Y.A.B,

Re: 1) Height of Indian poor wanting to sell his kidney to start a new Small
Business.

2) Proposals - Pemudah like Task Force, Commission

We were moved by the Tamil Nesan news report dated 22/07/08 at page 13 on one Murali [35] who was declared a bankrupt because his identity card got lost and was misused in a RM 36,000.00 loan. Murali is an asthma patient his wife a breast cancer patient having gone through eight treatments. He has four children aged between five and 14 years old and going to school.

He gets a Socso pension of RM 368.00 per month and RM 100 per month from the welfare department for his school going child. His total income per month is RM 468.00 which is way below the hardcore poverty line index of RM 687.00 per urban household of five [NST 18/05/08 page 26]. RM 1,500.00 per month being the maker for urban poverty [NST 28/06/08 page 23], RM 2,000.00 per below being in the lower income group [NST focus 13/07/08 page 32].

The average household income for an Indian family has been declared in the Mid term review of the Ninth Malaysia Plan as RM 3,799.00 [NST 27/06/08 page eight]. Murali’s family and thousands of other Indians and in fact at least 85% of the Indians do not earn RM 3799, 00 per month. This RM 3,799.00 per month figure certainly does not reflect the ground reality and appears merely speculative. Murali out of desperation has decided to sell his kidney to raise funds for capital to start a new business. Murali’s case is just the tip of the iceberg.

Hundreds of thousands of Indians are in Murali’s shoes. Baitulmal, Pusat Zakat, Vayasan Islam, Badan Amal, badan kebajikan etc. would not help him. TV3, Utusan, NST, Star and Berita Harian would never help publicize the serious Indian plight according to it’s gravity. UMNO, PKR, DAP and PAS would not campaign these very serious Indian poor issues. Felda, Felcra, Risda, Kejora, Kada, Project Agropolitan would not give Murali a business license to run a bus stop kiosk nor the UMNO Federal give him a taxi license. What alternative does Murali have? He and his family lie on the railway tracks and kill themselves as happened to the Indian family in Seramban last year?
Incidentally the Indian suicide rate is 800% higher that for the Malays because of poverty and poverty related issues. Unlike the Malays, Orang Asli, the natives of Sabah and Sarawak who have their inherited villages and even the Chinese who have their new Villages to fall back on, Murali and hundreds of thousands of other Indians have no where else to go to. Almost all the Indians do not have a village to fall back on or as a safety net.

We hereby propose that the Federal UMNO government set up a Permudah like high level task force with impeccable action oriented results in a short space of time to seriously address the critical Indian issues as per our 18 point demands to the prime minister dated 12/08/07.
This task force should be co chaired by the Chief Secretary to the Government and Hindraf Legal Adviser and to also be comprised of the Secretaries Generals of the Finance Ministry, Welfare Ministry, and the Directors Generals of the Economic Planning Unit.
plementation Unit, Secretary to the Prime Minister and social scientists to be nominated by Hindraf but to the exclusion of all “wayang kulit” and “mandore” political parties. A budget of RM 35 Billion is set aside annually.

This special task force is eventually to be replaced by a Race Relations Commission [to eliminate all forms racism and religious extremism] and an Equal Opportunities Commission in furtherance to Article 8 of the Federal Constitution [Equality before the law]

Kindly revert to us accordingly.

Thank you,

Yours faithfully,

PS from WMP - HINDRAF reaction on Bar Council forum

HINDRAF
135-3 KEMAYAN SQUARE
70200 SEREMBAN
NEGERI SEMBILAN.

PRESS STATEMENT 11TH AUGUST 2008

BAR COUNCIL FORUM - CLEAR EVIDENCE OF AUTHORITARIAN STATE
POLICE COLLUDED WITH PROTESTERS – AN INSULT TO ARTICLE 10 OF THE FEDERAL CONSTITUTION.
STATEMENT BY HOME MINISTER SYED HAMID IRRESPONSIBLE.

The latest fiasco on the Malaysian Bar Council forum on "Conversion to Islam" clearly indicates that our ruling government practices authoritarian policies where the elected representatives and police are used to suppress civil liberties and freedom of expression in the pretext of security and public order.

The ruling government and its agents, ie police were at their best to exercise their authority to allow the protest by the muslim mobs to incite racial sentiments and storm into the forum and slander, humiliate and insult
the non-Malays.

HINDRAF strongly condemns the veiled threat by Home Minister to the Bar Council that “he hoped that the Bar Council got the message that there are certain things that are out of bounds for public discussion, even if held in a private place." It is the duty of the country to protect its citizens who have gathered to discuss a legitimate concern of its community (under article 10 of the Federal Constitution) but to come up with such threats (especially) by the minister is most irresponsible and insults the intelligence of Malaysians.

Four (4) members of HINDRAF were arrested in a rainy day for creating an awareness of their cause in the recent CPA conference on 7th August 2008 but here you have over 300 protesters behaving aggressively, carrying inciting banners and storming into the Bar Council forum raising uncalled racial sentiments against fellow non-Malay Malaysians without fear and protected by the Royal Police Force. The statement by Home Minister appear to be condoning such “violent” behavior and supporting hooliganism and claims he has not received any complaints of threat to National Security or disturbance to public order is utter rubbish and nonsensical.

Such double standards is only prevalent in an authoritarian state where any issues that concerns the public and freedom of thought for egalitarianism is suppressed and oppressed to serve the interest of the majority Malay muslim.

There is no actual racial issue in Malaysia, it is only incited and seeded into the public to create a scenario that best serves an authoritarian state to serve its own agenda against the goodwill and humanity for the Malaysian society that have co-existed irrespective of their color, race, religion and creed.

Four Hindraf activists held at Commonwealth meet

Andrew Ong Aug 7, 08 7:41pm

Four Hindu Rights Action Force (Hindraf) activists were arrested near the Kuala Lumpur Convention Centre (KLCC) today for failing to disperse on police orders.

Dang Wangi OCPD ACP Zulkarnain Abdul Rahman told reporters that the four, including a woman, were arrested at the roadside while "picketing."

According to the detainees' lawyer N Surendran (photo:far left), the group were among 30 activists who were leafleting at the 54th Commonwealth Parliamentary Association Conference at KLCC at 3.30pm.
The leaflets were meant to raise awareness among international lawmakers of the two-year Internal Security Act (ISA) detention order against five Hindraf leaders.

However 15-minutes later, the police tried to disperse the group resulting in the four - S Jayathas, S Poobalan, K Balakrishnan and B Susila - being arrested.

"They were given 20 seconds to disperse before they were ambushed while leafleting in the rain," said Surendran when met at the Dang Wangi district police headquarters later.

‘Woman locked up with men'

Surendran also complained that Susila, 41, was being held in a police lockup with seven other unknown men.
"This is unacceptable. Was she treated this way because she is affiliated with Hindraf?" he asked.
At the Dang Wangi police station, Surendran, accompanied by Kapar MP S Manickavasagam and Teluk Intan MP M Manogaran, held a short discussion with Zulkarnain.
Manogaran told reporters later that Zulkarnain had confirmed that Susila was held in a cell with men but a woman police officer was stationed outside the cell.

Manogaran also said they were assured of Susila's safety by Zulkarnain. The police chief however refused to comment on Susila's detention when approached by reporters.
Zulkarnain refused to divulge details of the investigation but said that investigations were being conducted according to Section 27 (5) of the Police Act.

"There are foreign guests there and we must ensure their security," he said when asked if the four were arrested because of tightened security at the KLCC area.

Latest news, all released under police bail
All four of them later were released under police bail at 7.30pm and all were required to present at Dang Wangi Police Station on 7th Sept 2008. All four were cheered by the big grooup of supporter whom been at Dang Wangi station since the arrest news spread. There were about 30 supporters waited for the release and welcome the 'heroes' with Vaalge Hindraf Makkal Sakthi slogan in the police compound itself.

PS from WMP - HINDRAF Jalur Gemilang and future plans

HINDRAF
135-3 , KEMAYAN SQUARE
70300 SEREMBAN
NEGERI SEMBILAN
Malaysia

Press Statement 05.08.08.

I refer to the recent launch of the Jalur Gemilang on August 3, 2008. In addition to the teleconference that was interrupted due to technical reasons, I would to add the following;
  • Hindraf currently have been infiltrated with more than 200 Special Branch informers. HINDRAF's genuine supporters should and be aware there are many fellow "supporters " who pretend to be our loyal supporters but in fact they are agent provocateur planted by parties interested in destroying and dismantling HINDRAF's struggle for the Indian community. These agent provocateurs are not necessarily Police officers but informers who are in the payroll of Special Branch. In due cause, HINDRAF will reveal these personnels with evidence
  • The tag name HINDRAF has been used to promote businesses and enhancement of several personalities for their own benefits and objectives. Many see HINDRAF as an opportunity to gain leverage and dictate their own benefits. This is totally against HINDRAF principle. HINDRAF is you and me who are battling a war for better policies and governance for the Malaysian Indian as a society with equal and fair treatment in relation to education, economics and freedom of religion as oppose to individual glamour and glory. HINDRAF is involved for the well being of society not monetary and individual public recognization.

Further I would add the following as our future plans for the coming months
HINDRAF's flag campaign to celebrate our 51st Merdeka Day on August 31, 2008;

  • HINDRAF's request to the government for HINDRAF's supporter to march in the 51st National Day Parade as citizen of Malaysia;
  • HINDRAF Relay Hunger strikes throughout the country starting with KLCC on every Sunday from August 10, 2008
  • HINDRAF Hunger Strike for Merdeka Day and 24 hr YAAGAM in Seremban on 31st August 2008;
  • HINDRAF supporters of at least 10,000 to attend PM's Hari Raya Open in Kepala Batas and the National Hari Raya celebration in Kuala Lumpur;
  • HINDRAF supporter's of at least 10,000 in each state to attend the Hari Raya Open house in their respective Menteri Besar's house;
  • HINDRAF to initiate nationwide appeal to all Sultans and Yang Dipertua Negeri starting with the state of Penang.
  • HINDRAF request it's supporter to celebrate Deepavali in simplicity with family and friends and no open houses.
  • HINDRAF shall intensify its campaign to release the HINDRAF 5 by approaching all countries in the United Nation if the Malaysian government continue to hold them arbitrarily for voicing their concern for the systematically discriminated Malaysian Indians beyond the end of December 2008

HINDRAF would hold a mega gathering to commemorate November 25th mass Malaysian Indian uprising against neo colonialization of Malaysian Indians.

HIndraf peace protect at CPA (Commonwealth Parliamentary Association) meeting at KL Convention Centre

Kuala Lumpur, 3rd Aug 2008.

After successfully launching Hindraf's 1st Jalur Gemilang event in Brickfields, Kuala Lumpur attended by more than 3000 people, Hindraf continues it tireless struggle on the same day.

About 100 people had gathered in front of KL Convention Centre about 12.30 pm today.

They had a peace protest for more than 2 hours carrying banners and placards ("manila card") with various slogans. The group whom most dressed in their safron color dress were waving their placard to the passby people. Few foreign and local medias were seen covering the peace protest.
They group has managed to deliever the memo letter to more than 40 delegates whom came to the meeting today during their lunch break. Some of the delegates promised to raise the matter and seems to know about the Hindraf when the Hindraf volunteers explains to the delegates on the letter.

It is learnt that CPA ( Commonwealth Parliamentarian Association) is having their annual meeting in the convention centre from 1st August to 10th August. HINDRAF Chairman, Mr P.Waythamoorty whom is self exile in London now had earlier sent a official letter dated 15th July 2008 to Dr.William F. Shija, Secretary General of Commonwealth Parliamentary Association address to their office in London.

In the letter, HINDRAF has request the CPA Sec. General to raise serious Human Rights Issues of affecting Malaysian Indians at the CPA meet in Kuala Lumpur from August 1-10, 2008.
The 4 issues are;
1. Democratically elected representative at Selangor Legislative assembly Mr.M.Manoharan denied his rights to serve his constituents though he has won his state assembly seat with big majority while he was still detained under the draconian ISA (Internal Security Law).
but till today he is denied his right to serve his constituents. This is a serious affront to basic principles of human Rights.
2. HINDRAF 5 leaders and workers detained under draconian Internal Security Act (ISA) without trial for raising legitimate issues affecting minority rights.
3. P.Uthayakumar whom is one of the detainee have been denied right to seek medical attention for heart ailment.

4. 51 years of neo colonization of ethnic Malaysian Indians by the majority Malay UMNO led Government in Malaysia.

Mr Waythamoorthy also have stressed in his letter to CPA that Malaysia being one of the
materially developed Commonwealth members in every possible way has breached and failed to uphold its declaration and fundamental principal of the Commonwealth in affirming human rights and good governance for the Malaysian Indians with its practice of continued oppression and suppression towards their ethnic citizens. Hindraf feels that Malaysia breached the Harare Commonwealth Declaration, 1991, where the heads of government of the countries of the Commonwealth had reaffirmed their pledge that were set out in a Declaration of Commonwealth Principles agreed by their predecessors at their Meeting in Singapore in 1971 which amongst them being that;
1. They believe in the liberty of the individual under the law, in equal rights for all citizens regardless of gender, race, colour, creed or political belief, and in the individual's inalienable right to participate by means of free and democratic political processes in framing the society in which he or she lives;

2. They recognise racial prejudice and intolerance as a dangerous sickness and a threat to healthy development, and racial discrimination as an unmitigated evil;

3. They oppose all forms of racial oppression, and they are committed to the principles of human dignity and equality.

They stressed that Malaysian government continues to undermine human right and civil liberties issues although they had pledged to the Harare Convention and their membership with the United Nations Human Rights Council.
Hindraf Event Coordinator, Mr Kannan whom came for the peace protest at the KL Convention Centre said that this peace protest is to seek CPA attention and urge them to bring up the serious violation of Human Right and continues marginalization of Malaysian Indians in the their meetings here. "As they are here on the ground their should make effort to hear the plight of the marginalized Malaysian Indians", he said.
There were several police patrol cars and personnel both in uniform and plain clothes watching the group in briefand took pictures. The group later dispreased in peace after holding the peace protest outside the KL Convention Centre almost 2 hours.
Mr Kannan also mention that it was success day as the group successfully hand over the memo to several CPA delegates by hand and the outside peace protest were allowed without any issue. He hope the CPA and Malaysia government will look in to the request urgently.

Report on HINDRAF'S first annual Jalur Gemilang launching ceremony in Brickfields

Hindraf waits on Pakatan promises but still backs itSambulingam wants more done by Pakatan Rakyat for Tamil schools.
By Shannon Teoh, The Malaysian Insider

KUALA LUMPUR, Aug 3 — The Hindu Rights Action Force (Hindraf), frustrated at the slow pace of Pakatan Rakyat's promises to help poor Indians, hopes the federal opposition would do more to fulfill its election manifesto.
Interim leaders, speaking at its first annual Jalur Gemilang launching ceremony here today, urged Malaysian Indians to continue the struggle for equality despite the loss of its top leadership and lack of tangible change after helping to wrest four states from the Barisan Nasional.
"BN has denied our rights, that's why we support the opposition. But even they don't move in the exact direction we want. At the stroke of a pen, Pakatan-led governments can give us fully-aided Tamil schools,” ideological coordinator W. Sambulingam said in his speech.
"Right now, it's only one here and one there. Tell us what the plan is and how it will be executed. If you can allocate 130 hectares for pig farms in Selangor, I am sure something can be done for Tamil schools."
Pakatan controls Kedah, Penang, Perak and Selangor, as well as Pas's long-held Kelantan.
Hindraf chairman P. Waytha Moorthy, currently in exile in the United Kingdom, had last month sent a letter to the Selangor Menteri Besar Tan Sri Khalid Ibrahim concerning Tamil schools and also land for Hindu temples, crematoriums and burial sites.
Five Hindraf leaders are currently in detention under the ISA.
Surendran believes a Pakatan government will champion changes for minorities.Gobalakrishnan insisted that BN was blocking efforts to improve Tamil schools.Its legal advisor N. Surendran said the struggle was not about grabbing positions but to bring about change in the country.
"We are not supporting Pakatan Rakyat to gain political positions but because they have promised a free society and we have faith in their promise.
"We recognise that any government needs to be pressured and lobbied to give the people what they want and this can only be effective when society and media is free and oppressive laws are abolished," he told The Malaysian Insider after his speech.
Waytha had also addressed the gathering at the Federal Territory Girl Guides' Hall in Brickfields via a teleconference call in which he called for Hindraf to continue the struggle for their own betterment and not for the sake of the plight of individual leaders.
"Don't forget that the idea of Hindraf is for your rights," he said.
He also called for this year's Deepavali celebrations to be done low-key as a show of solidarity for the Hindraf 5 who would not be able to participate in festivities.
Also present at the gathering was PKR's Padang Serai MP N. Gobalakrishnan, who replied on behalf of Pakatan, that it was the federal government that blocked plans to improve Tamil schools.
"Tamil school headmasters have refused to meet with opposition figures and cited an Education Ministry order. I personally had to leave a parent-teacher association meeting in Kulim before the headmaster would attend."
Legal advisor Surendran rejected any reconciliation with MIC chief Datuk Seri S. Samy Vellu to resolve the problems of the Indian community.
"Samy's attempt to mediate for the release of the Hindraf 5 is a direct contradiction to what he said prior to the elections when he supported the arrests.
"As far as Hindraf is concerned, we have no faith in MIC's race-based struggle and we don't take Samy seriously. We ourselves are an offshoot of Police Watch and we were formed to fill the void because no one was fighting for Indians," said Surendran who is also legal advisor for the NGO monitoring the police.
Today's event was organised to dispel the notion that the group was not patriotic.
"We are not against the Yang di-Pertuan Agong or the country. We are simply against the government that denies us our rights. So with Merdeka coming soon, we want to launch our own campaign," Sambulingam explained.
Earlier, national events coordinator R. Kannan had recapped the group's activities since its inception last year and claimed that 69 per cent of Indians voted for the opposition in the March 8 polls and three states with 20 per cent Indian population made the difference in handing Pakatan Rakyat power.

"This proves that despite being a minority community, Indians can still be kingmakers," he said.

MIC wooing Hindraf, says Samy. No says HINDRAF

MIC wooing Hindraf, says Samy. No says HINDRAF

KUALA LUMPUR: The MIC says that it has been wooing the Hindu Rights Action Force (Hindraf) in secret discussions but the group has rejected this claim outright.
MIC president Datuk Seri S. Samy Vellu said the party had been holding discussions with Hindraf youth leaders in Kedah, Perak and Selangor, which he said went well.
He said the Hindraf leaders realised that the MIC was also fighting to upgrade the living standards of the Indian community.

“Whatever happened in the past, especially in the March polls, is history. We must work together for the betterment of the community,” he said, claiming that some of the Hindraf leaders also regretted supporting the Opposition.

In an immediate response, Hindraf national event co-ordinator Kannan Ramasamy pooh-poohed Samy Velu’s claims, saying none of the group’s 10 coordinators had met MIC leaders.
“Hindraf does not have a membership roll. It is led by P. Waythamoorthy who is assisted by 10 co-ordinators and as far as I know, none of us had met anyone from the MIC,” he said when contacted.

He stressed that Hindraf never regretted convincing the Indians to vote for the Opposition in the March general election, as the move had brought much improvement for the community in some parts of the country.

“We have noted that a lot of improvement has taken place for Indians in the five states led by the Pakatan Rakyat coalition since the election,” said Kannan.
Hindraf national coordinator R.S. Thanenthiran agreed with Kannan, saying the best thing that happened from supporting the opposition was the awareness created on the plight of Indians.

Letter from Supporter : Circus Seeker

CIRCUS SEEKERS

Given the most recent trials and tribulations facing us politically and economically, isn't it a wonder that much was spent on fruitless pursuits namely, public discourses concerning oil-prices when, we have roofs above our children in Tamil schools that are in urgent and dire need of repairs?

Notwithstanding reassurances time and again I cannot understand let alone wonder why should a 'specialist' be appointed to examine the butt of a sodomised 'victim', when the exact examination can be carried-out (at the private discretion and witness of qualified staff) by a Medical Officer? Are the powers that be saying that only a specialist automatically and seminally carries more merit normally not found, given thy clinical training and skills, of an MO? Come on children; everybody knows that any doctor worth his salt and legitimate credentials should be able to ascertain if anybody's arse was sexually assaulted/violated/ penetrated using force or otherwise; given his or her stint as a medical student prior to becoming a full-fledged doctor.

In equal measure I am wretchedly appalled if not left wondering further, why haven’t our children who have had their grandparents and parents delivered here, not conferred their Birth Certificates? I am scratching my head for I don’t know how can a girl of Indian origin, born on Malaysian soil, who is already pursuing Form Six given her excellent results in SPM apply for university if, she still doesn’t have proper documents to certify her birth and subsequent studies pursued here? If we have immigrants from across the straits that deliver and send their children to local schools, why then haven’t Indian students whose parents and grandparents borne and raised here, not accorded similar benefits?

Why o why are rural farmers from a particular race or so-called ‘poor’ settlers bestowed ‘annexed’ land, loans, schools, bungalows, skills-centers, air-conditioned libraries and recreational facilities, when another ethnic group had to continually contend and remain complacent with minimum wage plus no government-aided schools for their children? Have the Indians who toiled for the agricultural development of this country been forgotten so soon already? Have the gigantic status given the agro-based industries that formed the backbone of our envied economy become blind to the sufferings and years of hard-work by my people?

Why are we paying so much for products from resources reaped from our own bellies, mainly crude-oil, rice and palm-based cooking oil? If interest rates are raised to curb inflation further, why are prices of consumables on the rise? Especially since Malaysia is an oil and commodities producer?

Why must any independent body worry about conducting thorough investigations with resplendent ethics and dutiful integrity, when the Judiciary can be compelled and coerced into abdicating their responsibilities, in favor of the ‘one-man show’ Executive?

Maybe, just maybe if we forgot about Camrys and Mercedes-Benz C200 Kompressors for state ECs and focus on improving the lives of those marginalized and facing discrimination daily, then maybe just maybe we could get our priorities right.

I strongly urge the government to stop all sandiwara and wayang kulit and think about the 523 tamil schools that sorely need government aid. I am pretty sure now that MIC has jumped onto the bandwagon of assisting the Indians into the 21st century, this must seem trivial to have our needs served.

YAB Re:
(1) Land for SRJK (T) Seaport, Petaling Jaya and Simpang Lima, Klang Tamil Schools.
(2) Land for a Tamil School in Lindungan with 10,000 Indian families.
(3) Land for all Tamil Schools, Hindu Temples, Hindu Crematoriums and Burial Sites further to Section 76(AA) of the National Land Code.

With reference to the aforesaid matter, we hereby formally apply to the Menteri Besar of Selangor for state freehold land for the SRJK (T) seaport SS7, Petaling Jaya and the Simpang Lima Tamil School, Klang.

The Tamil Nesan and New Straight Times 14/07/08 at page 13 reported that the Parent Teachers Association of this SS7 Seaport Tamil School Mr. Purshothaman at a public meeting with MIC President had asked the present 0.6 hectare land to be increased to 1.2 hectares, Samy Vellu replied “Why don’t you see Pakatan Rakyat?” for the extra land. You people don’t understand how it works (i.e. under UMNO it does not work) Tamil School.

In the same news report the Kg. Lindungan area which has 10,000 Indian families also in need of a Tamil School. The Tamil Nesan in its front page report on 14/07/08 reported that the Simpang Lima Klang Tamil School which is the biggest Tamil School in Malaysia with an enrollment of 2,152 students and 97 teachers are having a shortage of land space and classrooms. They had asked the Deputy Education Minister who had visited the school for land for this school to be expanded.

We hereby apply that land be alienated to those Tamil Schools and the intended Tamil School in Kg. Lindungan according to Section 76 (AA) of the National Land Code where the State can alienate freehold land for a public purposes or when there are special circumstances (NST 01/06/08 pg 14).

To the Menteri Besars of Selangor, Perak, Penang, Kedah and Kelantan further to our letters to Dato Seri Anwar Ibrahim, YB Lim Kit Siang and Dato Seri Hadi Awang dated 21st April 2008 we hereby appeal that state government land be alienated further to Section 76 (AA) of the National Land Code to all Tamil schools, Hindu Temples, Hindu Crematoriums and Burial Sites in these five States. With this state land these Tamil schools will automatically become fully aided government schools and will not be looking like cow sheds any more. The Hindu Temples which are also the heritage of this country will stop being demolished. The Hindu Crematoriums and Burial Sites will no longer demolish and/or relocated at the smallest excuse of development.

This our appeal is not excessive as almost immediately after taking over power in Selangor, and Perak 130 hectares and RM 100 millions approved for the pig farm project and 60,000 TOL occupants of New villages in Perak were given freehold titles (Utusan 05/04/08 pg 14). After all this Indian appeal is, for public and not private or commercial purposes as above.

Thank you,

Yours faithfully,

PS from WMP on Why Uthaya refused ISA rehab program which violates UN Rules

MEDIA STATEMENT

21/07/2008

Re: P. Uthayakumar refuses to attend ISA rehabilitation programme by Police Special Branch which is in violation of Article 95 of the U.N standard Minimum Rules.

Mr. P. Uthayakumar was on 10/07/08 requires to attend a rehabilitation programme organized by the Police Special Branch and to be conducted by Associate Professor Dr. Mohammad Agus bin Yusof of the National University of Malaysia (UKM).

On two previous occasions last month and again this month a Police Special Branch Acting Commissioner of Police (ACP), Superintendent of Police and a DSP wanted to rehabilitate Uthayakumar but Uthayakumar refused to meet them. Uthayakumar’s position is that this is in violation of Article 95 of the United Nations (U.N) Standard Minimum Rules for the treatment of prisoners which provides that prisoners without charge are not to be subjected to Rehabilitation.

Further Uthayakumar’s detention is in violation to the Universal Declaration of Human Rights (UDHR) 1948 of which Malaysia is a signatory, International Covenant on Civil and Political Rights 1976, Article 3, 10, 11(1) of the U.D.H.R specifically provides that there shall be no detention without trial, provides the right to personal liberty and to a fair trial and that a person is innocent until proven guilty. Especially after having studied law and practiced law for sixteen years and also an active legal practitioner and himself a human and civil rights Lawyer Mr. Uthayakumar is unable to accept any form of sentence to imprisonment for a term of two years and continuing indefinitely at the pleasure of the Executive without trial and not having been found guilty by a court of law.

What more to be rehabilitated after the Judgment of Prime Minister Badawi of Malaysia who acted as Judge, Jury, Prosecutor and Executioner. Mr. Uthayakumar’s struggle is against the marginalisation, discrimination, oppression, suppression, equality and inequal opportunities and the permanent colonialisation of the ethnic minority Indians in Malaysia through lawful and peaceful means.

Badawi and the UMNO controlled government of Malaysia refused to even reply to the hundreds of letters, memorandums, and protest notes and running into thousands of pages scores of civil suits, it would appear that it would be a crime to champion equality and equal opportunities, Malaysian Bar Resolutions, hundreds of police reports etc. and when having exhausted all these avenues over a period of sixteen years of peaceful campaigning Uthayakumar organised a 100,000 Hindraf peaceful assembly at the Kuala Lumpur City Centre on 25/07/2007.

The Badawi regime took this as a threat to their authoritarian rule especially so in view of the then imminently impending general elections which we believe had to be postponed to 08/03/2008. Badawi’s excuse was that Uthayakumar and the three other Hindraf lawyers were threat to “national security”. Badawi’s reason for not having them prosecuted in an open court of law was their said detention was based on “intelligence information” which could not be tendered in open court, meaning there is no credible evidence and/or Uthayakumar and Hindraf has an avalanche of evidence as the aforementioned thousands of pages of documents and photographs which the Badawi regime can not or would not be able rebut. Thus Uthayakumar and the other 3 Hindraf lawyers have now been detained for eight months now.

P. Uthayakumar’s and Hindraf’s legal and peaceful struggle would continue irrespective until the rule of law is observed and justice is served. People power “Makkal Sakthi” will prevail one day.

Thank you,

P. Waytha Moorthy

VOH- UMNO demolishes 2nd Hindu temple since GE2008

Voice of Hindraf:

UMNO demolishes second Hindu temple since the 8th March 2008 General Elections without a valid court order and in total disregard for Article 11 of the Federal Constitution.

UMNO has also committed a crime punishable with a two years jail term, contrary to 294 (defiling a place of worship), 295 (disturbing a religious assembly), 296 (inciting religious hatred) and Section 441(criminal damage) of the Penal Code (Tamil Nesan 18/06/08 pg 4).

Even one cartoon of Nabi Muhammad caused so much anger in UMNO and the "multi –racial" community in Malaysia. But here the very idols the Hindus had been praying to at the Port Dickson Sri Muniswaran Hindu temple was demolished using a bulldozer and backed by 10 Port Dickson Land/District Officers and 20 Policemen.

This does not happen to any Malay Muslim Mosques and suraus. But it is only in Malaysia that the supposed "multi-racial" opposition parties PKR, DAP, PAS, Civil Societies and the Print and the Electronic media does not raise even their little finger. So UMNO has had a free hand over the last 50 years in bullying the mere 8% minority Indians and backed up by their police force, army, and the civil service.

M. Ravi PKR the state assemblyman could not stop the said demolishment. His boss Datuk Seri Anwar Ibrahim would lose Malay Muslim votes if they condemned this Hindu temple demolishment. So they pretend that they see no evil, hear no evil and therefore speak no evil. But have to acknowledge that in the PKR, DAP and PAS ruled states, no Hindu temples have been demolished since the March 8th General Elections.

The Indians and forces of "Makkal Sakthi" people power must go for self help which is allowed in law. They must form a legally trained group who invoke the citizens arrest power even if it means arresting the authorities themselves. But "Makkal Sakthi" must be prepared for the consequences and be prepared to pay the price for the eventual abuse of power and malicious and vindictive action by UMNO's police, Attorney General and UMNO's Courts. This is the only way to stop any further Hindu temples demolishment in Malaysia.

Send large scale SMSes and get as many people as possible to come to the temple which UMNO wants to demolish.

Vote UMNO out completely in the 2012/13 General Elections and vote for People Power "Makkal Sakthi".

VOH- Malaysian Indians are still Marginalised in Education Rights

Voice of Hindraf:
More foreign student were given opportunities in USM but where is the Malaysian Indians education right there ?

Comment from NST news-02July2008, pg 20

USM taken 115 foreign students from 13 countries, mostly to do post graduate studies (NST 02/07/08 pg 20).
But thousands of Indians are denied places in the local universities what more to do post graduate courses. UMNO would rather help foreign students prosper in their quest to make the Indians the new "coolie" (near slavery) by 2020 when Malaysia would become a fully developed country and the Malay Muslims the Masters.

Voice of Hindraf:
Tamil School field snatched in Teluk Intan.

Shop lots built under PKR, DAP and PAS state government in Perak. The 73 year old Thiruvalluvar Tamil School in Teluk Intan football and playing field had been snatched up by the Teluk Intan Municipal Council to built shop lots (Tamil Nesan 12/06/08 pg 7).

This atrocity of this nature does not happen to any Malay or Chinese Schools in Malaysia. It only happens to Tamil Schools. Why? Because the Indians in this country are soft target and a target of being bullied by the UMNO controlled Malaysian Government. In civilized societies like in the West, minority's rights are protected by the majority.
But in UMNO controlled Malaysia, the Indians are bullied, taken advantage of and bulldozed with impunity at every available opportunity.
What even supposed multi racial PKR. DAP and PAS government in Perak stands by and watches quietly like UMNO. PKR, DAP and PAS does not care as it merely involves the politically, economically and not international attention drawing community.

TV3 on 11/06/08 at prime time news covered some Malay Muslim Felda settlers who had yet to be paid compensation of up to RM 800,000 for their land taken about eight years ago. Good coverage by TV 3 as some of the beneficiaries are old while others have passed away. But the very same TV 3 would not highlight the plight of this Tamil School or almost all of the critical Indian issues because again it involves merely the Indians.

The only solution forward is Indian political empowerment. People Power "Makkal Sakthi" have to act at the appropriate time.
