A New Political Arrangement Is Needed To Bring Indians Into The Mainstream Of National Development.

The voters in the 4 estates in Bagan Pinang (Ladang Atherton, Siliau, Ladang Bradwall and Sua Betong) cast their votes overwhelmingly for the UMNO candidate. This was one of the reasons for the increased majority from 2333 to 5435. A swing of 1500 votes to BN of which at least 400 of these came from these 4 estates. Well, today the day after, normalcy will return to these estates and life will go on for all the people there with very little changing after this. The UMNO candidate goes away to continue with his usurpation of the National resources while the poor Indians go away to their miserable lives.

This is exactly how it has been going on for the last 52 years. Election after election empty promises and continuing illusions. Life never has changed for these Indian working people. Till today they live a life of very limited real opportunities. They live a life of indignity. They live on the edge of our society - forgotten till election time like this. They live a life that delivers so little to them and to their children.

The pundits of the country will have us believe it is because of their attitudes, their lack of desire, that they find themselves in this state. This is rubbish. This theory takes the focus away from the real reasons for this state of affairs. The mandores perpetuate this theory further – just listen to them. This is no accident of history either. This is occurring by design. It is a devious design. It is an UMNO charted design. It is a design of systematic neglect. A whole ecosystem has been developed to institutionalize this neglect. This system of neglect can be best understood when seen against a contrasting situation..

THE CONTRASTING SITUATION – THE FELDA SCHEME

This contrasting situation is taken out of today’s(12th Oct 2009) NST supplement on FELDA ‘s NEW GENERATION.

What started as a modest program in 1956 today has become a giant organization. The schemes it manages covers an area of 2 million acres and more than 530,000 people. FELDA's main role is to open up new land areas for agriculture and relocation of low income and landless rural inhabitants. It doesn’t say Malay only but the fact is that the Felda program is almost entirely for the Malay poor and landless. We have no problems with that. What we have a problem with is the systematic and wholesale exclusion of Indians from this program. Nowhere in the Federal Constitution does it say that programs like this must exclude Indians. This is the contrasting situation that I want to portray, to show the systematic neglect of the Indian poor.

This is very clearly basic UMNO policy. It helps it take care of its core constituency, the rural Malays. It becomes a platform for patronage that has been developed and honed and fine tuned over the last 50plus years, and provides the necessary opportunities for accumulation of wealth for the growing appetites of the UMNOputras.. The 2005 results of FELDA show a total turnover of RM 12 Billion. The profits alone are over 700 million. See the scale of things – enormous.

The NST supplement very clearly shows the many and varied human development programs initiated and supported by Felda. Just in the last few years the programs and initiatives launched by Felda - a RM 120 million Maktab Rendah Sains Mara in Trolak, Perak. Just for one school RM120 million. Compare this with the recent promise of an allocation of RM100 million by the PM for 523 Tamil schools in the country, which anyway has not been disbursed yet inspite of it being so many months since the announcement..

Felda supports the education of the youth from Felda with Aircraft Maintenance Engineer training program with MAS, Designer training programs in the Limkokwing University, Nurse training programs in Nilai College, scholarships to overseaes universities in the UK, Australia and the United States in the fields of Biotechnology, Actuarial Sciences, and various Engineering programs.

Felda has launched a new generation skills training program and has put out over 24,000 graduates since 2005.They have a budget of RM50 million annually for this program. Contrast this with all that has not been done for the Indian youth in this category. We can go on and on . the story is long and sad.

Just imagine the scope of opportunities that have been opened up to its beneficiaries. In contrast nothing has been provided for Indians in this program – zero. No opportunities for Indians in the Felda scheme which is materially significant.

If the estate residents like those in the four estates of Bagan Pinang, had been part of such programs, today the situation with the Indian community would be very different. Mind you again, this is only one of the hundreds of such programs that are going on in the country and zero for Indians in all of these programs.

This is really the situation that we must change. The electoral system must be used to bring about changes to the political arrangement in the country so Indians can be systematically brought into the mainstream of national development.. Every program of the government must include Indians fairly and there must be a designed effort to bring Indians into this mainstream of national development.

We have to stop the politicians create illusions and make empty promises and cart all these opportunities away from people who truly need them. Because Indian youth today are blocked from such legitimate opportunities, they tend to choose the path of crime for upward mobility. They are caught sometimes, many times shot dead, often after being caught, beaten to death. Their parents continue to languish in their never changing life , earning measly amounts and hanging on to their meager lives. And the scale of this problem has been growing. Indian lives do not seem to matter in this country.

So, UMNO, the culprit has to go, no doubt at all about that, if this state of affairs is ever to change. They cannot reform themselves to do the things we talk about here. And they will try very hard to hang on, as we can see from all the jostling they have been doing recently. They just have to go.

Even though the Indian votes went to the UMNO candidate in the Bagan Pinang Elections, it doesn’t change anything. This is only a by election. The ADUN who passed away was from BN anyway. Status quo has been maintained.

The point about the vote swing is very clear. If PR does not come out openly and significantly and start to address the Indian issues in areas where they do have authority, they are not going to get the Indian votes as completely as they did in the last GE. I think that much should be clear with the outcome of the Bagan Pinang elections. In fact we warned PR so. PR thought the Indians have no choice – well you saw, they do, but not necessarily because they want it, but because they had to deliver a message.

The same for the next General Elections. As the VP for PAS very succinctly put it and let me quote “In the last (general) election we got strong support from the Indian community... they had no choice, there was no alternative and they had high expectations of Pakatan.” "Now, they are not all for the BN government but I would say that their support is not as solid as it was in the last election (for Pakatan)," he added. Salahuddin said Pakatan need to be more serious in addressing the woes faced by the Indian community. "Pakatan is not doing enough," he added.

This ‘enough’ that he talks about is not anything unreasonable. We just want the Indians to be brought into the mainstream of National Development. As much attention as goes into the development of the Bumiputra programs by the government must go into the development of the Indian programs in the country. And base everything truly on needs. Who needs it most must get it. This is what we seek. Today in the UMNO based system, this is totally absent. And UMNO just cannot do it. They have to go and PR has to show they will make a difference.

Court orders cops to return Kugan's samples

The Magistrate Court today ordered the police to return the forensics samples of A Kugan, who died in police custody early this year, to Universiti Malaya Medical Center (UMMC).

"After hearing submissions by both parties, the court orders that the specimen and other items seized to be returned to UMMC immediately," he added.

Indra had filed the application to compel the police to return all items, documents, tissue samples and bodily fluids to the UMMC pathology department as she wanted to sent them to a medical centre in Australia for toxicology tests to determine whether Kugan was given any injection prior to his death in January this year.

Police officer charged

Kugan, 22, was arrested on Jan 15 on suspicion of being involved in car theft activities but was found dead later.

On Oct 1, a police officer from the USJ police station pleaded not guilty in the Sessions Court to two charges of causing grievous hurt to Kugan.

The case made headlines after a video clip revealed severe lacerations on the deceased's body, whom the first post-mortem report declared had died of fluid accumulation in the lungs.

However, a second post-mortem commissioned by the family revealed that Kugan had been beaten and deprived of food prior to his death. - Bernama

Selangor PKR Indian Mandore’s wayang kulit at Jenjarom hindu temple demolishment.

PKR EXCO Member cum Indian Mandore for Selangor Menteri Besar Tan Sri Khalid’s show time. The demolition of the 130 year old temple to be put off -Maha Mariaman Temple in Janjarom, Selangor. (The Star 9/10/09 at page N55 and also Makkal Osai 8/10/09 front page). This PKR Indian mandore comes to the temple and does the usual wayang kulit, which the previous MIC Indian EXCO Member cum UMNO Mandore had been playing for the previous 50 years until 8th March 2007.

It is the HINDRAF inspired people power residents of Jenjarom that stopped this demolishment. This PKR Indian mandore has done this very same wayang kulit at least two times before (and specializes in getting them published in the three Tamil newspaper)when this very same hindu temple previously came up for demolishment by the PKR led Selangor state government.

By the stroke of the pen the PKR led Selangor Menteri Besar, Anwar Ibrahim, DAP and PAS can stop this plantation’s historical and heritage hindu temple from being demolished by compulsorily acquiring this land and handing it over to this temple by virtue of Section 76 of the National Land Code (NLC). But UMNO or PKR, DAP and PAS would never save this or any other hindu temple for that matter. But they would all call themselves multi-racial parties.

Why doesn’t any surau or Masjid come up for demolishment like these hindu temples? The answer is that all suraus and Masjids which were previously on state and private land had been acquired converted and gazetted into Masjid and surau reserve land futher to Section 76 of the NLC by UMNO, PKR, PAS and DAP. But a different rule applies when it comes to hindu temples in Malaysia.

UMNO rejects Indian widow’s welfare dept aid for 6 years. No Deepavali for 10 years.

This 40 year old widow A.Parameswary has been applying to the Penang state welfare department for assistance since 2003 (6 years). But she is yet to receive any response (NST 10/10/09 at page 27) Also in Makkal Osai 10/10/09 front page (See both newspaper below). This is just the tip of the iceberg of this UMNO’s racist and religious extremist policies excluding even the poor and working class deserving Indians from receiving Welfare help. To add to her misery, Parameswary has a 19 year old son who is mentally and visually disabled. She needs RM 250.00 a month to buy adult pampers and special milk powder for this son.

Had Parameswar had been a Malay muslim, the UMNO controlled Malaysian government would have given her the due welfare department help she and her son needed. But poor Parameswary happens to be born an Indian which she had not asked for!

These extent of racism and religious extremism does not happen in any other part of the world except in UMNO Malaysian Prime Minister’s One Malaysia.

UMNO and Najib think they can use Makkal Sakthi Party (MMSP) to hoodwink the Indians especially in 62 Parliamentary seats and 138 state seats where the Indians form between 10% to 46% ( Indian political empowerment strategy by P.Uthayakumar at page 16). But no more after the 25th November 2007, 100,000 people Rally refer ( The Star 10/10/09 page N25) Since then there has been an Indian awakening.

Najib must be kidding himself by thinking that a party calling itself the Makkal Sakthi Party will move the Two Million Indians back to UMNO/BN. Here is a political tips for you Najib and UMNO. Seriously and sincerely address and solve the critical Indian issues. Stop all the wayang kulit as if you are helping the Indians. Put the Indians into the National mainstream development of Malaysia. Then and only then will you get a bulk of the Indian votes. Not by stealing the Makkal Sakthi name from HINDRAF.

WHO THE VOTERS IN BAGAN PINANG SHOULD VOTE FOR?

HINDRAF is an apolitical coalition which attributes its birth to the conscience and awareness for Malaysians to recognize the truth, fairness and equality for the Malaysian whose forefathers had forsaken their ancestry lands to live peacefully in this multi racial community.

The Malay has political power; the Chinese has economic strength, whereas the Indian along with lain-lain category are voiceless and trampled over in their equation as a citizen of Malaysia until election time.

Who HINDRAF supports is not the issue but what is just and fair for the society at large. The voters in Bagan Pinang are the reflection of Malaysia and they bear a heavy responsibility to make a choice to ensure that their frustration as a citizen is made known against the mishandled state of affair of the country as well as individual states.

HINDRAF is not accustomed to the art of pleasing and passing pleasantry to appease the politicians but rather a truth messenger to create the awareness to the public, the sorrow state of affairs of those systematically discriminated and marginalized society within a multi racial society in Malaysia.

How the voters in Bagan Pinang make their choice should not be dictated by what BN or PR can offer but to be the bellwether for rest of the Malaysian community on their stand for the welfare of their multi cultural community against the interest of the politicians and political parties.

Yes, HINDRAF as a loosely organized NGO meaning you and me with equal responsibility in all of us individually to provide the conviction in our own leadership in staying true to its cause rather than being being twisted and spinned around for lack of political will against fairness towards the community ie public. Whether one accepts it or not relies on the cause of just and fairness irrespective of the politicians need. Humanity has always been driven with a conscience that created the tilt in GE12 and believes it is very much alive in the society.

Recent events such as the death of Kugan, Teoh Beng Hock, mismanagement in Kg Buah Pala, cow head incident is Seksyen 23, Kg Tanjung Tokong shows that the people need to be empowered not parroting politicians either BN/ PR against the truth and reality for the community.

HINDRAF reinstate it’s position that no political organizations in Malaysia today should be able to twist our arms to condone against what is righteous for the community. For 52 years we have lived a life to accept and dealt with the crap and sweetener thrown in by the UMNO led government as we ignored the reality for the masses of people whether it is Malay, Chinese, Indian or lain-lain.

Now the people of Bagan Pinang have a choice through their votes to make a difference based on their own choice whether to vote or abstain if nothing is going to change their status quo whether it is a BN or a Pakatan rule. The choice is with the people of Bagan Pinang to decide for themselves how and why their choices will make a difference for them to ensure truth, fairness and equality will transpire across the board and resonate whole over Malaysia rather than the rhetoric created equally in balance by BN or Pakatan.

HINDRAF can enhance its objective to ensure a fair and equal Malaysia for all Malaysians with the ability and cooperation of the general public, if one that seeks for the community is able to see and understand its stance. Those voters in Bagan Pinang will need to make their own assessment of their own sacrificies on what is in stake for a Malaysian community to show that “People Power” can prevail over politicians and political parties.

HINDRAF is neutral in its stand in Bagan Pinang as those constituents need to achieve their own maturity to make a stand for what is their dignity, moral right and belief in creating an amicably ambience for the Malaysian society in fairness and equality in the long run without deluding ourselves.

Malaysia is in our hand for humanity, we decide and the change will appear for our community.

Waytha on the future of Hindraf


No Extra Deepavali School Holiday on 19/10/09

On 24th September 2009 we have written to the Prime Minister and the Education Minister amongst others as follows:-

1) School and Public Examination date are even held one day after Deepavali but for Hari Raya and Chinese New Year it is school holidays for one whole week, every year.

2) Urgent Education and Higher Education Ministry Circular to direct a similar one week school holiday also for Deepavali from this year onwards and for all other public examinations not to be held during the week of the Deepavali celebrations.

3) This is a recurring problem year in and year out but only when it comes to Deepavali in One Malaysia?

In regards of the above we are disappointed with the Education Minister’s statement ( The Star 8/10/09 page N2) stating that the State education directors have been told to approve request from schools for an extra day off. The schools are to opt to take either event holidays (cuti peristiwa) which need not be replaced, or replacement holidays.

We question why when it comes to Deepavali it becomes a problem. Why during Chinese New Year and Hari Raya it is School holidays and why not Deepavali? For this year’s Hari Raya holiday we welcome this move. But when it comes to Deepavali, the schools have to write in to the State Education Directors for an extra day leave on Monday 19/10/09 as Deepavali holiday. We call upon the Education Minister to sent a directive to make Monday 19th of October 2009 as an official school holiday for all government schools and educational institutions. This would at least the first step towards One Malaysia.

UMNO only want’s Indian Voters

In the Bagan Pinang by election UMNO once again only wants the Indian voters. After the election are over these Indians will be forgotten. These estate workers are still earning wages of RM300 per month. Till today the UMNO led government refuse to set a minimum wage for estate workers. The Indonesian Embassy set minimum wage of RM500 for Indonesian maids working in Malaysia or they would not be granted extention of their pasports. Even foreigners have better deal then Malaysians.

Not only that Malaysian did not get minimum wage but they also left out from the mainstream development of 1 Malaysia such as Felda, Felcra, FAMA, Risda so on and so forth. For instantce Berita Harian dated 8/10/09 on special report on RISDA, Prime Minister Najib holding a mock cheque for dividend in the sum of RM 202,248,566.67 for RTBB ( Rancangan Tanam Baru Berkolompok and TSK Risda ( Tanam Semula Komersial). These RTBB and TSK land settlers had been given 10 acres of land for planting largely Rubber and Palm tree purpose. Why have the Malaysian Indians to the contrary given this opportunity to prosper like the Malay Muslims.

We are disappointed the UMNO led government come with the slogan of 1 Malaysia but in realty it is not implemented especially for the Indians.

No Birth Certificate so no school for Indian children

Statement (No.50) to the Government of Malaysia for which we expect a reply:

2,203 (almost all working class Indian) children “to get” their right to attend school after they are issued with their birth certificates. So says Home Minister Hishammuddin (UM 08/10/09 at page 4) Primary school education is as of right and there is no compromise on this. So while processing their birth certificates with the target date of year end we ask the Home Minister for:-

1) The list of children who have been issued birth certificates from today onwards to be updated on a weekly basis in the Home Minister’s website to show sincerity that this UMNO Minister means what he said and is not a racist and that it is not merely the usual “UMNO paper politics”

2) What about the balance from the 93,360 applications for late birth registration at the latest by the end of the year that the National Registration Department has been ordered to clear? (The Sun 08/10/09 front page). Why is there no deadline to clear this Mr. Home Minister Hishammuddin. Because 98% of them are “merely” the poor working class and helpless Indian children? We urge your goodself to set a three month deadline and put up the names of those issued with their rightful birth certificates in the Home Minister’s Website within one week from today.

3) And finally issue an urgent Directive to all Primary and Secondary schools to with effect form 01/01/2010 to take in all Malaysian Indian children into all Tamil and National schools and Institutions of Higher learning even if they have been denied their birth certificates.

4) UMNO’s Deputy Prime Minister and Education Minister Tan Sri Muhyiddin should cancel the earlier Education Minister’s circular for 2008 onwards prohibiting Indian children from being admitted into Tamil schools and sacking existing Indian children from Tamil schools if they do not have birth certificates (actually denied their birth right to be issued their birth certificates) (P. PKR Selangor government refuses to grant proper land for Indian cattle farmers

Statement (No.49) to the Govenment of Malaysia for which we expect a reply:

PKR Selangor government refuses to grant proper land for Indian cattle farmers. The land given is too rocky and hilly (NST 07/10/09 at page 23). It is about two years since the Selangor state government is governed by PKR and PR but hundreds of deserving Indian farmers, lifestock farmers have been denied land to even earn a decent living. The Selangor Agricultural and Development Corporation and Selangor Land Development Authority has thus far given almost zero land schemes to the Indians in Selangor under even the PKR/PR led state government. Just like how UMNO had denied hundreds of thousands of deserving Indians land in their Felda, Felcra, Risda, Fama and Agropolitan land schemes. By doing this UMNO has excluded these deserving Indians from the national mainstream development of Malaysia. These Indians especially the plantation workers are 52 years behind time or remain in almost the same state as they were during the British colonial days. How then is this PKR, DAP and PAS state government any different from the UMNO government which has for 52 years excluded the working class Indians form the national mainstream development of Selangor vis a vis Malaysia.

Bangsar Shan kidnapped by UMNO police UTK (suspected) Zero reply from Home Minister Hishamuddin. Shan was on 29/08/09 at a nursey with his family when he was kidnapped. How can this be allowed to happen in broad daylight in Malaysia. Three police reports have been lodged thus far. Even an official legal letter to Home Minister dated 02/09/09 has not been replied to even after 5 weeks the letter was sent to him. UMNO does not care. The crime rate in Malaysia has passed the alarming rate and is now In the critical rate. We need a new Inspector General of police and also a new Attorney General for Malaysia who can effect a corrupt free and crime free police force. Because what happened to Bangsar Shan can happen to any one of us. We are living in fear on a day to day basis especially when many of the police personnell themselves are suspected to be involved in crime or work hand in glove with criminals. (P. Uthayakumar).

RE: 1) Four (4) Indians murdered by Malaysian police in Kulim yesterday
(4 “robbers” killed in shoot-out- NST 06/10/09 at page 12).
Prosecute police for murder.
2) Two Indians charged with killing one policemen.
3) But the 21 suspected policemen who killed A. Kugan in a
police lock-up were never prosecuted for murder by UMNO’s
Attorney General and Inspector General of Police.

1) Four (4) Indians were shot dead and murdered by the Malaysian police in Kulim yesterday. Why is it almost always that it is the Indians who are shot dead by the Malaysian police. We have official statistics of 1.3 persons being murdered by the police every week (The Star 11/05/1999) and about 60% of the victims thereto are Indians. The Kedah Police Chief Datuk Syed Ismail Syed Azlan said they were involved in “41 robbery cases”.

There are over one hundred thousand (100,000) policemen employed in Malaysia who could have easily captured these Indians alive. We also once again question why the police did not capture these Indians alive and prosecute them in a Court of law (if necessary) which is the due process of the law anyway. The law presumes a man innocent until proven guilty.

This is just the tip of iceberg of police victimization of in particular the Indians in Malaysia by either being brutally shot dead in cold blood, beaten up and tortured in police lock-ups, killed in police lock ups or thrown into jails and all this done with impunity.

2) To the contrary two Indians were charged with killing one policeman (The Star 6/10/09 at page N28- labourers charged with killing cop). “In Johor Bharu two odd job workers were charged with the murder of a policeman. S. Velo, 30 and S. Thavasilan, 21 were charged at the Magistrate’s Court with murdering constable C.Selva on 17th September 2009. Their offence was classified under Section 302 of the Penel Code”.

3) A. Kugan was tortured and beaten to death according to the second post-mortem report by Pathologist Dr. Prasanth of University Hospital. There were 21 police personnel who have had contact with A. Kugan while in detention but they were not prosecuted for murder by UMNO’s. Attorney General (AG) and Inspector General of police (IGP). We question the double standards practiced by the AG and IGP as opposed to A. Kugan’s case.

We demand that the 21 police personnel who had contact with A. Kugan similarly and by the same standards as in item 2 herein above be forthwith prosecuted under Section 302 of the Panel Code for the murder of A. Kugan.

We hereby protest this latest cold blooded police murder and call upon the Prime Minister, Home Minister, Attorney General and the Inspector General of police to similary as in item 2 hereinabove prosecute the responsible policemen for murder under Section 302 of the Penal Code.
