Don’t Make Mountains Over Mole Hills

Racism seems to be stirring Malaysia badly where it is the day after day talk of the town. Every single disaster involving different ethnics is being manipulated as a racist agenda by many.

The recent ghastly murders of cosmetic entrepreneur Dato Sosilawati and her three aides have sparked anger among Malays. Abusive words such as kelling, paria, India bodoh and so on have been bashed to the Indian community here.

Internet blogs and social network pages are created in quest of righteousness for the deceased but abusive and vulgar expressions towards the Indians are posted instead. These pages and blogs have followers whom are Malays, numbering in tens of thousands.

This is an act of immaturity and it is not Malaysian culture.

Non Malays have been tolerant and respecting the Malay culture for decades. There were a string of brutal murders where the killers were Malays but the peace loving non Malays respected the law and left the fate of the killers to the hands of the Malaysian judiciary.

In July 2000 Al Maunah, a Malay extremist group cruelly murdered two non Malays hostages one detective corporal Saghadevan from the Royal Malaysian Police Special Branch and another Royal Malaysian Army personnel Trooper Matthews Anak Medan. The duo were tortured to death without mercy by this group. The Indians and the Sarawakians did not make this a racial issue.

On June 14th 2003, IT analyst Canny Ong Lay Kian was rapped, stabbed and torched to death by aircraft cleaning supervisor Ahmad Najib Aris but the Chinese community did not turn this rape cum murder into a racial setback.

Weeks before the murder of the cosmetic tycoon and her assistants, the cold blooded murders of two Indian security guards by their Malay colleague due to a small misunderstanding also did not spark any racial sentiment from the Indian society.

These are only a few examples of cruel murders by Malay perpetrators and they were proven guilty by the judiciary system and sent to the gallows. The non Malays did not rent and rave against the Malays.

This is indeed evidence of patience and tolerance by the non Malays.

In the case of the aesthetic products magnate and her assistants, those detained are only SUSPECTS and not proven guilty by the court of law. This raises doubts from minorities in Malaysia of the unnecessary ruckus and rage by the Malays.

Although their action are believed to be politically provoked, Malays should restrain themselves from being the cause of any unwanted incidents in the name of race and religion which can possibly lead to further damage of this nation.

This nation has been blessed with serenity and harmony for eons. Please do not be the sacrificial sheep or a tool to malevolence plan by some politically inclined perpetrators with their motive to disrupt our unity for their political gains.

So, please stop crafting mountains over a mole hill.

We refer to the above matter and to the newsreports in Malaysia Nanban 23/9/10 at page 13, Makkal Osai 23/9/10 at page 9 and also in Sinar Harian 22/9/10 at page S5, and The Star 23/9/10 at page N48.
We regret to bring to your goodselves attention that despite the Selangor state government publicising the unveiling of the official signboard gazetting the Padang Jawa Kuil Sri Maha Mariamman, the gazette number and the date the same was gazetted was “conveniently” missing. 003
We regret to note that despite three years of PKR ruling Selangor, it is only now that the signboard has been unveiled and a mere “kosong” promise of RM300,000.00 to rebuild this hindu temple. Maybe we should not be surprised as one political analyst defined politics as making “empty” promises and creating “false” perceptions.
009Kindly let us have the gazette number, the date the same was gazetted and whether the land title has been issued in the name of this hindu temple trustees names, so as not to create the perception that this is merely an empty “kosong” political statement.
Further it has been acknowledged by the Selangor state government that there are 2,540 hindu temples in Selangor (TN 12/9/10 at page 1) and that 95 places of worship for non muslims have been granted land titles (SH 22/9/10 at page S5).
We would like to have a list of all these 2,540 hindu temples together with details of how many of these hindu temples have been granted land by the Selangor state government, the date it was gazetted, whether the titles thereto had been issued and if so whether the titles have been issued under the names of the respective temple trustees names and other relevant details. We would also appreciate photocopies of all these land titles issued, their gazette numbers and the date the same was gazetted together with the gazette notice.
In any event we regret to note that after all the atrocities committed by the previous state government on this Padang Jawa Hindu Temple and demolishing the 96 hindu temples in Selangor, “ethnically cleansing” and wiping out their 200 over year old history and heritage in Selangor. And with 90% of the Malaysian Indians having voted PKR, DAP and PAS to power to be able to form the Selangor state government they are now only granted this raw and piecemeal deal a la UMNO. Note: (One Hindu temple demolished every week nationwide. Between 2004 to 2007, 96 hindu temples were demolished in Selangor at an average of one hindu temple in every ten days.(TN 30/10/08 at page 3).
In fact it is rather insulting that the land this hindu temple has been granted is on a mere 15,000 square feet of land which is just over one quarter acre of land and that too below a health hazardous Telecoms Tower if not on the Telecoms Towers reserve land and endangering the lives of especially the hindu priest and the regular hindu devotees thereto.
From our records forcing a place of worship under a Telecoms tower has never been done before to any Masjids, Suraus, Chinese temples or churches or any other place of worship even in any other part of the world let alone in the world’s cruelest dictatorship regimes. Why are the Hindu temples singled out in Selangor and in Malay-sia? Indians soft targets? The poor and politically powerless Indians are easy to bully?100_2056
For and on behalf of the estimated half a million Indian community in Selangor we hereby apply for another suitable five (5) acre piece of land for this Padang Jawa hindu temple within two (2) weeks from the date hereof at the very least to undo the injustices that has happened to this hindu temple, if not to the hundreds of hindu temples that has been demolished and “ethnically cleansed” in Selangor. This new five (5) acre land is necessary to rebuild a proper hindu temple, a jasmine and other flower garden, a wedding hall, a community hall, a community centre to serve the neighbouring poor Indian community, a car park and land for future temple development which is to be planted with coconut trees and banana plants sacred to the hindus in the interim. This could serve as Selangor’s model hindu temple and which could become Selangor’s “Batu Caves” and also a prime tourist attraction. 100_2039
We also ask your goodself to grant land to all 2,540 hindu temples in Selangor all in one go and gazette the same accordingly under the name of the respective hindu temple trustees and not the usual kosong wayang kulit “PPP” peanuts political propoganda especially in the Tamil dailies by your Selangor Indian Exco mandore.

Relief for 10 caught in conversion turmoil

(Malaysiakini) The Human Rights Party (HRP) claims it has achieved its aim of upholding the constitutional right for freedom of religion, in bringing relief to 10 Indian Malaysians caught in conversion turmoil for years.

NONEThe 10 victims of alleged forced conversions are from the three families -- Rajina a/p Krishnan, Rani a/p Kandasamy and Banggarma a/p Subramaniam (left).

On Tuesday, HRP central committee member S Thiagarajan took them to the National Registration Department (NRD) headquarters in Putrajaya to iron out the long outstanding issue with seven NRD officers.

According to him, it took over eight hours of persuasion and reasoning with the NRD officers headed by NRD's births, deaths and adoptions deputy director I Azliza Shaharudin to complete this application process for change of name.

Initially, HRP encountered resistance from Azliza who after perusal of the documents, rejected the applications on the grounds that these three cases should be brought to the Syariah Court for the change of name and religion to Hindu.

After obtaining the Syariah Court order, only then should come back to the NRD, she had said.

Constitutional aspects discussed

But HRP instead briefed Azliza and her officers on the constitutional and legal aspects as well as the United Nations (UN) International Covenant provisions that reads:
  • HRP, converts with officer - HRP, converts meeting with NRDBy virtue of Section 6 of the Registration of Births and Deaths (Special Provisions) Act 1975 “A registrar (of births) shall record such particulars as may be prescribed in a report book in the prescribed form concerning any birth or death given to him by any person qualified to do so;
  • Article 11 of the federal constitution (freedom of religion) and 11(1) that says “every person has the right to profess and practice his religion and to propagate it”;
  • The federal constitution is the highest law of the country and is above all other laws, with no disrespect including Islamic laws which are only subsidiary to the federal constitution;
  • Article 14 of the federal constitution read with Part II of the Second Schedule provides for citizenship by “operation of law” and “for every person born within the federation of whose parents one at least is at the time of birth either a citizen or permanently resident in the federation;
  • Article 7 of the Convention on the Rights of the Child (that Malaysia ratified in 1995) provides, “The child shall be registered immediately after birth and shall have the right from birth to a name, the right to acquire a nationality and as far as possible, the right to know and be cared for by his or her parents”; and,
  • It also states that parties shall ensure the implementation of these rights in accordance with their national law and their obligations under the relevant international instruments in this field, in particular where the child would otherwise be stateless.
After HRP's briefing on the six rights, Azliza called the respective NRD officers to look into the various conversion cases.

Rajina's two-year-old son Tinesh had no birth certificate, since the NRD office in Johor had at the birth of her son refused to include the name of his natural father Mahendran a/l Habimanan and his religion as Hindu in the certificate.

Then for Banggarma's two children, Hisyanthini and Kanagaraj, application forms were sought to change their religious status to Hindu and include their father's name Sockalingam a/l Suppiah in their birth certificates, which column had been filled up with the words “Maklumat Tidak Diperolehi” (details not available).

Thiagarajan had also questioned Azliza as to how this could happen when the mother had confirmed that Sockalingam is the natural father, pointing out that this is in contravention of Section 5(1)(a) and (b) of the Registration of Births and Deaths Act 1975.

Rani had been told that the amendments she sought in the birth certificates of her children could not be carried out as they issued only once in their life time and remain the history of their birth.

The application to change the name and the status from Islam to Hindu was rejected by virtue of Section 15(1) of the Registration Births and Deaths Act 1975.

'NRD must be independent'

However, HRP informed the families that they could use Section 27(3) of the same Act to make corrections to the name and their religious status.

This included the case of Rani's (far left in photo) elder daughter Vijaya Letchumy who has a Hindu name but whose religious status in the NRD computer system is Islam, a discrepancy that prevented her from registering her marriage to her Hindu husband Tamilarasan a/l M Rajendran.

According to Thiagarajan, the NRD officers had told them that they would revert to the applicants on the matter within two months.

HRP will be taking the second batch of ten stateless Malaysian Indians to see the NRD next week.

NONEEarlier on Aug 13, a HRP team led by pro-tem secretary-general P Uthayakumar (right) had initiated the groundwork with a three-hour meeting with births, deaths and adoptions director Mohd Azmin Hassan and 12 of his senior officers at their Putrajaya office.

At the meeting the HRP team had emphasised that NRD should act on an independent, non-racial and non-religious basis, in a move to eliminate statelessness and uphold the constitutional right to freedom of religion.

16,965 Tamil school UPSR students will excel when all 523 Tamil schools are made fully government aided schools

This year 16,965 Tamil schools pupils are currently sitting for their UPSR examinations after having gone through their learning process for six (6) miserable years under very difficult circumstances. (see Utusan Malay-sia 22/9/10 at page 24).

May we bring to your kind attention that at least 371 of these Tamil schools are not fully aided (TN 5/1/09 at page 1), with 250 situated in the estates according to former Education Minister Dato Seri Hishamuddin Hussein (UM 25/7/08 at page 6). It is a shame that most of these Tamil schools are in cowshed like and dilapidated conditions even after 53 years of Independence.

The government has disallowed hundreds of new Tamil schools in Indian populated areas for example in Pandamaran which has 3,000 Indian families and Kg Lindungan which has 10,000 Indian families and also in Triang, Pahang (see TN 30/8/8 at page 13).

This has led to cramped up Tamil schools like the 355 Indian children cramped up in to the 0.2 hectres of land at the Cheras Tamil school (NST 9/9/10 at page S4). Only in One Malay-sia and no where else in the world we also have the whole of the Sungai Salak Tamil school fully in shipping cabins, the Lukut Tamil school upstairs a shophouse with no canteen and playing field, the basement Tamil school in Penang the Tepi Sungai, Klang Tamil school in a JKR store etc.

There are 1,522 untrained and temporary teachers in the 523 Tamil schools (TN 5/1/09 front page) . Whereas even for the Permata kindergartens trained Diploma kindergarten teachers are being sent to the Sultan Idris Teachers University in Tanjung Malim to secure degrees.

This state of affairs is in contravention of Article 12 of the Federal Constitution which states that there shall be no discrimination in education for schools receiving government financial assistance. Also Article 28 of the United Nations Conventions Convention on the Rights of the Child 1989 which Malaysia has rectified in 1995 which in effect guarantees compulsory free education for all children. (NST 30/10/08 at page 10).

Despite the odds, 817 of these Tamil school children managed to score 7As’ in their UPSR this year (Malaysia Nanban 20/11/09 headlines), which is an increase of about 100 students compared with 719 in 2008 (TN 14/11/08 headlines). However almost all of these top Indian students were denied places in the 5,900 places in the 39 Maktab Rendah Sains Mara colleges and 6,000 places in fully residential schools. (BH 17/1/10 at page 16).

The current up to sixth generation Malaysian born Indians no longer want piecemeal addressing of Tamil school problems and “peruntukan” allocations for “one school by one school” tamil daily propaganda but want a wholesome solution that is for all 523 Tamil schools to be made fully financially government aided schools and in line and on par with any other Malay muslim school.

We call upon the government of Malay-sia to declare all these 523 Tamil schools as fully aided schools by 31/12/2010 and for the same to be accorded equal status and with equal government financial allocations, teaching staff, clerical staff, school fields, sport facilities , resource rooms, computer and science labs etc.

This should be the case especially so after Malaysia having been independent for 53 years now and under Malay-sian Prime Minister Najib Razak’s One Malay-sia.

HRP tells NRD to be non race and religious bias in eliminating Indian statelessness and freedom of religion.

P9210420On 13/8/2010 our National Adviser Mr.N.Ganesan, P.Uthayakumar, W.Sambulingam, S.Thiagarajan and Manimaran had an official three (3) hour meeting with EnP9210438 Mohd Azmin bin Hassan, the Director of Births, Deaths and Adoptions and twelve (12) of his senior officers at their Putrajaya office. At this meeting we had emphasized on an Independent and non race and religious bias National Registration Department in eliminating statelessness and upholding the Constitutional Right to freedom of religion.

Having laid the groundwork we promised to come back with the real cases.
And today 21/9/10 we did just that. We brought to the National Registration Department (NRD) Headquarters in Putrajaya ten (10) Malaysian Indian victims from three different families of forced conversion or forced to Islam namely the families of Rajina a/p Krishnan ( whose name on the Identity Card is Rajina Bt Mohd Zaini @ Krishnan), Rani a/p Kandasamy ( whose name on the Birth Cerificate is Jamilah binti Abdul Kadir) and Banggarama a/p Subramaniam (whose name on the Identity Card is Siti Hasnah Vangarama binti Abdullah).

We arrived at the National Registration Department at about 9 a.m and were attended to by one Puan Azliza Binti Shaharudin the Timbalan Pengarah 1, BahagianP9210412 Kelahiran, Kematian & Anak Angkat .Upon perusal of the documents Pn Azliza Binti Shaharudin rejected the applications on the grounds that these three cases should be brought to the Syariah Court for the change of name and religion from Islam to Hindu and then to come back to apply for their Identity Cards and Birth Certificates with the Syariah Court Order.

We instead gave a briefing on the Constitutional, Legal and the United Nations(UN) International Covenant provisions to Puan Azlina and her officers as outlined hereinbelow in items No 1 to 6. She then called in Mr Nik Hassan Husin bin Nik Abdullah (Penolong Pegawai Pendaftaran Tinggi) to attend to the cases.

Another special officer Pn.Zabariah from Bahagian daftar lewat was assigned to attend to Rejina’s son case where he has no birth certificate since he was born. The National Registration Department office in Johor had at the birth of her son Tinesh (2) refused to include the name of his natural father Mahendran a/l HabimaDSC00176nan and his religion as
Hindu in his Birth Certificate.

Then another officer Rabiatul attended to Bangaramma’s two (2) children Hisyanthini and Kanagaraj to fill in the application forms to change their religious status to Hindu and include their father’s name Sockalingam a/l Suppiah into the birth certificates which column had been filled up with the words “Maklumat Tidak Diperolehi” (details not available).

We had questioned the said NRD Deputy Director how could this be when the natural father and mother had confirmed that Sockalingam is the natural father and that this is in contravention of Section 5 (1) (a) and (b) of the Registration of Births and Deaths Act 1975. (Note: the connotations can be so derogatory so as to cast imputations that the child could be an illegitimate child).
Upon completion, Banggarama and Rajina’s son’s application were forwarded to En.Nik Hassan bin Nik Abdullah for affirmation (oath).

Upon completion of Rejina’s son’s application, I was called aside with Mr Mohan to the meeting room by En.Nik Hassan to get feedback on the statelessness and P9210481the forced conversion to Islam cases we were handling. We raised several other issues on the stateless and forced religious status cases faced by Malaysian Indians. En Nik Hassan conceded that the JAKIM’s rule in handling the conversion case is cruel. He mentioned that they had meetings with Jakim and Jais personnell and with Majlis Raja-Raja Melayu and recently had discussed this matter but they are yet to come back with a solution since all the State Rulers will have to meet and discuss this matter to come to a solution.

Later, Rani was told by another officer En.Mohd Ashgar of the Birth Death and Adoption that the amendment in the Birth Certificates for her children could not be changed as the birth certificate is only issued once in their life time and it is to remain the history of their birth and the application to change the name and the status from Islam to hindu is rejected by virtue of Section 15(1) of the Registration Births and Deaths Act 1975. However they informed us that they could use Section 27(3) of the same Act to make corrections to the name and their religious status. Rani’s case was then handed over to the officer in charge of Identity Cards En.Zulkiflee (Penolong Pengarah Bahagian Kad pengenalan) and Puan Azliza to do the changes in the name and the status of their religion. Here we had submitted the six applications of:-

1. Rani-to change her name and religions status

2. Muniandy (Rani’s husband)- to change his name and the religious status (Mustapha Muniandy bin Abdullah)

3. Ganesan(son)-Name and Religious status (Abdul bin Mustapha Muniandy)

4. Chitra Devi (daughter)- to change Name and religion(Chitra devi binti Mustapha Muniandy)
Note: Chitra Devi was forced to stop school at 16 years of age as she was forced wear a tudung and attend Islamic religious classes. 

5. Nagendran (son) –Name and religious status (Hamzah bin Mustapha Muniandy)

6. Vijaya Letchumy (daughter) Hindu name but whose religious status in the NRD computer is Islam and cannot get registered to her Hindu husband Tamilarasan a/l M. Rajendran.

It took the whole day lasting over 8 hours including the lunch break with seven (7) NRD officers working to complete this application process and we were the last persons to come out of the National Registration Department office building. But all in the spirit of the Hindraf struggle. Also with me were the HRP 4M officials ie Mano, Manimaran, Mohan and Maniam (Kapar). And next week we would be taking the second batch of ten (10) stateless Malaysian Indians.

Origins: Indian community in Malaya

The peninsula of Malaya, as it was known before the formation of Malaysia in 1963, has a long history of external social and cultural influence. Its strategic location on the sea route between India and China meant that it came under the direct influence of diverse social and cultural forces from India, China, Thailand, Cham (Vietnam), Indonesia, the Middle-East, and the West from the 16th century.

Estimates place the earliest arrival of Indians in the Peninsula of Malaya region as approximately 1,700 years ago. The Indian travelers are known to have referred to this area as Shuvarnabumi or land of gold. Indisputable evidence of early Indian presence can be found in the ancient Hindu relics and excavations at Takuapa on the Kra Isthmus, Candi Bukit Batu Pahat and Bujang valley in Kedah.
More significantly, the influence of the centuries-old trade-initiated relationship with India can be observed in Malay culture. The Sanskrit influence on the Malay language, the Hindu epic of Ramayana still exhibited in the form of shadow play (wayang kulit), some cultural rituals (e.g. shaving the head of a new born child) and the notion of kingship still preserved in the Malay courts are just some of the things that bear testimony to the Indian influence. However, Malay legends hold no memories of a Hindu or Buddhist conversion, like the dramatic depictions of the adoption of Islam, as the merging of Indian with Malay proceeded imperceptibly, deepening and enriching an already vital culture. These early Indian travelers did not settle in the Malay Peninsula.

According to scholar S.Arasaratnam, “with the decline of Hindu shipping and mercantile activity and the expansion of Islamic political and economic power in India, the number of Hindu traders coming to Malaya declined, giving place to the more powerful and better equipped Muslim merchants of Bengal,Golconda, Coramandel and Gujerat. These traders intermarried with the local Malay population and absorbed much of the Malay Muslim cultural and religious practices.

In contemporary Malaysia, the descendants of these traders identify more strongly with the Malay community rather than the Indian community. The Indian immigrants who came later, in the19th Century, as a result of British intervention in the Malay states were however largely Hindu.

(Malaysiakini) The Human Rights Party Malaysia (HRP) claims that Umno's social engineering has denied Indian youths the right to education, jobs, business mobility, loans and contract opportunities that has resulted in many of them turning to gangsterism and violent crime.

NONEProtem secretary general P Uthayakumar (right) alleged this has resulted in the emergence of a new Indian criminal underclass at levels disproportionate to the Indian community's 8 percent of the nation's population.

He says detaining such youths without trial under the Emergency Ordinance (EO) will not do; Indian gangsterism must be tackled at its roots.

He also hit out at the MIC who instead of addressing the root causes, blamed Tamil movies, lack of parental care, and lack of guidance by Indian NGOs and the Indian community.

Uthayakumar said this in an open letter to Premier Najib Abdul Razak and Home Minister Hishammuddin Hussein dated Monday, copied to Malaysiakini today.

He was responding to an Utusan Malaysia report yesterday that called on the police to curtail increasing Indian gangsterism in light of the Sosilawati murder case.

Utusan Malaysia had also reported that 300 Indian youths were detained under the EO within four months in the Selangor alone.

'Overlooking root causes'

“We are against all forms of crime and violence, and are for appropriate action and punishment,” said the former ISA detainee.

He said no Indian youth would want to become a gangster, if he was not denied educational opportunities.

That 523 Tamil schools are not fully aided and unable to function at optimum level contributes to the problem.

Scholarships from the government and GLCs for Indians are also limited, he said.

He lamented that the Indian community is also denied land ownership schemes such as what the Felda settlers receive, as well as equal higher education opportunities in public universities.


Denied business opportunities

Uthayakumar also claimed that the community has been denied business opportunities, licences, permits and APs to do business and participate in contracts and projects, and denied government and bank loans to assist in business.

The reality however, said Uthayakumar, is that Indian youths are even denied licences to operate scrap metal shops, car washes, food, flower and fruit stalls and denied even garbage collection, security guard and car park contracts.

He said Indians were denied a host of other basic opportunities such as to run petrol stations, Ayamas outlets, Proton outlets and service centres, KFC and McDonald's outlets, low rental highway rest stop shops and local council stalls, and so on.

When a young Malaysian bashed racist principals through his vulgar yet anti racist video clip, he ended up in the police station for 8 hours while the 'non racist' principals still wandering freely as 'investigation is under process'. When a lady MP went into the 'surau' to give some donations to renovate the surau, she was slammed in the media and labeled as 'dirty' and interestingly many Al Quran illiterate strongly warned the Non Muslims that they should not enter Muslim's prayer space(Which Al Quran are they referring to? Their own version?) whereas when a group of 'extremists' protested the building of temple next to mosque by throwing cow heads into the temple, a 'non extremist' defended them and claimed that it was not wrong as they only voicing up their rights.Are they Barbarian, Jackass, or Racist? When a group of constitutional literate people were campaigning to educate people on our constituency, a group of 'well educated graduates' twisted the issue and blamed that this campaign was giving a wrong impression about constituency (This happens if we do not have meritocracy where all Tom and Hardy become graduates). Why so many of complaints you wonder? All these to justify an act of some 'responsible and civilized Councilors' who put sleep 9 'uncivilized and aggressive dogs' which belong to the 2 suspect lawyers in Datuk Sosilawati's case. Since, some of our basic human rights are not recognized, it is ridiculous to expect them to hear the 'voices of these innocent animals'. Why punish these animals? You cant tell they belong to murderers so should be killed as those lawyers are suspects. in Malaysia, 'Seseorang tidak bersalah sehingga dibuktikan kesalahannya'.

Well, what else can we say about this nation and its ' idiotic dejavu' system where your own sperm could end up in your anus, a dead man writes suicide note after strangling himself, big jets could disappear out of sudden blue moon and submarine does not sink. What we call these people?Barbarian, Jackass, or Racist? I do not know. You tell me. Interestingly, there is still a big chunk of Malaysians refuse to see truths. Marginalisation, not Tamil movies, the cause of violence

Another opinion, based on a selective use of mostly American studies on the relationship between media and violence, institutionalised by Consumers Association of Penang (CAP), suggests that the central agency causing the
problems within the Tamil community, in particular gangsterism, stems from the Tamils watching Tamil cinema.

Apparently, the Tamil cinema from Madras, India is the cause of Tamil Malaysians straying away from the path of expected positive community development. Solution: Get rid of Tamil films.

CAP has without doubt made major contributions to protecting the interest of the Malaysian consumers. But certainly it has done an unforgivable disservice to the Tamil/Indian community. Possessing a huge cultural capital and capable of influencing popular opinion, CAP seems to have been able to promote an argument that many, including the Malaysian government, like to
parrot.

Tamil films are the cause of Tamil anti-social behaviour. A recent New Straits Times editorial (Sept 12, 2000) offers a view that is contrary to what CAP likes to believe. The NST correctly observed that the characters in the films that CAP, and others like CAP, love to attack - films like Thalapathi and Nayagan by a sensitive and creative Tamil filmmaker Mani Ratnam -
are really about poor people who have been forced into situations that have led them to resort to violence. CAP seems either completely ignorant or evasive of complex Indian realities.

CAP has also the habit, at least in this case, to offer selective support studies as evidence of the connection between media and violence. It mentions some American studies, for instance, while carefully avoiding others that throw doubt about these studies or tries to explain the relationship between the media and violence in a more complex fashion, what I believe to be more realistic. In any case, CAP does not have last word on this matter. The relationship CAP is trying hard to establish is really a contested one. There is simply no agreement on it.

To American reports such as "Children, Violence and the Media" by the Senate Committee of the Judiciary brought in September 1999 that relates violence in America to the media, there are many more studies that simply throw doubts about a simplistic connection. CAP seems to make a moralistic analysis, a claim that implies that all violence spring from similar causes or that all violence has same characteristics. That is a rather naïve understanding about violence or aggression in society.

Murder rate lower

A 1998 Unesco global study on media violence suggest that "depending on the personality characteristics of the children, and depending on their everyday-life experiences, media violence satisfies different needs: It 'compensates' own frustrations and deficits in problem-areas. It offers 'thrills' for children in a less problematic environment."

In the discussion on solutions to media violence, the same report suggests, "What are possible solutions? Probably more important than the media are the social and economic conditions in which children grow up", an expert in the field has this say: "Children in Canada and the United States watch virtually the same television. Yet, the murder rate in Canada, and the rate of
violence in general, is much lower than in the United States. Children in Japan watch probably the most violent, the most lurid and graphic television in the world, and the rate of violent crime there is minuscule compared to Canada and the United States."

In a 1996 article, the same scholar, Jonathan Freedman, observed that "Television is an easy target for the concern about violence in our society but a misleading one. We should no longer waste time worrying about this subject. Instead let us turn our attention to the obvious major causes of violence, which include poverty, racial conflict, drug abuse, and poor parenting."

Melanie Brown, an Australian academic, in a 1996 article makes the following observation: "Numerous research studies identify an association between exposure to violence in entertainment and violent behaviour, but do not prove that exposure causes violent behaviour. Rather, there is a risk that exposure to media violence will increase the likelihood of subsequent
aggressive behaviour. This risk can be increased or decreased by a large number of other factors." Counter studies can be quoted at length.

The more serious problem with CAP's attack on Tamil cinema involves the logic of their mode of argument. CAP's argument - and those who look up to CAP - starts from the media not the individual and group or society s/he belongs. This reversal is
really the problem with the "media effects" model of explanation.

Essentially, the tendency is to start an explanation from the media and make a flat and unsustainable connection to the individual. This kind of explanation is also highly psychological in nature, losing touch with the social environment. If an explanation starts from the individual-in-community, then the tendency will be to look at the social background, identity issues,
race/ethnicity issues, gender issues, etc. In this cluster of effects, media would just be one contributory factor.

It is time CAP stopped attacking Tamil cinema as a central cause of the Tamils/Indians social problems such as gangsterism and address the more critical issues faced by the community. Of course, media is not innocent. But it needs to be critically addressed and not causally over-valued.

Minority community

A third group of people likes to believe that the Tamil/Indian peoples' problems are really a result of socio-economic and political marginalisation. Assigning causal status to Tamil schools or Tamil cinema for problems within the Tamil community is really confusing issues and blurring the focus and diluting the seriousness of socio-economic and political marginalisation.

The Tamils are a working-class minority community, a community that has been, as a result of the developments in Malaysia, pushed from rural to urban poverty, from plantation worker to factory hand, from living in an estate environment to living in a squatter area. Serious problems within the community stem from the state of socio-economic powerlessness it faces.

The Tamils/Indians are a poor minority community and poverty has become an inter-generational problem, poverty reproducing poverty. Economic powerlessness, the size of its population and poor political foresight of the Indian leadership have also led to political powerlessness.

Consequently, within the national community, the Tamils do not have much bargaining power. The Tamil community and its problems are hardly addressed seriously and systematically in the national context. Perhaps the only problem that constantly gets national attention at present is the problem of gangsterism. Even this is addressed as a punitive strategy rather than a preventive one. As part the preventive strategy if there was one, one cannot overlook the importance of upgrading the Tamil school system.

Powerlessness in the community has led to many difficulties. For instance, the young Tamil Malaysian youths educational and career options are severely limited in comparison to the other communities. Tamil schools are faced with serious  problems affecting education of a poor minority community. The presence or use of Tamil in the marketplace or public places is confined or limited to Tamil/Indian areas. Tamil Malaysians who have brought fame to Malaysia are hardly treated as
"national heroes" and have found difficulties being recognised or rewarded as one. A few millionaires like Anantha Krishnan produced by the system do not really solve the problems related to the general marginalisation of the community. Ordinary Tamils/Indians Malaysians have an uphill task to deal with in relation to their poverty and marginalised status.

Serious implications

The assignment of Tamil cinema and/or Tamil schools as main causes of Tamil Malaysians community problems is not only limited and careless but also dilutes the focus on more serious preventive measures addressing the community's socio-economic and political marginalisation. The focus on Tamil cinema and Tamil schools carry a number of serious implications.

One, Tamils/Indians who are critics of Tamil school system or Tamil cinema seem to suggest that there is something wrong with the Tamil culture or the way it articulates. Indirectly their suggestions imply severe limitation of, if not the complete removal of, certain popular Tamil cultural forms/institutions.

While cultural criticism is important for societal re-learning, corrective actions and creative cultural intervention and evelopment, they have to be part of a strategy that takes into consideration the "larger picture".

Two, such a tendency, in the context of socio-economic and political powerlessness, directly contributes to a subtle assimilation
agenda. Thus, for instance, without the proper institutionalisation of Tamil education or the promotion of an active educational system promoting multiculturalism and multicultural competencies or the production of popular Tamil entertainment forms, including Tamil cinema, the unfortunate direction of change would be the progressive loss of Tamil identity. In this context, we can see for instance a new phenomenon in Malaysia - dark brown-skinned Tamils taking on the behaviour of or, portrayed as, "blacks"!

Three, we need to re-think our strategy of building a national Malaysian community. Is it by an assimilation agenda or by actively promoting mother tongue education and/or multi-culturalism? The global society, for instance, is concerned of many languages and many linguistic communities on the brink of extinction. According to a recent study, the National Geographic Magazine observes, "half of the world's 6,000 languages will become extinct in the next century [and] 2,000 of the remaining languages will be threatened during the century after that."

In this context, it should be our effort to preserve and actively promote cultural diversity, not in terms "muzeumising" it for the purpose of selling it to tourist but in terms living it actively. Mother tongue education is not really anti-national if we can work out practically how our children, in their respective cultural stream, also go through national social and cultural socialisation.

Four, there seem to be a careful avoidance of the issues of governance in a multi-ethnic and multi-cultural society. Critics instead turn their attention on the consequences of bad and unsustainable governance instead of addressing the issues of bad or ineffective governance. Thus, the suggestion is "get rid of Tamil schools" not "Why it has failed or not doing well enough?"
This is really punishing the victim.

The debate over the problem of the Tamil/Indian Malaysian community will go on. I only hope that those in power to influence public opinion and popular action evaluate the situation carefully and propose a line of thinking and action that will help to deal with the cause of the problems faced by the Tamil/Indian Malaysian community rather than the symptoms.

Hindraf will rise to the occasion in 2012/2013 General Elections

We refer to the letter “Indians back to square one, pre 2007 – By Rally Optimist.” We note the somewhat “fair comment” but wish to make the following observations.

Hindraf, learning from the letdown from the PR coalition after it rallied the Indian votes to PR in the 12th GE has made a strategic decision to create an Indian vote bank to enable the negotiation of a better deal for the future of Indians in this country, something which has eluded the minority Indians for all of their existence. Of course this vote bank will be led by Hindraf – more specifically its political wing, the Human Rights Party. Hindraf continues to match the situation as the hrp flag 2 blue situation develops.



And of course there are plenty of people out there who are affected adversely by this move. Obviously, the UMNO led establishment will not have it .Using their large arsenal, they attempt in all ways to kill off the nascent movement. Using their Police Special Branch, by associating Hindraf with LTTE, by portraying Hindraf as an extreme group in the mainstream media, by bribes of money, perks, and other privileges they give out to opportunistic individuals and organizations, by the illusions of a splintering community, by the creation of new mosquito Indian political parties and by treacherous tactics, they try to kill off Hindraf. 



PAKATAN RAKYAT The PR coalition too for their part are also affected by Hindraf’s move to create the Indian vote bank and to lead it. PR responds by attempting to marginalize HRP and HINDRAF by branding them as racists. Unfortunately the Indian Mandores in their fold work with them on this initiative. All, so they can continue to keep the Indian votes they got in the last elections – for cheap and hopefully without too significant an obligation. Examples abound where the PR coalition has reneged on this implied obligation. The latest being their refusal to speak up for even the 13As Indian SPM top students who were denied their rights only because they are Indians. They are denied JPA scholarships, Matriculation and University places – also scholarships in Petronas, Shell, Mara, Khazanah, Tenaga, Telekom, 13 State Yayasan and scores of other public and private corporation Banks and Industries scholarships. PKR, DAP and PAS do not get any political mileage by championing the Indian poor cause, worse they fear losing Malay Muslim votes.
Hindraf pre-25th November 2007 was not ready to deal with post Nov 25th, as it was a tiny and almost two man show led by P. Waythamoorthy and P. Uthayakumar who caused that significant eruption after a 16 year struggle. For this reason Hindraf was never in any position to have a plan to deal with the mighty UMNO and the emergent PR post Nov 25th. All of this creates a situation now where people like the writer of the article conclude that Hindraf is back to square one.
umno-najib0 It was the case of a giant (UMNO) versus the then tiny Hindraf from the word go. There is no issue of Hindraf going back to square one returning to pre 2007, where a puny team is fighting “everyone”. If anybody else fought for the Indian poor then we won’t be seen to be fighting “everybody”. Because nobody else is standing up for the Indian poor, they (everybody else) do not like it when we do stand up and ask all these ugly questions to them. So, it looks like we are up against everybody else. But that has always been the case. Nothing new about that. It is just a lot clearer who stands where now. In fact Hindraf and HRP would be out of a job especially with PKR, DAP and PAS multiracialism, if their policies truly were inclusive and encompassing of the Indian issues. Up to date there have been zero takers for the issues of the Indian poor.
Given all of this and given the passage of time since Nov 2007 slowly but surely the lion inside Hindraf is growing from strength to strength day by day as you can see in our website www.humanrightspartymalaysia.com. The illusion of going back to square one is what the detractors of Hindraf would want people to believe. But Hindraf’s cause is a true and necessary and Hindraf will continue to struggle on – square one, two, three ….. whatever it takes, but not to stay at square one. Maybe two steps forward and one step back as often happens in any struggle, but forward always.
BN or PR do not have the answers for the future of the Indian community in this country. Only when they have meaningful answers will Hindraf become irrelevant and under those conditions Hindraf does not mind becoming irrelevant – mission would have been accomplished. Until then Hindraf and HRP will be there for the Indian community in the country and moving on step by step towards that ultimate goal.
One of the current initiatives embarked on by HRP is the gearing up for the 2012/2013 general elections, to realize the Indian minority vote bank via it’s Project 15/38 . P3210052 Project 15/38 is the creation of Indian majority Parliament and State seats and winning in these 15 Parliamentary and 38 State seats respectively to gain true representation for the minority Indians.
The unharnessed Hindraf energy after 2007 is slowly but surely being reharnessed – this time in an intelligent and organized way This phase of Hindraf is gathering more steam as the “bad boys”, the opportunists in Hindraf have been exposed or have left the struggle for greener pastures elsewhere leaving Hindraf with a passionate and sacrificing group of activists to lead the struggle.

While Hindraf and HRP is committed to end the 53 year old reign of terror by UMNO, we are not prepared to give PKR, DAP, PAS and P.R a blank cheque to Putrajaya either and risk waiting for another 53 years. Via our Project 15/38 we will find our own future, no matter the naysayers. We will be a check and balance on PR when they get to Putrajaya. In short we are not prepared to trust PR like how the Indians had blindly supported UMNO and BN for 50 long years. Nor are we prepared to become the mandores of PKR, DAP, PAS and PR either.

You may be right. Uthaya may have already become a legend had he been a mandore for BN or PR. but he chooses to remain the puny individual fighting “everyone” along with his band of passionate and sacrificing activists. But that fight is real one, one that moves the politics of the country and creates new history.

Indians back to square one, pre-2007

As far as Hindraf is concerned, consider that Umno neutralised it even before ‘The Game’ started. It was a knockout by default. Holding the Hindraf5 under ISA really did the trick. Today the Hindraf is in tatters. While under ISA, Umno successfully split up the Hindraf detained leaders, turning some Hindraf leaders to Umno’s side. They demonised Hindraf, making it lame, tame and powerless and even managed to get them to go against Pakatan Rakyat causing it to lose the community’s support.

It was even rumoured one of the Hindraf 5 is an undercover Special Branch agent. Umno’s tricks are boundless. Where Umno is concerned, it has achieved what it wanted. MIC’s win in Hulu Selangor gave Umno the credibility it needed.

Hindraf burst into the scene at a time when Indians were frustrated with their lot after 50 years of neglect. This included the Indians in estates (the lower income and the less fortunate), university graduates, middle-class and also many professionals. In the past 30 years, they have had only one Indian leader, S Samy Vellu who is both despised by many but worshiped by some who readily sit at his feet.

During the 1980’s, the Indians woke up because of the many NGOs and social activists. Many of them began to question the sincerity of Barisan Nasional and in particular, Umno. Nevertheless, few dared to even vote against BN hence the successful 2004 results during Abdullah Ahmad Badawi’s regime.

From the 1990s, many individuals, groups and network of NGOs have been airing their frustration with regards to the insensitive Muslim conversions, lack of education opportunities (especially the allotment of scholarships), the poverty level, the unjust and forced eviction from estates and lands, the high rate of street crimes within their communities and the manner in which they were thrust into hostile and congested city slums from a quiet, rustic estate environment.

These social ills and economic frustrations were never addressed by MIC, who is their political spokesman. Since the 1990s, MIC has won every single seat it was allotted except during the Lunas by-election, giving it a winning rate of almost 100% for its candidates. However, the grovelling and kissing-up to Umno, its thuggish behaviour and their callous disregard for its people, has made Indians begin to see beyond the veil and smokescreen of the MIC-Umno wayang.

The media has already reporters of a whole Indian village which was without electricity and water for over 50 years.

The advent of Hindraf gave the Indians a venue to vent their pent-up frustration and anger. By sending the memorandum to the British Embassy in a strategic move, Hindraf got Umno’s attention. Umno took immediate action on the 30,000-strong crowd in the street, creating a war-like zone with tear gas canisters, batons and heavily armed FRU and police presence to beat them back into their hovels.

It is my intention to inform your readers that there were ‘hundreds’ if not ‘thousands’ of professionals and businessmen at that Hindraf rally in 2007. You could even spot some ‘millionaires’ among the crowd gathered to hear the speeches that Nov 25. The Indian community solidly supported Hindarf en masse something which never happened previously.

Umno responded quickly. On Dec 13, Umno, fed-up and not wanting to drag Hindraf through a messy court trail, made its move. Abdullah dumped the five into Kamunting instead and the rest is history. Everything happened accordingly to Umno’s plan.

Since then, what has happened to these people? There was a lot of buzz on the ground, vigils, gatherings, prayers, numerous meetings and even campaigns that were initiated. P Uthayakumar probably didn’t anticipate such a success for Hindraf after 2007. Maybe, that’s why there was no plan B to harness this energy that was created. Such energy that was not used, dissipated and thus wasted. With no proper plan B to take over the leadership, it just could not compare with Samy Vellu’s huge, organised political-structure – the MIC.

There was such a huge energy among the people for Hindraf then. ‘Makkal Sakthi’ groups were formed across the nation and many individuals organised themselves with a new sense of awakening following the rally. The ballon of fear was burst open and the people began to come out of their shells, discussions were open and everyone wanted to do something. We did not want to go back to MIC as we had burnt our bridges to it but we were burning with desire to do something for the Indian community.

Among us was not just the labourer class of Indians as the media portrays but also the working class, the professionals, the educated and also the English-speaking. Unlike what has been labelled of us, we, too, had a reason to fight on and stay here, for the love of our country and to help the downtrodden and we did whatever we could in whichever way we wanted.

Can we be blamed if it didn’t turn out exactly as what the activists wanted because we were groping for our way? When Umno realised their mistake, they systematically had an exit planned. Never would they have wanted Indians to support Pakatan.

They wanted the community back for themselves, so we can see the sabotage and traitors who could be bought over as we saw during the following by-elections. The Maklal Sakthi Party is a prime example of sabotage. Will the Indians bite the bait? it seems to have been by the looks of Bagan Pinang and Hulu Selangor..

What went wrong for Hindraf? There were no plans to get appropriate people to work for the community on the social, economic and political levels. The Indians had no other choice but to run into the arms of Pakatan Rakyat. Socially, many individual bodies and networks were created with no links to Hindraf. Economically, many wanted to help but once Umno got Hindraf banned (a smart move), the rich did not want their names into a bad ight..

The ‘third force’ that is coming up is a dream come true for Umno. It is the best way to alienate the Indians and Pakatan. Umno has got two mangoes with one stone. Hindraf has turned the tables against the very people who it used to work with. We can only sit and lament at this conclusion taken by Hindraf.

All we wanted was to be rid the shackles under Umno and to start rebuilding for a progressive community after 50 years but we are back to square one, returning to pre-2007, where a puny team is fighting everyone. Uthaya is a leader who could have been a legend..
