Life savings gone into sinking homes

Residents of a village are crying foul because the houses they built on a former dumpsite are tilting dangerously.

(Free Malaysia Today) IPOH: Ten families who used their life savings to build their dream homes 15 years ago are now having sleepless nights – their houses are slowing sinking.

Life for these families from Kampung Tersusun Buntong Tiga Tambahan has become a daily nightmare since then.

The distraught residents feel they have been short-changed by the state government into building their houses on a former dumpsite.

The families are former squatters who have been relocated from various squatter areas by the state government to this village which has about 500 houses.

The affected families had invested between RM50,000 and RM80,000 each from their life savings including the Employees Provident Fund (EPF) to build their houses on the land given by the state government.

But to their horror, the families found out that the houses were built on an unstable dumpsite. With the passage of years, their houses began to tilt.

One of the affected residents, E Sutharam, 70, a schoolbus driver, told reporters today that he had withdrawn RM75,000 from his EPF to build his house in 1997. But after two years, he saw cracks appearing on the walls.

Over the years, the foundation of his house started to sink and now his house has tilted to one side.

Fearing for the safety of his family, Sutharam moved out, saying that his house may collapse at any time.

He is also worried that he might lose his job because of his age and wonders how he is going to pay the monthly RM450 for his rented house.

Gas-like odour

Another victim, A Sellahma, 70, took out all her family savings of RM50,000 for her house in 1994.

According to her, the house is now tilting and the back portion has sunk. But she said she does not want to move out to her children’s place because she has invested all her savings in the house.

Residents have also detected gas-like odour emitting from the ground and claimed it is flammable.

Another resident K Subramaniam, 70, also a schoolbus driver, had invested RM80,000 into his now sinking house and feels the state government has short-changed the residents.

All the 10 families had approached the state government in 2003 just before the general election. They also sought the help of former state MIC chief G Rajoo who allegedly promised them alternative houses or government quarters.

But until today, the state government has yet to fulfil its promise of repairing the damaged houses or providing alternative housing.

Meanwhile, DAP Buntong assemblyman A Sivasubramaniam said he highlighted the plight of the residents at the Perak State Legislative Assembly sitting on Aug ,3 last year.

But he claimed the state government was evasive in its reply.

He also alleged that the state government had made election promises in 2004 and 2008 of providing relief to the residents but they were not fulfilled

He added that he would raise the issue again at the next assembly sitting on April 12.

He also suggested that the government could relocate the residents to 27 unoccupied houses in Taman Buntong Ria.

Second Autospy rightly as of right for Malay muslim victim Ahmad Sarbani. But denied and misery for hundreds of such Indian victims under racist bully UMNO regime.

With no hue and cry the Federal Police HQ Deputy CID Director Dato Acyrl Sani under UMNO PM Najib Razak’s orders  as of right a second Post Mortem. For the racist UMNO bully this order is just because the victim is a Malay muslim.

We recall the tip of the iceberg case in 2004 when Francis Udayappan was brutally killed at the Brickfields police station and his body was thrown  into the Klang River.
His body was kept at the University Hospital mortuary for almost 2 years. When released only bits and pieces of his skull a piece of rotten and smelly flesh and bones were handed over (see photos below). In the mean time in this two years imagine the misery of Francis mother Sara lily every day and every night. But when it is a Malay muslim victim as in the instant case rightly the misery ended within the second day with the second post mortem being amicably conducted.
Tens of (now) Hindraf and HRP activists were arrested in public campaigns, scores of police reports lodged. But zero action on police murder despite 7 years now. Even the 98% Malay muslim UMNO racist and bully, High Court and Court of Appeal dismissed Francis’ civil suit without even hearing the Police murder’s defence.
One rule for Malay muslims and the economically powerful Chinese and another rule for the Indian poor.

No Justice for Human Rights Party? In 98% Malay muslim UMNO controlled Judiciary?

The Human Rights Party (HRP) had been granted a date for hearing of its application for Judicial Review for Certiorari and Mandamus vide Civil Suit No: R2-25-67-11 to compel the rightful registration of the Human Rights Party as a political Party. 26 April 2011 has been set as the hearing date for the above mentioned hearing for leave.
The case will be heard in Jalan Duta High Court on 26/4/2011 at 9.00 a.m. The application for leave was filed as the UMNO racist bully Home Minister and their Registrar of Societies refused to register Human Rights Party as a political party despite several applications and letters dated 18/6/09, 25/11/2010, 16/12/11, 17/2/11, and final Letter of Demand dated 14 March 2011 asking the Registrar of Societies to register Human Rights Party as a political party.
We await the day we see Justice for Human Rights Party in the racist bully UMNO Courts.

Teoh Beng Hock & Ahmad Sarbani: State murder victim must be Malay or Chinese to get justice. Indians denied justice under One-Malay-sian sun, zero media coverage & pin drop silence by PKR, DAP, PAS,NGOs & civil society.

Way back in 2003 at the height of police lock up murders at the rate of one such murder in every two weeks and police shoot to kill murders at the rate of one such murder in every week of almost all Malaysian Indians, then Senior Malay Mail reporter Neville Spykerman told me politely (and with no bad intentions) that if there were a few more such police murders in the next few weeks it would then take a national dimension with the public outcry and the media reporting the same and perhaps these deaths in police custody and by police shooting would come to an end.

Note: Public outcry by Malay-sian standards means protest and public statements by the 90% majoritarian Malay muslim and Chinese, PKR, DAP, PAS, NGOs’, Bar Council, “Malaysian civil society and the mainstream print and electronic media and alternative medias wide coverage of the same.

I replied that I begged to disagree. I also replied that he (Neville) would be right if it was a few more Malays or Chinese who were similarly killed in a short space of time.

As I anticipated the state police sponsored killings and murders went on unabated and with impunity as it was “merely” the Indian poor who were the victims.

Even the 25th November 2007 Hindraf Rally and my subsequent detention without trial under the ISA did not really make the difference.

The real difference started with Teoh Beng Hock and now Ahmad Sarbani Mohamad as they were (rightly) given the widest possible mainstream print and electronic media coverage’s the alternative media also carrying the public protests and immediate and urgent public statements by the top leaders of PKR, DAP, PAS, NGOs’ Bar Council, “Malaysian civil society”.

In the case of Ahmad Sarbani Mohamaed  at least the local dailies and alternative media carried the following  top headlines if not front page news including the three Tamil dailies are as follows:

And in the next few days many more PKR, DAP, PAS leaders, and especially Indian elite in the blogs, etc will rightly be howling for justice for the family of Sarbani Mohamed. They will all be outraged and stand up for the rights of the Chinese and Malay killed. No howling for Indian deaths.

We commend PKR, DAP, PAS, Bar Council, NGO’s the police and  the Malaysian civil society.

But on the very same day Teoh Beng Hock was killed at the MACC HQ, P. Gunasegaran was brutally killed at the Sentul Police station. But all of the aforesaid PKR, DAP, PAS, Perkasa, Bar Council, NGOs’,
Malaysian civil society mainstream print and electronic media coverage, the alternative media etc did not broadcast/speak up for justice for P. Gunasegaran simply because  Gunasegaran was a Malaysian Indian. In fact One malay-sia has never heard of P. Gunasegaran again because he was “merely an Indian” and they want to be “politically correct, play to the 90% Malay muslim natives and Chinese gallery or fear losing the 60% malay muslim voters.

If P. Gunasegaran had been killed in a police lock up in London or L.A being a soft target and vulnerable minority the white Christian 90% majority community and their media would have bend backwards to condemn, speak up and champion for Justice for P. Gunasegaran.

This is the reality “Malaysian civil society” as opposed to the Western Civil Society.
P. Gunasegaran’s case is only the tip of the iceberg.

Hundreds if not thousands of other Indians have been similarly killed by the Malay-sian state sponsored police force. But it never mattered to the Malay-sian civil society, including the Malaysian Indian elite, the usual howlers if Malay and Chinese rights are questioned! These are the ultimate jokers in the country.

But when we point out this level of Malay-sian racism both by commission and by omission we instead are accused of being racist by no less than the Opposition Leader Anwar Ibrahim, that it is Hindraf & HRP that is racist, a bizarre definition which exists in no other part of the world except by “civil society”, masyarakat madani Malaysia and the Opposition Leader who hiself has been accused of sodomy and adultery.

Hindu Temple to Goddess Faces Imminent Destruction in Pakistan

Washington, D.C. (March 13, 2011) - A historic and ancient temple of Durga Mata, dedicated to the Hindu Goddess, is facing imminent destruction in the Tharparkar district of Pakistan’s Sindh province. The temple, between 2,000 to 2,500 years old, is endangered by newly started quarrying for granite at the base of the hill on which the temple stands.

Hindus lodged a complaint to halt the work, but the Sindh government, ignoring their request, issued an official lease to the contractor of the quarry to continue. The temple may be destroyed within a month if the quarrying for granite continues, experts claim.

"Our 2010 Hindu Human Rights report again highlights the woeful condition of Hindus and Hindu places of worship in Pakistan,” said Prof. Ramesh Rao, Hindu American Foundation’s Human Rights Coordinator. “While the bulk of international opprobrium against Pakistan is concentrated on its machinations in Afghanistan and India’s state of Kashmir, the ongoing human rights crisis ongoing within its own borders involving the Hindu minority are too often overlooked. It is incumbent upon the U.S. to predicate its military aid to Pakistan on improvements in the country’s atrocious human rights record.”

Some 200,000 pilgrims visited the Durga Mata temple during the recent holy festival of Shivratri. The pilgrims protested the destruction and urged the government to stop the work. The work was halted during the festival but has resumed again. Pakistan’s media, both print and television, have thus far failed to publicize the Hindu complaints, and spokespersons for this fast shrinking and neglected minority feel that Hindus are increasingly alienated in Pakistan.

HRP goes to court on registration

Racist bully UMNO AG Gani Patail and Malaysian Court not ready with Witness List but fixes speedy hearing date to fix up 21 Hindraf activists and disqualify them from contesting in forthcoming General Elections.

This morning 6/4/11, at the trial of the Hindraf 21 we saw how the KL Magistrate Zulkapli bin Abdullah as does almost all other Magistrates, Sessions Court Judges, ie., they all literally look to the DPP or Federal Counsel for ‘directions’ and for Hindraf lawyer P. Uthayakumar the Attorney general Tan Sri Gani Patail himself for “directions” and then make their decisions accordingly.

In P. Uthayakumar’s Sedition charge in the immediate aftermath of the 25th November 2007 Hindraf Rally with the personal presence of the AG Gani Patail himself the K.L sessions Court imposed bail  of RM 50,000 ie ten times the maximum fine of RM 5,000 plus his passport being impounded..

And today morning the Magistrate looked at the junior just out of college but wielding almost absolute DPP powers. When this DPP told the Magistrate that she had “arahan” (instructions) not to serve the documents on the lawyer  but on the 21 accused directly the Magistrate delivered and executed AG Gani Patail’s “directions”. Incredible!

This is just the tip of the iceberg on almost all Court proceedings especially against the UMNO government this is the Order of the day or how justice it has evolved today after 54 years of Independence.

HRP sues for registration

ROS was bowing to Umno and BN when it refused its approval, says Uthayakumar

PETALING JAYA: The Human Rights Party (HRP) is seeking a court order compelling the government to register it as a political party within seven days.

In a suit he filed at the Kuala Lumpur High Court today, the party’s pro-tem secretary-general, P Uthayakumar, also asked the court to set aside the Registrar of Societies’ dismissal of his application to form HRP.

He named Home Minister Hishammuddin Hussein, the Registrar of Societies (ROS) and the Federal Territories ROS as respondents.

HRP has been trying to get ROS approval for more than three years. It submitted applications for registration in 2009, 2010, 2011 and last March 14. All were dismissed.

Uthayakumar claimed that the respondents, in ensuring the failure of HRP’s bid for registration, acted in bad faith and at the behest of Umno and Barisan Nasional. He alleged that Umno and BN were trying to hamper HRP’s effort to improve the lot of poor Malaysian Indians.

He also accused the respondents of “selective approval”, citing the speedy registration of Kita and Perkasa.

A member of HRP’s pro-tem central committee, S Thiagarajan, said he was optimistic about the outcome of Uthayakumar’s suit.

Once the party was registered, he added, his group would apply for the registration of Hindraf Makkal Sakti (HMS) as a non-governmental organisation.

In a related development, a court here has postponed the trial of 21 HMS activists accused of participating in last February’s rally against the novel Interlok, which critics say contain inaccurate and derogatory remarks about Malaysian Indians.

Thiagarajan told FMT that the Kuala Lumpur Magistrate’s Court had postponed the trial to July 25 and 26.

“The deputy public prosecutor asked for a postponement because they were not prepared with documented evidence,” he said.

It was these Indian poor who stood by the four Hindraf lawyers  right up to the end. Lest we will still be languishing in the ISA prison.

Ipoh Hindraf 6: Racist UMNO is World’s only regime to have ever prosecuted it’s citizens for merely being a member of a Human Rights NGO, other than the absolute monarchy Saudi Arabia.

Case documents from the DPP’s office which should be submitted to us before proceeding with that case must be investigated first before charging in the court but this is UMNO’s court anything can be done. Malay-sia – Semua boleh.

Subramaniam reporting from Ipoh magistrates Court 10.45 a.m. As the prosecution were no ready with their documents this case was adjourned to 5/5/2011 as the next Mention date.

Note:  Never in any part of the world has any human being a member of a Human Rights NGO except in Absolute Monarchy Saudi Arabia.  But this has  happened in One Malay-sia. To this effect Malay-sia has created history in being the first democratic country in the world to have ever prosecuted it’s citizen for merely being a member of a Human Rights NGO.
