Man charged with killing mom found dead in prison - Malaysiakini

A 22-year-old man charged with the murder of his mother was found dead in his cell at the Air Molek prison in Johor.

According to the authorities, J Saravanan (left) hanged himself using a pillow cover tied to a bar of his cell door.

However, his family refused to believe that Saravanan would have taken his own life and suspect foul play.

Hindu Rights Action Force (Hindraf) Johor coordinator Y Mohan told Malaysiakini that the family plans to file a police report on the matter this afternoon.

"When they saw the body in the mortuary, it was covered with bruises.

"The family thinks that Saravanan could have been beaten to death," he said.

Saravanan was charged with murdering K Malilla, 47, using an iron rod at their home in Kampung MIC in Ulu Tiram.

He had also allegedly stuffed her remains inside a travel bag after the incident between 9.30am and 10.30am on Oct 5.

Saya ayah kepada membuat laporan ini kerana saya syaki polis cuba memutarbelitkan keadaan anak saya R.Seetha yang minum paraquat.

Pada 8/11/09 lima orang remaja dibunuh/tembak mati secara kejam termasuk anak saya Surendran 24. Kenapa mereka yang bunuh anak saya tidak ditangkap tapi suami Seetha, Manimaran ditahan.

Pada 11/11/09, polis juga menganggu, geladah dan tahan keluarga kami di Balai Polis Kapar untuk soal-siasat.

Saya dapat tahu bahwa pihak polis dan pihak hospital memaksa Seetha menanda tangan satu surat yang memgatakan Seetha minum racun paraquat bukan kerana adiknya yang ditembak mati oleh polis dan polis tidak kena-mengena dengan cubaan membunuh diri oleh anak saya.

Saya tuntut agar pihak polis tidak menganggu ahli keluarga yang kini dalam keadaan sedih kerana kehilangan Surendran anak saya yang ditembak mati oleh polis dan Seetha anak saya dan 4 cucu saya dalam keadaan tenat.

Sebab utama Seetha minum racun paraquat adalah kerana dia tidak boleh terima yang polis tembak mati/bunuh adiknya Surendran secara kejam. Seetha terlalu sayang kepada Surendran. Dia selalu nangis dihadapan gambar Surendran yang meninggal.

Saya mohon agar polis jangan putar-belit dan cuba mempersalahkan suami Seetha, Manimaran. Manimaran amat sayang kepada anak saya Seetha. Semua ini berlaku kerana polis tembak mati anak saya Surendran dan saya tuntut agar tindakan diambil terhadap pembunuh anak saya dan pecat IGP Musa Hassan dan CID Director Bakri Zenin juga dipecat.

Police murder Indian in Penang

A 37-year-old man was shot dead in a car by the police in Weld Quay, George Town this afternoon.

Penang police chief Deputy. Comm Ayub Yaakob said the suspect was believed to be the leader of the ‘Deva Gang’, categorised as a ‘notorious robbery gang’ by the police.

He said a raiding party from Bukit Aman had been trailing the suspect, who was travelling in a black Perodua Myvi, from Bukit Jambul in Bayan Baru for about 20 minutes along the Jelutong Expressway.

Upon reaching the junction of Nordin Street Ghaut, he said the police car swiftly blocked the suspect’s car.

“A gunfight ensued when the suspect fired twice from his car the policemen.

“The suspect was however killed when the police returned fire,” summed up Ayub, adding that the incident happened about 3.50pm.

He also said a pistol HK 9mm and a Singapore identity card were recovered from the suspect’s car, which has a Kuala Lumpur registration number plate.

He said initial investigation revealed that the suspect had came from the federal capital to kidnap a person in Penang.

“He was foiled by the police,” Ayub alleged.

Today’s killing has happened just four days after police came under fire for killing five persons – aged 17 and 24 – during a shootout in Taman Klang Utama.

In the Monday’s killings, the police justified their act claiming that the deceases were part of a robbery gang ‘PCO Boy’.

Previously Bukit Aman police have claimed that ‘Deva Gang’ was a “brotherhood” formed at the Simpang Renggam detention centre 10 years ago.

The gang alleged gang leader Deva, who was at the time detained for alleged involvement in violent crimes and robberies, had allegedly formed the gang with two others he met at the centre.

The police had claimed that after roping in fresh blood after their release, the Deva Gang started its notorious crime spree and were allegedly behind at least 14 cases of armed robbery, luxury-car hijacking and murder in Penang, Perak, Selangor and Klang Valley.

Police have also linked the gang with the recent RM8.24 million cash-in-transit robbery outside a shopping centre in Cheras on May 18.

However, the shootout has not gone down well with the Human Rights Party leader P Uthayakumar.

He wants the government to set up a Royal Commission of Inquiry immediate to probe into all the killings carried out by the police under the current Inspector General Musa Hassan reign.

He also called on Pakatan Rakyat MPs to table and support an emergency motion at the on-going parliamentary sitting to protest and stop the cold blooded killing spree carried out by the police in the name of crime-busting.

Tamil daily warned over shooting reports - Malaysiakini

The Home Ministry has issued a warning letter to vernacular daily Tamil Nesan over its reporting on the killing of five suspected armed robbers by the police last week.

The ministry has accused the MIC-linked daily of playing up racial sentiments in its coverage of the police shooting in which all five suspects - all Malaysian Indians - had died on the spot.

Tamil Nesan' managing director S Vell Paari told Malaysiakini that the warning letter was sent to his office late yesterday.

"The letter was issued to Tamil Nesan in regards to our coverage on the gunning down of five young Indian men in Klang by police," he said.

He said that the ministry had felt that Tamil Nesan's reports on the matter could provoke others and may affect the harmony in the country.

He added that the letter also noted that a MIC Youth statement published in the daily on the shooting was provocative.

"The letter warned is that our publishing licence can be revoked if we continued publishing such articles," he added.

Doing our duty as a community paper

Vell Paari however defended his daily, which was established in 1924, in their coverage of the issue.

"We only carried out what transpired over an event and a press statement from MIC's Youth wing, which is part and parcel of newspaper role in this country.

"I'm also baffled on how news published by us can provoke the Indians when almost all the other mainstream media carried the same news, giving similar importance and using similar vocabulary.

"It is also being hotly debated in various blog sand online networking sites like the Facebook," he said.

Vell Paari also said that as a daily newspaper catering for the Indian community, Tamil Nesan has the right to publish news on matters affecting the community, just like how other dailies do for their own communities.

"As far as Tamil Nesan is concerned we have maintained a status of fair comment and have only published what had happened that day. Nothing more and nothing less," he stressed.

Police under fire

In the shooting incident on Monday (Nov 9), the police killed suspected criminals aged between 17 and 24 - and allegedly from the 'PCO Boy' gang - in Taman Klang Utama on Monday.

The police claimed that the five were responsible for a spate of robberies and defended the shooting.

"When police officers shoot, they do not shoot to kill, but rather they shoot to stop the deadly force threat," said CID director Mohd Bakri Mohd Zinin in a statement the following day.

However the police action came under a spotlight with many quarters accusing the police of being trigger-happy. Many had also questioned as to why such police shootings always included people from the Indian community.

Arising out of the latest police killing, a sister of one of the victims had attempted suicide by drinking paraquat on Thursday. She had also forced her four children to consume the poison.

We refer to the above matter and to the police “shoot to kill order” of
five Malaysian Indians in Klang on 8/11/2009 including a 17 year old
juvenile and subsequently leading to the attempted suicide of one of
the victims sister Madam Seetha and her four children. (Note: All five
are still admitted at the Intensive Care Unit of the Klang Tengku
Ampuan Rahimah General Hospital). This Malay-sian police force
atrocities has caused grave mysery to three generations of this and
scores of other Indian families.

We regret to note that there is no reply forthcoming to our letter to
your goodself dated 9/11/200 on these police murders.

Our monitoring reveals that up to 1.3 persons are being shot dead by
the police in every week (Refer The Star 11/09/2009). For the year
2008 and 2009 we estimate that up to 90% of the Malaysian victims are
of the ethnic minority Malaysian Indian origin when their population
is merely about 8%. For once the Indians seem to have overwhelmingly
overshot their “quota” and that too by about 1, 100%. Bravo One Malay-
sian UMNO!

We hereby also officially accept the invitation by the Federal CID
Director that was broadcasted on NTV 7 news at 8.00 p.m on 11/11/2009
for individuals and NGOs’ critical of the police to follow them in
their next “shoot to kill” mission. We further seek permission for our
camera and video crew to also be present. Kindly confirm the same.

As a lawyer by training your goodself, you may appreciate the most
celebrated legal principle that “a man is presumed innocent until
proven guilty” vis a vis especially Article 5(1) of the Federal
Constitution which provides:-

(1) No person shall be deprived of his life or personal liberty save in
accordance with law.

And read with Section 15(3) of the Criminal Procedure Code which
provides: -

“Nothing in this section gives a right to cause the death of a person
who is not accused of an offence punishable with death or with
imprisonment for life”.

(Of course to get around this Section the police each time “plant”
guns, bullets and parangs next to the dead bodies which cannot speak
nor defend themselves ) Even a comment in Malaysiakini yesterday that
the “same guns are exhibited at every such shooting case” is well
worth your serious attention.

In the light of even the 82 Pakatan Rakyat (P.R) Members of Parliament
not even moving an Emergency Motion in Parliament on especially this
very serious matter, we hereby call for a Home Ministerial Statement
made in Parliament forthwith and in any event by the end of next week
that the unofficial “police shoot to kill policy” does not exist.
Kindly also explain this vis a vis the standard police explanation in
about 99% of the times of the police high handed “high drama” that a
group (of up to 90% of the times Malaysia Indians) looked suspicious-
they flee upon seeing the police - the police gave chase -the suspects
shot at the police first - the police “in self defence return fire” -
and killing all the suspects -and in rare occasions one of the
suspects(suspected police informer) makes the escape – but he is never
found - there is no history of even one policeman injured let alone
who had died in this “operasi” - zero independent witnesses - as the
police cordon off the area for the “operasi” - only in rare occasions
a “display” of shattered police car windscreens - even rarer no bullet
holes or marks on the police car – and the police get away scot free
with cold blooded murder of innocent mere suspects when they should be
protectors of the law.

We note that even in the 1980’s the police force had very much more
higher standards. They did not practice this “unofficial shoot to kill
order”.
In this era crime buster S. Kulasingam for example successfully
captured alive about the most wanted at and dangerous criminal ie
Botak Chin despite he himself (S. Kulasingam) having been shot at and
wounded by Botak Chin. Botak Chin was put on trial, sentenced to
death, exhausted all his appeals to the higherst courts, his clemency
pardon being turned down by the King and he was finally sent to the
gallows. (Refer NST 25/09/2005 at page 10) This is the due process of
the law. This is the rule of law!
This is Justice! And this the due administration of law and order!

But this police actions today seems to be upholding the law of the
jungle as if they are the dictator of some African Kingdom where might
is right and with total disregard for especially the poor defenseless
and underprivileged working class Indians.

We do not condone crime but the due process of the law must be complied
with. Only the courts and not the police force should be seen to be
meting out especially “death sentences by shooting”. The police cannot
and should not any longer be allowed to singularly assume the role of
Judge, Jury, Prosecutor, Enforcer and Executioner all in one go.

We are also concerned about the alarmingly high rise in the crime rate
over the last three years under the leadership of the present Inspector
General of Police Tan Sri Musa Hassan. We once again call for his and
the Criminal Investigations Director (CID) Director Dato Bakri Zinin’s
immediate sacking.

With regards to this matter we hereby seek a meeting with your
goodself as follows:-

FINALLY, private investigator P.Balasubramaniam has come out of hiding after 15 months to give a no holds barred interview on what happened to him.

In the presence of three prominent lawyers on Oct 27, he reaffirmed that his first statutory declaration released on July 3 last year was true and that he was offered to RM5million to retract it.

He named carpet businessman Deepak—who is said to be an associate of Rosmah Mansor, the wife of Prime Minister Najib Razak—as the person who met him at a Rawang restaurant and made the cash offer.

In the interview, Bala said Deepak made more than a cash offer.

“He asked me to go to Putrajaya but he never mentioned who he wanted me to go and meet… then after that he offered me RM5million to retract the SD,” Bala said.

The meeting allegedly took place at a restaurant in Rawang, on the same day Bala’s statutory declaration became public alleging links between Najib, his aide Razak Baginda and murdered Mongolian model Altantuya Shaaribu.

Today, the first part of Bala’s interview appeared on YouTube and Raja Petra’s www.malaysia-today.net . This is to be followed by a series of other portions of his Bombshell 3 expose.

Bala is likely to name people who played a role in the retraction of his first statutory declaration, which was replaced by a second one read out at a press conference the next day, on July 4 last year.

It is learnt that some of the personalities to be named are those close to the Prime Minister and his wife as well as senior police officers.

The 50-year- old former Special Branch officer is also expected to give a full account of his family’s ordeal while hiding away from Malaysia.

It is learnt that he and his family first went to Singapore , then flew to Bangkok before arriving in New Dehli and Chennai via Kathmandu.

Who are the people and why they went to such lengths to buy Bala’s silence is likely to become clearer as his expose in the interview unfolds.

PKR, DAP & PAS: No call for Royal Commission for 5 police murders of Indian youths, 17 year old

One rule for Teoh Beng Hock who after intense public pressure led by PKR, DAP and PAS got a Royal commission within one week and even his body was ordered by the court to be exhumed by court and a foreign (Thai) pathologist whose qualification is not even recognized in Malaysia has no objections from even the Attorney General to examine Teoh’s body (Malay Mail 11/11/2009 at page 3).

But another rule for the hundreds of Indians who are killed in police lockups or simply shot dead by the police force especially these five Indian youths aged 24, 22, 21, 19 and especially the 17 year old juvenile. There is no Royal Commission of Inquiry called.

To add insult to injury the Federal CID chief Datuk Seri Bakri Zinin has the cheek to make a statement that the police “fired in self defence (NST 11/11/2009 at page 20 and Tamil Nesan Headlines on 11/11/2009) Why aren’t the top leaders and the 82 PKR, DAP and PAS Members of Parliament

and hundreds of State Assemblymen :-

1) Not demanding for a Royal Commission of Inquiry into these five police murders of these Indian youths (all in one transaction) as was rightly done for Teoh Beng Hock.

2) Not appointing two Selangor state government funded lawyers for each of the five (5) families as was rightly done for Teoh Beng Hock.

3) Demand the sacking of the IGP and Federal CID Chief for these police murders as was rightly done (for the MACC chiefs) in Teoh Beng Hock’s case.

4) Move and emergency motion in Parliament and the Selangor State Assembly on this police murders of Indian youths as was done for the former mufti of Perlis Dato Asri at the Selangor State Assembly today (Malaysiakini 11/11/2009)

But then for both UMNO and also PKR, DAP and PAS, when and where the victims are “merely the Indians” they won’t bother nor does it matter to them.

Championing of issue by PKR, DAP and PAS must not be majoritarian race based but must be based on the seriousness of the violations of the human rights suffered.

PKR, DAP and PAS not racist parties?

Some of them have distinguished that Teoh’s was a political murder. But then even in the case of ex politician and MIC ADUN Datuk S. Krishnasamy’s murder and Joe Fernandez’s there was pin drop silence by PKR, DAP, and PAS. Not even when the police bully the victim’s (Krishnasamy’s) son and engineer Raj Kumar by confiscating his lap top and handphone for sending e-mails and text messages addressed to Johor CPO Datuk Mohd Mokhtor Mohd Shariff” of the police protecting the suspects involved in Krishnasamy’s murder (NST 11/11/2009 at page 20)

3) Political rhetoric by UMNO, PKR, DAP and PAS to solve that too on a piecemeal basis as opposed to a wholesome basis.

4) Grant land and declare all 523 Tamil schools in Malaysia as fully aided by 1/1/2010.

5) Tip of iceberg of Tamil school problems.

We refer to the above matter and to the newsreport in Malaysia Nanban front page dated 11/11/2009 and The Star Metro 10/11/2009 at page M7.

To create the impression that a new Tamil school building would be built to replace the dilapidated existing Bagan Serai Tamil school building a “wayang kulit” signboard had been put up (by UMNO) nearby just before the last general elections. There is now a jungle growth in this new Tamil school land but the new Tamil school was never built.

Despite this being a fully aided Tamil school and the parents persistent protest it suffers this fate. Why is this school building been delayed for three years now when in the 2009 Budget the sum of RM 67 Million was specifically allocated for Tamil schools. Thereafter the Cabinet Committee on Tamil schools headed by Dato Seri Najib Razak approved a further RM 50 Million and then again a further RM 50 Million totalling RM 100 Million in the First and Secound Economic Stimulas packages respectively but from which not a single cent filtered down to any of these 523 Tamil schools in the pretext that the cost of Tamil school building materials having gone up (The Star 30/09/2009). Assuming even if the said price went up by double, the said RM 100 Million could have been utilized to build and/or upgrade at least half the number of the originally intended Tamil schools. Why was this not done?

Again for the 2010 Budget RM 30 Billion was allocated for 80 new schools, 1,100 additional blocks and 347 school replacement projects, to refurbish and upgrade schools in the RM 191.5 Billion Budget. But why zero flows down to these Tamil schools.

This is the very same problem with the SJK (T) Bukit Jalil which was promised RM 2 Million by the Deputy Prime Minister and Education Minister in April 2009 for the new school annexe building which would have additional facilities. “There is now a signboard for a proposed SJK (T) Bukit Jalil Tambahan. “This school even has to beg for a school field while others have to beg for chairs tables and books. (Refer The Star Metro 10/11/2009 at page M7).

This is just the very tip of the iceberg of the very basic and elementary problems in almost all of the 523 Tamil schools in your goodselves One Malaysia. This is hardly heard of in almost all Malay or Chinese schools.

We hereby once again call upon the UMNO controlled Malaysian government to grand land and declare all 523 Tamil schools as fully aided government schools with effect from the next academic year beginning 1/1/2010.

Kg.Buah Pala:- Kapitan Lim Guan Eng’s latest Atrocities- Now demolishing cowshed not in developer’s land

One of the last two remaining cowsheds at Kampung Buah Pala was demolished today by developer Nusmetro Venture (P) Sdn Bhd’s demolition squad. The shed was built to house cows and other livestock.

The other cowshed, a few metres away, was spared by the demolition team.

NONE According to the affected cowherd KT Sivananthan, 39, the demolition started at 12.15 pm and his cowshed was completely flattened by 4pm. Around 10 members of the police force were present during the demolition.

Sivananthan claimed that the demolition was illegal because his cowshed was sitting on state land.

He also said he did not receive any notice of eviction from any government authorities, especially the local Penang Island Municipal Council (MPPP).

When contacted, the developer’s executive director Thomas Chan claimed that the cattle ranch land belonged to the Kampung Buah Pala landowner - the Penang civil servants’ cooperative society (Koperasi Pegawai Kerajaan Negeri Pulau Pinang Bhd).

“If the villagers have a dispute, they can always refer to the courts,” Chan said over a telephone conversation.

No answers from cooperative

The cooperative society’s chairperson, Abdul Razak Mansor, when contacted told reporters to contact Deputy Chief Minister P Ramasamy for clarification over the land status.

“I don’t know . . . I don’t know. Contact Ramasamy,” he said over the telephone.

He repeated the answer when asked whether he was aware that the developer was demolishing the cowshed allegedly without any authorisation.

Senior executive councillor Chow Kon Yeow, who is in charge of local government affairs, could not be reached for comment. It is learnt that he is at the current parliamentary sitting.

Similarly, Deputy Chief Minister Mansor Othman and MPPP president Tan Cheng Chui did not pick up calls from reporters at the site despite several attempts.

Kampung Buah Pala was once known as ‘Tamil High Chaparral’ due to its population of cowherds, cattle, goats, other livestock, its unique hilly environment and Indian cultural features and festivities.

The 200-year-old Indian traditional village was demolished in September this year to pave way for a lucrative condominium project named ‘The Oasis’, undertaken by the cooperative society and Nusmetro Venture.

Sivananthan said a Nusmetro executive known as Gary Ho had told him last week to dismantle one of the cowsheds because the state authorities had been given permission. Nusmetro Venture is demolishing the shed to make way for an access road for the Oasis project.

He said, however, Ho failed to produce any documents such as a notice of eviction or authorisation letter from any authorities to prove his claim.

Police report lodged

NONE Sivananthan (left) has lodged a police report at 2.40 pm in Jelutong police station over the demolition.

He is now unsure as to where to keep his livestock.

Until the late 1970s, each household in Kampung Buah Pala was rearing livestock on their premises.

However, the number of cowherds dwindled to only four households belonging to the same Muthu Thevar family descendants - 81-year-old Karuppiah Thevar’s sons Murugan, 46, Sivananthan and Kalimuthan, 37, and the late Ramoo Thevar’s son R Supramaniam, 59.

They were collectively rearing about 300 cows on two ranches.

NONE Kampung Buah Pala was once the major supplier of fresh cow’s milk on the island, including the Penang Hospital.

Now the Thevar family’s livestock supplies some 500 litres of fresh cow and goat milk daily across the state.

Karuppiah (right), who was at the site, claimed that at least 15 goats have died since the village demolition due to lack of shelter from sun and rain.

He said that he was saddened by the demolition.

“I never thought our family ranch would one day be gone in this manner,” he told reporters.
