The people are our judges.

Let me start with a modified quote from a famous British Historian, Lord Acton, “..it is by the struggle of the weak, made under compulsion to resist the reign of force and constant wrong that justice is secured, preserved and extended.”.

History is filled with instances of such struggles and of the progress that justice has made, because of all such struggles. Knowingly or unknowingly it was on this maxim that Hindraf has catapulted itself onto the national scene. Fearlessness in confronting injustice symbolized Hindraf, made Hindraf.

It is this goal that Hindraf continues to pursue till today. The criteria that Hindraf applies for its involvement in the struggle of the people is the commission of injustice against the defenseless, weak, poor, marginalized and dispossessed in the country. It does not care who the perpetrators of that injustice are.

But when one stands up against such injustices, one invariably threatens the status quo and all the vested interests benefiting from that status quo. And this begets reaction from all those vested interests. Reactions in the form of suppression, repression, misinformation, smear campaigns, seduction, incarceration and whatever other means that are available.

Various of our brothers, Ganabatirau being the latest, have succumbed to the ploys of these vested interests, who would like to see Hindraf destroyed. Ploys that are crafted that even some at the helm, like Ganabtirau can succumb.

Wittingly or unwittingly Ganabatirau has become a victim of circumstances. He is a member of the DAP. On the Kampung Buah Pala issue DAP has chosen to throw in its lot with the rich developer community of Penang and against the small impoverished Indian community in Kampung Buah Pala . Hindraf and Waythamoorthy have stood up against the injustice meted out to these people of Kampung Buah Pala. Their land has been stolen from them and they are being hounded out from their land. Even the Penang DAP leaders reluctantly acknowledge this but they choose to ignore because of their close relationships with the rich developer community – never mind that there is a significant issue of injustice involved.

This has put Hindraf in collision course with the DAP. So where does that put our brother Ganabatirau – it is most unfortunate that he has succumbed to the side that has chosen to gloss over the injustice. This has caused him now to deviate from a fundamental principle of Hindraf. He has succumbed to the vested interests and has become part of a misinformation campaign against the very organization that created his public personality. He has become a tool to character assassinate the leaders of the true Hindraf spirit.

I say this is most unfortunate.

Whatever the personal and frontal attacks by Ganabatirau or by any others against Hindraf and its leaders, truth has a way of prevailing. The struggle will continue for justice. The vested interests will not give up. They will continue with attacks like these. And Hindraf for its part will continue to struggle for justice and for truth nevertheless.

If you want to know who is on the side of truth or justice, just measure them by whether they are helping to attain it or helping to destroy it. The question that the people need to ask and seek answers for is – who is helping to seek the truth and see justice prevail and who is seeking to destroy and bury such efforts.

Again, let me reiterate, it is by the struggle of the weak to resist the reign of force and constant wrong that justice is secured, preserved and extended. It is on that side that Hindraf will continue to stand and it is on that side that Waythamoorthy stands.

The people are our judges.

Federal Court strikes out Buah Pala residents' application - Malaysiakini


The Federal Court today dealt a blow to Kampung Buah Pala residents in Penang when it struck out their second leave application and allowed a preliminary objection raised by landowner Koperasi Pegawai Kerajaan Negeri Pulau Pinang Bhd and developer Numestro Venture Sdn Bhd.
Chief Judge of Malaya Justice Ariffin Zakaria - who led the three member bench - announced the unanimous decision.
The other two judges are Federal Court judge Justice Zulkefli Ahmad Makinuddin and Court of Appeal judge Justice Md Raus Sharif.Ariffin also ordered the villagers to pay cost.The villagers were represented by Darshan Singh Khaira and P Uthayakumar.
Nusmetro was represented Shareen Abdul Manan while Karin Lai acted for the Koperasi.The developer has fixed Sept 1 for the demolition of the houses.

Ganabatirau is wrong!

Mr.Murugan, was in London with Mr.Waytha Moorthy to solve the problem of Kg.Buah Pala with the World Heritage Trust in Unesco from 27th July 09 until 06th Aug 09, to list Kg.Buah Pala as one of the Heritage Village in Malaysia. Based on the remarks by Mr.Ganabatirau, I went on a personal interview with Mr.Murugan in Kg.Buah Pala to know the truth about the luxury life of Mr.Watha Moorthy in London as claimed by Mr.Ganabatirau. I conclude that Mr.Ganabatirau has a personal agenda is publishing those remarks with the influence by some irresponsible people that trying to pin down Hindraf as the saviour of the Indian Community who is in the center of marginalisation!. This is the statement by Mr.Murugan : Mr.Waytha is living a life which is below the medium life standard in London. He is staying in a small room approx 10"x12"ft in size. TV and a fan is the only accessory in his room. Mr.Murugan was sad after noticing the way a prominent lawyer and an Indian Leader is living in exile in the foreign land with only support from the Good Hearted Indians in the UK. He eats only simple fast food which is not expensive and consider the cheapest option in London. As a writer of this article,I have been to London as a Flight Crew about 20 times throughout my career and i agree that fast food is one of the cheapest option there. Although cars are cheaper compared to Malaysia, Mr.Waytha travels on trains and buses on a daily routine. The only person that is supporting his activities there in London financially, is his wife, family members and well wishers in London.

Ganabatirau is living a far more better life here compared to Mr.Waytha Moorthy and we can see clearly that Mr.Waytha is doing a great job from there by releasing articles and statements boldly compared to this Mr.Ganabatirau who has appeared like a mushroom after the rain and suddenly giving this unreasonable claims and accusations! Cheers to you Mr.Ganabatirau, all your efforts has gone into the drain! We proved that all your accusations are wrong...

Dear brothers and sister, I ve been updating news from Kg.Buah Pala for the past last one week.. since 12thAug2009 I ve been updating on each and every progress in the process of upholding Justice!, please understand that this is the truth, no one that we have depended for so long has helped the villagers! Non of them are coming all out for this poor, helpless families. No promises to give the villagers the 2storey houses as stated in all the media, I have uploaded the agreement and documents pertaining to this issue. Trust me friends, they are suffering and not as what you all are thinking, the value of RM200.000, RM500.000 is a story merely and nothing reality here. No one is giving anything concrete to the Villagers! This villages are really pressured, cheated and bullied by everyone around them, including the State Government and the developers! Neither of them came here to help the villagers sincerely. Sorry if some of my articles really put some of you down, it was out of anger that there are no help for this pitiful beings here, money is not everything in life, human values and happiness are the core of a life! Please pray hard for the souls that will attend the Federal Court hearing tommorow (21st Aug) hope the villagers will get what they deserve and justice uphold! MAy God Bless the Village and its beautiful people who were so kind to me throughout my stay here in Kg.Buah Pala, I love Kg.Buah Pala and wish the village that I m loving now will be here for another 100 generation to come. 2storey house for Kg.Buah Pala Villagers

Maybe this is the 2storey house that the State Government and Pakatan Rakyat Leader planning to be give to the villagers of Buah Pala, since there is no rights for the villagers to file a case in the court after signing the agreement, the villagers cant do anything even if this is the House they meant. Thats is what written in the invalid agreement given and asked to sign forcefully by the developer Nusmetro and Penang State Government best Leader of the year Lim Guan Eng, Ramasamy and RSN Rayer!

Trust me friends, Nusmetro and the state government is cheating the Villagers!

Heart Attack for Buah Pala Villager!

This is Mr.Murugan Karuppiah, he is the person that went all the way to the World Heritage Trust in Unesco to fight for the fellow Villagers and had his heart attack last Tuesday! He fight to save his village and villagers until he is affected badly, Look at this man, do you think that he will demand for a unreasonable compensation? He is worried that the villagers will be chased out without any damages paid and will live the village without knowing where to go and how to handle their children and their studies! Up to now, upto now, approximately about 10 people has been admitted in the hospital due to several reasons, mostly on stress reasons.The promises made by all the parties, including State Government is just a Castle made in the Air! No valid promises and agreement has been given to the villagers, the double storey house is just a say and not a reality! The agreement that has been given to them is an invalid document and it is a trap to ask the villagers to withdraw all the pending cases in the court and to prevent the villagers to file anymore cases in the court! Pure Injustice!

Self interested Mr.Ganabatirau

Yesterday on 19th August 2009 Mr.V Ganabatirau has given a special interview how Hindraf outlawed movement's Mr.Waythamoorthy collected millions of ringgits from people for his personal use while in exiled in London.

Mr Ganabatirau also accused the money didn't reach Hindraf 5 families but he forgot that his own brother had the money in his hand and he was paying for other expenses such as court payments and necessaries.

The initial reason the money collected for Hindraf 5 as he claimed did reach the families which suffered. He also mentioned millions of Ringgit was collected. As a reader of the article thinking that Mr Ganabatirau lost his sense. How could he knew about millions of ringgit while he was in ISA? It shows that someone from his side gave wrong info. As a smart lawyer he should address more details to public than just a word.

He said "My family did not receive a single sen". Sir, why are you so eager to have public money for your family? Can't your family members work like other grassroot Indians who is suffering daily for their meal. As my idea he is desperate because could not have public money for his family. Sir, we respect you for being in ISA and fought for Indians rights but now you being so frustrated about someone's money. You spoke about civil suit, May be you have joined the rest of the Hindraf leaders to get million from English government.

You have mentioned that Mr.Waytha deliberately allowed the suit to expire so that he can enjoy the money. I think most of your contacts or family member didn't update the news properly. As far as we Malaysian read, Mr Waytha went to many International organization such as UN and other countries to deliver you from the ISA atonement. We Malaysian have read how Mr.Waytha lobbied our government as a prime interest to release 5 of you.

Personally speaking I see you as ungrateful or thankful. A friend should be someone whom you can rely on in happiness and distress but Mr. Ganabatirau showed his true colour. The basic matter why Hindraf became successful or famous due to their fight for poor and marginalized Indians. Most of the Indians became happy due to supported our unity . We didn't support Hindraf for financial purpose. I think you and the other friends of you supported for money.
After your release from ISA till today, I have never seen you helping our Indian plight or speak out for our Indian struggle. Did you ever gave any media statement to say how Indians should be unite or how we can go further in our struggle? I think so far no.

Even after your release you have seen many media statements from Mr.Waytha regarding our community and our struggle. For example in Kg. Buah Pala the villagers are struggling between many parties such as developer and local government. You as so called an Indian leader should meet them and try to help them out but you smash them by supporting your party which you are being a member now. So how can we trust you for our struggle?

I don't see your question is relevant when you ask why Mr.Waytha must go for a pilgrimage to India on Nov 27, 2007? Can you tell me why someone should go for pilgrimage? It is everyones rights to do so. You are an educated lawyer should know that interference in others personal life is a offence or unkind.

Mr.Ganabatirau did you ever contacted other Hindraf leaders to understand better how the situation was when you were in ISA? Did you ever try to follow up our struggle again? Cowardly you just signed the police contract and you remain yourself without finding out the truth. Other than being helpful for us but you are just accusing one and another. Is this what you call unity? It is enough, Mr Samy did the same to Malaysian Indians almost 30 years. We didn't had any other alternative to speak for ourselves. Now after long time we have been united but people like you are breaking the unity and poisoning the people. For god sake could you please contact all the Hindraf leader and get a clear picture rather than accusing in the media. It is just showing our weakness to other races and our enemies.

As far as I read in newspapers Mr.Uthaya and Mr.Waytha started to help Indians many way last 10 years ago but you mentioned in Malaysiakini report that you met Uthayakumar on December 2006. For my view you have just born as a 3 years old baby and now you are trying to fly in the sky. According to me you are the joker of the year.
Don't politicise every issues. You said you and Vasanthakumar organized the rally and both of you played the key role in the rally.

If that is the case why you didn't agree this to the police or court by saying you are the man behind the rally? I didn't read anything like that. What I notice was, The police force and AG targeted Mr. Uthaya. Police knows very well who was the man behind it but now you are making Malaysians stupid.

You said Mr Waytha was a chicken in movement because he was always afraid of special branch police officers. A chicken doesn't go to court and will not refuse to pay its bail. Mr.Waytha stayed in jail as a sign of protest toward Malaysian government. I feel he also protested for our rights in the prison.

"Hijacked movement' "Waythamoorthy also appointed himself as the chairperson of Hindraf and appointed Thanenthirran and S Jayathas as coordinators. Who made him the boss? There was no election. Who gave him the right to appoint and dismiss coordinators?"

Mr.Ganabatirau claimed that other leaders of Hindraf was self appointed and there was no election. I am very confuse with your statements, earlier you said Hindraf was registered as a business company and now you are talking about election. Even a secondary school student can answer this question. When you are not a registered body how can you elect someone offcially? further more it is a company not a society. I think you are real power craze and money craze.Finally I think Malaysian Indians should understand right now that he(Ganabatirau) is just simply example of a self interest person and not working for the community but trying to gain some media attention.A coward that is trying to be the self-claimed leader!

Residents association of 4 Villages met for a Discussion.

Resident Association of Kg.Buah Pala, Kg. Tg.Tokong. Kg.Balik Pulau and Kg.Makam had a meeting on the Issue of demolition, Re-location and threatenings by Developer namely Nusmetro and UDA developers. The associations vowe to work together hand in hand to handle the issue of harrassement and has promised to be united in case of Demolition threats. This is a good news especially for the Kg.Buah Pala villagers since they are the current victim of a cunning developer! Nusmetro.Here, they plan to work together without racial borderline!

This is how the Wanita Umno team members listening to and consulting the village committee Secretary Mr.Steven. They acknowledged the problems faced in the village and assured to give full cooperation and support in case of demolition attempts practised again by the Illegal developer Nusmetro. They have finalized the contract / agreement given by Nusmetro to the VIllagers as silly and a trap for the Villagers, they also stated that the agreement is not an actual agreement which is not in the actual official format. Buah Pala Villagers sent Memorandum to Muhyiddin Yasin

The Villagers of Kg.Buah Pala submit a memorandum to the Deputy Prime Minister Malaysia Tan Sri Muhyiddin Yassin in the Permatang Pasir constituency election Operation centre at about 5.30pm today. The Village resident association comittee members has the opportunity to speak to DPM for about 5 minutes and explain the sufferings they are going through due to the act of injustices in the Land Scam involving Koperasi Pegawai Pegawai Kerajaan Negeri Pulau Pinang, Penang State Government and Nusmetro Ventures. Muhyiddin has given a word of confident to the Comittee members and assured to look into this matter rationally.

ISA, Police Act amendments to include freedom of assembly

KUALA LUMPUR, Aug 19 — The government will table amendments to the Internal Security Act (ISA) and the Police Act during the next Parliamentary sitting, with changes in the laws to include the freedom to assemble in specific areas without the need for a permit.

Home Minister Datuk Hishammuddin Hussein said today that among other provisions that may be relaxed is the initial 60 days detention period of the ISA.

The amendments are part of Prime Minister Datuk Seri Najib Razak’s promised reforms.

But it is likely to fall short of demands from the Pakatan Rakyat (PR) and other activists who want the ISA repealed.

“There may be only time to hold a first reading in October but hopefully the amendments can be debated by the end of the year,” said the minister

Hishammuddin denied claims that the law, which was passed in order to counter the threat of the communist insurgency in the 1960s, had ever been abused.

However he said each provision of the ISA is being reviewed along with other restrictive laws and the Police Act, in order to make them more relevant in today’s landscape.

He pointed out the ISA was still relevant and cited the example of the prevention of terrorism.

The Home Minster was speaking to the press today after chairing a special meeting on national security issues with Minster in the Prime Minster’s Department Datuk Seri Nazri Abdul Aziz and Information Communication and Culture Minister Datuk Seri Rais Yatim.

He added the government is considering holding an “aggressive” nationwide campaign to explain their stand in reviewing the ISA and their determination not to abolish the controversial law, which allows detention without trial.

The planned campaign will provide a comprehensive explanation on the various provisions of the ISA, so people will understand the law is not draconian or used arbitrarily.

He said the awareness campaign is to inform the people that the government was serious in overcoming the weaknesses in the ISA and were moving to ensure there is no room for the law to be abused, to prevent further allegations.

“We want the people to understand that the ISA is a preventive law to protect the country and its multiracial communities.”

When asked if the ISA would still be used against politicians, he said the Home Ministry had been consistent and used the law against any threat to national security and stability.

He added the right of the majority deserved equal protection.

Today’s meeting was held following a Cabinet decision which called on the Home Ministry, the Prime Minister’s Department and the Information, Communication and Culture Ministry to co-ordinate the roles of the various agencies under their jurisdiction.

Hishammuddin said while there would not be censorship of the internet, existing laws and agencies will be used against those who commit sedition, including against bloggers who touch on sensitive issues such as religion and the royalty.

He said the Malaysian Communication and Multimedia Commission (MCMC) will work more closely with the police and the Attorney-General to ensure cases are dealt with more effectively.
