MACC and Lim Guan Eng-Nice Game!

Kg.Buah Pala issues has been ongoing for more than a year now since the take over by the Pakatan Rakyat Government from 3rd March 2008 due to the influence by the Hindraf supports which cannot be denied by anyone. Upon taking over the Penang State Government, its DAP based Chief Minister the Faithful and generous, Lim Guan Eng, the leader who does'nt Lie! (Bullshit!) had promised to take severe action on the Illegal transaction of the land of Kg.Buah Pala to the Koperasi Pegawai Kerajaan Pulau Pinang by the former Penang TPM/DCM from Barisan Nasional Government.

He, and 2 more leaders with integrity(Bullshit!) and never lie leader(Bullshit!) Prof.Ramasamy and RSN Rayer(The Award winner for the best Liar! ADUN by Cryingvoices) had made a complaint to the MACC on the corruption and fraud found in the Buah Pala Land transaction. The report of the investigation is now available for public viewing at every bus-stop and public toilets nationwide!

Funny? are you thinking that this writer is insane and making fun of the situation? Yes I am, where the hell is the MACC report? why Lim Guan Eng who was so eager to file a case with MACC and bambooing UMNO and Barisan Nasional for the illegal transaction is on the developers underwear now? Why is he so eager to chase the Villagers and keep mum about the MACC report made by him and his pirates? Why was Jagdeep sent out of the State Assembly? What did he accused the former DCM who is from UMNO? Why blaming Koh Soo Koon for the fraud when you as the Chief Minister of a State has all the rights to stop the Project? and file a suit against the former government when you know it's an illegal transaction? Where is section 116(1)(D)? When you planned to use it? after all the houses been demolished and when the construction starts? so that you can use the land for your personal use and the senseless agreement that you are forcing the villager to sign now will be invalid when the project halts? or Is it because all the people there, are Poor Indians and the place is full of Cowshed and Cow Dungs all over like you have mention earlier?

You are not a racist Mr.Lim Guan Eng, yes we agree that you have 2 useless right hand mans with you who is a bigger liar than anyone else and blaming Samy Vellu and poking his backside whenever their fingers are itchy, Whatever Samy Vellu did for the past 30+ years in the politics maybe wrong, but he has never demolished anyones house and chase them out in the street, His 30+ years crimes are smaller compared to the sins that you two Liars commit! Prove me that I m wrong! Sue me if you have never promise the Villagers that this Land will be here as long as Ramasamy is in power with Pakatan Rakyat as the Deputy Chief Minister 2, Sue me if you say I talk nonsense and you have never promise to arrange for an allocation to have the Ponggal festival as an annual event in Kg.Buah Pala! Sue me if you did not say that Kg.Buah Pala is the only remaining indian Heritage Village in the country! Liar! Liar! Liar!

Simple point to think ; You were so eager to make this land fraud a big issue, then you said that you wanted to use 116(1)(D) to stop development project, then you screwed the Developer Nusmetro for trying to Demolish the Village, and now you are acting as Die Hard FAN for Nusmetro, why this much of changes in principals? What happened to case that you three stooges filed with the MACC?

Why Must you eager than the Developer and the Landowner Koperasi trying to persuade the Villagers to sign on the Shit agreement that Nusmetro Uneducated fools prepared? As a Chief Minister and Deputy Chief Minister, Professor, Lawyer and crook team, dont you think that the agreement is a mere trap for the villagers? Who has prepared it? who signed on behalf of the Director? Where is the Stamp? where is the chop? Where is the floor plan of the Double storey house which you, you and only you claiming will fetch up to RM500,000 in the market? What Material? where will it be built? Who guarantees the project? Why no letter from the state government?

So many question is lingering in my mind, even my mind, as a fool in the legal terms, what about u? Professor? Lawyer? Crooks? Think... we know everything thats going on, you still have another 4+days to retract the project and stop all your sins.. Good Luck for the next General Election, If Buah Pala falls! DAP Government in the Penang State will be dragged together and buried beneath the Debris of the Demolition!

Press Statement by the Kg.Buah Pala residents

Lim Guan Eng has stated that he has washed his hands off this issue. But we live here, we have to find a solution for our problems with or without the State Government’s help. It is most unfortunate for a Chief Executive of a State Government to take this negative stand against its rakyat.

Nevertheless we will proceed.

We have decided we will talk to whoever will help us to resolve this issue. This includes the Koperasi to whom the land has been sold by the State Government. We will propose to them that they should consider sharing the land with us so we can retain a Heritage village, even though a smaller one. We are hopeful that the Koperasi will want to talk to us and to resolve this matter amicably, something that the Developer and the State Government has not been able to do up to now. We will be doing this on our very own initiative without the assistance of any political party.

We are reasonable people and we do not seek the double storey houses worth RM500,000 that Lim Guan Eng and his supporters have been talking about. Their objective in doing this is to turn public opinion away from us by making us look like a greedy set of people. What we seek is only to retain our land and our way of life. If we can negotiate a portion of the land from the Koperasi, we will build it up into a Heritage Village.

If we are able to get the Koperasi to agree to sell a portion of the land through our negotiation at a price that is reasonable and which is within the State Governments budget to buy and build on, the State Government should not now start to give some reason and deny us this opportunity again.

We are hopeful that the State Government will work along with us on this solution if it comes to pass. We hope that the State Government will not give any more reasons like bad precedents or that the villagers are being too greedy or arrogant and other such reasons.

Hindraf head to sue DAP - Malaysiakini

Hindraf chairperson P Waythamoorthy is threatening legal action against three Indian DAP leaders over allegations that he misappropriated funds ranging from RM700,000 to millions allegedly collected to meet the cost of a civil suit against the UK government.

The exiled Indian rights activist came under attack last week with allegations that he misappropriated the funds to live a comfortable life in exile, while his followers footed the bill.

Waythamoorthy (right) has been living in-exile in London, after he fled the government's crackdown on Hindraf following the events of their rally on Nov 25 last year.

“The unfounded malicious and vindictive allegations by DAP leaders are defamatory,” said Waythamoorthy who will instruct his lawyers to initiate legal action against the DAP leaders in the coming weeks in a statement e-mailed to the media from London.

He named Penang Deputy Chief Minister II P Ramasamy, Sungkai assemblyperson A Sivanesan and Hindraf activist V Ganabatirau as responsible for the defamatory attack upon his character.

He added that the purpose of the action is to give all three DAP leaders the honour and opportunity to prove their allegations in a court of law.

DAP's diversionary tactics

According to him, “Hindraf have vigorously campaigned to save this last remaining heritage village (Kampung Buah Pala) and in the process have raised various legitimate questions that the DAP-led government could not and dare not answer”.

Waythamorthy also claimed that because of Hindraf's support of the Kampung Buah Pala villagers, “(Chief Minister) Lim Guan Eng had instructed his Indian party lieutenants to divert attention by attacking... Hindraf” in order to bury the issue.

On Aug 12 Ramasamy had called upon the leader of the outlawed Hindraf to account for the funds allegedly collected for Hindraf's suit. Sivanesan and Ganabatirau echoed the Penang DCM's call for an accounting of the purported funds.

Waythamoorthy stressed that he “never collected a single cent from the public to fund the civil suit” filed by Hindraf in 2007.

The suit against the Britain claimed damages for the suffering of their Indian forefathers and the present generation of Malaysians of Indian descent, allegedly caused by the then British Empire.

“I had been very reluctant to counter the allegations against me by these DAP Indian leaders as I did not wish to divert the attention and make the people of Kg Buah Pala scapegoats in their desperate attempt to save their village, however I am now compelled to break the silence” said Waythamoorthy.

DEFAMATORY STATEMENTS BY DAP INDIAN LEADERS TO DIVERT THE ATTENTION FROM KG BUAH PALA.

Over the last 10 days I have personally come under criticisms from Indian DAP leaders who have defamed me by unfounded allegations that I had collected RM700, 000 up to millions of Ringgit to file the civil suit against the UK Government.

The series of allegations beginning from The Penang Deputy Chief Minister, Perak ADUN for Sungkai and finally by ex ISA detainee – all leaders of the Democratic Action Party which is leading the State Government in Penang which is embattled in the Land Scam involving the 200 year old Heritage village of Kg.Buah Pala. HINDRAF is committed to fight for justice and for the poor and defenceless people of Kg.Buah Pala.

We acknowledge the previous BN Government under Tan Sri Koh Tsu Koon robbed their ancestral land from them. The current Government, which promised the villagers that their Land would be returned to them should they, win the elections held in March 2008 have instead short changed the people of Kg.Buah Pala.

Over the last 2 months HINDRAF have vigorously campaigned to save this last remaining heritage village and in the process have raised various legitimate questions that the DAP led Government could not and dare not answer. In return Lim Guan Eng had instructed his Indian Party Lieutenants to divert attention by attacking and alleging HINDRAF have been compromised by the BN Government. When that allegation did not find its way in the minds of the people, they are now resorting with malicious and vindictive allegations that I have personally collected millions of Ringgit to fund the civil suit in UK and had misappropriated those funds.

After filing the civil suit in the UK in August 31st 2007, I had attended a total of 10 road shows throughout the country and more than 50,000 people have heard me speak and explain on the civil suit. I was prepared for these sort of allegations even then. All those speeches and participants were video recorded. I had in all those gatherings specifically said that I would never collect a single cent from the public to fund the civil suit. At the same time I also emphasised that I will never promise anyone a single ringgit out of the suit. . I had then distributed almost 100,000 leaflets informing the Malaysian Indians that we will never collect any funds and instead they could do their part by attending the mass gathering on November 25th 07. The 50,000 over people who attended the road shows perfectly understood that my struggle was a genuine attempt to highlight their plight, thus the wave of support on November 25th.

Apart from this our Press Statements and websites clearly warned the public not to be fooled should anyone seek funds for purpose of the civil suit.

The unfounded malicious and vindictive allegations by DAP leaders are defamatory and I will instruct my Lawyers within the next weeks to take the appropriate action. The purpose of the action is give all 3 DAP leaders the honour and opportunity to prove their allegations in the Court of Law. It is plainly obvious to me that these DAP leaders and many other cohorts of theirs envy of the achievements of HINDRAF within a short space of time and are doing whatever possible to break the unity of the Indian Community. They failed to realise that we are not competing with them or any other political party. We are an entity only committed to fight for Justice for the Indian community and highlight their plight both locally and at the International forum.

We have done what others have failed for so many years and thus their personal attack on us.I had been very reluctant to counter the allegations against me by these Indian DAP leaders as I did not wish to divert the attention and make the people of Kg Buah Pala scapegoats in their desperate attempt to save their village, however I am now compelled to break the silence. Lim Guan Eng has to act equitably and rule the Penang State with fairness and compassion rather than bully the people who he himself acknowledged had their land robbed by the previous government.

Nusmetro Agreement to the Villagers!

Please pass this message around and show the people and bloggers from the Bathroom and Bedroom to understand that the villagers are not demanding more than what they deserve! This is the exact agreement that were given to them! No other agreements!

3.In any case the project is stopped, changed, modified or halted, this agreement consider invalid

4. No description on the house, materials used, type and model, even if they build the house in the plywood the villagers cant take them to court after signing this agreement.

5. The agreement must come from State Government or koperasi as the Land owner, not Nusmetro as the developer, who has no rights towards the villagers!

6.No guarantee from the State Government on the compensation.

7. The Location of the house decided by the developer, it can be anywhere!

8.All pending cases must be withdrawn, why?

In a way, the Kg Buah Pala saga has now come full circle. It was the BN government in Penang that approved the sale of the land (with the final payment made on 14 March 2008, after the Pakatan took over, while the temporary land title was registered on 27 March 2008).

Can the Buah Pala village be saved from demolition? Will Umno and the BN make a dramatic gesture and intervene in an attempt to recover lost Indian Malaysian support for the BN?

Meanwhile, the Koperasi has ceased updating its blog since 11 August.

The village has nine days to go before it is due for demolition.

The people are our judges.

Let me start with a modified quote from a famous British Historian, Lord Acton, “..it is by the struggle of the weak, made under compulsion to resist the reign of force and constant wrong that justice is secured, preserved and extended.”.

History is filled with instances of such struggles and of the progress that justice has made, because of all such struggles. Knowingly or unknowingly it was on this maxim that Hindraf has catapulted itself onto the national scene. Fearlessness in confronting injustice symbolized Hindraf, made Hindraf.

It is this goal that Hindraf continues to pursue till today. The criteria that Hindraf applies for its involvement in the struggle of the people is the commission of injustice against the defenseless, weak, poor, marginalized and dispossessed in the country. It does not care who the perpetrators of that injustice are.

But when one stands up against such injustices, one invariably threatens the status quo and all the vested interests benefiting from that status quo. And this begets reaction from all those vested interests. Reactions in the form of suppression, repression, misinformation, smear campaigns, seduction, incarceration and whatever other means that are available.

Various of our brothers, Ganabatirau being the latest, have succumbed to the ploys of these vested interests, who would like to see Hindraf destroyed. Ploys that are crafted that even some at the helm, like Ganabtirau can succumb.

Wittingly or unwittingly Ganabatirau has become a victim of circumstances. He is a member of the DAP. On the Kampung Buah Pala issue DAP has chosen to throw in its lot with the rich developer community of Penang and against the small impoverished Indian community in Kampung Buah Pala . Hindraf and Waythamoorthy have stood up against the injustice meted out to these people of Kampung Buah Pala. Their land has been stolen from them and they are being hounded out from their land. Even the Penang DAP leaders reluctantly acknowledge this but they choose to ignore because of their close relationships with the rich developer community – never mind that there is a significant issue of injustice involved.

This has put Hindraf in collision course with the DAP. So where does that put our brother Ganabatirau – it is most unfortunate that he has succumbed to the side that has chosen to gloss over the injustice. This has caused him now to deviate from a fundamental principle of Hindraf. He has succumbed to the vested interests and has become part of a misinformation campaign against the very organization that created his public personality. He has become a tool to character assassinate the leaders of the true Hindraf spirit.

I say this is most unfortunate.

Whatever the personal and frontal attacks by Ganabatirau or by any others against Hindraf and its leaders, truth has a way of prevailing. The struggle will continue for justice. The vested interests will not give up. They will continue with attacks like these. And Hindraf for its part will continue to struggle for justice and for truth nevertheless.

If you want to know who is on the side of truth or justice, just measure them by whether they are helping to attain it or helping to destroy it. The question that the people need to ask and seek answers for is – who is helping to seek the truth and see justice prevail and who is seeking to destroy and bury such efforts.

Again, let me reiterate, it is by the struggle of the weak to resist the reign of force and constant wrong that justice is secured, preserved and extended. It is on that side that Hindraf will continue to stand and it is on that side that Waythamoorthy stands.

The people are our judges.

Federal Court strikes out Buah Pala residents' application - Malaysiakini


The Federal Court today dealt a blow to Kampung Buah Pala residents in Penang when it struck out their second leave application and allowed a preliminary objection raised by landowner Koperasi Pegawai Kerajaan Negeri Pulau Pinang Bhd and developer Numestro Venture Sdn Bhd.
Chief Judge of Malaya Justice Ariffin Zakaria - who led the three member bench - announced the unanimous decision.
The other two judges are Federal Court judge Justice Zulkefli Ahmad Makinuddin and Court of Appeal judge Justice Md Raus Sharif.Ariffin also ordered the villagers to pay cost.The villagers were represented by Darshan Singh Khaira and P Uthayakumar.
Nusmetro was represented Shareen Abdul Manan while Karin Lai acted for the Koperasi.The developer has fixed Sept 1 for the demolition of the houses.

Ganabatirau is wrong!

Mr.Murugan, was in London with Mr.Waytha Moorthy to solve the problem of Kg.Buah Pala with the World Heritage Trust in Unesco from 27th July 09 until 06th Aug 09, to list Kg.Buah Pala as one of the Heritage Village in Malaysia. Based on the remarks by Mr.Ganabatirau, I went on a personal interview with Mr.Murugan in Kg.Buah Pala to know the truth about the luxury life of Mr.Watha Moorthy in London as claimed by Mr.Ganabatirau. I conclude that Mr.Ganabatirau has a personal agenda is publishing those remarks with the influence by some irresponsible people that trying to pin down Hindraf as the saviour of the Indian Community who is in the center of marginalisation!. This is the statement by Mr.Murugan : Mr.Waytha is living a life which is below the medium life standard in London. He is staying in a small room approx 10"x12"ft in size. TV and a fan is the only accessory in his room. Mr.Murugan was sad after noticing the way a prominent lawyer and an Indian Leader is living in exile in the foreign land with only support from the Good Hearted Indians in the UK. He eats only simple fast food which is not expensive and consider the cheapest option in London. As a writer of this article,I have been to London as a Flight Crew about 20 times throughout my career and i agree that fast food is one of the cheapest option there. Although cars are cheaper compared to Malaysia, Mr.Waytha travels on trains and buses on a daily routine. The only person that is supporting his activities there in London financially, is his wife, family members and well wishers in London.

Ganabatirau is living a far more better life here compared to Mr.Waytha Moorthy and we can see clearly that Mr.Waytha is doing a great job from there by releasing articles and statements boldly compared to this Mr.Ganabatirau who has appeared like a mushroom after the rain and suddenly giving this unreasonable claims and accusations! Cheers to you Mr.Ganabatirau, all your efforts has gone into the drain! We proved that all your accusations are wrong...

Dear brothers and sister, I ve been updating news from Kg.Buah Pala for the past last one week.. since 12thAug2009 I ve been updating on each and every progress in the process of upholding Justice!, please understand that this is the truth, no one that we have depended for so long has helped the villagers! Non of them are coming all out for this poor, helpless families. No promises to give the villagers the 2storey houses as stated in all the media, I have uploaded the agreement and documents pertaining to this issue. Trust me friends, they are suffering and not as what you all are thinking, the value of RM200.000, RM500.000 is a story merely and nothing reality here. No one is giving anything concrete to the Villagers! This villages are really pressured, cheated and bullied by everyone around them, including the State Government and the developers! Neither of them came here to help the villagers sincerely. Sorry if some of my articles really put some of you down, it was out of anger that there are no help for this pitiful beings here, money is not everything in life, human values and happiness are the core of a life! Please pray hard for the souls that will attend the Federal Court hearing tommorow (21st Aug) hope the villagers will get what they deserve and justice uphold! MAy God Bless the Village and its beautiful people who were so kind to me throughout my stay here in Kg.Buah Pala, I love Kg.Buah Pala and wish the village that I m loving now will be here for another 100 generation to come. 2storey house for Kg.Buah Pala Villagers

Maybe this is the 2storey house that the State Government and Pakatan Rakyat Leader planning to be give to the villagers of Buah Pala, since there is no rights for the villagers to file a case in the court after signing the agreement, the villagers cant do anything even if this is the House they meant. Thats is what written in the invalid agreement given and asked to sign forcefully by the developer Nusmetro and Penang State Government best Leader of the year Lim Guan Eng, Ramasamy and RSN Rayer!
