'Discrepancies in Banggarma's conversion' - Malaysiakini

Welfare Department director-general Meme Zainal Rashid should furnish evidence to substantiate her claim that S Banggarma was converted on Nov 30, 1983 in Rompin, Pahang.

NONEDemanding this at a media briefing today, Banggarma's lawyer Gooi Hsiao Leung pointed out that the conversion certificate dates the conversion at Dec 28, 1989.

“The Welfare Department now claims that she was converted by her Hindu parents when she was a year old. There cannot be two conversions into Islam for the same person,” he said.

Gooi chided Penang Islamic Affairs Council (MAINPP) president Shabudin Yahaya for saying that Banggarma, 27, is a Muslim and that her marriage to a Hindu is a legal issue.

He said the Welfare Department and Islamic authorities have failed to address the key question on the conversion of a minor by the administrators of the welfare home.

Section 80 of the Penang Administration of Islamic Affairs Enactment 1993 stipulates that anyone below the age of 18 shall not be converted to Islam without the consent of his or her parents.

Banggarma's conversion, Gooi said, was illegal from the start.

Gooi hoped that MAINPP will assist Banggarma by expunging records of her conversion, so that the issue can be resolved amicably.

Banggarma, who was present, told reporters that her father had never mentioned anything about the 1983 conversion.

“My father is a practising Hindu like me,” she said, showing a photo of her father with vibuthi (sacred ash) on his forehead.

He had enrolled her and three siblings - two elder brothers and a younger sister - at the home, after its welfare officers convinced him to do so, she said.

“He was shocked to hear that my siblings and I were converted to Islam in the welfare home,” Banggarma said, alleging that the four were then separated and have not met since.

Meme had told Malaysiakini yesterday that Banggarma, whose Muslim name is Siti Hasnah Vangarama Abdullah, was placed into the welfare home in Kepala Batas in March 1990 following a order under the Juvenile Courts Act of 1947, for her own protection.

Meme claimed Banggarma was found wandering aimlessly in Sungai Petani, Kedah.

Questioning this, Banggarma pointed to the conversion certificate which shows that she was converted in 1989.

Due to her Muslim name in her identity card, she has not been able to register her marriage to S Sockalingam. It had been conducted according to Hindu rites.

She has also been unable to register her husband as the father of the children in their birth certificates.

Her birth certificate shows that she was born on Aug 13, 1982 in Keratong, Pahang to plantation worker B Subramaniam and Latchumy Ramadu, both Hindus.

Describing herself as a staunch Hindu, Banggarma said she would fight till the end to restore her rightful identity.

“I was born as a Hindu, I live as a Hindu, I will die as a Hindu,” she said.

These Indian poor, handicapped and senior citizens almost always are given the run around at the welfare departments until they give up or are rejected at the very counter level. All these direct and blatant discrimination can only happen in Malay-sian Prime Minister Najib Razak’s One Malay-sia. These Indian poor are so desperate that they are prepared to come and wait for a mere hamper and to collect the RM 20.00 given for adults and the RM 3.00 for the 40 children. This only goes to show the height of the Indian poor who are prepared to wait for hours for a mere RM 3.00.

This is just the tip of the iceberg of the Indian poor problems in Malaysia.

We hereby call upon the welfare Ministry to stop all further and future racial and religious based discrimination against in particular the Indian poor.

The poor and working class squatters once again are being targeted to be bulldozed by the cruel UMNO regime today- 24/11/09. It is public knowledge that the Indians have been predominantly living in Sentul since the British colonial days. Most of them who had set up and built and were the backbone of the Malayan Railways. But today they have all been forgotten and now to be literally bulldozed!

Today UMNO’s racism and religious extremism reigns supreme in Malay-sia Prime Minister Najib Razak’s One Malay-sia.

These poor and working class Indians have not been given alternative homes and yet again have to suffer in silence. Even the ten out of the eleven Pakatan Rakyat (P.R) MPs’ in Wilayah Persekutuan are silent and do not care as yet again the victims are merely the Indians. PKR, DAP and PAS are only interested in the Indian notes and not the Indian problems. But they all claim to be multi- racial!

Seetha (31) had committed suicide by drinking paraquat last week because five Indian youths including her brother and a 17 year old juvenile were shot dead and murdered in cold blood by the Malay-sian police force in their shoot to kill policy

Today her four children had been discharged from the Klang General Hospital. ( Tamil Nesan 24/11/09 front page). Today they no longer have their mother to care for them to love them and to bring them up. From today onwards they have a bleak future. Because UMNO had and would not even at the very least give the welfare monetary assistance to these orphaned children (by the UMNO Malay-sian state).

With the side effects of the paraquat they had consumed, they are likely to suffer from the many medical complications ranging from kidney failure to leukemia

This is just the tip of the iceberg. Scores of previous such children were dumped just like that and denied even the very basic welfare assictance as they are merely the poor helpless and working class Indian children. All this can only happen in Malay-sian Prime Minister Najib Razak’s One Malaysia.

25th November 2007 – Wake Up Call for the Nation

The Coalition of Malaysian Indian NGO’s (COMIN) had in December 2007 called on the Government to look into the issues raised by HINDRAF and resolve these issues through dialogue and peaceful negotiations rather than suppressing the grievances raised through measures that can only be considered as vengeful and hateful.

We had made our call subsequent to the peaceful mass rally on 25th November 2007 organised by HINDRAF which was brutally suppressed by the Federal Reserve Unit who shot water cannon with chemically laced water and tear gas at peaceful protestors. Five of the key organizers, Waythamoorthy, Uthayakumar, Manoharan, Ganabathy Rao, Vasanthakumar and Kengadharan were incarcerated in Kamunting under the Internal Security Act while Waythamoorthy is still living in exile continuing his struggle.

Many saw the Hindraf rally as a wake up call for Malaysian Indians, but in truth we now realise that 25th November 2007 was a wake up call for Malaysians of all races. About 3 months later, on 8th March 2008, Malaysia saw a peaceful transition of power in 4 state governments to the Pakatan Rakyat with the Barisan Nasional losing its two-thirds majority in Parliament for the first time in recent memory.

The results of the General Elections in 2008 exposed the strong feelings of discontent against corruption, discrimination, abuse of powers by law enforcement agencies, violent action taken against peaceful demonstrators, use of ISA against dissenters, mismanagement and maladministration in the public sector, and a severe lack of meaningful initiatives to alleviate the problems of both the urban and rural poor. For once it exposed the weakness in the communal politics and the failure of the national leadership and that of the minority community in realizing their constitutional rights.

It was only after the severe defeat at the General Elections 2008 and the several subsequent by-elections did the authorities show any sign of realisation as to the depth and severity of the issues affecting the Malaysian Indians specifically and majority Malaysians generally.
Though, we note that some initiatives are being implemented by the Federal Government and State Governments on a piecemeal basis, we have concerns as to whether such initiatives are real institutional changes that will offer change and restore confidence in the minds of people.

This land belongs to all. It is our primordial duty to see that no single citizen is made to feel as if he is not one among us. There is enough for all and everyone. For democracy to succeed it has to be a tool that ought to address the needs of the weak and the minority more than the majority. We agree that the nation must be centred on the Federal Constitution, rule of law and institutional reforms that guarantee the rights of every citizen, without dwelling on our communal differences.

Noting the prevailing socio-political situation, on this, the 2nd anniversary of the HINDRAF rally, COMIN makes the following proposals:-

1. We urge the Indian Community in Malaysia to engage with each other and be united in what should be a common aim of empowering impoverished Indians so they can be useful citizens of this country. Whilst differences can and should exist and be debated rationally and through the democratic process, we urge politicians, temple leaders and NGOs to put aside personality clashes and political differences when dealing with the plight of poor Indians and work together across party lines in this common aim. Thus, we call on all Indian Members of the Dewan Rakyat, Dewan Negara and the respective State legislative assemblies to form one cross party political caucus to address Indian issues, similar to what we see in the US Congress, where Black and Pacific Island caucuses exist consisting of members from both the Republican and Democratic parties.

2. We also urge the Federal Government and all State Governments, be they from the Barisan Nasional or the Pakatan Rakyat, to show their sincerity in improving the lot of the Indian Community. Concrete and tangible efforts must be made to improve educational opportunities, moral upliftment, the provision of living skills training and the creation of employment and small business opportunities. Efforts to improve national unity must be done in a transparent and genuine method. To that end, we reiterate our call for the creation of an independent non political Task Force to be a monitoring body comprised of representatives selected by NGOs themselves to oversee the implementation of the initiatives for reform that are so desperately needed.

The Government’s “1Malaysia” concept must be practised and implemented in a manner that gives every Malaysian the sense of pride that he is wanted, appreciated and recognised in the development and progress of our beloved country.

HINDRAF: 25TH OF NOV - TWO YEARS AFTER.‏

A sea of aggrieved humanity descended to the center of KL on that historic day the 25th of Nov 2007, and there that day was born Hindraf . Even though it had existed as a loose grouping of just over 30 NGOs, the Hindraf we all recognize today was indeed born then.

It was more of a phenomenon than an organization even on that day.

Many of us were swept along into that phenomenon because of what it meant to all of us. What happened that day was a crystallization of something that had been brewing for a very long time in the minds of the Indians in the country. It includes emotions of seething anger, disgust, bitterness, alienation and helplessness. All these deriving from a lifelong experience of being put aside, being put down, being treated with indignity, being
sidelined, being discarded, being treated like subhumans in situations, being denied the most basic of rights, being denied equal opportunities, being given reasons and excuses which we felt totally helpless to do anything about.

Now after two long years of struggle as an organization we have found a clear direction and a firm basis by which to engage in what will be a prolonged struggle – for the inertia of status quo is very strong.

Hindraf Finds Itself

We have removed the chaff from the wheat. Most of those who do not belong, have found their way out. We have cleared ourselves of many wishful thoughts. We have a better understanding of reality. We know what the real issues are, who our true friends are and who fair-weather friends are and who our enemies are. Two years have given us much opportunity to engage with the issues and to learn from the various struggles. We can see our mission clearer now for all that.

And it is a historic mission.

This is our mission

The Indian marginalized and poor are factory workers, service workers,
manual workers, often contract workers, they are drivers, they are
security guards, they are the cleaners, they are the gardeners, they are the helpers, they are washerwoman in restaurants, they are criminals in prison, they are the dreg of Malaysian society. They form the majority of the Indians in the country. What characterizes the Indian society at large in Malaysia today is a constant struggle only for the basics of life. Compare with the other segments of society and you see a rams for them and this
basic struggle for the Indians.

The Indians are also the dispossessed in our society. They have no kampungs to go back to. They have no ancestral structures to fall back on. They only have their working power to live their lives by. And that, is being blocked in so many ways by the working of this racist system.
And to top this all, the poor and marginalized Indians have been kept in a state of ignorance for as long as they have existed in this country.
This makes them a group that is most desirous of change, most in need of change.

To bring about change is their historic role.

But they do not yet recognize this role. Hindraf and HRP now have set themselves the agenda of creating this recognition and in the process, uniting this group under one umbrella and forcing change in the system.
Forcing change through empowered participation in the political
processes in Government. The Indian poor and marginalized have the most to gain from a change to the system and they have the least to lose by any change. Thus they have the potential for leading change in this country like no other single group.

Hindraf has evolved over these two years to become that organization that discovered this historic mission for itself and this historic role for the Indian poor and marginalized. This role requires political clout – something which cannot be realized through any existing arrangement. The needs of the Indian working poor can only be met by a re-engineering of the basic grouping within Government, by restructuring the constitution of those holding the reins of power.

HRP, the political wing of Hindraf has taken on as its objective to
participate at levels of government that empowers them to bring about the change to the basic policies. This will mean a change for all the poor and marginalized, not just for the Indians. But the Indian working poor organized well and led well have the potential for leading the charge and creating change for all the working poor and marginalized in the country.

The work for the HRP has just begun. Hindraf forms the mass base and HRP becomes the wing that will take the agenda onto the struggle for national policy change.

This is so clear now after two years of struggle.

HRP: Kapitan Guan Eng’s Indian Mandore DCM2 Penang gives peanuts RM 1,000.00 to one poor Indian squatter family. (Makkal Osai 21/11/09 at page 4) Kapitan Lim Guan Eng demolished the last and only Indian traditional village in Penang. This kapitan despite the Indian anger ruthlessly proceeded to demolish even the cow sheds which is on the state government land on the eve of Deepavali.

Now this Kapitan literally instructs his Indian DCM2 mandore to dish out RM 2,000.00 to these two poor Indian families and get it publicized in the tamil newspapers and then washes his hands off as was typically done by his UMNO’S MIC mandore predecessors.

This way he thinks he gets to stay afloat and trying to remain relevant politically. There is no permanent solution no low cost house or flats for these poor Indian families in this Kampong Manis Seberang Perai and the thousands of other Indians in Penang.

How then is the DAP/PR any different from the previous Gerakan/ UMNO/ BN Penang State Government?

Hunger strike to mark Hindraf’s 2nd anniversary

Two factions of Hindraf will each host events to commemorate the second anniversary of the Hindraf’s (Hindu Rights Action Force) mass rally on Nov 25, 2007. The faction led by P Waythamoorthy plans to hold an 18-hour hunger strike as well as a memorandum handover.

NONEHindraf legal adviser and ex- ISA detainee, P Uthayakumar (right) said that 18 Hindraf supporters would take part in the strike, which is scheduled to begin at 9pm on Nov 24 at their respective homes and scheduled to end at 3pm on Nov 25 at KLCC.

The time of the strike was selected to mark the time when police began harassing the mass rally participants two years ago.

They are expected to break their fast at 3pm in the compound of the Prime Minister’s Department in Putrajaya after Waythamoorthy’s daughter, W. Vaishnavi, submits an 18-point memorandum to the Prime Minister, Najib Abdul Razak.

The memorandum would be the first to be sent to the Najib administration. Hindraf has submitted memorandums to the previous administrations as well.

The anniversary celebration does not end there.

On Nov 29, the movement would hold prayers at the Agora Veerabathrar Sanggili Karuppar Temple in Rawang, Selangor in hopes that the 18-point demands are fulfilled by the current government.

Prayers are also expected to be held simultaneously in 100 temples nationwide.

Different way of commemorating event

Another Hindraf faction led by K Vasanthakumar and V Ganabatirau is also holding celebrations in Dewan Hamzah, Klang.

“We have nothing to do with that event,” said Uthayakumar when asked to comment on the other Hindraf anniversary.

NONEHe added that he only recognised the Hindraf faction that was led by his brother, Waythamoorthy.

Two years ago, Vasanthakumar, Ganabatirau, Uthayakumar, R Kenghadharan and M Manoharan led 30,000 Indians in a mass rally to protest marginalisation and discrimination of the Indian Malaysians.

It led the five to be detained under the Internal Security Act, resulting in Waythamoorthy (left) going into exile in London.

At the time, there was a public fallout between Uthayakumar and Vasanthakumar. The fallout led to split loyalties within the movement as members chose sides in the Uthayakumar-Vasanthakumar squabble.

It has been two years since the Neo Democratic Revolution and uprising of the Malaysian Indians against the marginalized and systematic discrimination against them by the UMNO led Government.

HINDRAF would be organizing three events to commemorate the people’s Neo Democratic Revolution initiated by HINDRAF against the totalitarian government led by the UMNO.

Event No 1 -

A gathering of 18 HINDRAF supporters in front of KLCC between 9.00am- 4.00pm to observe a hunger strike representing the 18 point demands that was submitted to the UMNO led government in uplifting the Malaysian Indian community that has been systematically marginalized and discriminated by the government for the last 52 years.

Event No 2 –

HINDRAF chairman’s daughter, W. Vaishnavi will be attending the Prime Minister’s Department in Putra Jaya to hand over a letter from HINDRAF Chairman detailing the current and immediate problems of the Malaysian Indians in regards to the discrimination that they face in socio development backwardness of the Malaysian Indian society within the sphere of Malaysian community in regards to education, economics, business, police abuses, freedom of religious practice and other continued suppression on Article 5, 8, 10 & 13 of the constitution against the public more particularly against the Malaysian Indians.

Event No 3 :

Nationwide prayers at more than 100 locations to light 18 ghee lamps to signify the 18 Point Demands submitted by Hindraf to the then Prime Minister that is yet to be fulfilled. A complete list of temples holding such prayers would be available for viewing on our website on the 25th November 2009.

A separate mega Ruthra yagam/fire ritual would be held on 29th November 2009 at Agora Veerabathrar Sanggili Karuppar Temple 17 ½ Mile Kg.Benggali Rawang Selangor.

It is a common cause for all Malaysian if fairness and equality is what we pursue to enhance our community’s agenda against the repressive government led by UMNO and its voiceless and spineless coalition for the betterment of the society.

Hindraf warns the Royal Malaysian Police not to interfere, disrupt and/or sabotage these peaceful gatherings which are organised in accordance to our basic rights enshrined under Article 10 of the Federal Constitution and which is very meaningful and significant to Malaysian Indians.

Twins Sharmila (13) and Shalini (13) are both born handicapped. They are unable to walk or move about on their own. They move about on their wheelchair says their father Letchumanan who was in tears Letchumanan when relating their plight. He only earns RM 500.00 per month as a palm oil estate worker. Their mother Shanthi is suffering from diabetes. This family like hundreds of thousands of other Indian have been denied the UMNO controlled Malay-sian government’s state welfare assistance even though UMNO has allocated RM 40 Million for programmes including providing Welfare assistance and house rental payments in the 2010 national budget. (NST 24/10/2009 at page 10).

The E-kasih cards for those earning below the poverty level set at RM 687.00 per month is unknown to this twins (or most of the two Indians in Malaysia), let alone they having been issued the said cards or actually benefiting from the same in the first place. They are rejected “ab initio” ( from the very beginning) even at the counter level or given so much run around that they are forced to give up.

But this sort of direct, ruthless and blatant discrimination is only possible in the UMNO Malay-sian Prime Minister Najib Razak’s One Malaysia.

Almost zero Indian traders out of 1, 500 at Pudu Market.

(Chinese) Hawkers and Petty Traders Association and Bumiputera Traders Associations’ Presidents Tan Ker Chiang and Abdullah Mohamad said “they did not want hawkers to sub let their stalls to third parties”. (Refer The Star metro 16/11/2009 at page M 9)

Note: By sub letting these stalls at this Pudu market, scores of other markets and food stalls, even at the lucrative highway rest area food shops, restaurants and tid bit stalls, pasar malam, pasar tani and roadside stalls, the poor and working class Indians have been denied hundreds of thousands all of these petty trading opportunities.

The UMNO controlled Malaysians government intends these working class Indians to take up and/or remain unskilled and to do menial jobs, and unskilled like security guards, lorry drivers, taxi drivers, toilet cleaners, general workers and unskilled workers.

This working class Indians would not be given the training, licences loans and opportunities to do business (as is given to almost all the deserving Malay muslims) with the view for them (the Indians) to gain upward mobility opportunities and to be part and parcel of the national mainstream development of Malaysia.

So never mind if the Malay and Chinese traders sub-let their stalls to foreigners. It is “merely the Indians who would lose out” after all. So UMNO does not care! So why should it matter to UMNO!

Note: Action taken to weed out these foreign petty traders is a rare occasion. There are hundreds of thousands of other such foreign “businessmen” in Malaysia who have actually taken up the jobs petty trading and business opportunities from especially the working class Indians.

PR MPs, WHAT IS YOUR BASIS FOR ACTION - RACE OR SERIOUSNESS OF THE ISSUE

SUB:EMERGENCY MOTION IN PARLIAMENT FOR POLICE SHOOTINGS

Good Day to you all.
I refer to my letters of the 15th and 17th of November, 2009, requesting of all of you Honorable Pakatan MPs the following, in the current sitting of the parliament:
1) To pass an emergency motion calling for an immediate moratorium on all police killings, whether encounter killings or killings in Police custody.
2) In that same motion to include a call for setting up of a Royal Commission of Inquiry much like the one set up for Teoh Beng Hock’s case to investigate all these extrajudicial killings of suspected criminals, during the tenure of current IGP Musa Hassan.
3) In that same motion to also call for the prosecution of the police who are responsible for the killings, because it is non prosecution of such police personnel responsible for the killing that results in a continuation of the killing.
4) In the unfortunate event of the Speaker disallowing the motion, to stage a collective walkout from the Parliament.
As we understand, a motion to hold a public inquiry into the shooting was raised by MP for Ipoh Barat YB M. Kula Segaran. Deputy Speaker Datuk Wan Junaidi Tuanku Jaffar ruled the motion met two of the three criteria of being definite and of public importance, but it was not “urgent” as police investigations were ongoing. So, in effect this motion saw no light of day. And the PR lawmakers just left it at that, and did not stage a walkout to emphasise the seriousness of the continuing transgression of the PDRM onto the rights of citizens.
I have the following feedback and comments back to you MPs about this episode of the emergency motion:
1) First, I would like to thank YB Kula Segaran for having raised the motion - however watered down it was.
2) The motion falls way short of what was needed in the circumstance of usurpation of State Power by one arm of the Government. The motion should have been to set up a Royal Commission of Inquiry into the whole saga of Police Killings. Is there not sufficient evidence or enough seriousness in the matter to suggest that. Both the PR lawmakers and the BN lawmakers rushed and set up a Royal Commission of Inquiry for Teoh Beng Hock’s death. (May his soul Rest in Peace.). What you did was right, then. That was needed. Why not the same urgency and same emphasis here.
3) This motion should have been introduced by either YB Anwar Ibrahim the Leader of PR or by YB Lim Kit Siang one of the senior most Parlimentarian and the defacto leader of the DAP or by YB Datuk Seri Abdul Hadi Awang being the leader of the Opposition in Parliament because of the seriousness of the matter. Instead YB Kula Segaran raised it, suggesting the matter is not serious enough to warrant top leadership attention.
4) Further, letting it be raised by YB Kula Segaran only reinforces the paradigm that PR is no different in their approach to dealing with such issues than BN. Why does an Indian MP have to raise this matter? Is it because all the other PR MPs about 65 others - were not available or there were not enough of them? My conclusion is that because those killed were the Indian poor, in the sectarian and class conscious PR mindset, an Indian MP is the right person to take this up.
5) Is summary killing by the Police of citizens, not really a national issue or do you all consider it to be just an ethnic issue, as in this case? It is our opinion that this issue is really a national issue - the usurpation of State power by and the rampage of the PDRM. Only it is showing itself up in this form. So what about “PAS FOR ALL”, What about “ MALAYSIAN MALAYSIA” – is that all just for the votes and do they not really mean anything more? Are you all saying all these killings and the problem of crime are really ethnic issues and not national issues?
6) There is a major divergence between your utterances and your actions in this matter. UMNO always used to and still sends in their Mandores, whenever the issue involved the Indian poor. This had the effect of taking away the true significance of the matter. That suited the UMNO Government well. But DAP and PKR have been saying you are a multiracial party. What does that mean. Having more Indian MPs in your line up, is that it? Is that what you mean? As we understand multiracialism - issues are studied on the basis of the seriousness to the nation as a whole, not on the basis of which ethnic group it afflicts. If you take a step back and do some comparison between these extrajudicial Police killings and the death of Teoh Beng Hock at the MACC, and the way you all have responded in both cases, maybe you will be able to see this episode as we see all of this.
7) Be that as it may, When the motion was disallowed why did the PR lawmakers not stage a walkout? That was a wonderful opportunity to have repaired your eroding position with us, the Rakyat. Yet you all could not see the opportunity there. From where I stand, this gesture comes with very little cost. So, if you fail ultimately to unseat BN, I must say you have to blame it on yourselves and on all these lost opportunities.
As I had mentioned in my previous two letters to all of you who form the the PR coalition, that you need to distinguish yourselves from the UMNO led and bankrupt BN government. But you continue to fail. As far as the marginalized Indians go there is still no difference. Also, I had said that it is time you all provided some leadership to the Indian poor. Here too I must say, there is very little leadership being shown for the Rakyat at the lowest rungs in Malaysian society. Public opinion is now swinging away from PR. The most significant swing has been from the Indian constituency. I understand that 70% of the Indians polled come from the lower rungs of the Indian constituency. That means the most significant swing away from PR has been from the marginalized Indian groups. They were the ones that swung significantly away from the BN in the last general elections and swung to PR.
One thing is for sure, without the Indian poor votes, PR will never make it to the seat of Federal Power. You decide how, serious you are about getting to Putrajaya.

We want you to be there, but not like this.

You have not risen to the challenge on this occasion, I am sorry.
