights Advocate (Malaysia) P Waythamoorthy and the editor of Malaysiakini.com K Kabilan.

"This is an important event that emphasizes the need to sustain focus on a nation that continues to discriminate against the minority Hindu population by judicial onslaughts, educational impediments and temple destruction," Ms Chowdhury told the briefing.

"The Malaysian government needs to work with its peaceful and productive minority community and address these legitimate grievances. Only then can it ensure true upliftment of its people and progress as a multi-ethnic nation," she added.
Ms Yeoh said that Indians in Malaysia were excluded from the mainstream, were mismanaged, and was a misunderstood community.

She said that there were an estimated 40,000 unregistered Indian children nationwide and as a result they were excluded from examinations, university, scholarships, access to healthcare, business and employment.
"The Indian participation in the civil sector has also dwindled in recent years. Their representation in civil service stood at 7.2% in 2006 and now it is on 2.8%," she said.

Ms Yeoh also touched on the various Malaysian government measures and efforts to solve the Indian problems.
Kabilan spoke about the plight of the plantation workers in Malaysia, stating that their condition had largely remained unchanged since independence in 1957.
"Issues such as wages, housing rights, education and healthcare are still there," he said.

"In 1941 and then in 1946, there were reports published which stated that these plantation workers wanted a better wage structure, an improvement of living quarters, a proper healthcare and a proper education.
"Malaysiakini did a story on bonded laborers' two years ago and we found out that these workers were still in want of the same things which were originally sought in 1941," he added.

He also said that the measures implemented by the government had been insufficient in addressing the problems faced by these plantation workers.
Waythamoorthy, who is also the chairperson of the Hindraf, spoke on the marginalisation of the Indian community for the past 50 years.
"And for speaking up these issues, five Hindraf leaders have been detained under the draconian Internal Security Act which provided for detention without trial," he said.

He urged the Baroness to look into the sorry situation of the Indian community in Malaysia and to influence British politicians to raise their concerns to the Malaysian government.

"We will continue in highlighting the grievances of this community in the international arena as the local government is not keen to meet us and address the issues," he said in the briefing.

Representatives of Civil societies within the UK also attended the briefing which included Amnesty International, Human Rights Watch, European Centre for Human Rights Studies, The Law Society of England and Wales. Community leaders of the local Hindu/Indian community pledged their support and agreed to take up the matter further with the European Parliament members.

On behalf on Malaysian Indians we send its deepest condolences to the people of India in their recent predicament on the cowardly terrorist attack in Mumbai which unfortunately also claimed the life of a Malaysian citizen and wish to state we mourn with millions throughout the world with you.

India as a secular, plural, open and tolerant country is also resolute when its nations and subjects are threatened with premeditated terrorist act that cause unwarranted unrest to its secular society.

The Indian nation with its rich varied culture and like mind secular society should make a strong stand and take proactive action in combating this fanatical terrorism.

The Indian nation is the largest democracy society in the world and probably the only one that hold truth to its meaning to its secular population.

India should no longer be cowed but realize that they are a superpower that will act against any elements that threatens its subject and the peace of the nation.

India has been at the brunt of terrorism once too many, it is time India takes a stoic stand against these terrorists who continue to abuse and misuse the natural tolerance of this great nation.

Finally we bow in prayers for all those innocent people who lost their lives and may the almighty give strength for their families to overcome this great tragedy- May those souls rest in peace.

News on the Candle Vigil for the Mumbai victims.

On Friday 5th Dec at 7.00 pm around 50 people gathered in front of Indian High Commision Office at Jalan Duta to show peace protest on the recent cowardly terror act in Mumbai which took away many innocent lives.

Though it was raining and massive jam due to Hari Raya AidilAdha long holiday, these people showed the sympathy and condemns the terror attack in Mumbai. A petition ( as above) were also hand over to Indian High Commision cheif security officer at 7.30pm.

After 45 mins of peace gathering to show sympathy and condemns the terrorist act in India, these Makkal Sakthi supporters later when to Koothai Malai Vinayagar Temple to hold special prayers to all the Mumbai terror act victims and their family.
More than 70 people gathered there around 8.15 pm and they also held a candle vigil for those victims.

YB Manikavasagam ( MP of Kapar) also joins in the vigil and prayers. He condemns all kind of terror act which is against ahimsha (non violence). Makkal Sakthi been upholding this principle of ahimsha and will continue promoting it among Malaysian.

Forum Perdana Makkal Sakthi - Anti ISA

13th December 2008 ( Saturday) marks exactly a year where the Hindraf lawyers were held under the draconian law ISA. A National Forum of Abolish ISA will be held by Makkal Sakthi co-organised by Pakatan Rakyat as below ;-

This day marks as BLACK day to the Malaysian justice where the lawyers whom champion the real marginalization and highlighted the injustice done by the UMNO lead government for last 50 years towards the Malaysian Indians were arrested and unproven allegation made against them.


A year almost gone and these lawyers were denied many of their basic rights while detention under the ISA. Many felt sick and no immediate treatment were given. All of them have been warded for many days in the hospital due to late treatments and new illness. Outside, their family suffers many loses and harrasment from SBs.

Most recently even their right to visit sick family were denied when P.Uthayakumar's mother were hospitalized for more a week but P.Uthayakumar were not given proper information nor access to pay visit his bedridden mother !!

Makkal Sakthi condemns ISA and its misuse by the UMNO lead government to silence the voice of injustice. Together with Pakatan Rakyat partners, a National Forum of Anti ISA will be held on this 13th Dec. 2008.


Pls come and show the solidarity of Makkal Sakthi against draconian ISA and seek immediate release of all ISA detainees. Many leaders from Makkal Sakthi , Pakatan Rakyat including Datuk Seri Anwar Ibrahim, GMI and family members of the detainees will be delivering their speech followed by message from Mr Waythamoorthy from London.

Slides from Putrajaya Release Pics - 25 Nov 08

All the 10 people whom were held under remand for 4 days before last Deepavali for submitting Deepavali greeting top PM last 23 Oct 2008 at PM Office were released today without any charges.
They were released on police bail last month a day before Deepavali and called to report to Putrajaya Police Station on 25 Nov 2008. About 10.30 am ASP Rejali informed to all that police decide to drop all the charges against the 10 and let the free.
The family members and supporters whom waited outside cheered all the released with Vaalge Makkal Sakthi slogan.
Mr Jayathas, Police Watch Coordinator whom also one of the released condemned the police act a month ago for the unnecessary arrest. He said that Makkal Sakthi never impose any danger to anyone.
The day also marked a year of Hindraf mammoth peace gathering in KLCC and the released were happy that it was another gift for the struggle and hope the same would happen to those detained under ISA for championing the real issues.

Ethnic Minority Indians segregated and excluded from National mainstream development of Malaysia

We refer to the above matter and to the public lecture your good self is to present in Malaysia on the 6th day of December 2008.

Malaysia has successfully projected itself as a modern and progressive country with the tallest twin towers. However the mere 8% ethnic minority Indian community have been segregated and excluded from the mainstream national development and causing about 70% of them to be mired in poverty and remaining in the low income group and 90% being in the daily and monthly wage earning group (New Straits Times 25/11/08 at page 14).

May we seek your kind indulgence to also consider addressing some of the critical Indian problems in your lecture which would help draw attention to their day to day pain and suffering.

Article 8 of Malaysia’s Federal Constitution provides for equality before the law while Article 153 provides for a reasonable proportion of the civil service jobs, land, permits, scholarships, places in institutions of higher education etc to be reserved for the Malay Muslims. However the UMNO controlled Malaysian government which has been ruling continuously for the last 51 years since independence in 1957, in the name of Article 153 implements and practices an institutionalised racism, religious extremism and racial and religious extremism and racial and religious extremism and racial and religious supremacy to the brim resulting in the following consequences to the said Indian Community as follows: -

1. Slavery among the Indians who are made to toil from dawn to dusk with no salary and workers benefits sometimes having to go on one meal per day of watered down rice and in instances women and children have been made sex slaves. Children who do not work are beaten up so badly before the helpless mother until one boy almost died. These enslaved children are not allowed to attend school (New Straits Times 15/9/2008) at pages 12 and 13).

2. Birth Certificates and Identity Cards are denied to 50,000 (Editorial New Straits Times 23/10/08 at page 23)(our estimate is 150,000) mostly Malaysian born Indians which in turn denies them admission even into Primary Schools and to receive medical treatment in government hospitals, are denied jobs, upward mobility opportunities, driving licences, bank account and face problems in almost every aspect of life. They are made to become stateless.

3. Equal educational opportunities right from the Kemas Kindergarten (New Straits Times 14/10/08 at page 8) to fully residential, elite technical schools and science \junior colleges are almost 99.0% excluded to the Indians simply by reason of their not being a Malay Muslim.

4. For show only about 1% of the Indians are admitted to the civil service (New Straits Times 13/6/08 at page 14) 1.7% Indians granted scholarships to study overseas (New Straits Times 16/5/08 at page 6) Merely 1% admitted to Public Universities

5. 370 out of the 523 about 70% (New Straits Times 11/6/08 at page 24) Tamil (ethnic Indian) primary schools are not fully government aided schools and most looking like cow sheds. Of the 7,800 teachers (New Straits Times 30/6/08 page 24 teaching about 150,000 primary school children, 1400 (Tamil Nesan 16/6/08 at page 15) are untrained teachers and are refused formal Diploma level training let alone being graduate teachers as in the Malay Muslim schools. The per student allocation for Tamil schools is a mere RM10.55 but for the Malay Muslim
schools it is about 300% higher at RM33.31 (Sempurithi Magazine August 2008 at page 47.)

6. In the government linked companies, corporate, commercial, banking and the private sector the top Executive and \upper \management level jobs are excluded to about 99% of the deserving Indians.

7. In the Mid Term Review of the Ninth Malaysia Plan and the 2009 National Budget despite a whopping allocation of RM230 Billion (New Straits Times 27/6/08 at headlines) and RM207.9 Billion (New Straits Times 29/8/08 headlines respectively there has been zero allocation for especially the poor and under privileged Indians.

8. To compound matters even the opposition parties, NGOS, civil society and the media chose to abandon the Indians as they draw very little political mileage, have almost zero economic clout and draw almost zero foreign funding or help.

9. The Indians become so vulnerable that in one day alone six Indians whom the police deem ‘suspects’ are shot dead in broad daylight (New Straits Times 3/9/08 at page 12, Utusan Malaysia 3/9/08 at page 5 and TV3 News bulletin at 8.00 pm on 3/9/08.)

10. Over the past twenty-five years a new “Indian criminal class” has been created by the system as a result of no or very little upward mobility opportunities even though they are prepared to work hard. 60% of the prisoners in police lock ups and prisons are of ethnic Indian. One Indian could end up killing another Indian friend when he had refused to pay back a debt of a mere RM50.00 (USD 13.00) such is the pressure of life for the many Indians.

11. The weakest among them end up committing suicide. In just one day alone six Indians committed suicide (New Straits Times 14/4/08) due to largely poverty and poverty related problems.

We have raised the aforesaid problems on very strong terms after having written hundreds of letters, Memorandums, Protest Notes etc to the Prime Minister, Home Minister, Attorney General, Inspector General of Police etc and running into thousands of pages. For raising the same four of our Hindraf lawyers have been arrested and detained without trial under the draconian Internal Security Act for almost one year now since the 13th day of December 2007. Our chairman Mr P Waytha Moorthy was forced to seek asylum and is now living in exile in London. Hundreds of mere peaceful assemblers were arrested, detained and prosecuted for unlawful assembly and even a false charge of attempted murder.

Finally on 15/10/2008 our very NGO i.e. HINDRAF was declared unlawful and outlawed for good. Even the Sessions Court Judge who had dismissed the sedition charges against three HINDRAF lawyers was removed arbitrarily and in turn prosecuted for some trumped up criminal charges.

HINDRAF civil rights lawyer of sixteen years standing and frontline campaigner P. Uthayakumar in trying to draw the Commonwealth Heads of Governments attention wrote to the British Prime Minister exposing the “ethnic cleansing” of Kampung Medan from the 8th day of March 2001 for fifteen days in a row where the Indians were specifically targeted and five Indians were killed and one hundred over suffered grevious bodily injuries.

Despite this tragedy being Malaysia’s worst human rights tragedy, and despite our scores of written requests the Government had refused to hold a Royal Commission of Inquiry, refused to present a White paper in Parliament. The Chief Justice had refused to initiate Inquests into the death of the five Indians and the Attorney General had refused to seriously prosecute for the five murders and the one hundred over cases of causing grevious bodily harm. In short there was a whole scale cover up.

In the same letter to Mr Gordon Brown Mr P Uthayakumar had also highlighted that in every three weeks one Hindu temple was ruthlessly demolished in Malaysia.

For exposing these and other atrocities Mr P Uthayakumar was in turn arrested on his way to his legal office, prosecuted for a second charge of sedition and was released on RM50,000-00 court bail, rearrested right outside court, again detained overnight. Upon release P. Uthayakumar was again arrested from his legal firm on 13/12/2007 and for about one year now has been detained without trial under the draconian Internal Security Act on false and politically motivated charges. The courts have rejected four applications for his release vide habeas corpus applications. This is the classical workings of law, order and the administration of justice in Malaysia.

25 Nov 2008-1st Anniversary of Msian Indian Awakening Day prayers update










Hi vanakam,

A year have sailed through since 25th November 2007. Malaysian Indians have never seen such a mammoth gathering and unity to voice the true marginalization of the community in the last 50 years. Thousands of those participated in the peaceful gathering of last year 25th November wont never forget that historical event where thousand of tear gas canisters and thousand litres of chemical laced water FAILED to fade the unity and arising of Malaysian Indians rights.
That event opens the eyes of the world towards the real suffering, oppression, depression and systematically marginalized community in this "truly Asia" nation.
Though series of the oppression continues till todate towards those whom championed the matter to the community and global but Malaysian in large knew the cause of Hindraf was real and spirit never fade in struggle.
To remember this historical day and to seek the bless from Almighty GOD there were more than 1 million people gathered and prayed on this day in the temples throughout the nation on 25th November 2008 for the betterment of Malaysian Indians and the return and release of Makkal Sakthi leaders whom been self exile and some held under draconian law ISA.
Though in many parts of nation they were showered with rain in the evening (many believed it is the bless) but it doesnt stop the determination of the people to gather in unity and peace to get bless for the divide intervention. Neither does the presence and road blocks by police and special branch unit able to fear away people to gather for prayers on the day stop the people.
Thousand of people came to main temples prayer such as in Sri Maha Mariamman Temple in Butterworth and Batu Caves Murugan temple.
In Penang , the Deputy Chief Minister of Penang, Prof Ramasamy and Mr Thanethiran the National Coordinator of Makkal Sakthi were leading the "agal lights" walk for a kilometre towards the Butterworth Mariamman temple followed by thousands well wishers.

Whereas in Batu Caves Murugan Temple, Parliament Members of Pakatan Rakyat YB Manikavasagam and YB Manogaran together with PR ADUN, YB Ravi and other Makkal Sakthi leaders like Mr Jayathas and Mr Selvam leads the walk to the top with 18 big "agal vilaku" significant of 18 demand point submitted by Hindraf to the Malaysian Prime Minister last year August. Many Indian NGO leaders are also seen there to show support and unity on this significant day. Thousands of people walked with chanting and shouting "Vaalge Makkal Sakthi" (Long Live People's Power) and Long Live Makkal Sakthi leaders while they walked the 272 stairs to seek bless from Lord Murugan there.

Similar prayers conducted in nationwide temples conjunction of this day where it also falls on an auspicios day of "Prothosam" ( a blessed day in Hindu calender ) where it drew almost a million of people to temples.

It clearly shows the success for the call made by Mr Waythamoothy, Hindraf Chairman in his Press Statement dated 25th November 2008 where he called upon all Malaysian to join hands with their Indian brothers and sister to commensurate the 1st year anniversary of HINDRAF mass rally that highlighted the suppression and oppression of the Malaysian Indians for the last 51 years.
He also said that HINDRAF is not dampened by the attempts of the government agents and warn the authorities not to behave in unruly and assert violence on peaceful supporters who gather to offer prayers for what is the truth and reality. "We are committed to our continued struggle to achieve a fair and just treatment through change of policies so that everyone can be treated equally and fairly", explained by Waythamoorthy.

He also stressed that Malaysian Indians must remind , that November 25, 2007 brought all in UNITY and the same UNITY is needed for HINDRAF to continue its struggle and achieve the goals for the Malaysian Indians.
"The UNITY can only further increase if we continue to defuse ourselves with antipathy against another human being and work together in UNITY. HINDRAF implores you to walk in a manner worthy of all humility, gentleness, patience and tolerance for one another to preserve the UNITY of HINDRAF in the spirit of peace and humanity. When there is UNITY, there is always victory for the people", said Mr Waythamoorthy.

RE: UTHAYA DENIED RIGHT TO VISIT HIS HOSPITALIZED MOTHER and POLICE HARRASMENT OF UTHAYA'S MOTHER IN HOSPITAL

The oppression and suppression carried out by the UMNO led government tools ie Home Office and the PDRM towards HINDRAF never seem to cease.
P.Uthayakumar’s mother, Madam Kalaivaniy was admitted in the hospital for eight days from 12th Nov 2008 to 19th Nov 2008 due to hypertension, high blood sugar level as well as to treat her gall bladder. Repeated requests were made to Kamunting Detention Centre upon her admission to inform her son and request for permission for Uthaya to visit his mother but to no avail. UTHAYAKUMAR was not even made known of his mother being hospitalized until this Sunday on 16th Nov 2008 when his fiancée visited him.
In addition to this, four Special Branch officers from the Malaysian Royal Force had visited Uthaya's mother in the hospital on 18th and 19th Nov 2008 to ascertain whether it was really Uthaya's mother and further interviewed those nurses attended to her and asked them if they were aware that this is Uthaya's mother. Even the bedridden Uthaya's mother was not spared by this callous government agents as she was questioned and asked whether she would want her son to visit her.
The Malaysian police force has taken intimidation and harassment to new heights in questioning and interrogating Uthaya's hospitalized mother as well as enquiring the nurses on their awareness of whether she being Uthaya's mother. What is the relevant of this? If this is not intimidation and harassment, then I really don't know what this is.
Besides, does it take four Special Branch officers to verify the admission by personally visiting, questioning and interrogating hospital personnel and his mother? What a waste of public funds or is this merely another act of intimidation and harassment towards those who seek what is fair and just.
We urge the Prison authority at least in compassion and humanity grounds allow Uthaya Kumar to visit his mother in her residence as she is recovering from her illness and is unable to travel and was not fit to travel for the recent Deepavali visit.

Do not confront the poor Indians in a harsh manner

The perception now is that the Indians in the country are being hounded, teased and condemned mercilessly. This was what was expressed to me by a few Britons I met in Bali the other day. Apparently, they had nothing positive to talk about Malaysia. This is just unfortunate.

Why must foreign perception towards Malaysia be at an all-time low now? There can be a few reasons to this. One obvious concern is the Hindraf issue. It seems like most foreigners I have met sympathise with the Indians in this country as there is a lot of publicity over this issue overseas. This kind of understanding does not augur well for a small country like Malaysia. To the foreigners, it seems like the country is not politically stable and there are citizens here who are victimised.



When their business community perceives the same, they would not hesitate to leave Malaysia for some other economic hub. It is thus predictable that many investors are now venturing more into other Southeast Asian countries despite all the rhetoric by politicians that Malaysia is a safe place to invest. Malaysia is losing in many ways just because of a simple issue involving a minority ethnic group has been hyped by the media to give a picture that this community is a threat to the nation. Implicating Hindraf as a dangerous group has given bad publicity to the country. There was a time when this group was said to be associated with a `terrorist group' outside the country even when there was no evidence to the accusation. This was another mere rhetoric for local political consumption and politicians realised little that it would warp the general perception of the country. This move, as envisaged, has alarmed many potential investors.Living in this country, one would be able to assess the whole scenario with much more rationality.

There are undeniably many poor and displaced Indians in the country. Many were displaced when the rubber estates they were living in were taken away for development. Among those living in some of these existing rural estates, many were still poor and are uneducated. Their general mindset, sadly, had not changed much compared with that of their predecessors living in estates since they were brought in as indented labour by the British about 100 years ago. When they were later forced to leave their long time `habitat' many - with nothing in their possession - left for the urban areas and now make up about 40 percent of the urban hardcore poor in major cities. Their Tamil education has not helped them much to seek employment. Unfortunately, MIC politicians still insist that these schools should be retained. Many are without important documents due to their parents' ignorance and illiteracy. Many are also involved in crime to earn a living. With poor self- esteem, many of these displaced chain of population is have been affected by alcoholism and drugs. Political parties representing the ethnic Indians in the country have strived hard to help the Indians have a share of the economic pie in the country but the majority of the poor Indians have not achieved much in this process. Indian leaders have apparently failed this group of hardcore poor and many others who looked up upon their leaders for help the way poor ethnic Malays are being helped by their leaders. The inherent differences among ethnic Indians based on class, language, religion and place of origin of their ancestors have further alienated the Tamils who compose the majority of the poor among this ethnic community. These are the Tamils who descended from a generation of indented estate labourers brought in by the British to toil this land for the sole purpose of enriching the latter. They were made to work hard in British-owned rubber plantations with low wages, socially confined to only their workplace, living in shabby conditions and made to forget their miseries with cheap liquor. It was to a certain level a life of slavery for these labourers. Thousands died due to illnesses. For the past 100 years they have been systematically alienated from the mainstream culture.

The Hindraf movement is the result of this predicament faced by the downtrodden Indians. Hindraf is seeking help and awareness to uplift the economic status of these poor and that's all what they demand. Alienating the disgruntled poor Indians (or for that matter any other ethnic race) is not going to bode well for the country. Being harsh on them is not going to solve the inherent problem faced by these poor. Neither threats nor bad publicity is going to resolve the social and economic problems faced by the poor Indians; at worst, this will only tarnish the image of the country.These poor Indians had all throughout the history of this nation been loyal to the country, MIC, the Alliance party of post-independence and later the Barisan Nasional was looked upon as their saviour even when they got nothing much in return. Such was for their patronage. Poor or rich, the Indians had always been loyal to the incumbent government until the recent general election. These are the Indians in the country – a very loyal breed of people indeed. Their loyalty to the Barisan Nasional was never questioned until the last general election.


Over 95 percent of the Indians would without fail vote for Barisan Nasional came election time. When the Malays and Chinese were split through their political affiliations to PAS, DAP and Gerakan, the Indians were there to give full support to the government. Umno politicians should not forget this. The Indians were akin to `dogs venerating their masters' (the Alliance Party and later Barisan Nasional and their leaders) even when most of the poor and not well-connected did not get much help in return. These were the Indians at one time. Things have changed now, though.

There is a palpable shift in their mindset.Thus, the government now should not confront the Indians in a rough and ready manner. Belittling their significance in the country and locking horns with this disgruntled group calling themselves as the Hindraf movement is not going to help build a good image for the country. What should best be done is to immediately stop politicising the whole issue by branding this group of people as a threat to Umno or the nation. Engage them to sort out their grievances. There are so many poor Indians - the displaced Indians from all quarters who need help. Seek amicable solutions on how to overcome this predicament.By approaching the disgruntled Indians in a confrontational manner, BN will lose more. Their hope to get support from ethnic Malays through this move may not work in their favour. Political sentiments are hard to define.

Despite the onslaught by the government-controll ed media against this movement, the poor Indians are now getting more sympathy of not only from most of the Indians but also from the Malays, Chinese and others. Some newspapers are not highlighting the plight of the Indians but are painting them as nuisance and a threat to the nation. Has any Indian carried arms against the government? No. These are peaceful gatherers who are seeking social and economic `indemnity' the non-violent way.

They may have gone overboard at times, especially when provoked, but this does not mean that the present leaders could not engage them in useful dialogues. They cannot be equated with Al Arqam as the Indians in this country are peace-loving people. The pictures of Ghandi carried by some during their street protests only signify non-violence, not disloyalty to this country. Ghandi's principle of non-violence belongs to the whole world as he was a spiritual leader who advocated peaceful means of attaining justice. Ghandi never in his life time promoted aggression. He would not even kill an ant that bit him, for that matter.The focus now has to be that the poor Indians genuinely need help. That's their humble request.
They are just humans like you and me living in this transient world. They are not here to grab power, but history has fated them to be born and bred in this country. Their humble needs are only to live a decent life and have a decent three meals a day, with proper shelter, education and employment. Indians in general have contributed immensely to the progress of this nation and nobody can deny this fact. Just stop portraying them negatively for some cheap political mileage as this will not help the country in the long run.Engage the Indians in fruitful dialogues and not confront them with negativism. The Indians in this country have their shares of success and failures, just like the other ethnic groups. Indians being the minority and a big number of them still living in poverty need help - not unkind treatment from some self-seeking politicians.
