DAP wants HRP to clarify its political stand

(Malaysiakini) The Human Rights Party Malaysia's (HRP) must decide whether it supports Pakatan Rakyat or BN before negotiations for cooperation can be made for the coming general election.
In stating this DAP national labour bureau chief A Sivanesan (right) said that the HRP president, P Uthayakumar, since his release from ISA detention, had been attacking Pakatan and blaming it for every incident that has affected the Indian community.
"Why is he only targeting Pakatan political leaders especially DAP and not Umno-BN or MIC? Is there a hidden political agenda for this biased stand?," asked the state party vice-chief.
"Has he forgotten that it was DAP that stood by him in his hour of need like during his ISA arrest at Kamunting Detention Camp when DAP lawyers like Karpal Singh took on the legal battle to free him?," reminded the DAP Sungkai assemblyperson.
He also took the HRP leader to task for calling party supremo Lim Kit Siang a racist. Sivanesan said in May 14, 1992, Kit Siang was suspended from Parliament for eight months for championing the rights of 66,000 MIC shareholders which had allegedly been hijacked by three companies of MIC.
He reminded HRP that Kit Siang is a man for all political seasons and for all races.
"Now Uthayakumar chooses to field his members at Pakatan areas which are held by Indian politicians. Why not make the same political stand to contest in BN-held areas?," asked a puzzled DAP leader.
"Why the hesitation of Uthayakumar to criticise Umno-BN which had kept the Indian community in the dark ages without giving them equal rights for the past 53 years?," he queried.

Stop harping

Sivanesan explained that both DAP and PAS are long-established political opposition parties that had weathered the brutal political might of Umno-BN including tasting ISA detention, before Uthayakumar (left) came into the political arena as the new kid on the block.
He said that four out of the five Hindraf leaders who were detained under ISA are now backing Pakatan with Uthayakumar the lone wolf against Pakatan.
He advised the HRP leader not to take a racist stand on Indian issues in a multi-racial country like Malaysia as now more people, especially the young voters, are advocating for a non-racial stance.
The Human Rights Party, as befits its name, should reflect all Malaysians irrespective of race or religion, and only then, can they make any impact in the political arena, he reasoned.
He asked the HRP leader what had happened to the Parti Reformasi India Malaysia (Prim) that he formed when he walked out of PKR in 1999?
According to Sivanesan, Prim was not a registered party just as HRP is now (HRP is awaiting recognition from the Registrar of Societies).
He claimed that HRP, with its racist stand, is fast losing support among the Indian community as seen in the lukewarm attendance of Indians at HRP functions.
As for the peace talks that HRP wants with Pakatan for the forthcoming general election, Sivanesan said, "Uthayakumar must come with clean hands, expecting nothing, put his views across but don't demand and seek cooperation for the mutual benefit of all Malaysians."

Some ten years ago an Indian school girl Mellisa Odery of Convent Bukit Nanas was similarly raped and murdered. Her murderers were never seriously investigated nor the murderer prosecuted by Attorney General Tan Sri Gani Patail simply because she was an Indian victim. So was the case of dozens of other Indians.

The stampede broke out Saturday night, the news agency said, at the temple in Bihar's Banka district during the "Navrati" festival, one of the most celebrated festivals of the Hindu calendar.
More than 45,000 devotees were at the temple to offer prayers and sacrifice goats when the stampede occurred, officials told Doordarshan. A portion of the sacrificed goat's body fell on some people, creating a scare that led to the stampede, according to the report.
"Ten deaths have been confirmed so far, while four are stated to be in critical condition," District Magistrate Aadesh Chitarmare told the news agency.

DAP’s Lim Guan Eng now wants to demolish 280 year old Batu Kawan estate Hindu cemetery after Kg. Buah Pala

It was this very same DAP towkay Lim Guan Eng and his father twenty years ago has gone on a strenuous campaign and stopped the Malacca State government from demolishing the Bukit China Chinese cemetery.
But this rule or standards of justice does not apply when it is this and hundreds of other Hindu cemeteries. So much for DAP’s Malaysian “Chinese” Malaysia.
On the Hindraf people power swing about 90% of the Penang Indians had voted for DAP, PKR and PAS which led to DAP forming the Penang State government and towkay Kapitan Lim Guan Eng ascending the powerful Chief Ministers post which comes with 100% powers of all land in Penang.
But this Penang Chinese Chamber of Commerce influenced towkay Kapitan will not alienate land for this ancient Batu Kawan Hindu cemetery or any other Hindu cemeteries, Hindu temples, Tamil schools or Indian villages and settlements.
He will do what he did to Kg Buah Pala within months of coming to power.
Now how is this DAP, PKR or PAS any different from the UMNO/BN regime in so far or vis a vis the poor Indians are concerned?

RM 214 Billion Budget 2011: UMNO Prime Minister Najib Razak yet again segregates and excludes poor Indians from mainstream development. Offers mere peanuts temporary solutions and wayang kulit. Never permanent solutions.

For the 53rd year running the UMNO led Barisan Nasional government has yet again excluded and segregated especially the poor Indians from the national mainstream development of Malaysia. The reason…

In the said 2011 Budget there are no specific financial allocations and implementation mechanisms in place to place in particular the Indians back into the national mainstream development of Malaysia:-
1. No provision has been made to implement the minimum RM 1,300.00 per month monthly salary with effect from 1/1/2011.
2. No specific allocation has been made for the establishment of kindergardens in all the 523 Tamil schools. But najib today announced an allocation of RM 5 billion for a mega skyscraper tower in K.L to be called Warisan Merdeka but zero allocation for even one kindergarden each in all the 523 Tamil schools. But RM 111 Million could be allocated to the malay muslim Permata Kindergardens alone.
3. No financial allocations has been made to grant full financial assistance to all 523 Tamil schools. But again RM 40 Billion for Mass Rapid System. RM 49.2 Billion was allocated for development but zero allocation to rebuild for example the world’s only:-
1. Basement Assad (Tamil) school;
2. Upstairs shophouse (Lukut Tamil) school;
3. Fully in shipping cabins lading Jermal Kuantan (Tamil) school
4. And the dozens of especially pre colonial wooden dilapidated of Tamil schools falling apart being eaten by white ants and being burnt down because of electrical fault.
But RM 29.3 Billion had been allocated to the Education Ministry alone. (Note : RM 100 Million allocation was made under the 2009 first and second economic stimulas packages but zero funds from this RM 100 Million ever went to any of the said 523 Tamil schools (Refer to The Star 30/09/2009 and our aforesaid letter to Prime Minister Najib dated 13/10/2009). And now even the next two budget has been announced but each and every of these 523 Tamil schools which should have been granted RM 120 Million each like how the said MRSM Trolak but did not even get a single cent from the RM 100 Million allocation that was announced again and again repeatedly especially in the Tamil dailies under the UMNO wayang kulit propaganda.
4. No financial allocations has been made to alienate land to all 523 Tamil schools, all Hindu temples, all Hindu cemeteries, all Indian villages and all Indian settlements with the view to give it a permanent as opposed to the present temporary and ad hoc existence which is contrary to the One Malay-sia policy.
5. No allocations has been made to ensure that all 2,237 top and high achieving Malaysian Indian students are granted scholarships, universities and matriculation places and PTPTN study loans to all local and foreign Institutions of Higher learning especially studying Medicine even in AIMST University and Institutions of Higher Learning at Ukraine, Russia, India, Romania, Indonesia etc. But RM 10.2 Billion was allocated to the Higher Education Ministry alone.
6. An 1.593 Billion allocation was made for the five Development Corridors but there was zero allocation for the eradication of poverty among the Indian poor who in real effect are even than the poorer poor Orang Asli, Kadazan, Iban or Malay who are all blessed with their traditional villages and ancestral land.
7. An allocation had been made for 375 native English speakers from United Kingdom and Australia to teach English in Malay muslim schools. But Najib Razak has forgotten that it was the pre colonian and immediately post colonial Malaysian born Indian teachers who had thought Najib and his father English. But under UMNOs 53 years of racist and supremacist policies these dedicated and Prime Minister producing quality Indian English teachers have become extinct. Such is the height of UMNO racism and supremacy that is never mind the white man teaching English in Malay-sia but never the Malaysian Indian teachers.
8. The increase to RM 700.00 per month for (mostly Indian) security guards is an insult to Najib’s per capita income of RM 28,000.00. But 90 days mertanity leave up from 60 days for the almost 98% muslim civil servants.
9. RM 500 Million for the 1 Malaysia Training Programme but the Indian poor in reality are segregated and excluded.
10. RM 1.2 Billion Welfare but 95% of the Indian poor denied welfare help.
11. RM 1.9 Billion for River of Life but never food shelter and clothing for the 70% poor and hardcore poor Indians.
12. We laud the government’s launch of the Private Pension Fund.
(HRP’s Note: But UMNO refuses to allocate RM 1 Billion to keep especially Indian youths out of crime for example by giving them the licences, loans and training as given by PNS, MARA, Bank Rakyat and Entrepreneur Development Ministry and the Agriculture and Agro based Industry Ministry to Malay youths to open up and operate Petronas, Shell, Mobil and Esso petrol stations, KFC, Mc Donalds, A&W, Ayamas and scores of other franchise outlets, food shops and tid bit outlets at the scores of low rental and high income Highway rest areas, government buildings, government build food courts etc and thousands of other government supported businesses.
Conclusion
As there has been zero allocation from the RM 214Billion to uplift the socio-economic status of especially the working class Indians we also propose serious implementation mechanisms to place the Indians into the national mainstream development of Malaysia. The only way to give effect to this is and we call upon Prime Minister Najib Razak to over and above being the Chairman of the Cabinet Committee on the Indians to also assume and take over from the MIC Indian Minister mandore the position of the Chairman of the Implementation Commiitee of this Cabinet Committee.
We now propose that RM 10 Billion is allocated under the 2011 Budget to put the Indians into the national mainstream development of Malaysia especially to undo the 53 years of injustices to this poor Indian community.
UMNO has not been and is not transparent and has refused to publish all the details aforesaid in the Prime Minster Website.
We hereby once again ask the UMNO controlled Malaysian Prime Minister Najib Razak to stop all it’s racist, religious extremist and supremacist UMNO agenda and policies and their implementation thereto and especially not to exclude the Malaysian Indians from the National Budget 2011 and thereafter, future budgets and the future National Development Plans as UMNO has been doing for over all the last 53 years but segregating and excluding the Indians from the national mainstream development of Malaysia.

We refer to the above matter wherein this morning we had received a telephone call from a vegetable farmer from Cameron Highlands.
On 11/10/10 an Indian local vegetable farmer cum seller one Ramu a/l Appalasamy’s vegetable stall by the roadside selling vegetables in the popular tourists Cameron Highlands was issued a Summons.
But hundreds of Indian farmers application for licenses has repeatedly been rejected. Why this level of UMNO racism?
To stop the Indians from sharing the country’s wealth by tapping on the lucrative tourists purchasing power coming to Cameron Highlands?
Some six years ago this farmer’s vegetable stall was demolished and he went out of business.
In the recent past alone some 13 Indian stalls were demolished for “not having a license” when in fact their license applications were rejected (list enclosed herewith). This has also happened to hundreds of Indians in Cameron Highlands over the years who have been denied their rights to engage in business and to earn a decent living. (MO 13/10/2010 at page 8).
Why is the Cameron Highlands Municipal and District Council throwing sand into the rice bowls of these Indian vegetable farmers vis a vis denying them upward mobility opportunities and excluding and segregating them from the national mainstream development of Malaysia.
To the contrary vegetable stall licenses have been liberally granted to hundreds of Malay muslim and Chinese vegetable farmers. We are told that even some 30 vegetable stall licenses have been granted to foreign Bangladeshi workers. In Kuala Terla alone six shops that are illegally run by illegal foreign Bangladeshi workers.
Kindly investigate and prosecute if there are elements of corruption on the part of the relevant Cameron Highlands Municipal and District Council and District officers and whether these Indian stalls are demolished and summons issued because they are the politically and economically powerless. They refuse to give the bribes to the Cameron Highlands District Council.
Kindly forthwith grant 100 vegetable stall licenses to the deserving Indian farmers in Cameron Highlands.
Kindly also grant the estimated 4,000 Indian farmers freehold titles to the land they have been working on at least over the last 53 years.
Kindly also similarly grant the estimated 500 Indian plantation workers a ten acre freehold land each as granted to 442,000 Malay muslim farmers in Felda, Felcra and Risda (BH 25/2/2010) to undo near slavery like living conditions they are living in coupled with a mere RM13.00 per day a tea plantation workers wages are earning. Thousands of Indians in the Blue Valley tea plantations in Cameron Highlands are paid a salary mere RM13.00 (USD 3.50) per day. They do not get annual leave, bonus and when they fall sick they cannot even afford to go to the Ipoh General Hospital for treatment (Tamil Nesan 11th Oct 2008 page 4) (Malaysian Indian Minority & Human Rights Violations Annual Report 2008). The irony is one cup of tea at a hotel in Kuala Lumpur in itself is RM13.00.
Kindly also stop taking in and deport all the Bangladeshi and all other foreign workers from Cameron Highlands and Malaysia as they depress the earning capacity of the Indians to the poverty stricken Bangladeshi standards up to as low as RM13.00 per day and taking away business and upward mobility opportunities from even the sixth generation Malaysian born Indians.
Because of these racist UMNO policies, thousands of Indians have been forced to leave their Cameron Highlands farms and only to take up unskilled general workers, cleaners, security guards, road sweepers, drivers and office boys jobs elsewhere. Why the Malay-sian “ethnic cleansing” of these peaceful Cameron Highlands ethnic Indian farmers and plantation workers.

Kindly also similarly grant the estimated 500 Indian plantation workers a ten acre freehold land each as granted to 442,000 Malay muslim farmers in Felda, Felcra and Risda (BH 25/2/2010) to undo near slavery like living conditions they are living in coupled with a mere RM13.00 per day a tea plantation workers wages are earning. Thousands of Indians in the Blue Valley tea plantations in Cameron Highlands are paid a salary mere RM13.00 (USD 3.50) per day. They do not get annual leave, bonus and when they fall sick they cannot even afford to go to the Ipoh General Hospital for treatment (Tamil Nesan 11th Oct 2008 page 4) (Malaysian Indian Minority & Human Rights Violations Annual Report 2008). The irony is one cup of tea at a hotel in Kuala Lumpur in itself is RM13.00.
Kindly also stop taking in and deport all the Bangladeshi and all other foreign workers from Cameron Highlands and Malaysia as they depress the earning capacity of the Indians to the poverty stricken Bangladeshi standards up to as low as RM13.00 per day and taking away business and upward mobility opportunities from even the sixth generation Malaysian born Indians.
Because of these racist UMNO policies, thousands of Indians have been forced to leave their Cameron Highlands farms and only to take up unskilled general workers, cleaners, security guards, road sweepers, drivers and office boys jobs elsewhere. Why the Malay-sian “ethnic cleansing” of these peaceful Cameron Highlands ethnic Indian farmers and plantation workers.

HRP received a complaint from a parent that the management of CQ-Tec College is going overboard by denying the rights of its student from wearing the traditional Indian saree to the Convocation which is scheduled to be held on 17th October 2010.
The College circular to the student dated 14th Ogos 2010, see below No.1.7 – “That all graduates and family are allowed to wear formal and traditional dress except Saree”. Why such discrimination against the minority Indians by denying their rights of wearing their traditional dress?
Article 8 of the Federal Constitution provides that all persons are equal before the law and entitled to its equal protection and there shall be no discrimination against citizens on the ground only of religion, race, descent, gender or place of birth. And Article 12 In respect of education, Article 12 provides that there shall be no discrimination against any citizen on the grounds only of religion, race, descent or place of birth (i) in the administration of any educational institution.
Is this the concept of Najib Razak’s One Malay-sia? Only kebaya and baju melayu allowed for the Convocation? Is this the racist UMNO regime’s to “ethnically cleanse” the Indian culture and tradition from the face of Malaysia.
Irrespectively we have advised the students and the parents to go to the convocation attired in saree.
HRP contemplates sueing the college for racial discrimination for being in breach of the Article 8 of the Federal Constitution.

"In the last election Hindraf was the deciding political factor in making Pakatan shine in five states and denying BN a two-thirds majority."

In return BN expected the Indian voters to support the other BN candidates.

Non-starters
"But in PKR, DAP and PAS/PR, we are non-starters because they are not prepared to share any seat with HRP. All they want is the 715,099 Indian votes free of charge," said the angry HRP leader.

"Why aren't the top leadership of PKR, DAP and PAS in furtherance of their multi-racial claims, attend to the pressing Indian problems like giving land for Tamil schools, Hindu temples, cemeteries, Indian villages and settlements?"
HRP has to make the change
He asked where is the change Pakatan had promised in the March 8th 2008 general elections.
"As there is none, HRP has to make the change by being the third force and the alternative for Indians.
According to Jayathas, there is now a 14 percent Indian support swing for the party based on the recent survey by the International Islamic University of Malaysia (IIUM) of 1,367 respondents aged 21 and above.
It was taken from Aug 1-18, on the popularity of BN among Malaysians.
The Oct 8 Bernama survey report, claims that support for BN has now increased to 55 percent from 51 percent taken during the 2008 polls while Pakatan has registered a drop of 12 percent from the previous 49 percent.
The report claimed that Malay support for BN has increased by 3 percent to 61 percent in August from 58 percent that was registered the same month last year.
Likewise Chinese support has increased by 2 percent to 40 percent during the same period.
However, support from the Indian community has dropped from 63 percent to 59 percent by 4 percent (14 percent of the Indians chose not to support any political party).
Jayathas's argument is that out of the 14 per cent undecided Indians, BN has lost 4 percent while the remaining 10 percent is Pakatan's loss.
The party information chief said the dedication and commitment of pro-tem secretary general P Uthayakumar (right) after his release from Kamunting Detention Camp on May 9, 2009, helped gain the increasing support of the Indian community.
The former ISA detainee who was detained for 514 days, had crisscrossed the country to gauge the support of the marginalised Indians with his various community oriented projects and road-shows.
During his ISA detention, he had mapped out an ambitious political long term project of capturing 15 parliamentary seats and 38 Indian majority state seats, named project 15/38.

"It is plain and obvious that both these parties of the political spectrum only want the Indian votes and never want to address their pressing community problems."
He said the IIUM survey report of the 14 percent support for HRP will further boost the party's 15/38 project and end the Indian mandore system now being practiced by both political divides.
In the first phase of the party's project 15/38, the party is concentrating on seven Parliamentary and seven state seats namely Padang Serai/ Lunas in Kedah, Batu Kawan/ Perai in Penang, Ipoh Barat/ Buntong in Perak, Kota Raja/ Sri Andalas in Selangor, Teluk Kemang/ Port Dickson in N. Sembilan/ Cameron Highlands/ Tanah Rata in Pahang and Tebrau/ Puteri Wangsa in Johor.
"The evidence of our first major breakthrough is with the creation of the very first Indian majority state seat Buntong in Perak which rose from 46.2 percent as at the 8th March 2008 General Elections to 54 percent last month," claimed Jayathas.

If and if only The Star, News Straits Times, Berita Harian, Utusan Malaysia, Sin Chew, China Press, Utusan Malaysia, Malaysiakini and the mainstream print and electronic media had similarly covered in their headlines, front pages and prime news also of the hundreds of Indians similarly shot dead, hundreds of these poor Indian mothers, wifes and childrens’ misery would have been relieved vis a vis justice, the due administration of law and order and human rights being upheld.
But today the mainstream and alternative media are functioning as the racial One Malay-sian media. Where it gives due coverage only when the victims are from the politically and economically powerful Malay muslim or the economically powerful Chinese. Where Indians are the victims, scarce coverage is given.
And neither does the so called ‘multi-racial” PKR, DAP, PAS NGOs, Bar Council, Indian elite and the Malaysian civil society speak up when the victims are the Indian poor. The Indian elite publicly lament when the victims are Chinese or Malays so as to rub shoulders and seek acceptance within those communities.
But in the western civil societies the majority whites and christians almost always bend backwards to protect, speak for and champion the poor minority interests. In fact they take pride in doing so. But in One Malay-sia the Indian elite, Malays and Chinese having fallen victim to Malay supremacy and the Chinese economic power almostly completely sidesteps the Indian poor however pressing the injustices and human rights violations against them.
