Obsolete Interlok Book should be replaced with 25th Nov 2007 Hindraf Rally Book to reflect current realities on causes and effect of UMNO racism and religious extremism on Indian poor.

Article 10 provides for freedom of expression and the author of Interlok is entitled to his literary works.

But making the UMNO racist and religious supremacist Interlok Book as a compulsory book in order to pass SPM is another matter altogether;  it is mischievous, degressive and an attempt to continue suppressing, oppressing and depressing the Indian poor in One Malay-sia.

What is the motive of the Education Ministry in compelling our students to study about the degressive thoughts of the author?

We hereby propose that Interlok is forthwith replaced by the 400 page “25th November 2007 Hindraf Rally” by P. Uthayakumar which outlines the current very serious problems faced by the Malaysian Indian poor by being excluded and segregated from the National mainstream development of Malay-sia under the UMNO regime’s racist and religious supremacist policies.

Unlike Interlok, 25th November 2007 is progressive in having identified UMNO racism and religious supremacy policies of excluding and segregating the Indian poor from the national mainstream development of Malay-sia, equal rights and in particular equal job, educational, scholarship, licences and business opportunities as the way forward and progressive.

Talking about the Interlok the Indian poor may actually have been better off 150 to 200 years ago when they were brought into Malaya.

At least they had an attap hut in their villages in India to sell or mortagage to raise money top come to Malaysia (see page 210). And upon arriving in Malaya they were free to sell kacang putih, ice water, mee (goring) rice (food) or the kandar tea. Many could save enough to even set up a food shop in India when they finally returned home. But in One Malay-sia today an Indian poor unlike a Malay muslim poor is excluded and segregated from setting up a kacang putih, ice water, mee goreng food or a tea stall.
Even when they have attempted, their stalls are demolished within months if not within weeks.

Because of the UMNO racist and religious supremacist policies, the Indian poor cannot even afford to pay RM 124 being their monthly rentals and end up 20 including a one month old baby living in one small government low cost flats, if not made homeless and having to sleep on the streets.

And their can they go back to India as an estimated 450,000 Malay-sian Indian poor have been rendered stateless when they have even been denied their innate Birth Certificates and Identity Cards. This level of racist and religious extremist atrocities does not happen in any other part of the world. (see Malaysian Indian Minority & Human Rights Violations Annual Report 2010).

In conclusion replace this Interlok book with 25th November 2007 Hindraf Rally Book as the compulsory book for all Form 5 students as the very least attempt to undo the injustices the these Indian poor.

BJP to push for caucus on Malaysian Indians – FMT

Activist Uthayakumar is pleased with the results of his New Delhi meeting with senior officials of the Indian opposition party.

GEORGE TOWN: A senior MP in India has promised to pursue the idea of forming a parliamentary caucus to fight for the rights of Malaysian Indians, according to human rights lawyer P Uthayakumar.

He said Avinash Rai Khanna, who heads the Barathiya Janata Party (BJP) in Punjab, would confer on the matter with BJP supremo Lal Krishna Advani and parliamentary opposition leader Sushma Suvaraj.

Uthayakumar and several other delegates from Hindraf Makkal Sakthi and the Malaysian Human Rights Party (HRP) were in New Delhi recently to attend a conference on the Indian diaspora.

They had a meeting last Monday with Avinash and other BJP officials at that party’s headquarters in the Indian capital.

“It was a major breakthrough in our efforts to form the caucus,” he told FMT today.

“BJP officials were shell shocked to learn of the level of atrocities befalling the Malaysian Indian poor.”

They had thought of Malaysia only as a “prosperous and fair country with the world’s tallest twin towers”, he added.

Avinash was one of nine senior BJP officials at the meeting. Among the others were the party’s Kashmir chief, Dr Nirmal Singh, secretary-general Vijay Goel and supreme court judge Sudhir Aggarwal.

Aggarwal heads BJP’s human rights cell, of which Avinash is a member The meeting was facilitated by Vivek Goyal, a senior lawyer and Hindraf sympathiser.

Human rights violations

“The caucus would be an important group to lobby the New Delhi administration to pressure its Malaysian counterpart to address and resolve the Indian predicament,” Uthayakumar said.

“Hindraf-HRP and the caucus will be a thorn in the flesh in New Delhi-Putrajaya ties until the plight of Malaysian Indians has been addressed.

“The caucus aside, Avinash nonetheless will raise the question of serious human rights violations against poor Malaysian Indians by the Umno-led Putrajaya administration.”

He said Avinash had promised to speak up on such Malaysian Indian problems as statelessness, forced conversion to Islam and discrimination in employment and education.

At Monday’s meeting, Uthayakumar briefed the BJP officials on the contents of the Hindraf-HRP report on Malaysian Indian Minority and Human Rights Violations for the year 2010.

The report noted that the first batch of students under the Universiti Sains Malaysia international medical programme commenced classes last September in Jawaharlal Nehru Medical College in Belgaum, Karnataka, India. Of the 74 students in the programme, only one is Indian. She is Abilasha Nair of Johor.

Uthayakumar said he also told the BJP officials that the 15 ethnic Indian MPs in Malaysia were all political mandores playing to the dominant Malay-Chinese gallery.

New Delhi Indian Parliamentary Caucas on Malaysian Indians (IPCMI) on the cards.

On 10/1/11 a breakthrough meeting was held between the 8 member HRP/Hindraf delegation led by P. Uthayakumar and Mr. Avinash Rai Khanna, BJP Senior Member of Parliament (MPCRS) and Punjab BJP Chief who is also a lawyer at the BJP Human Rights Cell at the BJP Headquarters at No. 11 Asoka Road, New Delhi.

Also present at the one and a half hour meeting was Dr. Nirmal Singh the BJP Chief for Kashmir, Mr. Sudhir Aggarwal the BJP Human Rights Cell Chief and Supreme Court of Indian Advocate and finally joined in by Mr. Vijay Goel the Secretary General of BJP and four other Senior BJP officials.

This meeting was facilitated by Mr. Vivek Goyal, Additional Advocate, Punjab and Advocate, Supreme Court of Indian and a Hindraf sympathizer.

P. Uthayakumar began by briefing the BJP party on the Malaysian Indian Minority & Human Rights Violations Annual Report 2010. The BJP party were shocked at the level of atrocities befalling on the Malaysian Indian poor as they have otherwise only known of Malaysia as a prosperous and fair country with the world’s tallest Twin Towers.

M.P. Mr. Avinash said that he is agreeable in principle to our proposed IPCMI but would have to confer with Lok Sabha Parliamentary Opposition Leader Madam Sushma Suvaraj BJP Supremo Lal Krishna Advani and the BJP Leader in charge of the External Cell.

In the interim Mr. Avinash had agreed to raise the serious Human Rights violations against the poor Malaysian Indians in particular on the 450,000 4th, 5th and 6th generation poor Malaysian Indians made stateless, forced conversions to Islam, Malaysian Indians denied upward mobility opportunities, government scholarships. We also pointed the exported UMNO racism and religious extremism to Indian soil ie medical seats in 14 medical colleges in India for almost all malay muslim Mara and JPA scholarships. For example P. Uthayakumar pointed out that at page 56 of the Malaysian Indian Minority & Human Rights Violations Annual Report 2010 “The first batch of University Science Malaysia’s International medical programme students will be starting their classes in September 2010 in Jawaharlal Nehru Medical College, Belgaum, Karnataka India. Out of the 74 students, only one (1.35%) medical student was Indian, Abilasha Nair, 19, from Masai, Johor. (News Straits Times 6.7.2010, page 27)” were also raised Mr. Avinash promised to raise these issues at the upcoming session of the Rajha Sabha in March 2011.

On a query as to whether there are Indian elected MP’s in Malaysia P. Uthayakumar explained that there are 11 ethnic Indian MP’s in PKR, DAP and PAS (P.R) and a further 4 from MIC/BN.

But these 15 Indian mandore MPs’ refuse to raise even 1% of the atrocities against the Malaysian Indian poor as per the Malaysian Indian Minority & Human Rights Violations Annual Report 2010 as they merely choose to play to up to the 90% Malay and Chinese voter gallery in their constituencies. And the same with the rest of the 76 PKR, DAP and PAS Opposition MPs’.

Thus we having to resort to IPCMI until HRP’s Project 15/38 ie winning in 15 Parliamentary and 38 state seats in the highly anticipated March 2011 General Elections.

HRP meets BJP Secretary General Shri Vijay Goel in New Delhi. Multi billion ringgit Malaysian infrastructure projects in India would be reviewed when BJP takes over power after impending snap elections.

New Delhi Yesterday 10/1/11 at 12.30 pm the 8 member HRP/Hindraf delegation led by P. Uthayakumar met the Secretary General   of the main Opposition Bharathiya Janata Party (BJP) and former sports Minister  Mr. Shri Vijay Goel at the BJP Headquarters at No 11, Asoka Street, New Delhi.

After a one and a half hour meeting and briefing  Hindraf’s Malaysia Indian Minority & Human Rights Violations Annual Report 2010 was presented to Mr. Vijay Goel ( pictures to be followed tomorrow).

The NST in November 2010 had reported that there are RM 1 trillion worth of infrastructure projects in India in the next five years. And Malay-sian UMNO linked companies Scomi, Gamuda, PLUS, IJN, etc are eyeing the lion’s share of these projects.

Thus the reason for the tuan UMNO Prime Minister Najib Razak appointing his longest serving Indian mandore ex-Minister of 31 years standing as the Special Envoy on Infrastructure with Ministerial status to secure all these lucrative projects. HRP presented their case to the top BJP leadership that this is one way that India could help address the UMNO Malay muslim racism and religious extremism cum apartheid against the poor Malaysian Indians as per our aforesaid Malaysian Indian Malaysia Indian Minority & Human Rights Violations Annual Report 2010.

Expressing shock at the level of exclusion of the Malaysian Indian poor from the national mainstream development of Malay-sia, the top BJP leadership appeared receptive of our proposals.

Other strategies and proposals were also discussed vis a vis the racist and religious supremacist apartheid UMNO regime and addressing the Indian poor problems in Malaysia.

Police agree to second post-mortem on Krishnan

KUALA LUMPUR: A second post-mortem is set to be conducted on M Krishnan, a 37-year-old wire-man who died in police custody last Friday, police confirmed today.

Kuala Lumpur CID chief Senior Assistant Commissionner II Ku Chin Wah told FMT that an application would be made through the court.

“We will be applying for a second post-mortem to be done through the magistrate,” said Ku.

Previously, Federal Criminal Investigation Department principal assistant director (prosecution) Senior Assistant Commissioner Razali Basri said the court order was required to seek a second post-mortem. He said the family would require to bear the cost of the post-mortem.

Razali said this after he received a memorandum from Krishnan’s family asking the police to allow the second post-mortem on Monday.

However, N Surendran, lawyer for Krishnan’s family, said that a court order was unnecessary. He said all that was needed was for the police to say they had “no objections” to an autopsy.

“They (the police) are being dishonest. They are trying to mislead the public by saying we need to go to court. We did not go to the court in A Kugan’s case, and the police allowed it (second post-mortem,” he said.

(Kugan, 23, a suspected car thief, died in police custody on Jan 16 last year. A policeman was charged with causing grievous hurt to Kugan at the interrogation room at the Taipan police station in USJ, Subang Jaya. The policeman, constable V Navindran, will know on Jan 28 whether he would be required to defend himself in the case.)

Surendran was also the lawyer for the Kugan’s family.

“Asking us to go to court is simply a time-delaying tactic to frustrate the family. After today’s revelation, police should consent to a second post-mortem,” he said.

Today, a jailmate of Krishnan came forward and lodged a police report claiming that the latter was a victim of police brutality.

A Sargunan said he witnessed Krishnan being beaten up and even jumped on by policemen in boots. He also claimed Krishnan was denied medical assistance.

Krishnan was arrested with several others in Taman Miharja, Cheras, on Jan 3 under suspicion of drug possession.

Last Friday, Krishnan, a father of the six children, was found dead in the lock-up at the Bukit Jalil police station.

According to police, the initial post-mortem results showed the death was related to an ulcer, but Krishnan’s family has disputed this, claiming there were bruises on the body.

Krishnan’s family claimed he had bruises all over his back, an open cut wound on his right abdomen, and a bruise on his right eye.

School is a ‘cowshed’ for Indian students

BATU KAWAN: A plot of land, four estate staff quarters and a container do not a school make. But that’s exactly what 134 students in Batu Kawan Tamil school in Penang have been saddled with in addition to encroaching wild vegetation and snakes!

Fearful of their children’s safety and frustrated at their community leaders, several angry parents from the school banded together to form the school’s Parent Action Committee (PAC) in the hope of pressuring the state and federal governments into allocating some funds to build a new school.

Their efforts, however, have proved futile, according to PAC chairman A Annadurai.

“We have tried to see the politicians including (Deputy Chief Minister Dr P) Ramasamy for funds but have not been successful.

“The state government said it has given us land… now we have to ask the federal government for money to build the school.

“But this also is not easy… we have sent several memorandums to the federal and state governments. But they have not replied … they don’t seem keen on helping us build a new school,” he said, adding that parents were trying to raise the RM2 million needed to rebuild the “almost 100- year-old school”.

Another parent, Thanaletchumi, said, the school is no longer safe for students.

“The school building is now surrounded by jungle and it’s become a breeding ground for snakes.

“The school authorties recently caught a snake in one of the classroom,” she said, adding that everytime the school organised a programme, local leaders would come and make promises that never were fulfilled.

Racial discrimination

According to Annadurai, what is most frustrating is that other vernacular schools – Chinese and Malay – in the area are “beautiful buildings”.

“As an Indian I feel ashamed and disappointed seeing Batu Kawan Tamil school and what has happened to my people.

“After all these years our students are using a small container and the estate quarters as their classrooms.

“The Chinese and Malay schools in the area are beautiful buildings. Our school is a cowshed… it’s a symbol of the discrimination against Indians in the country,” he said.

The original, almost century-old Batu Kawan Tamil school building was destroyed in a fire eight years ago.

In an immediate reaction, the school was offered the temporary use of four estate staff quarters.

But what was temporary went on to become permanent!

When the school’s student enrolment increased, the school authorities ventured to ask the state administration for help and the then BN government gave them a container!

Just after Pakatan Rakyat took over Penang in 2008, the school was allocated a two-acre plot.

No difference between BN and Pakatan

But with no funds they cannot build their school, said Annadurai.

“Even though the school was given two acres for the new building, until today there is no development,” he said, adding that neither the school authorities nor the existing Parent-Teacher
Association were any help.

Some 250 Indian families live around the school.

Asked if the state government had come forward with any other forms of support recently, he said:

“Pakatan or BN, for us it is nothing new; their goal is to ensure that Indians remain poor and depend on their support for school books…

“I think the government does not want to face the Indian community… it is playing politics with the school issues,” he said.

Annadurai added that what was shocking was that Batu Kawan Tamil school came under the purview of Ramasamy.

Ramasamy is MP for Batu Kawan which has 9,000 Indian voters.

Malaysian NRIs ask India to terminate its business relations with Malaysia

NEW DELHI: The Malaysians of Indian origin might put India in a tight spot. The community has asked the government of India to terminate all present and future business projects with Malaysia. The demand has come at a time when most Non-Resident Indians (NRIs) are keenly looking for business and investment opportunities between India and foreign countries.

According to the Malaysian Indian Minority & Human Rights Violations annual report 2010 compiled by Hindu Rights Action Force (HINDRAF), Malaysians of Indian origin have been suffering grave human rights violations committed by the Malaysian government. The report was distributed by the HINDRAF activists at the inaugural day of Pravasi Bharatiya Divas (Overseas Indians Festival) here on Friday.

Based on the news reports published in major Malaysian newspapers like The Star, The Utusan Malaysia, News Straits Times of Malaysia, the HINDRAF report claims that 95% people killed by the Malaysian police were ethnic Indians.

Indians constitute 8% of the Malaysian population.

The report also says that 90% of the custodial deaths and 80% people who experienced "police harassment, unlawful arrests, frivolous and malicious prosecutions," were Malaysian Indians. At least, 48% prisoners in 28 prisons of Malaysia are ethnic Indians and on 2010 alone, 5000 Indians were arrested and detained under Emergency Ordinance, the report points out. However, 36,000 prisoners including 17256 ethnic Indians in Malaysia are serving custodial sentence for minor crimes, the report claims.

According to the human resources ministry of Malaysian government, 200,000 Indian youth in Malaysia are involved in crime. The report says that this figure amounted to 60% of the Indian population in Malaysia.

"There are about 100,000 ethnic Indian gangsters operating in Malaysia. The acute problem which requires multi faceted intervention to address the issue, is understood to have low priority with the government, which lacks the political will to avert the situation. The only known current policy towards the social problem is the alarming increase in police killings," the HINDRAF report observes.

Chairman HINDRAF, Malaysia, Waytha Moorthy Ponnusamy has asked the government of India to issue a note of censure against the Malaysian government for its human rights record with respect to people of Indian origin in a language consistent with the serious and urgent nature of the problem and to urge the Malaysian government to reverse marginalization of the people of Indian origin in Malaysia.

Indians are generally recognized as a vibrant and successful community wherever they migrate, and even the poor indentured labour of the colonial era managed to elevate itself to positions of status and wealth in countries like Fiji, Mauritius, Trinidad, Africa, and the Caribbean nations, through sheer dint of hard work and education. In independent India, the educated middle class opted to send its children to the west in search of better professional opportunities, and Indians in general made a mark in the professions there as well, though of late racism is again becoming overt in these countries, as witnessed by the ugly Indian-bashing in Australia.

Islamic Malaysia, however, has been less than fair to its Indian-origin citizens, and even after being embedded in that soil for up to five generations, Malaysian Indians are tormented in various ways by an overtly racist and religious extremist Government. Malaysian Indians are routinely robbed of their fundamental rights and denied equal opportunities in every facet of life.

The current ruling coalition, dominated by the United Malay National Organization party, by explicit State policies excludes the vast majority of Malaysian Indians from the national mainstream, violating Articles 8 and 12 of the Malaysian Federal Constitution. The result is that as much as 70% of Indian Malaysians have been made to be and/or remain hardcore poor, with 90% being in daily or monthly wage-earners only. This poverty is caused by exclusion from proper basic life facilities, from education at all levels, from economic, social and cultural development programs, from equal opportunities in employment, and so on.

This is further catalyzed by a system called Mandorism. It involves the cooption by the ruling elite (UMNO at Federal level and Pakatan at State level) of a small layer of successful Indian Malaysian entrepreneurs, professionals and politicians to subjugate the rest of the Indian Malaysian community. This encourages human rights activists from other groups to ignore the horrendous abuse of human rights of Indians under their very nose.

To begin with, the government’s decision to outlaw Hindraf, a Minorities and Human Rights movement championing the poor and marginalized Indians, in October 2008, has not been rescinded. Malaysia is the current current Chair of the Organisation of Islamic Conference (OIC).

Malay Muslim Supremacy Agenda

Malaysia’s racist system is perpetuated is through the Administration which is effectively manned by Malays, the majority of whom are members or supporters of UMNO. It is akin to the discredited Apartheid of South Africa which once had a 500,000-strong all white administration! For example, as the largest employer in the nation, the government has 1.2 million employees. Excluding teachers of Chinese and Tamil, over 95% employees would be Malays. The administration is indoctrinated with Malay supremacist ideology by an indoctrination arm – the Biro Tata Negara. It ensures the blocking of non-Malay Indians and promotion of Malays. UMNO-controlled Malay daily, Utusan Malaysia, continuously spouts racist distortions of events, and influences social polarization.

Discrimination is rampant. Instances of racism include:

-        Rejecting applications for entitlements on petty grounds

-        Blocking information on entitlements from eligible Indians

-        Making it difficult for poor Indian Malaysian to register as citizens

-        Ensuring that lower level policies are in line with the overall racist bent of higher-level policies

-        Ensuring statistics of disbursements or acceptance or selections are not known to non-Malay Indians

-        Ensuring interpretation of policies is such as to disfavour Indians, and

-        Making procedures for various applications in respect to Government unduly complicated for Indians.

 

Worse, steps are being taken to deepen the Malay-Muslim Supremacy agenda by tampering with the education system again, this time in the SPM examinations where a candidate now must get a credit in History for a First grade in the SPM and a pass in history for a pass in SPM.

Extra-Judicial killings and Police abuse

Indians are the main victims of police shootings and custody deaths in Malaysia, and the racial profiling of Indian Diaspora and steady increase in crime rate reflects the corruption in the law enforcement agencies and their ineffectiveness as in upholding law. Corrupt officers are ever willing to act as cohorts of the government and overlook misdeeds perpetrated by the authorities. In return, the police force is immune from prosecution in crimes committed, a vicious circle. The situation is aggravated by marginalisation of Indians, which aggravates poverty, and perpetuates crime – something well known in the country.

Ignoring the larger context, Police resort to brutal methods to extract confessions from detainees. Nearly 90% Malaysians killed in Police custody are ethnic Indians suspected of committing crimes. There is also an unofficial policy of ‘shoot to kill’ codename ‘Operasi copperhead’.

On the basis of national newspaper reports, Human Rights Party has collated the some of the following facts for the year 2010:

 

-        The Star newspaper (16 March 2010, p. 40) published information obtained by the Selangor Hindu Sangam which confirmed that 48% of prisoners in the 28 prisons nation-wide continue to be ethnic Indians. 

-        Utusan Malaysia (20 September 2010, p. 5) reported that in just four months in 2010, 300 ethnic Indian youths were arrested and detained under Emergency Ordinance in the state of Selangor. Another 900 Indian youth were arrested in Selangor and a total 5,000 countrywide.

-        The same newspaper (22 September 2010, p. 10) reported that there were about 100,000 known ethnic Indian gangsters operating in Malaysia.

-        News Straits Times of Malaysia (25 March 2010, p. 20) said 36,000 prisoners nationwide including 17,256 Indians are serving a custodial sentence for minor crimes.

-        Babu (28), an orphan who surrendered to Police in Jempol on a suspected petty robbery case on 24 Jan. 2010 was found dead in Police lock up a week later. He allegedly hanged himself but Police refused to disclose the findings of a CCTV linked to the cell to NGOs representing Babu’s family (Malaysiakini, 3 Feb.)

-        On June 14, A. Gnanapragasam, 53, died in Police custody. He had complained to a Magistrate during remand proceedings of beating in custody. His wife met him the Friday before and noticed beating marks. The Police said he would be released on Monday, but he died mysteriously on Sunday. Police said it could be drug abuse [how this could happen in prison was not explained]. No inquest was held to determine cause of death.

-        Investigation and prosecution of the unlawful killing of Kugan remains unchanged at the time the Human Rights Party prepared its report for Pravasi Bharat Divas in Delhi, India. In this high profile prosecution, only one police officer was prosecuted after much public pressure for use of unlawful force to extort confession from a 22-year-old ethnic Indian detainee.

-        On July 16, police arrested R Gunasegaran, who died at the Sental Police Station with 2-3 hours of his arrest. An initial autopsy found Gunasegaran died of a drug overdose, but many witnesses claimed he was beaten in custody. At his family’s request, the high court ordered a second post-mortem and inquest, which was said to be inconclusive despite the presence of various wounds and injuries to the body. An eyewitness to the above inquest was later arrested in the presence of his family and beaten by the police.

-        On 8 November 2010, police shot and killed five ethnic Indian youths aged 17 to 24. They were alleged to be members of a criminal gang who fired first; but the Indian community protested the ‘shoot to kill’ policy. Till the end of the year there was no official inquiry into the matter

-        On 22 Nov. K. Kalaiselvan (21) was believed to have been murdered by Malay members of the police force at Kota Tinggi, Johor police station. The cover up says lung congestion (New Straits Times, 17 Dec. p. 22).

-        Mahalingam (35) was believed to have been killed by police at Nibong Tebal police station on 23 Nov. but in an alleged cover-up the police placed the blame on five other fellow detainees and sent them to Simpang Renggam Prison without trial for two years and thereafter indefinitely (see Makkal Osai 7 Dec. p. 7).

-        Two brothers from Taiping were shot dead by the Malay police force in what is believed to be a shoot to kill policy of Indian suspects (humanrightspartymalaysia.com 4 May). The road where the two brothers were travelling was cordoned off and baklava-wearing Special Action Forces simply murdered them in cold blood.

-        On 6 Jan. Isaikumar Sathieyananthan reported being beaten by several policemen with rubber hose while a policewoman stuffed her booth into his mouth and took pictures of his private parts. He was slapped and kicked by her. He was arrested for suspected theft and released 8 days after the police realised he was not involved. (NST 7 Jan 2010). Federal CID Director promised full investigations but nothing has happened so far.

-        14 year old Mugilan was slapped on the spot for accidentally touching a young Malay girl in an open area swimming pool. He will now be forced to plead guilty for an offence he did not commit as he cannot afford the bail of RM 1,700 (USD 485). Currently he is serving a two-month jail without even being found guilty in a Court of law (see Free Malaysia Today 6 Aug.).

-        13 year old G. Karpagam who complained to the police that her brother was stabbed was in turn locked up with adults at Ipoh police station (see Makkal Osai 13 Dec. p. 13).

-        In the sedition trial of human right lawyer P. Uthayakumar on 30 Nov. (humanrightspartymalaysia.com 1 Dec.) the Deputy Federal police criminal investigations department Director DCP Acryl Sani Abdullah Sani testified in effect that Indians are disproportionately 60% higher in comparison to locals killed in police lock ups and shot dead by police!

-        In another written parliamentary reply to Michael Jeyakumar Devaraj (PSM-Sungai Siput) on 28 June 2010, Home Minister Hishammuddin revealed that police shot dead 82 suspects in 2008 and 88 in 2009.

-        Although 5 million Malaysian Ringgit has been allocated to the legal aid foundation, 80% defendants appear unrepresented at trial (The Star, 30 July, p. 24). News Straits Times (24 Jan. 2010, p. 20) reported that 80% of accused involved in theft and assault were unrepresented when charged in court.

Segregation and exclusion of Indian poor from the national mainstream development of Malaysia has forced thousands into a world of crime.
