Umno at odds with race-tolerant world, says HRP

By Athi Shankar - Free Malaysia Today

KUALA LUMPUR: The Human Rights Party (HRP) today congratulated Malaysia-born Penny Wong for her appointment as Australia’s new finance minister and used the occasion to denounce the current Malaysian government as racist and out of tune with the times.
HRP pro-tem secretary-general P Uthayakumar said Wong’s appointment yesterday to the Australian cabinet was part of a global tide against racial and religious prejudice.

“Sadly, though, this will never happen in our 1Malaysia,” he said.

“The whole world is now going against racist and religious supremacy, except our Umno-ruled 1Malaysia.”

Uthayakumar, a former ISA detainee, is also the legal advisor for Hindraf Makkal Sakti.

He also criticised Pakatan Rakyat parties for similarly going against the global trend.

He said Malaysia was not only bucking current trends but also going against its own admirable history of appointing officials without reference to their racial or religious backgrounds.

He recalled that the first minister of education of the yet-to-be-independent Malaya in 1955 was Clough Thuraisangam and that in post-independence Malaya the first two finance ministers were Tan Cheng Lock and Tun Tan Siew Sin, the first navy chief was Rear Admiral K Thanabalasingam, the first chief justice was CS Gill and the first governor of Malacca was Leong Yew Koh.

“And the list goes on if one were to refresh one’s memory on the number non-Malay or non-Muslim CPOs, OCPDs, district officers and council mayors,” he said.

“This cannot happen again in Umno’s 1Malaysia.”

To illustrate his assertion that the rest of the world was moving away from racial and religious prejudice, he mentioned, among other personalities, former Peruvian president Alberto Fujimori, former US secretaries of state Colin Powell and Condoleezza Rice, former Tamil Nadu governor Fatima Beevi, former Indian presidents Zakir Hussin and APJ Abdul Kalam and several Singapore presidents and foreign ministers.

“But most intriguing is that the current president of the world’s most powerful nation, the United States, is a black with a Muslim name,” he added.

He alleged that in contemporary Malaysia “even sixth-generation Malaysia-born Indians could only dream” of becoming national school headmasters, postmasters, district officers or “even assistant district officers”.

Turning his ire on Pakatan Rakyat, he said “Pakatan Indian exco mandores in Selangor, Penang, Kedah and previously Perak” all held only the minor portfolios such as welfare, labour and community activities.

“Why don’t Pakatan governments give them more significant local government, finance or land portfolios even when they qualify?”

He blasted Penang Chief Minister Lim Guan Eng for not elevating the highly qualified political scientist P Ramasamy to the post of Deputy Chief Minister 1 instead of maintaining him as Deputy Chief Minister 2.

He charged that Lim did not promote Ramasamy when Mohammad Fairus Khairuddin resigned in April last year because “he was merely a politically powerless ethnic minority Indian”.

IGP GETS DOWN TO BUSINESS ON FIRST DAY....WILL HE BE SINCERE TOWARDS HIS DUTIES....??

By Muralitharan Ramachandran

KUALA LUMPUR: Inspector-General of Police Tan Sri Ismail Omar began his first day in office yesterday with a series of meetings with senior officers. (NST 14/09/10).

Looks like the new top cop in our nation has officially started his duties promising to combat crimes...bla, bla, bla.....just like the other top cops who spoke on their first day of their duty but what about Tan Sri Ismail Omar? Will he be sincere towards his duties...?? To safe guard the nation's law and order, to fight corruption within the forces, to combat abuse of power by his officers and the most talked about lately, the interference of third parties concerning police duties?

 I am sure Tan Sri Ismail has plans and answers for all these questions above. Every Malaysians like me will be wondering what is he going to do about this. And, during media interviews pertaining on going crisis, is he going to answer the same way as the former, The Great Tan Sri  Musa Hassan answers....:"Do Not Speculate, Let Us Investigate" and after someone is shot dead by the police, the same stereotype answers from him " My Men were Following Them, Upon Knowing It, They (the suspected criminals) Fired A Few Shots Forcing My Men To Open Fire At Them."

As for me, I wonder what are his actions going to be on the allegations by his former boss on "Interference Of Third Parties". Is he going to dig up old files and start investigations or wait for the former to lodge an official complain about this? Whatever his actions going to be it should clear the  doubts of all Malaysians who will be magnifying his actions from now.

Now, Lets look at the image of our Polis Diraja Malaysia. It doesn't really portray an image of what it should be. There was a spree of  deaths in custody and unwanted shootings lately. How is he going to change it?  Is he going to hold a Royal Commission or at least an internal enquiry on all those police personnel involved?
There are a lot of issues to be looked into by the new Top Cop.

So, Malaysians of all ethnics, let us wait patiently for our answers. And then again, "Do Not Speculate, Lets wait And See".

Dear Sirs,
RE: Suspend Racist and religious supremacist UMNO Utusan Malay-sia for maliciously implicating Hindraf lawyers in murder of Susilowati.

We refer to the above matter and to the Utusan Malay-sia headlines amongst others “Siasatan juga mendapati Datuk itu (an Indian lawyer) pernah memberi bantuan guaman kepada Pertubuhan haram Hindraf dan menjadi ahli seumur hidup sebuah parti politik”.
This statement is a completely untrue, false, malicious and a Seditious statement calculated to tarnish Hindraf, cause disunity among the peaceful Indian and Malay communities in Malaysia and to cause racial disharmony.
Hindraf categorically denies that the lawyer/s implicated in the murder of Susilawati has ever represented Hindraf or any of it’s supporters or had rendered legal assistance to Hindraf at any material time. And neither do we know them or had ever known them.
This is not the first time but this UMNO linked Utusan Malay-sia has repeatedly done this especially during the period immediately before and after the 25th November 2007 Hindraf Rally.
We hereby call upon your goodselves further to Article 8 of the Federal Constitution (Equality before the law) to stop this UMNO and Utusan Malay-sia racist and religions supremacist agenda and forthwith suspend Utusan Malaysia like what your goodselves had done to Makkal Osai at least on two occasions
within a space of about six (6) months or so in 2008 and previously to Tamil Malar a Tamil daily and various other publications.
End the UMNO racist and religious agenda in One Malay-sia.
Kindly revert to us accordingly.
Thank you.
Your faithfully,
………………..

Finally, Mahathir concedes he screwed the merit system

JB03_170508_MAHATHIRSambu lingam, via e-mail - free Malaysia Today

Former Prime Minister Mahathir Mohammad in a statement (FMT Sept 4, 2010) finally admitted that he and the Umno government intentionally discriminated against innocent non Bumiputra students by denying their educational rights as enshrined in the Constitution.

He said: "If we use the merit system , half of the university students (Bumiputeras) don't qualify..."

What one can gather from his statement is that the education system over the past 53 years has failed to produce Bumiputera students to meet the set requirement by Umno's own higher educational qualification merits.

Despite the billions spend to improve the educational achievements among Bumiputeras, citizens of this country are now been told by this longest serving Malaysian Prime Minister that Bumiputera students in Malaysia can only survive upon discrimination against their fellow non Bumi students. What a shame!

The former Prime Minister also revealed the truth on why local public universities are constantly dropping in international standard ratings. He admitted that half of the undergraduates did not qualify for entry into universities but were nevertheless granted places merely on race considerations.

I wonder how he justifies such brutal educational injustices. The moment a government tolerates such discrimination, it is actually planning to fail the country and its citizens over the years to come.

By implementing this racist based policies, thousands of fully qualified non Bumiputera students are cruelly denied entry into matriculation courses , local public universities intakes as well the PSD scholarships.

To summarise Mahathir's statement, he as the former prime minister and those in power ruling this country today clearly do not implement meritocracy in local university intakes, half of our university students are actually non qualifiers for higher education.

Fully qualified non Bumiputera students are oppressed and suppressed by the implementation of racially biased educational discrimination. The Umno-led Barisan Nasional government over the past 40 years have conveniently violated article 8 and 12 of Federal Constitution.

What you call as an Independence?

By Sara,File:Rajendra map new.png

The Chola dynasty was a Tamil dynasty which known as one of the longest-rulings in some parts of southern India. The earliest datable references to the dynasty are in inscriptions from the 3rd century BC left by Asoka, a northern ruler. The dynasty continued to reign over varying territory until the 15th century AD. This particular empire ruled Suvarnabhumi(Malaysia) too. In the early 15th century, came a Hindu traitor from Palembang, Indonesia to Malacca and established a new government called as empire of Malacca. These facts are denied in the present Malaysian history due to the rising of Islam.

In the early day before independence of Malaya , The Malays were practicing
wayang kulit or a puppet show which adapted from Ramayana and Mahabharata. Those villagers who did not have a chance to watch the wayang kulit had ‘penglipur lara’or a story teller. He used to travel everywhere like Indian saint and spread the message of Hindu epics. After the independence this was abandoned.

After the independence of Malaysia, The Chinese had a very strong opposition party. It was very impressive and not only that they had several organizations which channeled their support to champion their own causes and maintain the stability of their economy .
With their unity, they made impressive changes in the economy of Malaysia. Whereas, Indians were still living at Indian settlements and estates. The UMNO government understood very well that if the Indians were to be united, they would form an opposition party which would challenge their deeds. In order to inhibit this from occuring, step by step they planned to separate the Indians. Many Indian settlements, villages and estates were quietly demolished. In the name of development, Indians were pushed to the residency where they have to live with other races. How could estates which were source of income for British government wasn’t beneficial for the UMNO government?

The Indians were basically intelligent people by birth. Knowing their intelligence could be a threat for UMNO, UMNO followed British's 'break and rule'. It may sound I am exaggerating but it is the fact.In order to cover up all their deeds, they introduced New economy policy(NEP), Bumiputra status and quota systems.

According to UMNO statistics the country have more than 60% Malay populations whereas the non Malays are 35% only. With a country ruled by Malay government together with their Chinese and Indian coalitions, how could 35% of the non Malay population appear as a threat to the 65% of Malays? They said Chinese are leading the economy so they wanted to help the Malays with their NEP system. The simple question is when the country itself ruled by Malay government how could the Malays be poor? Dear readers think wisely, the 65% is more than 35%. If the 35% can do wonders why don’t the 65%? The logic is they have been pampered and dependable on the government. The tradition has been carried forward till today. The Malays have been feed with silver spoon. The poor Indians are scattered left poor day by day.

After the rising of Hindraf, the Indians are united with one motive to bring betterment for the community. When the government realized the unity of the Indians was strengthen, they were worried.So the UMNO government played their dirty trick to break the community by breaking the leaders of Hindraf. Some were even planted as police intelligence. So finally Hindraf was broken.

Even though so many dirty tricks were played yet the 35% non malay are still trying to get their rights back by using slogan as Malaysia for Malaysian and even 1Malaysia. The fact is the Malays are not giving equal rights to the others and still playing racial cards. As I mentioned they have 3 systems which act as protecting power for Malay privileges.

a)New economic policy (NEP)

b)Bumi Putra status (son of soil)

c)Quota system

Even if all the non Malays could get rid of one policy to make up their equal rights, the two other remaining priviliges will barr them from succeeding. It is well planned by the former prime minister Tun Dr Mahathir Mohammed. How could the country progress with their racial agenda?

Earlier, the Indians and Chinese had more schools and temples compared to the Malay Muslims before independence. The Muslims, in championing their Islamic cause, they abandoned the Tamil schools and many temples which were built before or after the colony of British were demolished by UMNO government. While some at one corner of the world trying hard to preserve ancient and old cultures, those precious elements are destroyed here in the name to bring up new Islamic culture which plotted by the government to erode the Indian's culture in Malaysia.

The writer of this article feels hurt and may sound unrealistic but what do you describe or call as freedom when equal rights of others grabbed away and instead of establishing Malaysia for Malaysians, ONE RACIST Malaysia is being reared. Can it change in another 10 years or can they be educated? Ask your self.

Hindraf challenges Umno to call Mahathir’s bluff

By Joe Fernandez - Free Malaysia Today

KOTA KINABALU: Hindraf Makkal Sakthi has challenged Umno to call former prime minister Mahathir’s Mohamad’s bluff on Perkasa, the NGO that claims to be assisting the ruling party to keep its Malay vote bank intact.

Mahathir had claimed that Malay voters would desert Umno without Perkasa which, according to him, has substantial Malay support.

“It’s not true that Umno will be even weaker than it is now without Perkasa as Mahathir claims,” said Hindraf’s London-based chairperson P Waythamoorthy. “Umno will be in even deeper trouble if it continues to associate itself with Perkasa. Already, it has only 35.6% of the parliamentary seats, that is, 79 seats.”

He was speaking with FMT by telephone from London after Mahathir issued a statement implying that Umno needs Perkasa more than the latter needs the former.

Mahathir was flogging the line that “it was more important for Umno to worry about keeping its Malay vote bank intact than place greater emphasis on its relationship with its fellow component parties in the Barisan Nasional (BN) coalition”.

Waythamoorthy noted that Umno was getting increasingly weaker, which is Mahathir’s worry, but not for the reasons that he has trotted out in public. Umno is weak because it not only has no ideology whatsoever but has run foul of Article 153 of the Federal Constitution, said the Hindraf chair, and mismanaged the New Economic Policy (1970-1990), the economy and race relations.

“The Malays themselves have increasingly realised that Umno is not for all of them but just a handful trading on their name,” charged Waythamoorthy. “If Umno has any ideology at all, it’s jealousy of the Chinese in business.”

'Perkasa approach will fail'

Mahathir, said Waythamoorthy, belabours under the misconception that twisting and turning every issue into a racial issue will scare the Malays into circling the wagons under a common platform, Umno, against the non-Malays. Such tactics, he surmised, will no longer work after more than half century of independence.

He explained that the Perkasa approach will fail because the Malays will no longer be used again by the ruling elite for their own self-serving agenda, the passage of time has matured Malay politics, the Malays are too large a community to root for one political platform, the opposition is now Malay-led and increasingly better organised, and the alternative media has broken the stranglehold of the mainstream media on public thinking.

“Perkasa and Mahathir are dated. Umno should reject both in no uncertain terms as history and go back to the drawing board if it wants to remain relevant,” said Waythamoorthy. “But that doesn’t mean that Umno needs the BN component parties more than ever.”

Asked to elaborate on his statement, the Hindraf chief stressed that Umno must drop the fiction that the ruling coalition represents the democratic will of the people.

“BN was something that happened in the wake of the May 13, 1969 riots when non-Malay leaders decided to sue for peace with the ruling Malay elite at the expense of all Malaysians,” said Waythamoorthy. “It’s not a democratic set-up at all and should be discarded.”

The BN concept, said Waythamoorthy, circumscribed the democratic process by endorsing elite power-sharing and tacitly denying the grassroots majority meaningful participation in the electoral process.

The Hindraf chair’s main concern with Umno is that it may not give up power even if it’s defeated at the next general election. To prevent this distinct possibility, he urges the ruling party to re-invent itself “to ease itself eventually out of power gracefully and become a loyal opposition”.

Waythamoorthy sees the need for Umno to get away from the BN coalition which he describes as saddled with mere passengers like the MIC and MCA, among others. Instead, he urged Umno to leave the BN coalition and open its doors to Indian and Chinese membership in particular in Peninsular Malaysia and withdraw from Sabah.

“It’s time for Umno to get away from discredited race-based policies and politics and emerge as a truly multiracial platform as envisaged rightly by founding father Onn Jaafar,” said Waythamoorthy. “This is one of the two paths to political salvation for Umno.”

The other path, said Waythamoorthy, is for Umno to weed out the distortions and deviations in the implementation of Article 153 and the NEP.

Dustbin of history

The NEP, which takes its inspiration from Article 153, pledged the elimination of poverty irrespective of race, religion, class and colour, he pointed out. “It also pledged to eliminate the identification of race with economic function and place of residence.”

On Bumiputera equity, the Hindraf chief reminded that it was not meant to be a sapu bersih (clean sweep) of the entire economy but merely confined to a 30% stake in the corporate economy, that is, companies listed on the local stock exchange.

Likewise, Article 153 is not another sapu bersih clause in the Federal Constitution, argued Waythamoorthy, but one that provides for a reasonable proportion for the Malays and Natives in four areas, namely intake into the civil service; intake into institutions of higher learning owned by the government and special training privileges; government scholarships; and business opportunities created by the government.

“This is the special position recognised by the Federal Constitution for the Malays and Natives but they were only supposed to last 15 years after independence,” said Waythamoorthy. “The Federal Constitution makes no mention of special privileges for the Malays and Natives.”

Umno, said Waythamoorthy, should stop harping on the so-called special privileges – Perkasa’s constituency -- and seek a way out of its current political dilemma or be consigned into the dustbin of history.

Malay-sian police aid Malay mob in beating up Indian youths-HINDRAF & HRP

Goodbye Musa Hassan. Welcome Tan Sri Ismail Omar to continue UMNO brute police racism and religious supremacy against Inds. Almost zero action against Malay policemen and Malay criminals.

image By Human Right Party

For 53 years UMNO has been using the brute police force against the Indians.Just two weeks ago a mob of 15-20 malay muslims attacked Nithananthan a few Indian youths who were at the compound of their Vista Damansara flats after accusing them of trying to steal motorcycles. The police patrol car unit which arrived arrested instead the injured youths and let off the hook the Malay mob despite police reports against the said mob and the police for the inaction. The Indian victims were prosecuted for rioting and the Malay muslim mob gets away scot free.
Even as late as two months ago a Malay muslim mob of about 100 attacked an Indian family in Nilai, N. Sembilan. In broad daylight they beat up an Indian youth, seriously injuring him right before the eyes of the Malay muslim policemen. Three car windscreens of the Indians were smashed up. Instead nine Indian victims of the Malay muslim mob were arrested. One of them was actually beaten up by the police right in the centre of the Nilai police station.mugilan
Two months ago, Mugilan, a 16 year old youth and his friends were accused of disturbing an 8 year old Malay girl at a swimming pool in Pantai Hill. The police which was called in slapped Mugilan straight away and arrested him and his 5 friends, one of whom was dangerously handcuffed to the police motorcycle rear seat bar and taken to the police station. Mugilan was again beaten up in the police station by the very same policeman.
kuganIn another case, A. Kugan was brutally beaten up and killed in police custody. The rest of the 10 Malay policemen who were suspended after 3,000 Indian rallied at a  mass funeral procession. but was eventually let off the hook. When police reports were lodged one policeman and that too an Indian policeman was prosecuted to make it appear as an Indian and Indian problem. The rest of the 10 suspended Malay policemen were let off the hook.
In the 2001 Kg Medan racial attacks against the working class Indians where a Malay muslim mob from outside Kg. Medan killed five Indians and grievously injuring 100 over Indians.It is 10 years now and zero action has been taken against the malay muslim mob despite scores of police reports against the police for their inaction.kg. medan
95% of the Malaysian victims killed in police lock-ups and shot dead by the police for merely being “suspects” are the Indians.
80% of the detainees without trial for alleged gangsteriem at Simpang Rengam are Indians when they form only 8% of the population. Police summary justice, arbitrary action and expediency. Why not prosecute them in a court of law.
In fact almost every day we receive phone calls from nationwide of Indians being unlawfully arrested, beaten up, maliciously prosecuted by Attorney General Gani Patail. 99% of them being forced to plead guilty as they cannot afford to raise the bail or pay their lawyer legal fees.
This is just the tip of the iceberg of the racial and religious supremacist agenda and police enforcement of the law led by Tan Sri Musa Hassan of the Malay-sian police brute force, abuse of powers, high handedness, above the law mindset and police crime against in particular the most vulnerable and soft target poor Indian community who are politically powerless against the racist and religious supremacist.
And now the baton of command is passed on to Tan Sri Ismail Omar. Old wine in new bottle.
Only with a four star army general assuming the top leadership of the police force will we see some significant changes.
Selamat Hari Raya PRDM. Eat well!

Malay-sian Police even shoot dead and murder a deformed and visually impaired and five others in their shoot to kill Indian policy.

image
No police gunshot wound on legs of suspects. Almost all gunshot wounds on the head and chest of six Indians shot dead by the police.

And their Inquest begins only 15 months later.

HRP and Hindraf has way back in 2006 stopped attending and in fact have boycotted any of these Inquests because the police, attorney general, judiciary chemist and the hospital all work hand in glove in a full scale cover up of all cases of death by police shooting dead and death in police custody.

And the outcome is so predictable, ie “Open Verdict” and the police criminals get away scot free from their police murders.

95% or some 8,000% of the victims of these police killings are disproportionately the Indians when they only form 8% of the Malaysian population.
All these possible only in One Malay-sian.
Selamat Hari Raya.

Release all local and foreign ISA detainees this Hari Raya (10/9/10) Abolish ISA. Close down Kamunting Prison.

Copy of uthayakumar
(Open letter by P.Uthayakumar to Malaysian Home Minister Hishamuddin)
Copy of Copy of Poskadanti-ISA We welcome the release of the longest serving Internal Security Act (ISA) detainee Shamsuddin Sulaiman, a suspected Jemaah Islamiah (JI) detainee without trial who was released on 2/9/10 after eight years (The Staronline 3/9/2010).
In the spirit of Hari Raya on the 10th and 11th of September 2010 we call upon the Home Minister Hishamuddin Tun Hussein to release all our local and foreign ISA friends still being detained without trial at the Kamunting Prison in Taiping.
On this Hari Raya occasion I had recall how I had fasted for the whole of the Ramadan month in 2008 along with my Jemaah Islamiah (JI) friends and other muslims. Also how when each J.I and other detainees are released, it used to be a happy and also sad occasion. Happy because our fellow ISA detainee is released from detention. And sad because we are going to miss him and perhaps will never ever see him again. Even when we bid and hug them goodbye it was from the heart.
Behind the walls of the ISA prison there was truly One Malaysia as everyone was treated equally irrespective of their race or religion.
Even though the Hindraf lawyers were labeled as Hindu extremists by UMNO we had zero problems with the J.I. “Islamic extremists” at Kamunting Prison.
This is evidence that racist and religious supremacy in Malaysia is largely the creation of the UMNO controlled government to maintain and sustain their already 53 year old rule of Malaysia.
We learnt in Kamunting Prison that genuine One Malaysia will naturally take place and does not have to be artificial as it is in reality today only when UMNO practices genuine equality for all the communities in Malaysia especially for the poor and politically powerless Malaysia Indians as is guaranteed in Article 5 of the Federal Constitution (equality before the law) and when UMNO stop all acts of rule by majoritarian might and the UMNO racist and religious supremacist bully agenda.
The rule of law is for every man to be given a right to be heard, a fair hearing as per the Latin maxim Audi Altrem Partem.
Under the law every man is presumed innocent until proven guilty and therefore no one should be arbitrarily detained under thPoskadanti-ISAe ISA but instead should be given a full hearing and be tried in an independent and fair Court of law and that too only if there is a genuine case against him.
The pain and torture of detention under the ISA is a lot more worse than for the ordinary prisoners who would know exactly when they would be released. But for the ISA detainees, their detention is indefinite and they would not know when they would be released. This alone is designed to make it a lot painful and most suffer from mental torture on a day to day basis.
On this auspicious Hari Raya occasion, I recall my 514 days of detention without trial under the ISA at Kamunting Prison, feel for my friends still detained here and call upon the Home Minister to release them all on the occasion of this Hari Raya on 10/9/10.
Finally we call for the abolishment of the ISA and for the closing down of the ISA Kamunting Detention Prison.

Hartal: Untold Merdeka Story

by Dinesweri Puspanadan

This nation and its people stand out proudly on the Independence platform for almost 53 years. Every citizen of current generation is fed through the education system and reminded constantly on our leaders' struggle in the past to fight for 'Merdeka'. In fact, many tend to brag that Malaya(that time) achieved its Independence from British in a peaceful manner without dropping a single blood. Every ordinary and educated(even not educated) people of this land is aware of this cliche or 'fact'. However, the concern is how much truth is lingering in this structured piece of Malaysian History? Many, in the name of trust,accept  the presented history blatantly without posting any doubts or question its validity.

Today, at this date, every single element of past history is re casting which paves way to dig out the buried history of the real Independence struggle which many 'heroes' would avoid to talk about it and what more to reveal about it. The writer who is inspired by Fahmi Reza's documentary; '10 tahun Sebelum Merdeka' presenting to you Hartal:Untold Merdeka Story. What is hidden beneath the Pro British History? Time to unlock the hidden history of this land.

As many believe(or told to believe that), UMNO(United Malaya Nation Organization) started the ball rolling on initiating the thought of Merdeka. However, as stated by certain sources, the Alliance PUTERA-AMCJA was the first to initiate the thought of Merdeka. When British wanted to implement Malayan Union, many raised to project their rejection. Undeniably, UMNO was one of many in the agenda. After demonstrations and pressure from all corner, British then decided to form a team to sketch structure for Federation.

One event that should be highlighted here is before British agreed to terminate their thought to go ahead with Malayan Union and form the team to discuss about Federation, Parti Kebangsaan Melayu Malaya(PKMM) which was formed on 17 October 1945 which joined UMNO earlier pulled out on 29 June 1946 and refused to cooperate with British to be part of the team to plan the Federation.

PKMM came out with a plan to form an alliance with parties of other races. AT this point, Malaysian Indian Congress(MIC) formed with 600 members in August 1946 under the leadership of the first President, John A. Thivy. On 14 December 1946,

Council of Joint Action (CJA); a joint effort from PKMM,Malayan Democratic Union(MDU), Singapore Federation of Trade Unions (SFTU), MIC, Clerical Union, Straits Chinese British Association (SBCA), Indian Chamber of Commerce dan Ceylon Tamil Association which worked one collaborative effort to draft out a new constitution for Malaya. Below is the summarized chronology of events which illustrates the formation of PUTERA-AMCJA

* On 22 December 1946, this council expanded with new members; PMFTU, dan Malayan Peoples Anti-Japanese Ex-Service Comrades Association and renamed as Pan-Malayan Council of Joint Action (PMCJA) where Tan Cheng Lock was appointed as the first President.

*  On 22 February 1947,

Pusat Tenaga Ra’ayat (PUTERA) formed at  Kuala Lumpur with 29 Malay associations including PKMM, API, Angkatan Wanita Sedar (AWAS), Barisan Tani Se-Malaya (BATAS), Gerakan Angkatan Muda (GERAM) and other associations.

* In March 1947, PMCJA dan PUTERA formed  PUTERA-PMCJA which later known as PUTERA- AMCJA which focused on 10 people's principles

PUTERA-AMCJA was the first multiracial Alliance which included three main races, Malay, Chinese, and Indians and also was the first to spread the thought of Merdeka among people. In this context, UMNO was silent about Merdeka for almost 10 years. While UMNO was busy sketching draft of the Federation, PUTERA-AMCJA collected all the voices to fight for Independence and structured a new constitution after some brainstorming sessions with all the main races and this constitution was known as People's Constitution. While that, this alliance protested and expressed their rejection to the Federation as they felt the Federation was again paved way for British's full power on Malaya which would make the process towards Independence difficult. UMNO's willingness to cooperate with British angered PUTERA-AMCJA as they believed UMNO was a traitor for jeopardizing people's welfare by nodding their head to British's demands. Below is an article from;

The Malaya Tribune dated 15 February 1947 on PKMM admonishing Dato Onn Jaafar

The Malaya Tribune dated 15 February 1947 on PKMM admonishing Dato Onn Jaafar

On 10 August, PUTERA-AMCJA officially approved the People's Constitution. Below is an article from;

The Malaya Tribune(11 September 1947)

The Malaya Tribune(11 September 1947)

One question that should strike right now is 'what are the differences between People's Constitution and Federation?'. There are certain sections from both; People's Constitution and Federation should be highlighted. PUTERA-AMCJA started to reach the people and spread the idea of Merdeka and establishing own government;people's government while that UMNO with British, despite all the protest by PUTERA-AMCJA, they worked on Federation and refused to give ear to PUTERA-AMCJA. Below are some newspaper articles on Hartal

Utusan Melayu Newspaper 6 October 2010 -- Announcement on Hartal

During that time, with newspaper as the mainstream media, UMNO also did not fail to spread its message about Federation to gain people's support. One of PUTERA-AMCJA's strengths was the unity. As mentioned earlier, the collaboration stood proudly with cooperation from 3 main ethnics; Malay, Indian, and Chinese. If UMNO could break this unity, the task to defeat PUTERA-AMCJA should appear easy. One of the ways (surprisingly used until today) was media; newspaper. Majlis known as UMNO's mainstream media while  Utusan Melayu was PUTERA-AMCJA's loyal mainstream media. One of the political cartoons created and used in Majlis to break the unity among the people and spread racial slurs was Ah Chong-Ramasamy cartoon.

One of the cartoons could be found in Majlis newspaper dated 6 September 1947. The title was Malaya Hak Melayu (Malaya is Malay's rights). Below is the political cartoon;

Majlis newspaper dated 6 September 1947

The character wearing tie was Edward Gent, Gabenor of Malayan Union who was telling that;

Malaya hak Melayu! Melayu tak ada negeri lain. Negeri China hak Cina. Negeri India hak Indian. Kamu orang dagang bila² suka ada negeri tempat kamu pindah.

Translated: Malaya is Malay's rights. Malays do not have other countries. China belongs to Chinese. India belongs to Indians. You are traders. When ever you like, you can go back since you have your own countries.

Three cartoon characters near the bridge were Chinese at the front, Indian, and the one labeled as DR was Dr. Burhanuddin Al-Helmy.

The Chinese cartoon character was saying;
Gua tak suka Fedelesyen. Fedelesyen atak, tentu Melayu sinang.

Translated:I do not like Federation. Federation will definitely benefit Malays

At the right a Malay farmer character was holding UMNO's flag with a smile on his face.

This political cartoon was enclosed with 2 stanzas of 'Pantun' which read;

Apabila Federation hampir terserlah,
Melayu nampaknya mendapat faedah,
Pekemam Putera mengapa gelisah?
Dengkikan Melayu mendapat tuah!

Negeri Melayu hak Melayu,
Ikan senohong bukannya yu,
Ah Chong tak boleh bertukar bulu,
Ramasamy tetap bercorak Hindu.

Translated:First stanza:With Federation, Malays are gaining benefits, PUTERA seems to get worried as it is jealous when Malays are gaining more benefits

Second Stanza:Malaya belongs to Malay. No matter what, Ah Ching(Chinese) and Ramasamy(Indian) could not be Malays

Without giving up, after the approval of People's Constitution, PUTERA-AMCJA announced Hartal. Hartal,  which was held on 20 October, 1947, carved in Malaya's history where it portrayed the greatest political demonstration which never been seen  in  Malaya. This political protest was against Federation which was worked on by UMNO and British together with Kings. PUTERA-AMCJA united with all the different races and moved forward to spread the word about Hartal.They preached people about the People's Constitution and explained how Federation actually would continue to push them into slavery under British. They used media like Utusan Melayu, went from one village to another and plowed into people's mind the urge to be freed from British and establish their own government. People from different background, especially different ethnics and races began to move to one common thought. With that, Hartal emerged as a gigantic wave which shook British and its crony, UMNO.

On 20 October 1947, the Protest Day, where British would debate on the constitutional issue in Malaya,  those who regard Malaya as their real home and who supported the People’s Constitutional Proposals issued by PUTERA and the All-Malaya Council of Joint Action, were asked not to carry out their usual occupations, but to remain indoors throughout the day and night.

Sending a strong message, every Malayan(Malay, Chinese, and Indian) stood together without any fear by protesting towards British's undemocratic and unconstitutional ruling.Hartal turned out as a big success as the main cities were deserted and only few people could be seen on the street. This was something very unnatural for British and UMNO who thought Malayans (Malay, Chinese, and Indians) were weak and would bow to their orders. Hartal received wide coverage not only form local mainstream but also International media. It was estimated that around 140,000 participated in Hartal (A big quantum if we consider the population at that time with some limitations to spread the news). Below are news excerpts on Hartal;

Sunday Tribune(26 October 1947) which estimated the number of workers took part in this political demonstration

Hartal resulted in many outcomes. Associated Chinese Chamber of Commerce of Malaya sent a proposal to British on 25 October 1947 to revise the Federation as the people were against it and supported Hartal. Below is the official letter;

An excerpt from the letter;

Indicative of the widespread dissatisfaction, there was an almost complete cessation of work and business throughout the length and breadth of Malaya from dawn to midnight on that day. Malays, Chinese, Indians and others participated in the move, showing that the opposition to the present Proposals is neither sectional nor communal, nor the result of simply party demands but of the upward surge of a widespread desire for a new ideal of Malayan unity in which all can work together without any communal emphasis.

However, British still proceeded with Federation as UMNO was channeling its full support to the implementation of Federation and officially Federation was officially formed on 1 February 1948.

Even though PUTERA-AMCJA failed in its Peace Demonstration to stop British and UMNO from implementing Federation, they proved to both British and UMNO that people at Malaya at that time despite the different ethnics able to unite and fight for freedom. It actually created a very strong impact where people started to realize about the importance to fight for 'Merdeka'. Hartal is the basic foundation for a continuous and tragic struggle to free Malaya from colonization.

The fact that Malaya gained its Independence without dropping a single blood is a blatant lie! UMNO was not involved in the war and struggle to free the nation but behind the Independence enjoyed by every Malaysian today for almost 53 years(Looking at current situation, it is not fair to call it as a 'freedom'), there are untold sacrifices, unappreciated warriors who swept out all the differences and united to free Malaya. Some questions for us to reflect on;

1. If our grandparents could be united those time to fight for Independence, why today are we tarnishing the unity in the name of championing our race and religion?2. Who is/are the culprit(s) spreading racial slurs from the day one to divide us ?3. Are we too dumb or naive to still believe the facts that our Independence is genuine?4. Why is this piece of history is not emphasized (Perhaps mentioned but not emphasized)?5. This part of history is only until 1947. What happened from 1948 to 1957?

Writer's note: History repeats itself if we fail to learn from it. Our generation failed to learn. Thus, every single event in the past is repeating now. Look around you. Read the news! Can you identify the newspaper which spreads racial slurs like Majlis (Political cartoon-Ah Chong Ramasamy). Can you see freedom is restricted? If today we do not learn, our future generation will suffer. Failed struggle and bastardized Independence in the past are the reasons for today's conditions. Our grandparents did their best yet they did not manage to continue the struggle. We are still colonized by  restricted freedom, corrupted judiciary, racist leaders, ..you name it.... Transformatin is needed. If you still believe we are fine, then the choice is yours. I am awake for the betterment of my future generation! I am speaking up against inequality subjected to Malaysians!! Kick out the racists leaders, Use your Vote, let us move towards a clean government. Let us unite and WE ARE NOT DIFFERENT. Let us continue the struggle of our grandparents until we see the desired changes!!!PS: Sorry I do not believe in rethoric of 1Malaysia because it sounds as though we are so different. Emphasizing again, we are NO DIFFERENT. We are MALAYSIANS!!

What ‘Social Contract’ Mr. Prime Minister Najib? Where is it in writing? Or is it license to bully the poor and politically powerless Indians? Why supremacist Article 153 after 53 years of Merdeka?

url what In today Utusan Malaysia headlines 7/9/10 the racist and religious supremacist UMNO Prime Minsiter Najib Razak plays to the 60% majoritarian Malay muslim gallery with the headlines screaming to the effect, “Don’t question Malay muslim supremacy in One Malay-sia”.

To start off with where is this much hyped about Social Contract in writing? There is nothing in writing! When the social contract is not in writing how can one even question it in the first place? But only going by the Malay muslim supremacist logic is this possible. And not by the universally accepted standards.

Well it is never in the Federal Constitution as we have perused the proposals to the Reid Commission which formulated Article 153 of the Federal Constitution.

The closest is where we can only see the then Alliance Party’s (now Barisan Nasional) proposal to the Reid Commission, the gist of which is in ‘50 years of Violations Of The Federal Constitution By The Malaysian Government’, compiled by P. Uthayakumar: Venue : Selangor Chinese Assembly Hall Kuala Lumpur on 28/7/2007 at 7.00 p.m. Organised By : Hindu Rights Action Force (HINDRAF) at pages 34, 35 & 36 are as follows:-

clip_image001clip_image002clip_image003
These are the only provisions that our nation’s forefathers had agreed to as stated by UMNO Prime Minister Najib Razak in The Sun 7/9/10 at page …..

But there is nowhere in the Alliance proposal of the much hyped Article 153 of the Federal Constitution it shall be the responsibility of the Yang di-Pertuan Agong to safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak which permits or authorizes the Malay muslims to sweep clean @sapu licin and dish out mere peanuts and crumbs to the Indians for UMNO’s wayang kulit showpieces and showcases.

Why go far. In fact the second limb of Article 153 “the legitimate  interests of other communities in accordance with the provisions of this Article” protects especially the Indian poor from being segregated and excluded from the mainstream development of Malaysia.

But UMNO refused to follow the Federal Constitution or the law. UMNO uses their majoritarian might the 100,000 almost all malay muslim police force, another 100,000 or so army and the 1.2 million civil servants to segregate and socially engineer to keep the poor Indians poor and make the poor Indians poorer.

The brute truth is UMNO keeps harping on Article 153 and the social contract to bully especially the poor Indians and keep them segregated from One Malay-sia. Najib is telling the Indians that the cream and meat is for the Malay muslims and the leftovers and crumbs for the Indians and Najib insists that this is One Malay-sia.
