Racist UMNO National Heart Institute (IJN) denies admission to Indian poor suffering near heart attack. Ambulance turned away. Police Report by Hindraf Makkal Sakthi National Secretary P. Ramesh
Mr TinagaranYesterday evening (28/4/2011), we had been informed by the family of Mr. Thinagaran a/l Somasundram (IC 461105-01-5519) that at about 5pm Mr. Thinagaran had suffered severe heart pain and was rushed to Ipoh General Hospital. The Ipoh G.H physician urgently put Thinagaran onto an ambulance and rushed him to National Heart Institute (IJN) K.L.However the admission medical doctors refused to admit and treat Thinagaran on the false excuse of he not being a Malaysian citizen, packed him off and send him back to Ipoh by the very same ambulance.
We have today been advised by our Specialist doctor friend that Thinagaran’s conditions is critical and warrants urgent admission and treatment at IJN
This is yet another height of UMNO’s racism raring its ugly head in PM Najib Razak’s 1 Malay-sia. We have been told by Thinagaran a/l Somasundram that this was simply because of the racist UMNOs’ National Registration Department denying Thinagaran his innate right to Malaysian Identity card and citizenship despite he being the 4th generation Malaysian born ethnic Indian. The irony is both his parents Somasundram and Meenachi and all his 7 siblings Vijayaletchimy, Thiagarajan, Nadarajan and Salavathy etc are all Malaysian citizens with valid Malaysian Identity Cards and citizenship.
Should anything happen to Thinagaran by reason of this UMNO’s state sponsored racism and implementation of the BTN lead racist practices and policies we will hold responsible the 1 Malay-sian Prime Minister Najib Razak, Home Minister Hishammudin who directly denied his innate citizenship and the Director of IJN Tan Sri Dato Seri Dr Robaayaah binti Zambahari who had denied Thinagaran admission into IJN.
This case is just the tip of the iceberg as we are informed that tens of thousands of cases have been denied medical treatment at IJN and the tens of General Hospitals Health and Institutions Nationwide on racist excuses like this.
We hereby call upon the aforesaid IJN Director to forthwith and in any event by 12.00p.m today admit Thinagaran at IJN for treatment.

Cruel & Racist PKR, DAP & PAS S’gor like UMNO tears down disabled poor Indian woman’s fruit stall.

The council says all the stalls along Jalan Teratai, Meru, will be demolished.

KLANG: The Klang City Council (MPK) bulldozed a disabled woman’s fruit stall and refused to tell her why it was done.

P Banu, 35, who runs a fruit stall business with her husband in Jalan Teratai, Meru, for the last seven years, said last week a group of MPK enforcement officers came to the stall and asked her to pack up her goods as they were going to tear down the stall.

“When I asked why, they just smiled at me and started the bulldozer. I could not stop them as I am disabled.”
Banu said that she tried to get a licence from MPK but was told she had to register the fruit business with the authorities.

According to her, the MPK wants to clear the land after getting numerous complaints from residents at Taman Daya Maju, Meru.

She added that MPK was selective in tearing down the stalls. A few stalls owned by people from a different race were not touched.

A restaurant and retail store operating from houses without licences were also left untouched.

Said Banu: “I am disabled; what else can I do to make a living? I have two children in primary school.”

She said although she received RM200 from the Welfare Department, it was only enough for school expenses.

A MPK councillor, K Deepakaran, denied that the council was practising double standard, saying that MPK will demolish all the stalls along Jalan Teratai.

“The rest of the stalls have been given eviction notices and will be demolished in the next 14 days,” he said.

Hindraf moves to get charge against 54 dropped

Named as defendants in the civil suit to be filed next month include PM Najib, AG Gani Patail and IGP Ismail Omar.

GEORGE TOWN: Hindraf Makkal Sakti will file a suit at the KL Hight Court next month to strike off a charge against 54 of its activists of ‘being members of an illegal society’.

It is seeking to obtain a declaration that the charge is ultra vires of Article 10(1)(c) of the Federal Constitution, which allows freedom of association.

Prime Minister Najib Tun Razak, Home Minister Hishammuddin Hussein, Attorney-General Abdul Gani Patail and IGP Ismail Omar are to be named as defendants in the civil suit.

Hindraf legal advisor P Uthayakumar said the suit would also cite other constitutional grounds such as equality before the law to declare the charge as “null and void.”

“The charge against so many of us is obviously a government attempt to foil our cause to champion minority rights in the country.

“But we won’t be cowed by such criminal intimidation. We will fight on,” said Uthayakumar.

Hindraf national secretary P Ramesh and Human Rights Party (HRP) pro-tem information chief S Jayathas, were among those charged after a crackdown in March.

The charge was under the Societies Act 1966. Hindraf has thus far spent about RM111,000 to bail out all the activists pending hearing.

Nationwide fundraisers

The movement was declared an illegal organisation by the home ministry in late 2008. However, the government has no court declaration to this effect.

Dublin-based human rights movement, the International Foundation for the Protection of Human Rights Defenders or Frontline, stated that Malaysia had created a world record in being the first and only democracy to charge 54 human rights activists from a single organisation for the same allegation within the same period.

Apart from the absolute monarchy of Saudi Arabia, Frontline said that Malaysia is the only country in the world to have charged so many citizens for being members of a NGO.

The activists were charged following an aborted anti-racism march on Feb 20.

Meanwhile, Hindraf / HRP will organise a nationwide roadshow starting tomorrow in Parit Buntar to raise funds for the movements and finance the legal costs of the charged activists.

Tomorrow’s fundraiser in Parit Buntar will be followed in Ipoh, Kluang, Cameron Highlands, Sitiawan and Hutan Melintang.

“More fund raising dinners will be arranged soon to finance our rising costs,” said Uthayakumar, who is also HRP protem secretary-general.

Solution sought to resolve high price for maids

NUSAJAYA: The Human Resources Ministry will try and find a solution to high agency fees for Indonesian maids, said Minister Datuk Dr S. Subramaniam.

He said reducing the agency fees would be among the topics to be discussed before the country signs an MoU with Indonesia next month.

“We are still discussing the matter (agency fees),” he said, adding that monthly wages for maids would still be dependent on the market rate.

Dr Subramaniam was speaking to reporters after opening the National World Safety and Health Day at the Work Place event at the Malborough College site here yesterday.
 

He said the Government was flexible about hiring maids from regional countries.

“Malaysians can hire maids from Sri Lanka, India, Myanmar, Cambodia or the Philippines but the main problem is to get them to come here,” he said.

He noted that the country had many Indonesian and Cambodian maids but there were only a small number from other countries.

“Phillipines maids demand high salaries which most Malaysians are not willing to pay.

“Women from other countries such as Sri Lanka and India, however, prefer not to leave their countries to work and therefore there are only a few of them here,” he said, adding that it was a matter of demand and supply.

Indian students taunted ‘Keling Pariah’, hauled to police station (CPI)
SHAH ALAM: The parent of a secondary student expressed his disappointment with the principal who had allowed a racially tinged quarrel between schoolboys to get out of hand.
Stephen Perumal Velu (left) said the problem ensued [on the morning of April 20] after a group of students had taunted the Indian boys with harsh and insulting words. He told the reporter when met at the school that he received a call from his son around 10.30am and had immediately rushed there.
Stephen, who is a former committee member of the Parents-Teacher Association (PTA), said, “I asked the principal why quarrels between students of different races have been happening so often of late but I was not given a satisfactory answer as she only blamed the Indian students.”
Stephen claimed that his son had recounted that the Malay students denigrated the Indian students by calling them ‘Keling Pariah’.
At about 11am, a few police officers and parents were already gathered at the school front gate after being informed of the occurrence. Stephen said the principal handed over 26 students to be taken to the police station for questioning. It is reported that altogether 23 Indian and three Malay students had their statements recorded.
“I’m very disappointed that my son and other students were taken to the police station when the real culprits who started the quarrel were let off the hook,” said Stephen.
According to him, a school prefect had given the police a list of names of the students who were involved in the quarrel but these were not called up for investigation.
An attempt by Free Malaysia Today to get the principal’s comments was unsuccessful.

SHAH ALAM: The parents of a group of students who were taken to the Section 15 police station to give their statements on April 20 have still not received any clarification from the school principal, said their representative Stephen Perumal Velu.
“We read a Bernama report that Assistant Commissioner of Police (Shah Alam) Zahedi Ayob had said that the case is reverted to the school authorities because the incident occurred within the school premises”.
The report also quoted a source in the Selangor Education Department as saying, “the case is considered closed and the matter handed over to school to be resolved” and “the school administrators have informed [the department on the next day] that the parents of the students have been called for a discussion”.
According to Stephen, what the school said is untrue as the parents were never called. “In fact, we went to the school on our own accord on April 21 and were disappointed with the attitude of the principal who washed her hands of the matter and tried to blame the police for hauling our children to the station”.
“Not only had she neglected to inform us, she furthermore gave the excuse that the school did not have our contact details,” said Stephen when telephoned by the FMT reporter.
Stephen said several parent were with him at the station on April 20 when the 23 students had their photographs taken and IC photostated by the police. He added that the students were traumatized by the experience, and he also feared that a stigma will be attached to them because they were treated like criminals by the principal.

SHAH ALAM: About 50 parents assembled outside a secondary school in Section 25 here to protest the behaviour of the principal who denies that she had instructed 23 students to be detained by police.
Spokesman for the group Stephen Perumal Velu said that by right the police could not detain their children without express permission from the principal.
The gathering to demand the principal’s transfer lasted 20 minutes and ended upon negotiation with the police.
Former PTA chairman A. Sivaprakasam who resigned his post last month told FMT that the discipline problem in the school had gotten worse.
He said a number of teachers were also dissatisfied with the principal. “She’s a dictator”. Several calls by FMT to reach Megawati Hasbullah [the principal] were not answered.

Friends of Hindraf in Geneva, Switzerland contributes RM 3,000 to HRP


This sum was forwarded to our HQ in Bangsar yesterday evening (25/4/11) and has accordingly been banked in to the HRP bank account.

According to Mr. Bala of Geneva, this money was collected after a luncheon meeting of local native Swiss at Geneva who were moved to make a contribution as Geneva is the world centre for the protection and preservation of Human Rights.

More important than this cash contribution is the creation of awareness in Geneva on the gross UMNO racism targeted against the Malaysian Indian poor.

This morning P. Uthayakumar represented himself as the Applicant at the Kuala Lumpur High Court before Yang Arif Dato Rohana binti Yusof in the civil suit for a Writ of Certiorari and Mandamus to compel the Registration of the Human Rights Party (HRP) as a legal political party in Prime Minister Najib Razak’s One Malay-sia.


Before the said Court Judge the following submissions:-

1.    Technically HRP has been denied legal registration as a political party for twelve (12) years now beginning from the 2000 when P. Uthayakumar had submitted the Registration of Parti Reformasi Insan Malaysia (PRIM).

2.    Thereafter on 18/6/2009 we had written in to the Registrar of Societies for the approval of HRP as  political party but the Registrar of Societies RO has refused to reply.

3.    On 25/11/2011 we submitted the full application forms as was required by the ROS but again they refuse to approve HRP.

IMG_61304.    Three letters of demand to ROS dated 17/12/10, 17/2/2011 and 14/3/2011 were refused to be replied despite we saying we will go to Court. This is the UMNO ROS’ above the law mindset.

5.    And this morning even the (mighty almost absolute power wielding Attorney General Tan Sri Gani Patail’s) Federal Counsel “Tuan” Noor Hisham bin Ismail, the Head of the Construction and Administration Unit at Putrajaya refused to attend Court despite having been served the cause papers on 204/2011.

6.    Another Federal Counsel Puan Aidha binti Abu Bakar who happened to be in court  on another matter made frantic  phone calls to the “Tuan”. (The Malay muslim Court Interpreter “helped” by pushing our case to the last case).

press 27.    Suddenly Puan Aida not the Senior federal counsel in conduct of this case barged into the Judge’s Chambers panting away and informed (lied to) the Court that as they had not received some of the documents she is asking for another date.

8.    When Uthayakumar asked what document was not served on the A.G’s Chambers she had no reply.

9.    P. Uthayakumar further submitted that if at all they had not received some of the documents (which is denied as they had acknowledged with their rubber stamp having received all the cause papers) they should have written in to us which they have not.

10. And in any even the “Tuan” should have been present in Court to explain to Court.

11. And that this is a Court of law………………

12. Uthayakumar had further submitted to Court that this is an ex parte (one party) application according to Order 53 (3) (2) of the Rules of the High Court and that according to the Order 53 (3) (3) it only require us to serve and notify the A.G’s Chambers which we have done.

13. And that once leave is granted the AG can contest the same at the inter parte (both parties stage) if he wants to.

Be that as it may the Judge, a Malay-sian Judge as usual looked to the Federal Counsel for “directions” and adjourned the matter to the 6th May 2011.

IMG_6128“Justice must not only be done but must manifestedly and undoubtedly be seen to be done! This is at least what we studied at first year  law school. But which will be seen at the final verdict as to whether HRP would be registered as a political party when no other political party has had it’s registration rejected ever before and that the record stands that there are 21 registered political parties in One Malay-sia, with the tallest pro UMNO/BN MMSP and KLIA getting their registration approved within 2 weeks and one month respectively by the One Malay-sian Prime Minister Najib Razak and his Home Minister Kerismuddin.

UMNO does not want a legal HRP as they do not want us to champion or speak up against the very serious acts of UMNO racism and gross violations of human rights targeted against the Indian poor on a day to day basis and which is documented and reported on a day to day basis in www.humanrightspartymalaysia.com

This morning, HRP & Hindraf’s P. Uthayakumar, S. Thiagarajan, C. F Mani, Manimaran, Magen, etc were at Kg Muniandy to stop the “ethnically cleansing” of Kg Muniandy, the last tin mining Indian village in Selangor.
53 years of oppression under the UMNO led Selangor State government and now over 3 years of PKR, DAP and PAS rule.

Irate residents shoo away minister’s aide

Residents tick off Donald Lim's aide, saying that they don't want leaders who seek publicity from their suffering.

PETALING JAYA: Residents of PJS 1 here gave Deputy Finance Minister Donald Lim’s aide the cold shoulder when he turned up at their protest.

When Kevin Chong arrived around 10.30am, the residents told him off, saying they do not welcome the representatives of leaders who wanted to seek publicity from their suffering.

“When we highlighted the problem to Lim earlier, he told us to deal with the Pakatan Rakyat state government. Why are you here now?

“If you want to help, then bring the developer (Peter Brickwords Sdn Bhd) here,” said the residents.

Earlier, some 50 residents staged a peaceful protest urging Peter Brickworks to fulfil their demands before trying to evict them.

The developer had issued eviction notices to two families residing in the area early this month, which expired today.

However, Block E residents action committee chairman M Sugumaran had obtained an interim injunction against the developer and the court had fixed April 27 for the hearing.

“We held a meeting with the Petaling Jaya City Hall and the developer’s lawyers last Friday. The developer agreed to retract the eviction notices pending discussion,” said Sugumaran.

Calling on the developer to build their low-cost houses as promised seven years ago, he reminded the state government of its pledge that there would be no forced eviction in the state.


“We want a written guarantee that our demands will be met,” he said.

The residents, who were formerly from Kampung Pinang, Kampung Petaling Tin and Kampung Muniandy, moved to the current place after being promised a low-cost flat in 2003.

However, the developer failed to build the flats citing an injuction obtained by the residents on the proposed site for the project.

Hindraf Makkal Sakthi pro-tem secretary-general P Uthayakumar, who was present, criticised the state government for ignoring the plight of the residents for three years.

“Where is the change you promised? Pakatan claims that Selangor is a welfare state but I do not see any changes in the way it does things.

“If the developer fails to fulfil its promise, then the state government should intervne and build the houses for the residents,” he said.

Hope yet for Borneo people

International agencies, including the UN, are now more aware of the the plight of the natives in the island.

GENEVA: The people of Borneo can rest assured that they are not neglected by the international community. Their woes have been heard by the various United Nation agencies and international organisations.

Secretary-general of Common Interest Group Malaysia or CigMa, Kanul Gindol, told FMT in Geneva that dialogues with European leaders and the UN Commission for Human Rights (UNCHR) have been fruitful.

“They certainly are listening to our reports and had promised more dealings not only with our governments but also with the people and civil societies, both local and from abroad, who are working to improve the life of the people of Borneo,” Gindol said after meeting with the UNCHR rapporteurs here.

Gindol said the international community had not “abandoned” the 19 million people of Borneo, more than half of whom are allegedly living in impoverished conditions.

“Leading parliamentarians in The Hague and Brussels told us that they are now more aware of what is going on in Borneo including in Sabah and Sarawak. In fact, a delegation of EU met the Sabah state government officials only a few weeks ago in Kota Kinabalu.

The UNCHR was represented in the dialogue by rapporteurs and officers from its various sections, including the human rights section; the economic, social and cultural rights section; the religious rights section; and the indigenous peoples and minorities section.

CigMa president, Daniel John Jambun, presented his paper “Disenfranchisement of bona fide Sabahans”, the same paper he had presented in earlier meetings in The Hague, Holland, and Brussels in Belgium.

Hindraf leader, P Waythamoorthy, also made a presentation on the condition of Indian community in Peninsular Malaysia.

Brown, who operates the Sarawak Report blog and also the London-based Radio Free Sarawak, highlighted how political manipulation of the simple-minded natives in Sarawak had contributed to the triumph of the ruling Barisan Nasional (BN) in the recent Sarawak election.

20 bully policemen pounced on Hindraf Secretary P. Ramesh who was standing peacefully outside the Perak symbol of democracy ie the Perak state Assembly.
The racist Malay muslim policemen literally rounded him up, blocked the press, video and photographers, pushed him down to the ground, hit his head and lower back with police batons. It was a free for all.
Any and every policemen including Indian mandores DSP Glenn and ASP Rajendran were spotted on video kicking P. Ramesh from the back. Such cowards.
And for doing all of this finishing up Hindraf under Ops Padam Hindraf and “ethnically cleansing” the Indian poor Datuk Khalid will be rewarded with a Tan Sri ship within a few years when he retires.

Saravanan is a total bystander who met up with Vinodkumar and Vijayakumar way after the said accident. After which Vinodkumar and Vijayakumar who sustained injuries and their motorcycle was damaged on being knocked down by Sheikh Ahmad Ali. The boys as is usually practiced had negotiated a payment to settle this matter. But Sheikh Ahmad Ali had lodged a police report which was with such haste termed “Kes Samun” (Robbery) by the racist UMNO police. Despite Sheikh Ahmad Ali within hours lodging a police report withdrawing his complaint the police still refuse to release them and have remanded them for seven (7) days – for a mere civil case.

If it was a Malay, Chinese, Orang Asli, Kadazan or Iban the racist Polis Raja Di Malaysia would treat it as a civil case and/or “Refer to Magistrate” and close the case. But when it is Indian youths a civil case automatically becomes a very serious “kes samun” and Robbery etc.

All this possible in 1 Malay-sia 1 Bumi and 1 Melayu

Every day hundreds of innocent Indian youths nationwide are being racially profiled and targeted for victimization by the racist UMNO Attorney General Tan Sri Gani Patail and Polis Raja Di Malay-sia and aided and abetted by their nasty Indian police mandores.

Imagine the misery, heart ache and heart sick their mothers, wives and family have to go through. And not being able to afford a lawyer and bail tens of thousands of these innocent Indian youths languish in jails and prisons. And when they come out of prison, they become the real criminals having learnt the “trade” from the real and hardcore prisoners in jail. And only to serve longer jail sentences thereafter if not shot dead by the racist Polis Raja Di Malaysia.

Dear Sirs, 
Re: Unfair Seven (7) day Remand of three sickly Indian youths arising from a were civil matter Road Traffic Accident and especially so when complainant has withdrawn the complaint via a police report.
We act for Vinodkumar a/l Nagendran (NRIC- 910509-14-6575), Saravanan a/l Rajadran (NRIC-900526-08-6229) and Vijayakumar a/l Rajadran( NRIC-910509-08-5549) of No. 3-1, Jalan 8C/6, Taman Setapak Indah, 53000 Kuala Lumpur.
With reference to the above mentioned matter, our clients had been arrested by police personnel from Setapak Police Station (L/KPL 147672 and 158586) at about 12.30 am on 19/4/2011 acting on a Police Report (Stp/4944/11) made against them.
Following are the brief facts of their arrest:
a) On the midnight of 18/4/2004 our clients namely Mr. Vinodkumar and Saravanan were riding their motorcycle along Jalan Air Panas, Setapak.
b) Their motorcycle was knocked down by a car driven by the Complainant Sheikh Ahmad Ali.
c) As a result of this collision Mr. Vinodkumar had injured his hand and damage was also caused to his motorcycle.
d) Our clients as is the practice and with the view to an amicable settlement asked for monetary compensation from the complainant who had voluntarily agreed to the same
e) The complainant had informed our clients that he needed to withdraw money from a nearby ATM Machine and in return handed over his hand phone voluntarily to our clients before leaving to the bank.
f) However our clients believe the complainant had gone to the Setapak Police Station and lodged a false report against our clients alleging that he has been robbed by our clients.
g) Then the Police arrived at the Air Biru Field at Air Panas, Setapak Kuala Lumpur and arrested our clients together one with Mr.Vijaykumar who happened to with Vinodkumar & Saravanan at that time but is not connected to the case at all. Why is this so?
However, the complainant had on the very same day on 19/4/2011 withdrawn the police report lodged against our clients and wanted this civil matter to be settled outside court via his police Report dated 19/4/2011. A copy of the Police Report is enclosed herewith for your reference.
Despite the fact that the complainant had withdraw the false report made against our clients and clearly having identified that Mr.Vijayakumar is not connected in this case at all but all three of them are as of date still being unfairly detained .
Our clients have been denied their right to a phone call and their parents have been denied the right to meet their children despite the fact that Mr. Vinodkumar is an asthmatic patient since one years old and Mr. Vijaykumar is suffering from fits since 12 years of age and need proper medication. We had advised our clients’ parents to lodge a police report to ensure the safety of our clients. A copy of their Police Reports are enclosed herewith for your reference.
We have made some twenty or so phone calls to the police headquarters in Bukit Aman, SIO, I.O and the Jinjang Police Station but as usual to no avail.
Therefore with all due respect to your goodselves, we humbly request the release of all our clients forthwith and in any event by 5.00 p.m today (22/4/2011). And if there is evidence of a crime they can always be prosecuted thereafter. This is especially so because the complainant has already voluntarily withdrawn his police report and wants this civil matter to be settled outside Court. Our clients have been already detained for four days of police investigations and it is not fair to detain them for another three days until Monday and/ or anytime thereafter.
